The Ordinance waives the prohibition on the sale of champagne wine before 12:00 noon on Sunday.If adopted,the ordinance would permit Girls Incorporated of Omaha to sell champagne on Sunday morning, April 27, 1997, beginning at 11:00 a.m. Although Omaha Municipal Code section 15-2(b)prohibits the sale of alcohol in the City prior to 12:00 noon on Sunday,Nebraska statutes provide that beer and wine may be sold prior to that hour if allowed by ordinance. This Ordinance exercises that authority and waives the restrictions of Section 15-2 only with respect to this sale of champagne wine by this Special Designated Liquor License holder on this specific day. Mumgaard Assistant City Attome P:\LAW\3717.MAF ORDINANCE NO. 3 /j 7,C AN ORDINANCE to waive the limitations of Omaha Municipal Code section 15-2 pertaining to the sale of alcoholic liquor before 12:00 noon on Sunday;to authorize sale of champagne wine commencing at 11:00 a.m. at the champagne brunch to be held by Girls Incorporated of Omaha at the Holiday Convention Center, 3321 South 72nd Street, Omaha,Nebraska, on Sunday, April 27, 1997; and to provide an effective date immediately upon passage. WHEREAS, Nebraska Revised Statutes section 53-179 provides, in part, that, except as provided for and allowed by ordinance,no alcoholic liquor, including wine, may be sold at retail or dispensed between the hours of 6:00 a.m. on Sundays and 1:00 a.m. on Mondays; and, WHEREAS,Omaha Municipal Code section 15-2 provides that alcoholic liquor may be sold only between the hours of 12:00 noon Sunday and 1:00 a.m. the following Monday; and, WHEREAS, Girls Incorporated of Omaha has requested permission from this City Council to sell champagne wine on Sunday, April 27, 1997, commencing at 11:00 a.m. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1.Notwithstanding the provisions of section 15-2 of the Omaha Municipal Code,the City of Omaha authorizes and consents to the sale and consumption of champagne wine between the hours of 11:00 a.m. and 12:00 noon on Sunday,April 27, 1997,on the premises covered by a Special Designated Liquor License issued to Girls Incorporated of Omaha for a champagne brunch at Holiday Convention Center, 3321 South 72nd Street, in Omaha,Nebraska.
