Submitted herewith for your consideration is a proposed Ordinance amending .
Chapter 40 of the Omaha Municipal Code, entitled "Mechanical Code."
The amendments represent a joint effort by the Planning Department,the Mechanical
Contractors Association of Omaha,the Heating and Cooling Contractors Association,
Metropolitan Utilities District, local mechanical trade union representatives, local
engineering firms, the Steamfitters Examining Board, the Air Conditioning and Air
Distribution Examining Board and the Fire Prevention Bureau of the Omaha Fire
Department to update Chapter 40 to better serve the citizens of Omaha.
Major revisions to the Mechanical Code contained in this proposal are:
1
1. Adoption of the 1994 Uniform Mechanical Code with Amendments.
2. Updating lists of adopted Fire Codes.
3. Revision of Sec. 40-177 to define Exemptions for Boilers not covered by
the Code.

1 AN ORDINANCE to amend Chapter 40 of the Omaha Municipal Code, entitled "Mechanical
2 Code";to provide for adoption of the 1994 Uniform Mechanical Code with amendments;to
3 provide updated lists of adopted Fire Codes; to define exemptions for Boilers; to provide a
4 revision of the Steamfitter Code to clarify License requirements and scope of work;to repeal

1 There is hereby adopted by the city for the purpose of establishing rules and regulations for
2 the erection,installation, alteration,repairs,relocation,replacement, addition to,use or maintenance
3 of any heating,ventilating,cooling,refrigeration systems, incinerators or other miscellaneous heat-
4 producing appliances within this jurisdiction, including permits and penalties, that certain
5 mechanical code known as the Uniform Mechanical Code,published by the International Conference
6 of Building Officials,being particularly the 1988 1994 edition thereof,save and except such portions
7 as are hereinafter deleted,modified or amended, of which not less than three copies have been and
8 now are filed in the office of the city clerk; and the same is hereby adopted and incorporated as fully
9 as if set out at length herein; and the provisions thereof shall be controlling in the design,
10 construction, installation, quality of materials, location, operation, and maintenance or use of
11 heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat-
12 producing appliances and other subjects therein contained within the corporate limits and within the
13 jurisdictional area outside the city limit.
14 Sec. 40-2. Same--Adoption of subsequent editions.
15 Subsequent editions or revisions of the code adopted by the provisions or revisions of this
16 article shall be considered adopted and of full force and effect within the city upon the approval
17 thereof by the council and the filing of three copies thereof in the office of the city clerk.
18 Sec. 40-3. Same--Conflicting provisions.
19 In the event of any conflict between the provisions of the mechanical code adopted by the
20 provisions of this article and any other provisions of this Code or other city ordinances,the provision
21 which imposes or requires a higher standard shall prevail or be controlling.
22 Sec. 40-4. Penalty for violations.
23 Any person who violates any of the provisions of this chapter shall,upon conviction thereof,
24 be punished as provided in section 1-10 of this Code. Every such person, persons, firm or
25 corporation shall be deemed guilty of a separate offense for every day on which such violation shall
26 continue.
27 Sec. 40-5. Exceptions to quadrupling fees.
28 No quadruple fee penalty set forth in this chapter shall be imposed if:
29 (a) The work is on an emergency nature where a delay in performing the work may
30 cause a risk to life or health or will significantly increase the risk of property damage,
31 provided a permit is applied for within 48 hours of completion of the work, in which
32 case no penalty shall be imposed; or

1 (b) An applicant applies for a permit after the work has begun, but before the work is
2 observed and recorded by a city inspector, in which case a double fee shall be
3 imposed.

5 ARTICLE II. AIR CONDITIONING AND AIR DISTRIBUTION
6 DIVISION 1. GENERALLY
7 Sec. 40-7. Definitions. •

10 Air conditioning commercial contractor: A contractor certified to perform those tasks as set
11 forth in this article for industrial and commercial establishments and family dwelling units.
12 Air conditioning residential contractor: A contractor certified to perform those tasks as set
13 forth in this article for single-family and two-family dwelling units.
14 Board: The air conditioning and air distribution board created by.this article.
15 Contractor: A holder of a valid certificate of competency for air conditioning/air distribution
16 issued under the provisions of this article.
17 Minor repairs and/or alterations: Replacement and/or adjustment of components initially
18 installed in an air conditioning/air distribution system,where total costs do not exceed $300.00.
19 Sec. 40-8. Complaint procedure.
20 Any person having knowledge of any suspected violation of this article may file a complaint
21 with the permits and inspections division. Each complaint may be in writing,filed in duplicate,with
22 one copy being retained by the permits and inspections division and one copy being forwarded to
23 the secretary of the board. Such complaint may be signed at the option of the party making the
24 complaint. Such complaint shall contain the following information:
25 (a) Name and address of suspected violator.
26 (b) Location and description of suspected violation.
27 (c) Nature of violation and evidence of existence of same.

1 Each complaint,as determined by the superintendent of the permits and inspections division,
2 shall be investigated by the permits and inspections division. The results of such investigation shall
3 be available to the board upon request of the board.
4 Sec. 40-9. Enforcement authority.
S. The chief mechanical inspector and his assistant inspectors, under the direction and
6 supervision of the superintendent of the permits and inspections division,shall be authorized and
7 directed to enforce this chapter.
8 Sec. 40-10. Right of entry.
9 Upon presentation of proper credentials,the superintendent of the permits and inspections
10 division, or his duly authorized representatives, may enter, at reasonable times, any building,
11 structure, or premises within the jurisdictional area of the city to perform any duty imposed upon
12 him by this article.

14 DIVISION 2. CERTIFICATES OF COMPETENCY
15 Subdivision A. In General
16 Sec. 40-26. Required.
17 It shall be unlawful for any person within the jurisdiction of the city to engage in the business
18 or to proceed to install, alter, repair, or add to, or change in any manner any air conditioning/air
19 distribution system, or any furnace,restaurant appliance hoods and their duct systems, or any other
20 exhaust or intake ventilating systems,unless such person shall be a holder of a valid certificate of
21 competency issued by the permits and inspections division. Exception to this section may be
22 allowed, for work performed by a homeowner subject to the provisions of Section 40-107.
23 Sec. 40-27. Registration required.
24 Any person desiring to engage in business as a contractor within the jurisdiction of the city
25 shall have such person's full name, residence and place of business registered with the permits and
26 inspections division. No person shall in any case be granted a contractor's certificate unless
•;27 registered as required by this section.

1 Sec. 40-28. Change of address.
2 It shall be the duty of any person registered with the permits and inspections division as
3 required by this article, in the event of a change in address, to notify the permits and inspections
4 division at once of such change.
5 Sec. 40-29. Compliance with other laws.
6 Any person holding a valid current certificate of competency as a contractor shall comply
7 with all provisions of the city relating to the operation of a business within the zoning jurisdiction
8 of the city.
9 Sec. 40-30. Qualifications.
10 Before any person shall be issued a certificate of competency under the provisions of this
11 chapter,he shall:
12 (a) Submit a verifiable experience record showing a minimum of five years' experience
13 in the HVAC field.
14 (b) Take and pass an examination administered by the board with a grade of 70 percent
15 or more.
16 (c) Pay the required fees.
17 (d) Post a bond as hereinafter required.
18 Sec. 40-31. Appeal from denial.
19 Any person who has been denied a certificate of competency by the board under the
20 provisions of this article may appeal the decision of the board to the administrative appeals board
21 by complying with the provisions of section 2-171 et seq. of this Code.
22 Sec. 40-32. Bond and insurance.
23 (a) Prior to receiving a certificate of competency required by the provisions of this article,
24 an applicant who has successfully passed the examination required by this article shall furnish a
25 corporate surety bond in the penal sum of not less than $10,000.00 conditioned that the applicant
26 shall, in all material by him furnished and in all work by him done and performed within the
27 jurisdictional area of the city in installing, altering or repairing any air conditioning distribution
28 system, strictly comply with this Code and ordinances of the city related thereto as now existing or
29 hereafter enacted.

1 (b) Said bond shall be executed by a qualified surety company licensed to do business in the
2 state. Said bond, before being accepted by the permits and inspections division, shall be approved
3 as to form by the city law department, and shall further be conditioned, among other things, to
4 indemnify the city against any lawsuits brought or judgments obtained against the city, or any of its
5 officials, employees or the board, and to hold the same harmless from any costs or expenses
6 occasioned by any injury or casualty happening to any person,persons or property,real or personal,
7 either directly or indirectly through the installation, altering,cleaning or adding to, or change in any
8 manner of any air conditioning/air distribution system, or any furnace, restaurant appliance hoods
9 and their duct systems,or any exhaust or intake ventilating systems as set forth in this article, at any .
10 and all places within the jurisdictional area of the city by the applicant or by his or their employees.
11 (c) The bond for an individual holding a certificate of competency in his own behalf shall
12 name said individual as principal. The bond for an individual holding a certificate of competency
13 on behalf of a firm or corporation shall name both the individual and the firm or corporation as
14 principals.
15 (d) In addition to the aforementioned bond, prior to the issuance of a certificate of
16 competency, an applicant shall furnish a certificate of insurance which provides a combined
17 ' coverage for bodily injury and property damage in a minimum amount of$300,000.00.
18 (e) Inactive status may relieve an individual of the above requirements subject to the
19 provision of Section 40-92.
20 Sec. 40-33. Issuance generally.
21 Upon certification that an applicant has successfully passed the required examination, the
22 permits and inspections division shall issue a certificate of competency when the applicant files the
23 bond and insurance as required by section 40-32.
24 Sec. 40-34. Issuance restricted; use of certificate.
25 A certificate of competency required by the provisions of this article may only be issued to
26 an individual on behalf of one firm or one corporation actively engaged in the business of a
27 contractor.
28 Sec. 40-35. Transfer.
29 Certificates of competency issued under the provisions of this article shall not be transferable
30 to any other person.
31 Sec. 40-36. Temporary certificates.
32 If the only certificate holder of a firm or corporation leaves the firm or corporation, as in case
33 of death of the holder of a certificate of competency or the termination of the employment p yment of
the
34 holder of a certificate of competency, the estate or business may be issued a special temporary

1 certificate of competency permitting such firm or business to engage in business as a contractor so
2 long as the legal representative or proposed certificate holder is of good character,has first obtained
3 and posted the required bond and insurance and is found by the board to be competent to hold such
4 certificate. In no event shall such temporary certificate be valid for more than six months from the
5 date of its issuance.
6 Sec. 40-37. Renewal.
•
7 (a)Before the expiration date of any certificate of competency or before the expiration date
8 of any renewal thereof,the holder of such certificate may,upon the payment of$50.00 and the filing
9 or having on file a bond and insurance as required in section 40-32,make application to the board
10 for a renewal of such certificate. All renewal fees shall be paid on or before December 31 of each
11 year for the ensuing year.
12 (b) Should the person fail to pay the application renewal fees by December 31,no work shall
13 be performed thereafter in regard to air conditioning and air distribution by any such person and
14 double the fee as stated in section 40-37(a) shall be paid for the renewal of such certificate. If said
15 person is delinquent in his renewal in excess of 30 days from December 31, it shall become
16 necessary for said person to be requalified by the board as required for the original certificate.
17 Sec. 40-38. Cancellation for inactivity.
18 If a certificate holder does not take a permit for a period of one year, the board shall hold a
19 hearing; and, if the certificate holder shall fail to show good cause why a permit has not been taken,
20 his certificate of competency may be revoked. Inactive status may be requested by an individual
21 subject to the provisions of Section 40-92.
22 Sec. 40-39. Revocation--Grounds.
23 (a) A certificate of competency issued under the provisions of this article may be revoked
24 immediately by the board upon the conviction of the holder thereof of any state law or provision of •
25 this Code relating to installation, repair, or alteration in or to any air conditioning/air distribution
26 system.
27 (b)A certificate of competency issued under this article may be revoked by the board when
28 it finds that the holder thereof is guilty of:
29 (1) Fraud or misrepresentation in securing such certificate.
30 (2) Incompetency in the exercise of the privileges of such certificate.
31 (3) Fraudulent use of a certificate.

