1 AN ORDINANCE to amend Section 23-363 of the Omaha Municipal Code entitled"When allowed"
2 to provide a procedure for allowable use of accumulated sick leave by employees;to provide
3 for creation of a new subsection (f) allowing administrative and executive employees and
4 Civilian Management employees to utilize up to forty(40) hours of sick leave for illness or
5 injury to immediate family members;to repeal Section 23-363 of the Omaha Municipal Code
6 as heretofore existing; and to provide for the effective date hereof. •
7 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
8 Section 1. Section 23-363 of the Omaha Municipal Code is hereby amended by adding
9 thereto subsection (f)to read as follows:
10 Sec. 23-363. Use of sick leave.

12 (f) The definition provided for in this subsection shall be binding with respect
13 to Functional employees, Administrative and Executive employees and
14 Civilian Management employees. "Family" sick leave provisions: Functional
15 employees, Administrative and Executive employees and Civilian
16 Management employees may utilize up to 40 hours of sick leave for illness
17 or injury to immediate family members. Family members shall be limited to
18 a parent, son, daughter, and/or spouse. For purposes of this section, a parent
19 is defined to mean the biological parent of an employee or an individual who
20 stood in loco parentis to an employee when the employee was a son or
21 daughter. Son or daughter shall be defined to mean a biological, adopted, or
22 foster child, a step child, a legal ward, or a child of a person standing in loco
23 parentis who is - (a)under eighteen years of age, or(b) eighteen years of age
24 or older and incapable of self care because of a mental or physical disability.
25 A spouse shall be defined to mean a husband or wife, as the case may be.

27 Section 2. That Section 23-363 of the Omaha Municipal Code as heretofore existing is
28 hereby repealed.
