L. g p C., providing regulations for signage; and to provide for the effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure that the property located Southeast of 129th Street and West Maple Road, is developed in accordance with the provisions of the Development Agreement attached hereto and made a part hereof by reference. 1 Section 2. That if this Ordinance, Development Agreement, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Development Agreement is hereby approved. Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage. DAT MAY OF THE CITY OF OMAHA DA PASSED FEB - 4 1997 7--e DATE ATTEST: ‘' '5' '`'- CIT CLERK OF THE CITY OF OMAHA DATE APPROVED AS TO FO _ A X77 IST TY ATTORNEY DATE P:\PLN2\5494.SKZ AGREEMENT This Agreement,made and executed this /2" day of eX-ie 99�by and between the CITY OF OMAHA, a municipal corporation, ("City") and BARG ADT PROPERTIES, L.L.C., a Nebraska limited liability company, ("Bargstadt"), WITNESSETH that: WHEREAS,Bargstadt has heretofore submitted to the City a final plat of Bargstadt Addition and has requested approval thereof; and WHEREAS, the City has required that, as a condition to approval of the final plat, Bargstadt secure from the Zoning Board of Appeals a recommended sign budget for the lots within Bargstadt Addition and that Bargstadt allocate the proposed budget between the lots of Bargstadt Addition and determine the sizes and types of signs to be placed upon the subject lots; and WHEREAS, Bargstadt, on October 17, 1996,was granted waivers from the Zoning Board of Appeals increasing the total sign budget to 606 sf. and approving a projecting/roof sign projecting 8'41/4 "out from the face of and 2' above the top of the building proposed for construction on Lot 2, Bargstadt Addition; and WHEREAS, Bargstadt, on November 21, 1996, secured from the Zoning Board of Appeals a waiver of sign regulation allowing placement of a pole or monument sign on Lot 1, Bargstadt Addition, complying with the area,height and set-back limits applicable to Lot 1, Bargstadt Addition, which sign may include an off-premise sign for the benefit of the owner of Lot 2, Bargstadt Addition; and . WHEREAS, the parties desire to stipulate as to the size and location of signs to be placed on Lots 1 and 2 of Bargstadt Addition in order that the agreement pertaining to such matter can be incorporated in the ordinances or resolutions adopted by the City Council of the City approving the final plat of Bargstadt Addition. NOW, THEREFORE, in consideration of approval by. City of the final plat of Bargstadt Addition, the parties agree as follows with respect to signage on the property to be platted as Lots 1 and 2 of Bargstadt Addition: 1. SIGN BUDGET AND ALLOCATION BETWEEN LOTS The total sign budget for Lots 1 and 2 of Bargstadt Addition shall be 606 square feet, which amount shall be allocated equally between the lots, with Lots 1 and 2 each being allocated a total sign budget of 303 square feet. 2. SIGN A. The sign budget for Lot 1,Bargstadt Addition, shall be utilized in the following matter: Shared monument sign 90 square feet • ' Monument sign 25 square feet Wall and roof signs on building(s) 188 square feet TOTAL 303 square feet B. The sign budget for Lot 2,Bargstadt Addition, shall be utilized in the following matter: Shared monument sign 60 square feet Projecting/Roof sign 119 square feet Drive-thru menu sign 25 square feet Product band building marque sign 99 square feet TOTAL 303 square feet C. Bargstadt shall be entitled to utilize any or all of the shared monument sign portion of the aforesaid sign allocation of Lot 2 for the benefit of the business to be constructed upon Lot 1, Bargstadt Addition, and Bargstadt shall be entitled to modify the individual sign types applicable to Lot 2 in compliance with Chapter 55,Article 18 of the Omaha Municipal Code,provided that in no event, without prior approval of City, shall the sign budget for Lot 2, Bargstadt Addition, be reduced below 243 square feet.