1 (4) Refusal to perform work in accordance with law.
2 (5) Misuse of a certificate.
3 (6) Performance of work in violation of any law.
4 (7) Violation of the zoning law of the city.
5 (8) Any other violations of law which the board finds to be contrary to the intent and
6 purposes of this Code.
7 (9) Fraudulent business practice connected with the use of the certificate of competency.
8 Sec. 40-40. Same--Procedure.
9 (a) In all cases involving revocation of a certificate of competency, at least 15 days' notice
10 of the contemplated revocation shall be served in writing by certified mail at the address of the
11 certificate holder as shown in the permits and inspection division; and said notice shall indicate the
12 time and place of the hearing and the general grounds of said contemplated revocation, and shall
13 advise the holder of his right to appear at said hearing in person or by counsel for the purpose of
14 presenting his defense.
15 (b) The board shall make a complete record of the case and may at its discretion keep a
16 stenographic record of the testimony produced at such hearings. The board may take up such other
17 business at such hearings as it may deem advisable.
18 (c)No person whose certificate has been revoked shall be granted a new certificate until the
19 expiration of 12 months after the revocation aforesaid and successful reexamination and payment
20 of all fees as in the original instance. The revocation of a certificate of competency shall not entitle
21 the holder to a refund of any part of the fees which he may have paid.
22 Sec. 40-41. Same--Appeal.
23 The holder of a certificate of competency issued under the provisions of this article may
24 appeal a decision of the board revoking such certificate to the administrative appeals board by
25 complying with section 2-171 et seq. of this Code.

1 Subdivision B. Board of Examiners
2 Sec. 40-56. Created.
3 There is hereby created a board to be known as the air conditioning and air distribution board
4 in and for the city.
5 Sec. 40-57. Composition; qualifications of members.
6 The board shall consist of four air conditioning/air distribution contractors and a registered
7 professional mechanical engineer.
8 (1) Each contractor shall have the following qualifications provided that the conditions
9 of paragraphs (a), (b) and (c) may be met by a retired contractor that has held a
10 certificate of competency within the last five years:
11 (a) A holder of a current, valid and registered certificate of competency issued
12 by the city.
13 (b) Actively engaged in the business of installing,altering,repairing,or servicing
14 air conditioning/air distribution systems in the area of the city.
15 (c) A permanently established air conditioning/air distribution business in his or
16 her own right or shall be registered as doing business on behalf of a firm or
17 . corporation that is permanently established in the business.
18 (d) Had at least five years' experience as a certified and active contractor in the
19 city.
20 (e) Two contractors shall be representative of the domestic contractors and
21 primarily engaged in the installation and construction of all types of furnaces,
22 air conditioning units and ventilating systems over 500 CFM in residential
23 units.
24 (f) Two contractors shall be representative of the commercial-industrial
25 contractors and primarily engaged in the installation and construction of
26 commercial and industrial air conditioning and air distribution systems.
27 (2) The registered professional mechanical engineer shall have the following
28 qualifications:
29 (a) Be registered in the state, and practicing in the Omaha area.

1 (b) Have had at least five years' experience in the design of air conditioning/air
2 distribution and ventilating systems.
3 Sec. 40-58. Appointment of members.
4 The members of the board shall be appointed by the mayor and approved by the city council.
5 Sec. 40-59. Term of members.
6 Of the members originally appointed to the board, the registered professional mechanical
7 engineer shall be appointed initially for a term of three years. One contractor (domestic) and one
8 contractor(commercial-industrial)shall be appointed initially for a term of two years. One contractor
9 (commercial-industrial)and one contractor(domestic) shall be appointed initially for a term of one
10 year. Each succeeding appointment thereafter shall be for a term of three years.
11 Sec. 40-60. Vacancies.
12 Any vacancy occurring in the membership of the board for any reason other than the
13 expiration of a term shall be filled for the unexpired term.
14 Sec. 40-61. Compensation of members.
15 The compensation for each member of the board shall be$10.00 for each meeting attended.
16 Sec. 40-62. Organization.
17 (a)To accomplish its duties the board shall select one of its members each year in January
18 as chairman, one to act as secretary, and one to act as vice-chairman.
19 (b)The officers shall serve from February 1 of each year to January 31 of the following year.
20 (c)It shall not be the duty of the chairman to preside at all meetings. If the chairman is not
21 present for any meeting, the vice-chairman shall preside.
22 (d) The secretary of the board shall keep full, true and correct minutes and records of all
23 meetings, applications for examinations, examinations given the results thereof and certificates
24 issued.
25 (e) Board decisions shall be concurred in by at least three members of the board.

1 Sec. 40-63. Office supplies and secretarial services.
2 The permits and inspections division shall provide the board with all stationery and
3 stenographic services necessary for the conduct of its business and duties.
4 Sec. 40-64. Quorum.
5 Three members of the board shall constitute a quorum for the transaction of business coming
6 before it.
7 Sec. 40-65. Adoption of rules and regulations.
8 The board shall make such rules and regulations and prescribe such procedures as may be
9 necessary for its operation in conformity with the provisions of this article.
10 Sec. 40-66. Scope of authority.
11 The board shall have the complete control over the examination of applicants for certificates
12 of competency required by the provisions of this article and shall decide upon the qualifications of
13 all applicants.
14 Sec. 40-67. Duties.
15 The duties and responsibilities of the board shall include but shall not be limited to the
16 following:
17 (a) The board shall hold regular meetings when necessary for the purpose of examining
18 applicants who have filed their written application for certificates required by the
19 provisions of this chapter, or for the conduct of any other business upon call by the
20 chairperson.
21 (b) Examination of applicants shall be conducted at the board's discretion with a
22 minimum of once each quarter. The written portion of the examination shall be
23 monitored by the board or, at the board's discretion, by a duly authorized
24 representative.All rules and regulations shall be uniformly applied. The board shall
25 keep an accurate record of all applications for examinations and examinations given
26 with results.
27 (c) The board shall certify to the permits and inspections division the names of all
28 successful applicants with recommendations for the issuance of certificates of
29 competency. It shall keep accurate minutes of all its meetings and keep such other

1 records as may be required thereafter. The minutes of all meetings shall be available
2 for public inspection.
3 (d) The board shall adopt written examinations designed to determine if the applicant is
4 capable of designing and installing residential or commercial and industrial air
5 conditioning, air distribution and ventilating systems to protect and promote public
6 safety and welfare.
7 (e) The board shall review the examination grades and pass upon all applications for
8 certificates of competency required under the provisions of this chapter.
9 (f) The board shall have the authority to accept, as equivalent, examinations taken in
10 other jurisdictions.
11 (g) The board shall annually review the tests given for the certificate of competency and
12 shall adopt such revisions as are necessary to keep tests current with building and
13 industry methods and requirements.
14 (h) The air conditioning/air distribution examinations shall be given at the
15 Omaha/Douglas County Civic Center.
16 (i) Storage and filing facilities shall be provided by the city.
17 (j) Some of the examination questions shall be taken from the various codes and
18 regulations legally adopted by the city.
19 (k) The board shall at each meeting review all complaints as filed.
20 (1) The board may request legal advice from the city law department.
21 (m) The board shall have authority to grant a temporary certificate of competency as
22 required in section 40-36.

24 Subdivision C. Examinations
25 Sec. 40-86. Application.
26 Any person desiring to engage in business as a contractor may make written application to
27 the permits and inspections division to take the examination established by the board. The
28 examination fee shall be paid at the time of making such application.

1 Sec. 40-87. Fee.
2 Any person desiring to take an examination for a certificate of competency required by this
3 division shall pay the following appropriate fee:
4 (a) Air conditioning commercial examination and/or reexamination . . . . $100.00
5 (b) Air conditioning residential examination and/or reexamination . . . . . 75.00
6 No part of such fee shall be refunded on account of the failure of the applicant to qualify for
7 a certificate of competency.
8 Sec. 40-88. Notice on failure.
9 In case the applicant shall fail to satisfy the board that he possesses the necessary knowledge
10 and skill to properly and safely perform the things set forth in this chapter, he shall not be granted
11 a certificate of competency. The board shall notify the applicant of his failure to pass the
12 examination,
13 Sec. 40-89. Waiting period for reexamination.
14 No new application for a certificate of competency required by this article shall be accepted
15 by the board for an applicant who has failed to pass the required examination before 90 days has
16 elapsed since the date of the examination which was failed; however, such waiting period may be
17 waived by the board in cases involving extreme hardship to the applicant.
18 Sec. 40-90. Request for reexamination.
19 In the event of a failure to successfully pass the examination required by this division, an
20 applicant may request reexamination, in writing,paying the required reexamination fee.
21 Sec. 40-91. Certification of successful applicants.
22 The board shall, at its next regular meeting after an examination has been given, certify to
23 the permits and inspections division the names of all successful applicants with recommendations
24 for the issuance of a certificate of competency for said person to act as a contractor within the
25 meaning of this article.
26 Sec. 40-92. Inactive status of certificate.
27 (a) If any person holding a current certificate of competency wishes to be relieved of the
28 provisions of sections 40-32 and 40-38 of this Code, he shall apply to the air conditioning and air

1 distribution board in writing or in person, stating the reason for requesting an inactive status of the
2 certificate of competency.
3 (b) Upon approval by the air conditioning and air distribution board, the certificate of
4 competency shall then be marked "inactive" and coded numerically as such. Additionally:
5 (1) No bond or certificate of insurance as stated in section 40-32 shall be required by the
6 holder of such certificate.
7 (2) No permit shall be taken out by the holder of such certificate, nor shall any work as
8 a contractor be done by said person.
9 (3) An annual renewal fee of$50.00 shall be paid as provided in section 40-37 of this
10 Code.
11 (4) After a five-year period of inactive status, the certificate holder shall appear before
12 the board to renew his/her inactive status.
13 (c)If a holder of a certificate of competency wishes to put the certificate into an active status
14 again, the provisions of sections 40-32 and 40-38 shall apply as before.
15 Secs. 40-93--40-105. Reserved.
16 DIVISION 3. PERMITS AND INSPECTIONS
17 Sec. 40-106. Permit required.
18 The installation, alteration, repair or replacement of any air conditioning/air distribution
19 system or exhaust system shall not be undertaken within the jurisdiction of the city without a permit
20 issued by the permits and inspections division prior to said installation.
21 Sec. 40-107. Work by homeowners.
22 (a) Any homeowner doing air conditioning/air distribution work in a single-family
23 dwelling which he owns and in which he resides shall notify the permits and inspections division
24 of the nature of the work he intends to do and pay an inspection fee equal to the permit fees listed
25 herein. The work must be inspected and approved by the permits and inspections division. He will
26 not be required to have a certificate of competency provided acceptable proof of ownership and
27 residence is provided.
28 (b) The applicant shall live in the house the permit is applied for and it must be his or her
29 postal address. The house for which the permit is being applied for must be a single-family dwelling.

