C12-23-144 Lakeside Farms, LLC REQUEST: Preliminary Plat approval of LAKESIDE FARMS, a cluster subdivision outside city limits, with a waiver to Sections 53-8(2)(g), Pavement Width; 53-9(9), Sidewalks; 53- 8(2)(b), Cul-de-sac Length; 53-9(3), Street Surfacing; 53-9(10), Streetscape Standards to waive installation of street lights; 53-8, Stopping Site Distance; and 53-8(4)(d), Lot frontage LOCATION: Northwest of 72nd Street and Bennington Road At the Planning Board meeting held June 7, 2023 Jim Buser, 10250 Regency Circle, appeared before the Board on behalf of the applicant. Mr. Buser stated that this is a large development parcel over 300 acres located north of Bennington Road and west of 72nd Street. He stated that they have worked with Public Works and the Planning Department in how best to proceed with the vision of the developer. Mr. Buser stated he was available for any questions. In response to Ms. Franklin, Mr. Buser stated that it is a private lake, privately constructed,and a privately owned dam. Pat Ackerman, 11901 N 72nd Street, owner of the North Omaha Airport. Mr. Ackerman stated that he wants to confirm that the development has been reviewed by the City for AB Zoning as part of the recommendation approval. He also discussed details regarding the flight path of planes at the North Omaha Airport over the proposed development. In response to Mr. Englund, Mr. Ackerman stated that the elevation of the planes over the development would be 1200 to 1500 feet. In response to Mr. Morris, Mr. Ackerman stated that the airport currently has four to five flights a day, though they are trying to increase air traffic at that location. Eric Englund, Planning Department, stated that this development will be using a tool called the Ag cluster. He also stated that the entirety of the property is within the Future Development Zone, meaning there is not sanitary sewer service that is available to this site, but at some point in the future when those sewer extensions do get extended this site would be. He stated that there are limitations to what the City can support, the Ag cluster is one of those tools that does allow some level of construction of homes for a site in this area. Mr. Englund stated that the plan has 17 home sites utilizing the cluster and that there is a large area, Outlot A and Outlot H, that make up over 150 acres that are being preserved for future developable area if the current landowner or a future landowner chooses to develop them. He went on to discuss the waivers being requested, going into detail regarding the waivers for sidewalks and lighting, and the waiver for stopping distance. Mr. Englund further stated that this site is part of the Lake Cunningham Overlay District and discussed the lake on the proposed site and any discharge that may affect Lake Cunningham. He also discussed lots one and four that have restricted slope areas that would require easements. Mr. Englund stated there was also possible previous destruction to wetlands that would need to be addressed with the applicant and the US Army Corps of Engineers. He also briefly discussed the floodplain requirements. Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department. Mr. Englund stated that staff recommends approval of the waiver to Section 53-8(2)(g), Pavement Width, approval of the waiver to Section 53-9(3), Street Surfacing, approval of the waiver to Section 53-8(4)(d), Lot frontage, approval of the waiver to Section 53-8(2)(b), Cul-de-sac Length, and approval of the Preliminary Plat, subject to the 25 conditions. Mr. Pate motioned for approval of the waiver to Section 53-8(2)(g), Pavement Width, approval of the waiver to Section 53-9(3), Street Surfacing, approval of the waiver to Section 53-8(4)(d), Lot frontage, approval of the waiver to Section 53-8(2)(b), Cul-de-sac Length, and approval of the Preliminary Plat, subject to the following conditions: 1. For the request to waive required sidewalks and streetlights, either 1) coordinate with the City on an acceptable reduced level of street lighting for a waiver of sidewalks on the private streets, or 2) provide acceptable sidewalk or trail improvements for a waiver of all street lights on the private streets. 2. Coordinate with Public Works on the acceptability of the Chapter 53 waiver request regarding stopping site distance. 3. For North 78th Circle within right-of-way, construct the street in compliance with City public street standards; all Chapter 53 street-related waivers as part of this request shall only apply to the private streets in outlots. 4. In the subdivision agreement, cover the private ownership and permanent maintenance responsibility of the private streets by the owner’s association, and record a Memorandum of Agreement (MOA) on lots 1-17 covering the private streets. 5. Receive approval from Public Works on the alignment and dimensions of the sanitary sewer easement (including approval of a 30% design report and acceptable plan and profiles) prior to forwarding the subdivision agreement to City Council. 6. OPPD has overhead power lines along the south side of the property; coordinate with OPPD as needed. 7. A grading permit shall be required; coordinate with Public Works. 8. Receive preliminary approval of the PCSMP from Public Works prior to the application for final plat approval; upload the drainage study and preliminary plans to Permix. 9. Comply with all stormwater management ordinances and policies. 10. Provide for the use, ownership, and maintenance of the outlots in the subdivision agreement, including allowable improvements on Outlot J. 11. Coordinate with the Parks Department regarding the required park within the future development area. 12. A wetlands analysis and mitigation plan (if necessary) must be submitted with the final plat application. 13. Lots 1-4 include restricted soil and slope area identified on the maps in Section 55 -902. These areas must be placed within protected easements. 14. A tree canopy analysis and mitigation plan (if necessary) must be submitted with the final plat application. 15. No part of the lake may be platted within the individual Ag -cluster residential lots as part of this development. 16. Submit a letter from Douglas County Emergency Management confirming that acceptable emergency warning is being provided for the area. 17. In the subdivision agreement, cover the requirements for future minimum development density for Outlots A, B, F, G, and H, and the conveyance requirements for Outlots B and G; record an MOA on each of these outlots. 18. Obtain a waiver from the Zoning Board of Appeals for Section 55-88(b)(4), to allow for lots greater than two acres in size. 19. All previous work completed and future development within the FF-Flood Fringe Overlay District will require a floodplain development permit. 20. Fifty feet of right of way shall be dedicated along the west side of 72nd Street, widening to 60 feet within 300 feet of Highway 36. 21. Obtain all necessary permits from Douglas County. 22. Proposed site grades along the eastern boundary of the platting, adjacent to 72nd Street, must be coordinated with the future improvement of those roadways. 23. If Lakeside Farms Addition will not be located in a Sanitary Improvement District, a maintenance agreement will be required before Douglas County will provide routine maintenance of public streets or request street lights on behalf of the Developer. 24. Storm sewer design computations and final plans must be submitted to the Douglas County Engineer’s office for review. 25.
