The attached Ordinances provide for two items: (1) the inclusion of non-exempt Civilian
Management employees in Section 23-253 which provides for compensatory time off for overtime
work in accordance with the Fair Labor Standards Act; and (2)the inclusion of Administrative and
Executive Employees and Civilian Management employees in Section 23-363 which provides for
the utilization of up to forty (40) hours of sick leave for the illness or injury to immediate family
members.
The classification was submitted and approved by the Personnel Board at its December 16, 1996
meeting.

1 AN ORDINANCE to amend Section 23-253 of the Omaha Municipal Code entitled "Same-
2 Procedures," to provide procedures for compensating non-exempt Civilian Management
3 employees when working overtime;to provide for inclusion of said employees within section
4 (a)of Section 23-253;to repeal Section 23-253 of the Omaha Municipal Code as heretofore
5 existing; and to provide for the effective date hereof.
6 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
7 Section 1. Section 23-253 of the Omaha Municipal Code is hereby amended to read as
8 follows:
9 Section 23-253. Same-Procedures.

11 Overtime worked by municipal employees shall be compensated by pay or compensatory
12 time off in accordance with the provisions of pertinent collective bargaining agreements,the
13 federal Fair Labor Standards Act and the following procedures:

15 Civilian personnel: Work by an employee in excess of eight(8)hours in any work day shall
16 be compensated at the rate of one and one-half times (1 %2) the regular rate of pay for the
17 number of hours of overtime worked except employees exempt according to the Fair Labor
18 Standards as determined by the personnel director. Work performed in excess of forty (40)
19 hours per week shall be compensated at the rate of time and one-half for the number of hours
20 of overtime worked, except employees exempt according to the Fair Labor Standards Act as
21 determined by the personnel director. Holiday, funeral and annual leave shall be counted as
22 days worked only in computing overtime pursuant to this ordinance.

24 Non-Exempt Functional,AEC, Civilian Management,and Full-time Unclassified personnel:
25 An employee shall have the option of accruing compensatory leave time at a rate of one and
26 one-half(1 '/2)times the actual hours worked in lieu of the payment of overtime. Employees
27 may accrue a maximum of one hundred twenty (120) hours of compensatory time. The
28 compensatory time off shall be taken at a time mutually agreed upon by the employee and
29 his/her supervisor,but must be taken within three months after the end of the calendar year
30 in which it is earned; compensatory time remaining at the end of this period shall be paid for
31 in cash. However,the employee retains the right to cash out his or her compensatory time
32 at any time. It is understood that the usage of compensatory time is to be requested just like
33 annual leave and may be denied as any other annual leave consistent with the FLSA.

35 Any overtime, court pay or call-in pay is eligible to be accrued as compensatory time by the
36 employee. Any hours earned at straight time shall be placed in the employee's compensatory

37 time bank at straight time; any hours earned at overtime rates shall be placed in the
38 employee's compensatory time bank at time and one-half.

40 (b) Police management personnel: Members of the police department in pay range (1 MP) and
41 above shall receive time and one-half for those hours worked in excess of eight(8)hours per
42 day or forty (40)hours per seven(7) calendar days only when permission for such overtime
43 work has been requested and approved by the police chief prior to the performance of such
44 overtime work.

46 Firefighting personnel: Uniform members of the fire department shall not receive overtime
47 compensation except in cases of extraordinary conflagrations involving multiple alarms,
48 during such emergencies firefighting personnel who are called in when off duty or held over
49 beyond the end of their normal shift, shall be compensated by pay or compensatory time off
50 at the rate of two (2) times the number of hours so worked or one full shift, whichever is
51 greater. This provision shall not apply to fire officers with the rank or equivalent rank of
52 battalion fire chief and above.

54 Section 2. That Section 23-353 of the Omaha Municipal Code as heretofore existing is
55 hereby repealed.
56 Section 3. This Ordinance shall be in full force and take effect immediately upon its passage.