3 Sec. 40-108. Application for permit to be signed by certificate holder.
4 Each application for an installation permit required by this article shall be signed by the

6 Sec. 40-109. Fees generally.
7 Before any permit shall be issued under the provisions of this article, the applicant therefor

10 (3) Reinspections. In case the air conditioning/air distribution inspector is required to
11 make more than one trip from his office for the purpose of inspecting any work on
12 account of violation of rules,wrong address,or any other irregularities caused by the
13 contractor or any of his employees, the following charges will be made and paid
14 before the certificate of inspection is issued:
15 (a) First additional trip: No charge.
16 (b) Second additional trip and each additional trip thereafter: $15.00.
17 Sec. 40-110. Quadruple fees for commencing work without permit.
18 If any work coming under the provisions of this article is started without first obtaining a
19 permit as provided in this article,the person doing such work shall be in violation of this Code, and
20 a fee quadruple the amount due under this article, or$50.00,whichever is greater, shall be imposed

1 for the required permit in addition to any other penalty which may be imposed for the violation of
2 this Code.
3 Sec. 40-111. Exclusions from permit requirement.
4 A permit shall not be required under the provisions of this article for the installation or
5 construction of the following items:
6 (a) Window air conditioning units of 21/2 hp or less that are not connected to duct work.
7 (b) Exhaust systems of 500 CFM or less.
8 (c) Minor repairs such as cleaning, adjusting and replacement of minor parts where the
9 total cost does not exceed $300.00.
10 These minor repairs do not include any change in the duct work, plenum or the adding of
11 registers, in which case a permit must betaken and fees charged according to this article.
12 Sec. 40-112. Issuance of permits restricted.
13 (a) A certificate holder may only secure permits for the person named on the bond filed
14 by such holder. The holder cannot secure permits individually and for a firm or
15 corporation.
16 (b) No permit shall be issued to a contractor for work other than his own.
17 (c) Before a permit can be issued, the certificate holder must have an established usual
18 place of business.
19 (d) All trucks used by contractor in his business must have his firm name and the
20 contractor's registration number noted thereon.
21 Sec. 40-113. Responsibility for work.
22 When a certificate holder obtains a permit required by the provisions of this article, it is the
23 responsibility of such holder that the work be completed in compliance with the provisions of this

1 Sec. 40-115. Approval of work required prior to connection or use of fuel or power.
2 Fuel or power shall not be supplied or turned on until defects have been corrected and the
3 system has been approved by the permits and inspections division. The permits and inspections
4 division may, on inspection and approval, grant permission for operation on a temporary basis.
5 Sec. 40-116. Temporary operation of equipment.
6 Temporary operation of equipment coming under this article shall only be allowed in an
7 unoccupied building where heat is necessary during construction work. Such operation shall cease
8 before occupancy unless final inspection has been made.
9 Sec. 40-117. Inspection required.
10 It shall be unlawful for any person to operate any air conditioning/air distribution or
11 ventilating system installed,altered or repaired until such systems have been inspected and approved
12 by the permits and inspections division.
13 Sec. 40-118. Covering work prior to inspection.
14 Upon the completion of the framing of a building or structure and when the erection of all
15 structural or component parts of a building or structure has been completed, and before any air
16 conditioning/air distribution system, ventilating or exhaust system is covered with insulation, lath,
17 wall board,wall paneling or other interior finish materials,the contractor shall call the permits and
18 inspections division for a rough-in inspection of the air conditioning/air distribution,ventilating and
19 exhaust system to determine whether all requirements relative to air conditioning/air distribution
20 ventilating and exhaust systems rough-in work has been installed to comply with the provisions of
21 this article.
22 Sec. 40-119. Removal of covering placed prior to inspection.
23 The permits and inspections division shall have the authority to cause to be removed, at the
24 contractor's or builder's expense, all covering which has been placed over any air conditioning/air
25 distribution or rough-in work without having first obtained the inspection and approval thereof as
26 hereinbefore required.
27 Sec. 40-120. Disapproval of work.
28 Should it be found upon examination of the air conditioning/air distribution rough-in work
29 in any building or part of a building that the same or part of the same does not comply with the terms
30 of this article,the permits and inspections division shall attach to such work a tag or label stating that

1 the work has been inspected and is not approved; and such air conditioning/air distribution or rough-
2 in work must not be covered until approval of same has been obtained.
3 Sec. 40-121. Failure to attach tag to unapproved work.
4 Failure on the part of the permits and inspections division to attach a nonacceptance tag or
5 label to work not acceptable shall not be construed as an acceptance by the permits and inspections
6 division of such defective work.
7 Sec. 40-122. Approval of work.
8 If it is found upon inspection that all provisions of this article have been complied with, the
9 permits and inspections division shall affix to such work a tag or label stating that the work has been
10 inspected and approved and may be covered.
11 Sec. 40-123. Annual review of building requirements.
12 The board and the superintendent of the permits and inspections division shall annually
13 review the minimum requirements set forth above, and the board shall recommend such changes as
14 are necessary to keep the building requirements current.

16 ARTICLE III. BOILER AND PRESSURE VESSELS
17 DIVISION 1. BOILER INSPECTORS
18 Subdivision A. In General
19 Sec. 40-133. Qualifications.
20 The boiler inspector shall be a stationery engineer qualified by experience in the installation,
21 use and construction of such equipment as he is required to inspect or cause to be inspected. He shall
22 not be interested, directly or indirectly, in the manufacture, ownership or agency of any equipment
23 which he is required to inspect. He shall have had at least ten years' practical experience as an
24 engineer or he shall be a professional mechanical engineer who has had not less than ten years'
25 experience in the designing, construction, installation and use of appliances of the kind that he is
26 required to inspect, either of whom shall qualify as a first grade stationary engineer. The boiler
27 inspector shall hold a National Board of Boiler and Pressure Vessel Inspectors commission.

1 Sec. 40-134. Inspection duties.
2 The boiler inspector shall make such inspections, or cause such inspections to be made, as
3 are provided for by this article and other applicable provisions of this Code, state law, and city
4 ordinances, rules and regulations.
5 Sec. 40-135. Records.
6 The permits and inspection division shall keep a record of the names of all owners and users
7 of boilers,together with a description of the boilers, the pressure allowed, and the capacity thereof,
8 and a record of all inspections made thereon, and shall maintain a complete record of all engineer
9 extel-fiferitali certificates issued.
10 Secs. 40-136--40-142. Reserved.
11 Subdivision B. Deputy Inspectors
12 Sec. 40-143. Office created; purpose.
13 For the purpose of insurance,by insurance companies authorized to do such business by the
14 state against explosion or rupture of boilers and other pressure vessels,there is hereby created the
15 office of deputy boiler inspector.
16 Sec. 40-144. Designation.
17 Any insurance company coming under the provisions of this subdivision may designate to
18 the permits and inspections division one or more persons,to be appointed by the superintendent of
19 such division subject to the approval of the planning director,to act as deputy boiler inspectors.
20 Sec. 40-145. Examination.
21 Before any person shall be appointed a deputy boiler inspector for the city, he shall first
22 present a National Board commission showing that he is qualified to make the examinations and
23 tests of all boilers and pressure vessels necessary to carry out the terms, intents and purposes of the
24 provisions of this Code and ordinances of the city governing boiler and pressure vessel inspection,
25 maintenance and operation.
26 Sec. 40-146. Bond.
27 An applicant for appointment as a deputy boiler inspector shall file with the permits and
28 inspections division a bond in a form prescribed by the division in the penal sum of not less than
29 $3,000.00. Such bond shall be executed by a qualified surety company licensed to do business in this

1 state,and before being accepted by the permits and inspections division shall be approved by the city
2 law department. The bond shall be conditioned, among other things, to:
3 (a) Indemnify the city, its officials, employees and the board of engineer examiners
4 against any and all claims from improper conduct on the part of the applicant;
5 (b) Comply with all requirements of this Code and ordinances of the city pertaining to
6 and regulating the conduct of deputy boiler inspectors; and further
7 (c) Deliver to the city all goods, chattels, funds or other property in his hands belonging
8 to the city at the close of this term of office.
9 Sec. 40-147. Appointment.
10 Upon approval of the bond required by this division,the superintendent of the permits and
11 inspections division, subject to the approval of the planning director, may appoint the applicant a
12 deputy boiler inspector for the city.
13 Sec. 40-148. Compensation.
14 A person appointed as a deputy boiler inspector shall receive no compensation from the city.
15 Sec. 40-149. Inspections restricted.
16 It shall be unlawful for any deputy boiler inspector to make any inspection of steam boilers
17 or other pressure vessel other than for the insurance company by which he is employed for the
18 purpose of insuring any such boiler or other pressure vessel.
19 Sec. 40-150. Inspection report.
20 Within 15 days after making any inspection, a deputy boiler inspector shall, in the name of
21 the insurance company employing him, file with the boiler inspector a full and complete report of
22 such inspection upon a standard American Society of Mechanical Engineers boiler or pressure vessel
23 inspection form as the case may require. This report shall be a true and correct statement of the
24 conditions of the boiler or pressure vessel inspected and shall show whatever recommendations have
25 been made for the correction of any defects disclosed by such inspection.
26 Sec. 40-151. Inspection permit required.
27 A deputy boiler inspector shall obtain a permit for the examination or inspection of any steam
28 boiler or pressure vessel, for the first inspection made each year, in the name of the insurance
29 company by whom he is employed.

1 Sec. 40-152. Inspection fee.
2 A fee of$4.00 shall be paid for each boiler to be inspected.
3 Sec. 40-153. Cancellation of authority.
4 In the event any deputy boiler inspector shall:
5 (a) Make any inspection without first obtaining the required permit;
6 (b) Fail to make reports as required by this division; or
7 (c) Make any false or improper inspection, recommendation or report;
8 he shall be deemed guilty of a misdemeanor and subject to the penalties provided for the violation
9 of this chapter. The superintendent of the permits and inspections division may also remove such
10 deputy from office and cancel all authority vested in him.

