The Lease allows for the use of approximately 97,000 square feet of space on which abandoned and dead storage vehicles would be towed pending reclaiming by owners or sale at auction. The pilot program in the northeast and southeast sectors of the city conducted under "Operation Clean Sweep" was so successful that the effort is being expanded city-wide. During the pilot period, tows have filled the existing impound lot, capacity of 680 vehicles, necessitating short term usage of a portion of this neighboring land. With the program expansion, the additional space will be necessary and can be accommodated under the Lease which will provide space for temporary storage of an additional 315 vehicles beyond the current lot capacity. Acquisition of a property of this size could cost$125,000 to $200,000 depending upon the location and availability of a parcel for this purpose,to which would have to be added site development and staffing costs. This alternative was quickly rejected as economically unfeasible. The close proximity of this property allows for management oversight and easy access by impound lot personnel and customers,without duplication of staff at a secondary site. The Lease has a term of two years with a 60 day cancellation notice provision. The monthly lease of$3,314.00 will be paid from the Vehicle Impound Organization 1006, Fund 001 and will be recouped from tow charges and auction revenue collections. Execution of this Lease Agreement is sought in accord with the provisions of Section 5.17 of the Home Rule Charter of 1956,as amended, which authorizes approval for appropriations of more than one fiscal year. Honorable President and Members of the City Council Page 2 American Driver Service, doing business as American Dock and Storage, has filed the required Annual Contract Compliance Report Form, CC-1, in the Human Relations Department; as is City policy, the Human Relations Director will review the firm to determine its compliance with Ordinance 28885. LANDLORD: American Drivers Service d/b/a American Dock& Storage LANDLORD'S ADDRESS: 4100 South 76th Circle, Omaha,Nebraska 68127 2, TENANT: The City of Omaha, a municipal corporation TENANT'S ADDRESS: Administrative Services Department 1819 Farnam Street, Suite 706 Omaha,Nebraska 68183 3. PREMISES: Located at 4100 South 76th Circle, Omaha,Nebraska. Approximately 97,000 square feet at the southeast corner of the property. Tenant shall have the exclusive use of the fenced lot shown on Exhibit "A", attached hereto. 4. TERM: Twenty four (24) months commencing on June 1, 1997 and expiring on May 31, 1999 unless otherwise extended as provided for in this lease. In the event occupancy is prior or subsequent to June 1, 1997, the rental payable hereunder shall be prorated for the first month. 5. RENTAL RATE: $3,314.00 per month payable on the first day of each month. 6. CANCELLATION: Either party may cancel this Lease Agreement by giving 60 days prior written notice before the first of the month. If this Lease Agreement is cancelled, all future rental obligations shall terminate. 7. TAXES: Real Property Taxes will be paid by Landlord. 8. MAINTENANCE AND REPAIRS: Parking surface and fence to be maintained and repaired by Tenant. Tenant agrees that the Leased Premises is in reasonably good and usable condition and that Tenant will restore it to at least that condition within 30 days after termination of this Lease. Tenant is responsible for snow removal of their own immediate leased area. 9. USE: Parking of vehicles. No storage of HAZARDOUS MATERIALS allowed. 10. INDEMNIFICATION: The Tenant shall hold the Landlord harmless from any liability for damages to any person,firm or corporation occasioned by or resulting from Tenant's use and operation of the Leased Premises for the impoundment and parking of towed vehicles during the term of this Lease. Tenant shall also assume the burden and expense of defending all such suits, whether brought before the expiration of this Lease or thereafter and commenced to recover for injuries occasioned by such use and operation. This obligation of the Tenant shall e extend to both injures to persons and to property and its obligation to hold Landlord harmless therefrom shall extend to claims arising from such use and operation which are either valid or groundless. Tenant shall provide liability coverage with a minimum limit of$1,000,000. Tenant may satisfy liability coverage obligations through a program of self insurance. 11. DAMAGE: Landlord shall not be responsible for theft, vandalism or any other case, whatsoever,to Tenant's property. 12. RENEWAL OPTION: Tenant shall have one(1), six(6)month renewal option following the initial lease term. The renewal option must be exercised in writing sixty(60)days prior to the end of the current term. The renewal rate will be the rate for the initial term. 13. TENANT ALTERATIONS: Tenant shall be permitted to install and maintain an access gate in the western perimeter fence of 4100 South 76 Circle. Tenant shall install and remove the access gate at the expiration of the term at Tenant's expense. 14. TENANT ACCESS: Tenant shall have a non-exclusive access license over Landlord's property for pedestrian and vehicular traffic between the premises and the western perimeter access gate.