1 Sec. 40-154. Identification of inspected equipment.
2 Upon inspecting each insured boiler or other pressure vessel,the deputy boiler inspector shall
3 mark in an approved manner for identification each such boiler or other pressure vessel approved
4 by him. •
5 Sec. 40-155. Report to insurer.
6 Upon completion of his inspection each deputy inspector shall make a complete report
7 thereof to the insurer by which he is employed and to the owner of the apparatus inspected. A true
8 copy of such report shall be filed with•the permits and inspections division.
9 Sec. 40-156. Inspection prerequisite to insurance.
10 Any insurance company duly qualified by the state to write liability or indemnity insurance
11 upon boilers and other pressure vessels shall, before placing such insurance, make or cause to be
12 made inspections of the fitness and safety of each appliance to be insured by it located within the
13 city. Such inspection shall be made only by the boiler inspector of the city or by duly qualified
14 inspectors who have been deputized as set forth in this division to do such work.
15 Sec. 40-157. Compliance by insurance companies.
16 Inspections of boilers or other pressure vessels made by any deputy boiler inspector in the
17 name of an insurance company may be accepted by the permits and inspections division in lieu of
18 inspections made by the city boiler inspector for the purpose of obtaining a certificate of inspection
19 if and when the insurance company shall comply with the following requirements:
20 (a) Present in writing to the permits and inspections division the name or names of the
21 person or persons who have been deputized under the terms of this division, and who
22 such company desires to act for them as boiler inspectors.
23 (b) Notify the superintendent of the permits and inspections division, in writing, within
24 24 hours of each acceptance, suspension or cancellation of insurance coverage by the
25 insurer.
26 (c) Make application,pay any required fee and obtain a permit for the inspection of each
27 appliance to be inspected before making or causing to be made such inspection.

1 Sec. 40-158. Effect of issuance of inspection permit.
2 Inspection permits issued under the provisions of this division shall entitle the insurance
3 company to issue insurance for the inspected boiler or other pressure vessel during the duration of
4 the validity of such permit.
5 Sec. 40-159. Duration of inspection permit.
6 Every inspection permit issued under the provisions of this division shall be valid for one
7 year from its date of issuance.
8 Sec. 40-160. Additional inspections.
9 The fact that any boiler or other pressure vessel has been inspected,passed and accepted as
10 an insurable risk by any such insurance company shall not act as a bar to any future examination or
11 tests which the superintendent of the permits and inspections division may, in his judgment, deem
12 necessary in the interests of public safety,nor shall his right to order changes, alterations or repairs
13 be abridged thereby.

15 DIVISION 2. BOARD OF EXAMINERS
16 Sec. 40-165. Composition.
17 The board of engineer examiners shall be composed of three members. One shall be the
18 boiler inspector.
19 Sec. 40-166. Qualifications of members.
20 The appointed members of the board of engineer examiners shall each have at least ten years'
21 practical experience in the operation and maintenance of steam boilers, shall be qualified to make
22 boiler inspections and shall hold first grade stationary engineer's certificates.
23 Sec. 40-167. Appointment of members.
24 The members of the board shall be appointed by the mayor and approved by the city council.
25 Sec. 40-168. Compensation of members.
26 The appointed members of the board of engineer examiners shall receive $10.00 for each
27 meeting of the board at which they are present.

1 Sec. 40-169.Meetings.
2 The board of engineer examiners shall meet at least once each calendar month for the
3 examination of applicants or their examination papers; however, such meeting shall not be held
4 unless there are two or more applications on file. The president of the board shall have the power to
5 call special meetings of the board when deemed necessary. The secretary of the board shall be
6 required to keep minutes of all meetings.The board shall not hold more than two sessions per month.
7 Sec. 40-170. Quorum.
8 A majority of the members of the board of engineer examiners shall constitute a quorum for
9 the transaction of business.

10 Sec. 40-171. Office supplies and secretarial services.
11 The boiler inspector and the board of engineer examiners shall be provided with all stationery
12 necessary for their official duties and stenographic services for use in the conduct of examinations.
13 Sec. 40-172. Duties.

14 The board of engineer examiners shall prepare and conduct all examinations provided for in
15 this article.

17 DIVISION 3. CERTIFICATES
18 Sec. 40-176. Required.
19 No person shall operate, or cause to be operated, any boiler plant unless there shall be in
20 charge of such plant an experienced person who holds a certificate of the proper grade in good
21 standing granted by the board of engineer examiners as provided in this article, or who holds a
22 temporary permit as provided in section 40-189.
23 Sec. 40-177. Exemptions.
24 The following plants shall be exempt from the provisions of this article:
25 (a) Heating plants used for heating a private dwelling.

1 (b) All is plants having a pressure not exceeding 15 pounds per square inch steam
2 and not exceeding 750 square feet of boiler
3 heating surface.
4 (c) All steam plants over 15 pounds pressure under 500 square feet heating surface.
5 Hot water heating plants not exceeding one thousand (1,000) square feet of heating
6 surface.
7 Sec. 40-178. Required personnel for plants in continuous operation.
8 In the event that a boiler plant is operated day and night, the owner or user thereof shall
9 employ certified engineers,or ccrtificd fircmcn, as required by this article, during the entire time the
10 plant is in operation.
11 Sec. 40-179. Preventing compliance.
12 No owner, agent, lessee or employer shall by means of threats of dismissal or by any form
13 of compulsion or persuasion attempt to prevent compliance with the provisions of this article by any
14 person amenable thereto.
15 Sec. 40-180. Grades established.
16 The board of engineer examiners shall issue grades of certificate based on examinations
17 therefor and upon which the applicant has received passing grades:
18 (a) First grade stationary engineer's certificate.
19 (b) Second grade stationary engineer's certificate.
20 (c) Third grade stationary engineer's certificate.
21 Sec. 40-181. First grade certificate.
22 A first grade stationary engineer's certificate shall entitle the holder to take charge of and
23 operate any steam, power, refrigeration or compressor plant within the city. At least one such
24 certificate shall be required for each plant having steam prime movers which in the aggregate amount
25 to 100 horsepower or more. This examination shall cover the various types of engines, steam
26 generators and auxiliary equipment,refrigeration and compressor equipment, and their construction,
27 operation, maintenance and defects; the use, operation and care of electric generators and motors;
28 and the causes and prevention of smoke.

1 Sec. 40-182. Second grade certificate.
2 A second grade stationary engineer's certificate shall entitle the holder to take charge of and
3 operate any boiler power plant having steam prime movers which in the aggregate amount to less
4 than 100 horsepower. At least one stationary engineer's certificate shall be required in each shift for
5 each such plant. The holder of a second grade stationary engineer's certificate shall be entitled to
6 operate as a shift engineer under the general supervision of a holder of a first grade stationary
7 engineer's certificate. This examination shall cover hot water boilers and equipment, steam
8 generators and auxiliary equipment, and their construction,operation, maintenance and defects; the
9 use, operation and care of electrical generators and motors; and the causes and prevention of smoke.
10 Sec. 40-183. Third grade certificate.
11 A third grade stationary engineer's certificate shall entitle the holder to take charge of and
12 operate any boiler plant having no steam prime movers. This examination shall cover hot water
13 boilers and equipment, steam generators and their auxiliary equipment, and their construction,
14 operation, maintenance and defects;the use, operation and care of electrical motors; and the causes
15 and prevention of smoke.
16 Sec. 40-184. Reserved.
17 Sec. 40-185. Required certificates for persons in charge of equipment.
18 (a)It shall be unlawful for any owner,firm or corporation to operate or cause to be operated
19 any engines operated by steam or any turbines operated by steam within the city having an aggregate
20 capacity of 100 horsepower or more,unless there is in charge at least one person holding a first grade
21 stationary engineer's certificate; and all other shifts shall be operated by the holder of at least a
22 second grade stationary engineer's certificate under the supervision of the first grade engineer.
23 (b) Where aggregate capacity of engines operated by steam, and/or turbines operated by
24 steam, is less than 100 horsepower, there shall be in charge at least one person holding a second
25 grade stationary engineer's certificate,or a limitcd ccrtificatc, at all times the engines or turbines are
26 in operation.
27 Sec. 40-186. Application.
28 Every person desiring a certificate required by the provisions of this article shall make his
29 application upon a blank furnished by the permits and inspections division and obtain thereon the
30 endorsement of two citizens of the city, at least one of whom shall be the user of steam or a certified
31 engineer.

1 Sec. 40-187. Qualifications of applicants.
2 (a)Every applicant for a certificate required by the provisions of this article shall be at least
3 18 years of age and shall furnish proof of date of birth.
4 (b)An applicant for a first grade stationary engineer's certificate shall have had at least five
5 years' experience in power and/or heating plants.
6 (c) An applicant for a second grade stationary engineer's certificate shall have had at least
7 three years' experience in the operation and care of steam boilers under the supervision of a holder
8 of a certificate of like or higher grade to that applied for, or experience equivalent thereto.
9 (d)An applicant for a third grade stationary engineer's certificate shall have had at least one
10 year's experience in the operation and care of boilers under the supervision of the holder of a
11 certificate of like or higher grade to that applied for, or experience equivalent thereof.
12 Sec. 40-188. Examination required.
13 No certificate shall be issued under the provisions of this article until the applicant therefor
14 has passed the examination required for such certificate.
15 Sec. 40-189. Temporary permits.
16 The beiier chief mechanical inspector may issue a temporary permit without examination
17 therefor to a person or persons who have applied for a certificate upon proper proof of qualifications
18 and upon recommendation of an intended employer,but such temporary permit shall remain in force
19 only until the applicant has been provided an opportunity to be examined by the board of engineer
20 examiners. All persons to whom such temporary permits are issued shall be subject to and shall
21 comply with all of the provisions of this chapter.
22 Sec. 40-190. Examination fee.
23 Along with his application for a certificate required under the provisions of this article,the
24 applicant therefor shall pay the appropriate examination fee as follows:
25 (a) First grade stationary engineer's certificate $40.00
26 (b) Second grade stationary engineer's certificate 30.00
27 (c) Third grade stationary engineer's certificate 20.00

1 Sec. 40-191. Failure to appear for examination.
2 Any applicant for a certificate required under this article who shall fail to present himself
3 before the board of engineer examiners for examination within 60 days from the date of his
4 application shall forfeit the required fee and his application shall be canceled unless he has been
5 excused for good cause by the secretary of the board of engineer examiners.
6 Sec. 40-192. Conduct of examination.
7 All examinations for a certificate required by the provisions of this article shall be oral,
8 written, or both at the discretion of the board of engineer examiners.
9 Sec. 40-193. Passing grade on examination.
10 A grade of 75 percent shall be required to pass any examination required by the provisions
11 of this article.
12 Sec. 40-194. Record of examination.
13 A complete stenographic record of all oral examinations given under the provisions of this
14 article shall be made, which, together with the written examinations, shall be kept on file by the
15 secretary.
16 Sec. 40-195. Reexamination.
17 Any applicant for a certificate required by the provisions of this article who shall fail to pass
18 the required examination shall be required to wait at least 30 days after the date of such examination
19 before again making application for the certificate. The applicant shall be required to pay the same
20 fee as for the original examination.
21 Sec. 40-196. Duration.
22 All certificates issued under the provisions of this article,unless revoked for cause, shall be
23 valid until December 31 of the year of issuance.
24 Sec. 40-197. Renewal.
25 Any certificate issued under the provisions of this article shall be renewed from year to year
26 thereafter on the payment of$35.00. Such renewal fees shall be paid within 30 days after the date
27 of expiration or the certificates shall become void. If not renewed within one year from the date of
28 expiration, a new application and reexamination shall be required.

1 Sec. 40-198. Reserved.
2 Sec. 40-199. Display.
3 Every holder of a certificate issued under the provisions of this article shall display his
4 certificate in a conspicuous place in the plant where he is employed. The boiler chief mechanical
5 inspector is herewith empowered to suspend, for a period not exceeding 90 days, the certificate of
6 any person failing to comply with the foregoing provision.
7 Sec. 40-200. Temporary assignments to fill vacancies.
8 The boiler chief mechanical inspector shall have the authority in an emergency, and when
9 the public interests shall require,to make temporary assignments if and when vacancies occur. Such
10 assignments shall be made for a period not exceeding 90 days. Any such appointee shall be the
11 holder of a current certificate and in the judgment of the boiler inspector shall be possessed of proper
12 qualifications for the assignments. , ' ,
13 .
14 Sec. 40-201. Leaving boiler unattended.
15 (a)No boiler shall be left unattended for a period longer than two hours.However,any boiler
16 shall be exempt from the above provisions when and if fired by an approved burner or firing device
17 and if said boiler is equipped with approved controls which will automatically maintain the water
18 level in the boiler and which will extinguish or properly retard the fire if the steam pressure exceeds
19 a predetermined maximum or the water level falls below a predetermined minimum. Such burner,
20 if using gas or oil, shall also be equipped with approved devices,mechanical or electrical,which will
21 automatically prevent an abnormal flow of gas or oil, and which shall completely shut off the flow
22 of gas or oil when combustion ceases. Such burner shall also be equipped with an approved
23 automatic device, so designed that gas or oil, upon being turned into the combustion chamber, will
24 become ignited substantially immediately or else shut off. In such case, the boiler inspector shall
25 designate on the certificate of boiler inspection the length of time that any such boiler may be left
26 unattended.
27 (b) Except as hereinbefore provided, no certified engineer shall leave his post during the
28 operation of the plant unless relieved by a certified man, properly qualified. The penalty for any
29 absence, except as hereinbefore provided, shall be the suspension or revocation of the certificate.
30 This shall not include the time the plant is not in operation.

1 Sec. 40-202. Neglect of duty; suspension of certificate.
2 (a)Any certified engineer who shall negligently endanger the life of any person or jeopardize
3 property by allowing the water to fall below the flues or crown sheet, or who otherwise grossly
4 neglects his duty, or who is intoxicated on duty, shall have his certificate suspended indefinitely.
5 (b)Any certified engineer who shall willfully, or through careless firing,cause dense and/or
6 unnecessary smoke or soot to issue from the chimney or smokestack shall have his certificate
7 suspended for a period of not exceeding 90 days.
8 Sec. 40-203. Reserved.
9 Sec. 40-204. Appeals generally.
10 Any person aggrieved by an order, requirement, decision or determination concerning the
11 granting, issuance, denial, revocation or cancellation of any permit or license provided for by any
12 provision of this Code or city ordinance may appeal such order, requirement, decision or
13 determination made by an administrative official, agency, division or department to the
14 administrative appeals board.
15 Sec. 40-205. Appeal procedure.
16 When any person has made application for a stationary engineer's certificate and such
17 certificate has been denied or refused by the administrative board of appeals, or when any certificate
18 heretofore or hereafter granted has been revoked or suspended by the boiler inspector, or when any
19 person believes himself otherwise injured or wronged by the administrative board of appeals or the
20 boiler inspector,such person may appeal such action of the board of engineer examiners or the boiler
21 inspector to the board of appeals by filing a written request with the city clerk within three days after
22 receiving notice of such denial,revocation or suspension or other ruling. The board of appeals shall,
23 within three days after filing,hear such appeal, and it is hereby authorized to take such action or to
24 make such orders in the premises as in its opinion may be just and proper. All testimony shall be
25 under oath, administered by the chairman of the board of appeals. This section shall not be deemed
26 to deprive or oust the city council of final jurisdiction in any matters covered herein.

28 DIVISION 4. INSTALLATION AND CONSTRUCTION OF BOILERS
29 Sec. 40-210. Exemptions.
30 The following boilers shall be exempt from the provisions of this article:

1 (a) Boilers of railroad locomotives;
2 (b) Boilers under the jurisdiction of the United States government;
3 (c) Boilers in private residences used solely for heating purposes and carrying pressures
4 not exceeding 15 pounds per square inch steam and 30 pounds per square inch hot
5 water;
6 (d) Boilers having less than six square feet grate surface and carrying pressures not
7 exceeding 15 pounds per square inch steam and 30 pounds per square inch hot water;
8 (e) Boilers of less than five horsepower carrying pressures not exceeding 3$ 15 pounds
9 per square inch steam and 30 pounds per square inch hot water.
10 Sec. 40-211. Inspection upon installation.
11 All boilers shall be inspected when installed. All pressure tanks used as containers for air or
12 other gases shall be inspected when installed.
13 Sec. 40-212. Periodic inspections.
14 All boilers and their appurtenances shall be inspected at intervals of not over one year. No
15 person shall operate or cause to be operated any boiler,not exempted by the provisions of this article,
16 until the boiler has been inspected as hereinafter provided for,nor until a certificate of inspection has
17 been issued by the permits and inspections division.
18 Sec. 40-213. Display of certificate of inspection.
19 The certificate of inspection for a particular boiler shall be so placed as to be easily read
20 within the boiler room of the plant where the boiler is located. In case of a portable heater, such
21 certificate shall be kept on the premises where the boiler is in service and shall be accessible at all
22 times.
23 Sec. 40-214. Exceeding safe pressure.
24 It shall be unlawful for any person to operate or cause to be operated any boiler not exempted
25 by the provisions of this chapter at a pressure in excess of the safe working pressure stated in the
26 boiler's certificate of inspection.

1 Sec. 40-215. Safety appliances required.
2 All boilers coming under the jurisdiction of the permits and inspections division shall be
3 equipped with appliances to ensure safety of operation.
4 Sec. 40-216. Standards for boilers and pressure vessels.
5 All boilers and pressure vessels shall be fabricated and installed in accordance with the
6 minimum standards set forth in ASME Boiler and Pressure Vessel Code.
7 Sec. 40-217. Standards for use of lethal gas.
8 The term "lethal gas" as used herein shall be as defined by section VIII, "Pressure Vessels,"
9 division I, 1989 edition,published by the American Society of Mechanical Engineers, of which not
10 less than three copies have been and now are filed in the office of the city clerk, and the same are
11 hereby adopted and incorporated as fully as if set out at length herein and the provisions thereof shall
12 be controlling in the city.
13 Sec. 40-218. Other pressure vessels.
14 All pressure tanks, retorts, vulcanizers and vessels for cooking or other processes under
15 • pressure of more than 15 pounds gauge and of a capacity of 75 gallons or over shall be governed by
16 the provisions of this Code,except vessels containing only water with a maximum storage capacity
17 of 120 gallons under pressure for domestic supply, including those containing air,the compression
18 of which serves only as a cushion or in an air-lift pumping system.
19 Sec. 40-219. Installation fees.
20 (a) The following installation fees shall be charged for each unit in an installation,which
21 will include the cost of final inspection and certificates:

11 Sec. 40-220. Permit required.
12 It shall be unlawful for any owner or user of any boiler or other appliance coming under the
13 provisions of this chapter to fail to apply to the permits and inspections division for a permit
14 authorizing any such work before the same is begun.
15 Sec. 40-221. Quadruple fees for commencing work without permit.
16 Any owner or his agent who shall fail to make application for the permit required by the
17 provisions of this article before starting any work for which a permit is required shall, upon being
18 granted a permit for such work,be required to pay quadruple the amount of the regular fees imposed
19 by this article, or$50.00, whichever is greater.
20 Sec. 40-222. Inspection required.
21 The permits and inspections division reserves the right to make inspections of any and all
22 boilers and other appliances carrying pressure within the city as herein described and at such times
23 as may be considered necessary for the safety of the public, notwithstanding that such boilers or

1 other appliances may be under periodic inspection of insurance companies authorized to ensure
2 boilers and other appliances carrying pressure within the state and who are qualified as herein
3 provided to make such inspections within the city; however, any boiler or other appliance carrying
4 pressure and requiring inspection under the provisions of this Code is to be inspected at regular
5 intervals by a qualified inspector of an authorized insurance company whose report of inspection is
6 filed in the office of the permits and inspections division. Such report will be accepted and received
7 as an authentic statement of the condition of the boiler or other appliance carrying pressure reported
8 thereon at the time such inspection was made, and will be considered equivalent to an inspection by
9 the bailer mechanical inspector of the permits and inspections division, for which no inspection fee
10 shall be charged.
11 Sec. 40-223. Preparation for inspection.
12 It shall be the duty of the owner or user of each boiler coming under the provisions of this
13 article to have the boiler prepared for inspection as follows:
14 (a) All hand hole and manhole plates and washout plugs shall be removed;
15 (b) The boiler shall be washed out clean of mud and loose scale; and
16 (c) The furnace, combustion chamber, tubes, smoke box and breaching shall be
17 thoroughly cleaned.
18 Sec. 40-224. Notification that boiler is ready for inspection.
19 The owner or user of a boiler to be inspected under the provisions of this article shall notify
20 the permits and inspections division at least two days prior to the date the inspection is to be made
21 that the boiler will be ready for inspection.
22 Sec. 40-225. Scope of inspection.
23 (a) It shall be the duty of the boiler mechanical inspector to observe, in the inspection of a
24 boiler,the pressure carried,to test the gauge and safety valve and correct the same when needed to
25 the pressure allowed by the certificate of inspection, and to observe the level of the water in the
26 boiler to ascertain if the water glass and water gauge cocks are in proper working order,the condition
27 of the blow-off valve and catch basin,boiler and feed connections,brickwork, draft appliances and
28 the general condition of the plant with regard to ventilation, light and cleanliness.
29 (b)In addition to the provisions of paragraph(a) of this section, the inspector shall observe
30 the general internal and external condition of the surface of the boiler, the condition in regard to
31 scale, pitting, corrosion, blistering, bagging or fire cracks, condition of tubes, braces, seams,

1 staybolts, steam arms,tube ends and water legs,and fusible plugs,and to test by hammer those parts
2 he considers necessary.
3 Sec. 40-226. Hydrostatic testa
4 (a) If the bailer mechanical inspector shall determine that a hydrostatic test is required to
5 determine whether the boiler is safe to carry the pressure allowed, the owner or user of the boiler
6 shall supply the labor, water and pipe connections for such test. The boiler shall be tested at a
7 pressure 1 1/2 times the pressure to be carried. If, on account of leakage or any other reason, the
8 boiler will not hold this pressure,the owner or user shall have all repairs made as quickly as possible
9 before another test is made.
10 (b) If the second test develops weakness, which in the judgment of the inspector would
11 impair the boiler and not permit the allowed pressure to be carried, he shall condemn the boiler or
12 reduce the pressure allowed to that which, in his judgment, will be safe.

8 Sec. 40-228. Report of inspection; repairs.
9 (a) A written report of each inspection made under the provisions of this article shall be
10 furnished to the owner or user of the boiler.
11 (b) The owner or user shall make any repairs or alterations to the boiler which the boiler
12 inspector recommends.
13 (c) In case any of the recommended repairs or alterations are considered necessary for
14 public safety, the boiler shall be shut down until the same are made. It shall be unlawful for any
15 owner or user to use or cause to be used such boiler or cause any such boiler to be fired until such
16 repairs are made, inspected and accepted.
17 (d) When the recommended repairs or alterations are made,the owner or user shall notify
18 the permits and inspections division.
19 (e) After inspection and approval of any recommended repairs or alterations,a certificate
20 of inspection shall be furnished for the boiler.
21 Sec. 40-229. Issuance of certificate of inspection.
22 A certificate of inspection shall be issued by the permits and inspections division for each
23 boiler inspected under the provisions of this article,in which shall be specified the date of inspection,
24 kind of inspection,whether internal or external,test,whether hammer or hydrostatic, steam pressure
25 permitted to be carried at the safety valve,type and number of the boiler,name of owner or user with
26 address,and location of the building in which the boiler is in service. Such certificate shall be signed
27 by the inspector who made the inspection.

1 Sec. 40-230. Tampering with safety valve.
2 It shall be unlawful for any person to remove or tamper with any safety appliance prescribed
3 herein or to in any manner load the safety valve to a greater pressure than that allowed by the
4 certificate of inspection. Should inspection show that the safety valve has been altered and a higher
5 pressure carried on the boiler than permitted by the certificate of inspection,then and in that case,
6 whosoever shall own, use, fire or cause to be used or fired any such boiler will be liable to
7 punishment as provided in section 1-10 of this Code and the certificate of the engineer in charge of
8 such boiler shall be revoked.
9 Sec. 40-231. Removal of boilers--Permit required.
10 It shall be unlawful for any person to:
11 (a) Remove from any building within the city for relocation either inside or outside the
12 city; or
13 (b) Bring from outside the city for relocation within the city;
14 or cause the same to be done, any boiler which had theretofore been used without first obtaining a
15 permit therefor from the permits and inspections division.
16 Sec. 40-232. Same--Permit fee.
17 Before any permit shall be issued for the removal of any boiler,the applicant therefor shall
18 pay a fee of$20.00 to the permits and inspections division.
19 Sec. 40-233. Same--Contents of permit.
20 The removal permit required by this article shall contain the cause for such removal, the
21 name of the purchaser of the boiler and the final disposition of the boiler should it be relocated
22 within this city.
23 Sec. 40-234. Same--Inspection.
24 The owner, purchaser or user of a boiler for which a removal permit has been issued shall
25 have the same prepared for inspection before it is coated with paint or any other preservative, and
26 the boiler shall not be used for any purpose where pressure is carried until a new certificate of
27 inspection has been issued for the same. If it is found that such boiler has to be repaired or
28 overhauled,the person doing such work shall file a full detailed description of the boiler and repairs
29 made with the permits and inspections division. When repairs have been made,the boiler shall be

1 subject to inspection, if it is to be used in this city, before it is coated with paint or other
2 preservatives.
3 Sec. 40-235. Portable boilers.
4 Portable boilers attached to steam shovels, ditching machines, dredges, drag lines, pile
5 drivers, derricks,hoists, concrete mixers, rock crushers, conveyors, asphalt machines, road rollers,
6 or other portable rigs used in construction or repair work, and not exempted otherwise by the terms
7 of this Code,the users of which have complied with the provisions of this chapter, may be removed
8 from one general location to another within the city or taken out of and brought back into the city,
9 without payment of a fee for such removal,provided that a removal permit as required by this article
10 shall in all cases be first obtained.

12 ARTICLE IV. FLAMMABLE LIQUIDS
13 DIVISION 1. GENERALLY
14 Sec. 40-242. Definition.
15 For the purpose of this article, the phrase "installing or servicing oil or flammable liquids
16 storage equipment" shall be as defined in applicable rules and regulations promulgated by NFPA 30-
17 1990,NFPA 30A-1990,NFPA 37-1990,NFPA 31-I-990.
18 Sec. 40-243. Flammable and Combustible Liquids Code adopted.
19 There is hereby adopted and made a part of this division, with the same force and effect as
20 though provided by ordinance of the city,the rules and regulations promulgated by the '9 0-editron
21 of-the Flammable and Combustible Liquids Code,NFPA numbers 30 and 30A thereof, relating to
22 enforcement of regulations, of which not less than three copies have been and now are filed in the
23 office of the city_clerk; and the same is hereby adopted and incorporated as fully as if set out in
24 length herein; and the provisions thereof shall be controlling insofar as the same shall not conflict
25 with any other provisions of this article or other ordinances of the city.
26 Sec. 40-244. Dealers' permits.
27 It shall be unlawful for any person to engage in the business of selling and/or vending
28 combustible or flammable liquids without first having secured a permit from the chief of the fire
29 department as provided in chapter 46 of this Code. Such permit shall set forth the maximum quantity
30 of each flammable liquid permitted on the premises, together with the maximum size of containers
31 for such liquids; shall be valid only for the particular location designated in the permit; and it shall

1 be the duty of the chief of the fire department to forthwith cancel such permit upon the conviction
2 of the person holding the permit of the violation of any of the terms of this article, whether such
3 person convicted shall appeal therefrom or not.
4 Sec. 40-245. Storage permits--Required.
5 Any person desiring to store oils or other liquids designated in this article within the city in
6 storage tanks, other than portable containers, either above or below the ground surface, shall first
7 obtain a permit to do so from the permits and inspections division.
8 Sec. 40-246. Same--Application.
9 Application for a storage tank permit required by this article shall be accompanied by
10 accurate plats or drawings showing the lot or tract of land with the location,size and description of
11 each tank,extent and depth of diking,and layout of fill and vent pipes,together with the location and
12 size of the pump,and shall be accompanied by specifications for the construction of each said tank,
13 and its connection, fittings, openings, and safety appliances.
14 Sec. 40-247. Same--Fee.
15 The fee for a permit to store oils or other liquids designated in this article shall be based upon
16 the capacity of the storage tank as follows:
17 (a) 100 to 600 gallons $ 55.00
18 (b) 601 to 3,000 gallons 85.00
19 (c) 3,001 to 10,000 gallons 125.00
20 (d) 10,001 to 40,000 gallons 195.00
21 (e) 40,001 gallons or more 320.00
22 and shall be paid for each such storage tank prior to the issuance of such permit. Such fee shall cover
23 the cost of inspection of such tanks. Any owner or his agent who shall fail to obtain the necessary
24 permit before starting any work for which a permit is required by the provisions of this article shall,
25 upon being granted a permit for such work, be required to pay quadruple the amount of the regular
26 fees.

1 Sece 40-248. Same--Inspection.
2 It shall be unlawful for any person to bury or otherwise cover up any storage tank for which
3 a permit has been issued under this article or any piping thereto until same has been inspected and
4 approved by the chief mechanical inspector and fire department. Either of these officials shall cause
5 to be uncovered, at the owner's or lessee's expense, any piping or tank when in his judgment repairs
6 or replacements to same are necessary, or where same has been covered unlawfully.
7 Sec. 40-249. Same--Discontinuance of use.
8 Prior to placing any flammable liquid storage tank that is covered by this Code out of service,
9 on either a temporary or permanent basis, the superintendent of permits and inspection shall be
10 notified and a permit shall be obtained. The disposition of the tanks shall be as required by state and
11 city regulations, and shall be in accordance with the provisions set forth in the '990 cd tier o ft,-c
12 Flammable and Combustible Liquids Code,NFPA numbers 30 and 30A.
13 Permit fees for discontinuance of service of a flammable liquid storage tank shall be:

16 Any owner or his agent who shall fail to obtain the necessary permit before starting any work
17 for which a permit is required by the provisions of this article shall,upon being granted a permit for
18 such work, be required to pay quadruple the amount of the regular fees.
19 Sec. 40-250. Heating flammable and combustible liquids.
20 (a) Where processes are used involving the heating of flammable liquids,thermostatic
21 controls shall be introduced to prevent the temperature of the contents of such receptacles from rising
22 above a predetermined maximum.
23 (b) Processes involving the heating of flammable liquids having a flashpoint of 100
24 degrees Fahrenheit(37.7 degrees Celsius) or more to temperatures near or above the flashpoint of
25 such liquids shall be conducted only in specially constructed fire-resistive buildings located in class
26 A oil districts, or in a district especially designated for such purpose created by ordinance. In the
27 design and location of such buildings, the explosive nature of the commodity shall be taken into
28 consideration and all possible safeguards provided to lessen the dangers and effects of explosions.
29 Adequate ventilation shall at all times be provided to quickly remove flammable and combustible
30 vapors wherever generated. This provision shall not apply to preheating of fuel oil preparatory to
31 feeding oil burners.

1 Sec. 40-251. District classifications.
2 (a) Storage of delivery tanks. It shall be unlawful to keep, house or store any delivery
3 tank or any truck or other vehicle equipped with delivery tanks for flammable or combustible liquids,
4 nor shall such liquids be stored in tanks outside above ground, except in oil districts as set forth in
5 this section.
6 (b) There shall be no Storage of Class I Liquids in Vessels defined as Tanks (60 gallons
7 or more),or Class II Liquids in amounts of 600 gallons or more unless a Flammable or Combustible
8 Liquid Fire District is established, which requires filing an application with the Chief of the Fire
9 Prevention Bureau(Fire Marshal) and receiving approval from the Fire Chief, the Chief of the Fire
10 Prevention Bureau,the Planning_Department, and the City Council.
11 (b3C0 Class A oil districts for storage above ground. Flammable liquids, which shall
12 include highly flammable liquids comprising crude petroleum, refined oils, and all other liquids
13 having a flashpoint of less than 100 degrees Fahrenheit (37.7 degrees Celsius), may be stored in
14 tanks above ground only in districts as prescribed in this section and as amended by previous
15 ordinance, and in such districts as may hereafter be created by ordinance.
16 (ej(d) Class B oil districts for storage above ground. Combustible liquids, including such
17 fuel oils and other liquids having a flashpoint between 100 degrees Fahrenheit(37.7 degrees Celsius)
18 and 350 degrees Fahrenheit (176.6 degrees Celsius)may be stored in storage tanks outside above
19 ground only in districts as prescribed by this section,and in such districts as may hereafter be created
20 by ordinance or have been created by previous ordinance.Exceptions include tanks connected to any
21 one oil burning or using appliance such as furnaces, water heaters, boilers, ranges and generators.
22 The capacity of these tanks shall not be more than one 660-gallon tank or two tanks of aggregate
23 capacity of 1,320 gallons or less installed in accordance with appropriate standards in lowest floor
24 or basement.

16 DIVISION 2. BOARD OF EXAMINERS

1 Sec. 40-259. Composition.
2 The examining board shall be composed of the chief mechanical inspector,the superintendent
3 of the mechanical section and one person holding either a current city first, second or third grade
4 stationary engineer or oil burner installers certificate.
5 Sec. 40-260. Appointment and term of appointed member.
6 The mayor shall appoint, subject to the provisions of the city's Charter and this Code, the
7 member of the examining board who is a certificate holder, who shall serve for a term of one year
8 or until his successor is chosen.
9 Sec. 40-261. Compensation of members.
10 Except for city employees on the examining board, each member of such board shall be
11 compensated at the rate of$10.00 for each meeting of such board.
12 Sec. 40-262. Adoption of rules and regulations.
13 The examining board shall make such rules and regulations for the conduct of examinations
14 and tests as it may deem necessary to enable it to ascertain the fitness of applicants to perform the
15 functions, or of mechanisms to meet the requirements, set forth in this article.
16 Sec. 40-263. Duties.
17 The examining board created by this division shall pass upon all applications for certificates
18 of approval and certificates of competency required by the provisions of this article.

20 DIVISION 3. CERTIFICATE OF COMPETENCY
21 Sec. 40-268. Required.
22 It shall be unlawful for any person desiring to engage in the business of installing or servicing
23 any storage tank for which a permit is required by this article, or any pump or other mechanical
24 device connected therewith,or any piping leading to or from either such storage tank or pump within
25 the city, unless such person has been issued a certificate of competency therefor.

1 Sec. 40-269. Bond.
2 No certificate of competency required by this division shall be issued until the applicant
3 therefor has filed a bond with the city and same is accepted by the mayor and city council in the
4 amount of$5,000.00. Such bond shall be conditioned, among other things, to indemnify the city
5 against any lawsuit brought or judgment obtained against the city or any of its officials and save and
6 keep harmless the city from any and all losses, costs, expenses or liabilities of any kind whatsoever
7 which it,the city, may suffer or be put to, or which may be recovered from it from or by reason of
8 the issuance of any such permit or by reason of any act or thing done under or by virtue of the
9 authority given in such permit.
10 Sec. 40-270. Examination required.
11 Before any person is issued a certificate of competency under the provisions of this division,
12 he must pass an examination, either written, oral, or both, at the discretion of the examining board,
13 to prove his qualifications for such work. Application for such examination shall be made to the
14 permits and inspections division and shall set forth the name and address of the applicant,the nature
15 of his experience, and the length of time he has been engaged in such work.
16 Sec. 40-271. Examination fee.
17 The applicant for a certificate of competency required by the provisions of this division shall
18 pay the sum of$40.00 to the city cashier at the time of making application therefor to cover the cost
19 of examination.
20 Sec. 40-272. Appearance for examination.
21 The applicant for a certificate of competency required by the provisions of this division shall
22 appear before the oil burner examining board at the time and place as notified by the board for the
23 purpose of taking the required examination.
24 Sec. 40-273. Failure of examination; reexamination.
25 In the event the applicant for a certificate of competency required by this division shall fail
26 to satisfy the examining board that he possesses the necessary knowledge and/or skill therefor, he
27 shall not be granted such certificate.No new application for a certificate shall be received from such
28 applicant before 90 days have elapsed since the date of the examination he failed.New applications
29 shall be made in the same manner as the original application for a certificate.

1 Sec. 40-274. Issuance.
2 Upon the satisfactory passing of the required examination, and upon compliance with the
3 other requirements of this division, the applicant for a certificate of competency required by this
4 division shall be issued the same.
5 Sec. 40-275. Expiration.
6 Every certificate of competency issued under the provisions of this division shall expire at
7 midnight of June 30 next following its date of issuance.
8 Sec. 40-276. Renewal; renewal fee.
9 Upon application, and subject to the approval of the examination board,a renewal certificate
10 of competency shall be issued annually and a fee of$30.00 for each renewal shall be paid to the city
11 cashier. The examining board shall have the right to require an additional examination and/or other
12 proof of proficiency before approving the issuance of any such renewal certificate.
13 Sec. 40-277. Cancellation.
14 (a) If any certificate of competency issued under the provisions of this division is not
15 renewed on or before July 1 of each year, it shall be canceled automatically.
16 (b)The chief mechanical inspector may at any time cancel any certificate issued under this
17 division for the violation of any applicable provision of this Code, state law or city ordinance, rule
18 or regulation, or for any other good and sufficient cause.
19 (c) In the event of the cancellation of his certificate, the holder of the same is forbidden to
20 do any work for which such certificate is required by this article.
21 Sec. 40-278. Authority.
22 It shall be the duty of the chief of the fire department, as well as the duty of the
23 superintendent of permits and inspections, to require strict compliance with all provisions of this
24 chapter.

1 DIVISION 4. OIL BURNERS
2 Subdivision A. In General
3 See. 40-282. Definitions.
4 For the purpose of this article the following words and phrases shall have the meanings
5 respectively ascribed to them:
6 Fuel oil: Any liquid used as fuel and having a flashpoint of not less than 100 degrees
7 Fahrenheit(37.7 degrees Celsius).
8 Installation of oil burner: The act of setting the burner,connecting all piping to and from the
9 burner, and installing all necessary burner controls, and including setting of a tank of up to 600-
10 gallon capacity, such tank to be connected to the burner.
11 Oil burner: Any device used for the purpose of burning or preparing to burn fuel oil and
12 having a tank or container with a capacity of ten or more gallons connected thereto.
13 Oil-burning equipment: Oil burners and all equipment connected thereto, including every
14 internal and external tank,pumping apparatus, piping, wiring and all accessories thereto.
15 Underwriter: The National Fire Protection Association.
16 Sec. 40-283. Approved equipment.
17 (a)It shall be unlawful for any firm to install or cause to be installed any oil burner not listed
18 as standard equipment with the Underwriters'Laboratories or approved by the oil burner examining
19 board.
20 (b)The operation of a burner and equipment installed prior to the passage of this article shall
21 not be affected by the terms hereof; however, any repairs made to such burner or equipment shall
22 be in conformity with the terms of this article and if,or when,such burner shall prove to be defective
23 or unsafe, it shall be the duty of the chief mechanical inspector to order same removed. Any oil
24 burner replacement shall be in strict conformity with this article.
25 See. 40-284. Installation standards adopted.
26 Oil burners and control equipment shall be installed in accordance with the standards of the
27 National Fire Protection Association for installation of oil-burning equipment,NFPA pamphlet no.
28 31,datcd 1987,which is hereby adopted by reference,three copies of which are on file in the office
29 of the city clerk; and the provisions thereof shall be controlling within the city.

1 Sec. 40-285. Permit required.
2 It shall be unlawful for any person to install and/or service and repair, or cause the same to
3 be done, any oil burning equipment within this city without first obtaining a permit therefor.
4 Sec. 40-286. Application for permit.
5 Any person desiring a permit required by this article shall make application therefor to the
6 permits and inspections division on such forms as shall be provided therefor. Such application shall
7 fully describe the oil burner installation to be made.
8 Sec. 40-287. Permit fee.
9 The fee for a permit for the installation of an oil burner unit shall be $21.00 for each such
10 unit.Any owner or his agent who shall fail to obtain the necessary permit before starting any work
11 for which a permit is required by the provisions of this article shall,upon being granted a permit for
12 such work, be required to pay quadruple the amount of the regular fees.
13 Sec. 40-288. Issuance of permits restricted to holders of certificate of competency.
14 A permit for the installation of an oil burner unit shall be issued only to holders of certificates
15 of competency issued under the provisions of this article.
16 Sec. 40.-289. Permits to be issued only for approved equipment.
17 No permit required by this article shall be issued for the installation of an oil burner which
18 has not been approved.
19 Sec. 40-290. Inspection and approval of installation or repair.
20 Upon completion of the installation or repair of an oil burner unit,the permits and inspections
21 division shall be.notified. Upon approval of the installation or repair, an inspection notice of
22 approval shall be attached to the same. Such installation shall not be put into service or used until
23 after official approval.
24 Sec. 40-291. Display of manufacturer's instructions.
25 A printed copy of the rules and instructions of the manufacturer for the operation of the oil
26 burner shall be conspicuously posted near each burner.

1 Sec. 40-292. Shutoff device.
2 All oil burners shall be equipped with an approved device, mechanical or electrical, which
3 will automatically prevent an abnormal flow of oil and which further completely shuts off the flow
4 of oil in case combustion shall cease.
5 Sec. 40-293. Filter and service valve.
6 All oil burner supply lines shall be provided with an oil filter (sedimentation bulb) and
7 service valve, both located inside the building for protection against freezing.
8 Secs. 40-294--40-297. Reserved.
9 Subdivision B. Certificate of Competency
10 Sec. 40-298. Required.
11 It shall be unlawful for any person to perform the manual labor of installing and/or servicing
12 any oil burner in the city unless such person has been issued a certificate of competency for such
13 work.
14 Sec. 40-299. Other certificates acceptable.
15 The holder of an engineer's certificate of competency may service the oil burner or burners
16 installed in the plant where he is regularly employed.
17 Sec. 40-300. Limited certificate.
18 Any holder of a stationary engineer's certificate may, upon application to the examining
19 board, be examined regarding his qualifications and, if upon examination he is found competent,
20 shall be issued a limited certificate of competency to service and maintain the oil burner or oil
21 burners installed in the plant where he is regularly employed. Such applicant shall not be required
22 to pay any fee for his examination, nor shall he be required to pay any fee for the renewal of his
23 certificate; provided that such certificate limits his qualifications to servicing only the oil burner
24 equipment in the plant where he is regularly employed and upon which he was examined; and
25 provided,further,that said limited certificate shall automatically lapse concurrently with the lapse
26 of the aforesaid engineer's certificate.
27 Sec. 40-301. Examination required.
28 Before any person is issued a certificate of competency under the provisions of this division,
29 he must pass an examination, either written, oral or both, at the discretion of the examining board,

1 to prove his qualification.Application shall be made to the permits and inspections division and shall
2 set forth the name and address of the applicant, and all types of burners the applicant will install and
3 service,or that he is the holder of a stationary engineer's certificate and desires a limited certificate
4 of competency.
5 Sec. 40-302. Examination fee.
6 The applicant for a certificate of competency required by the provisions of this division shall
7 pay the sum of$40.00 to the city cashier at the time of making application therefor to cover the cost
8 of examination.
9 Sec. 40-303. Appearance for examination.
10 The applicant for a certificate of competency required by the provisions of this division shall
11 appear before the oil burner examining board at the time and place as notified by the board for the
12 purpose of taking the required examination.
13 Sec. 40-304. Failure of examination; reexamination.
14 . In the event the applicant for a certificate of competency required by this division shall fail
15 to satisfy the examining board that he possesses the necessary knowledge and/or skill to properly
16 and safely install and/or service all types of oil burner equipment specified in his application, he
17 shall not be granted a certificate of competency.No new application for a certificate shall be received
18 from such applicant before 90 days have elapsed since the date of the examination wherein he failed.
19 New applications shall be made in the same manner as the original application for a certificate.
20 Sec. 40-305. Issuance.
21 Upon the satisfactory passing of the required examination, and upon compliance with the
22 other requirements of this division, the applicant for a certificate of competency required by this
23 division shall be issued the same.
24 Sec. 40-306. Expiration.
25 Every certificate of competency issued under the provisions of this division shall expire at
26 midnight of June 30 next following its date of issuance.
27 Sec. 40-307. Renewal; renewal fee.
28 Upon application,and subject to the approval of the examining board, a renewal certificate
29 of competency shall be issued annually, and a fee of$15.00 for each renewal shall be paid. The

1 examining board shall have the right to require an additional examination and/or other proof of
2 proficiency before approving the issuance of any such renewal certificate.
3 Sec. 40-308. Cancellation.
4 (a) If any certificate of competency issued under the provisions of this division is not

13 Subdivision A. In General
14 Sec. 40-313. Definitions.
15 For the purposes of this article the following words and phrases shall have the meanings
16 respectively ascribed to them:
17 Appliances: All gas-burning appliances intended for use with liquefied petroleum gas.
18 Installation of liquefied petroleum gas equipment: The location and setting of the equipment,
19 and all piping attached thereto, or any alteration of such liquefied petroleum gas system.
20 Liquefied petroleum gas: Any material which is composed predominantly of any of the
21 following hydrocarbons or mixtures of them: propane, propylene butanes (normal butane or iso-
22 butane), or any butylenes.
23 Liquefied petroleum gas bulk plant: An establishment for transfer of liquefied gases to
24 smaller containers and the subsequent sale thereof.
25 Liquefied petroleum gas equipment: All devices,piping and equipment pertinent to the use
26 of liquefied petroleum gas, except gas-burning appliances.

1 Sec. 40-314. Storage and handling standards adopted.
2 All use, sales, storage,transportation and installations of liquefied petroleum gases shall be
3 in conformity with the provisions of the Fire Protection Association for the Storage and Handling
4 of Liquefied Petroleum Gases known as Pamphlet No. 58 datcd 1989, and standards of the NFPA,
5 National Fuel Gas Code, known as Pamphlet No. 54 datcd 1989, three copies of which are on file
6 in the office of the city clerk, which are hereby included and made a part of this section.
7 Sec. 40-315. Maximum storage--Residential zones.
8 In residential zones as defined by the city's zoning ordinance, not over 2,000 gallons'
9 aggregate capacity of liquefied petroleum gas shall be permitted at any one point,and such capacity
10 shall be confined to not more than two tanks.
11 Sec. 40-316. Same--Commercial zones.
12 In commercial zones as defined by the city's zoning ordinance, not over 4,000 gallons'
13 aggregate capacity of liquefied petroleum gas shall be permitted at any one point, and such capacity
14 shall be confined to not more than four tanks.
15 Sec. 40-317. Same--Industrial zones.
16 In industrial zones as defined by the city's zoning ordinance, not over 60,000 gallons'
17 aggregate capacity of liquefied petroleum gas shall be permitted at any single location, and such
18 capacity shall be confined to not more than six tanks and used solely on the premises whereon such
19 tanks are located. The filling of tanks supplying fuel to engines propelling vehicles upon which such
20 tanks are carried is permitted where such vehicles are operated solely by firms controlling liquefied
21 petroleum gas storage.
22 Sec. 40-318. Same--Increasing capacity.
23 The quantities set forth in sections 40-315 through 40-317 of this division may be increased
24 provided approval is secured from the building board of review. Such board may require special fire
25 protection when increased storage is allowed.
26 Sec. 40-319. Bulk plants.
27 New bulk plants may be established and the quantity of existing bulk plants may be
28 increased. The applicant shall meet all applicable codes that are required for such installation,
29 including zoning ordinances. The preplan and plan review shall be approved by the fire prevention
30 bureau, tank division, along with permits and inspections, mechanical section, before installation
31 begins.

1 Sec. 40-320. Parking transportation vehicles.
2 Tank vehicles used for the transportation of liquefied petroleum gases for containing
3 liquefied petroleum gas or gas vapors shall not:
4 (a) Be left unattended on any street, highway, avenue or alley; provided that this shall
5 not prevent a driver from the necessary absence from the truck in connection with the
6 delivery of his load, except that during actual discharge some responsible person
7 shall be present at the vehicle, nor shall it prevent stops for meals during the day or
8 night if the street is well lighted at the point of parking.
9 (b) Be parked out-of-doors at one point for more than one hour except within the
10 premises of an existing liquefied petroleum gas bulk plant or at some location
11 approved jointly by the chief mechanical inspector and the city fire marshal.
12 (c) Be parked,garaged or serviced in any building other than those specifically approved
13 for such use by the chief mechanical inspector and the city fire marshal.
14 Sec. 40-321. Record of installations.
15 Every person installing liquefied petroleum gas equipment,other than gas burning appliances
16 and replacing of portable cylinders, in the city shall keep a record of each installation, showing the
17 name and address of the customer at whose place the liquefied petroleum gas equipment has been
18 installed, and the date of the installation, and shall disclose such record to the permits and
19 inspections division or city fire department at any time,upon request, during regular business hours.
20 Sec. 40-322. Storage permit--Required.
21 Any person desiring to store liquefied petroleum gas within the city, other than in portable
22 containers, in either aboveground or underground tanks, shall first obtain a permit to do so from the
23 permits and inspections division.
24 Sec. 40-323. Same--Fee.
25 Before any permit for storage of liquefied petroleum gas in this city shall be issued, the
26 applicant therefor shall pay a fee based upon the capacity of the tanks to be used as follows:
27 (a) 400 to 2,000 gallons' capacity $ 40.00
28 (b) Over 2,000 gallons' capacity 180.00
29 on each tank to be used.

9 The provisions of section 42-323 shall not apply to any container already installed prior to
10 December 20, 1977.

12 Subdivision B. Certificate of Registration
13 Sec. 40-332. Required.
14 Any person engaged in the business of installing liquefied petroleum gas tanks and/or
15 appurtenant equipment shall first obtain a certificate of registration therefor.
16 Sec. 40-333. Fee.
17 Before any certificate of registration shall be issued under the provisions of this subdivision,
18 the applicant therefor shall pay a fee of$60.00 therefor and a Competency Exam shall be completed
19 with a minimum grade of 75%to obtain a Certificate of Registration.
20 Sec. 40-334. Board of examiners.
21 The board of engineer examiners, provided for in sections 40-165 through 40-175 of this
22 chapter, shall pass upon all applications for certificates of registration covering contractors who
23 install liquefied petroleum gas tanks.
24 Sec. 40-335. Bond.
25 When approved by the examining board, an applicant for a certificate of registration under
26 this division shall file with the city an acceptable bond in the amount of$10,000.00. Such bond shall
27 be in a form satisfactory to the city law department and shall indemnify the city, its officials and
28 employees, and the examining board from any liability arising from any claims, demands, or

1 judgments by reason of duties, liabilities or responsibilities imposed under the provisions of this
2 article.
3 Sec. 40-336. Renewal fee.
4 The renewal fee for each year of registration after the first year shall be $50.00.
5 Secs. 40-337--40-340. Reserved.
6 Subdivision C. Automobile Filling Stations
7 Sec. 40-341. Permitted.
8 Automobile filling stations supplying liquefied petroleum gas to the general public for use
9 as fuel in motor vehicles shall be permitted in the city.
10 Sec. 40-342. Dispensing of fuel restricted to tanks affixed to vehicles.
11 The transfer of liquefied petroleum gas at filling stations shall be limited to the filling of
12 tanks permanently attached to the motor vehicles, the purpose of such tanks being to supply fuel
13 solely to the engine propelling the vehicle to which such tank is attached,
14 Sec. 40-343. Removable fuel tanks.
15 No liquefied petroleum gas may be transferred at an automobile filling station where such
16 tank requires removal from its normally established installed position for weighing and/or gauging.
17 Sec. 40-344. Maximum storage.
18 The aggregate capacity of all storage containers at any liquefied petroleum gas automobile
19 filling station shall not exceed 2,000 gallons aboveground storage and 18,000 gallons underground
20 storage.
21 Sec. 40-345. Setback for dispensing units.
22 All dispensing units in liquefied petroleum gas filling stations shall be located not less than
23 25 feet from the line of the adjoining property which may be built upon. Such distance may be
24 reduced when approved by the permits and inspections division and the city fire department.

1 Sec. 40-346. Attendant training.
2 An attendant dispensing liquefied petroleum gas shall have a certification from the company
3 supplying the dispensing equipment and/or product stating that he/she has received instruction on
4 the proper handling of the gas.
5 Sec. 40-347. Protection of dispensing equipment.
6 All dispensing equipment in liquefied petroleum gas filling stations shall be adequately
7 protected against mechanical damage.
8 Sec. 40-348. Minimum working pressure of equipment.
9 All equipment for storage and for dispensing liquefied petroleum gas at filling stations shall
10 have a rated working pressure of at least 250 pounds per square inch.
11 Sec. 40-349. Protection of aboveground storage.
12 In the event liquefied petroleum gas storage is located above ground within ten feet of the
13 adjacent outer edge of a driveway or parking area, the storage shall be protected by a barricade of
14 four-inch pipe filled with concrete or the equivalent thereof and set in concrete a minimum of#wee
15 four feet above ground, a distance of not more than four feet apart,not less than five three feet from
16 such storage container or any piping above the level of the top of the barricade.
17 Sec. 40-350. Exception.
18 Nothing contained in the provisions of this subdivision shall apply to operations conducted
19 on the premises of bulk plants existing in the city as of May 7, 1974.

21 ARTICLE V. HOISTING AND PORTABLE ENGINEERS
22 DIVISION 1. GENERALLY
23 Sec. 40-356. Purpose and scope of article.
24 In the interests of public safety, and to protect life, limb and property, there are hereby set
25 up and defined certain standards and qualifications requisite for the safe operation of certain
26 machines or appliances used for the mechanical handling of materials of construction, and for the
27 excavation of, or the handling and transfer of, or the grading, leveling, sloping or compacting of,
28 earth or other materials, or the use of compressed air, in, upon or about any building or other
29 structure,or any public or private works,or the site thereof,during the construction,alteration,repair

1 or demolition thereof. It is clearly understood that the improper or careless handling or manipulation
2 of such machines or appliances may be a source of jeopardy to life or limb and the destruction of
3 property.Nothing contained herein shall be construed as covering the operation of trucks used in the
4 transfer of such materials, or other machines or appliances hereinafter exempted by this article.
5 Sec. 40-357. Enforcement.
6 The permits and inspections division shall enforce the provisions of this article.
7 Sec. 40-358. Penalty for violations.
8 Any person who violates, neglects or refuses to comply with or who resists or opposes the
9 enforcement of the provisions of this article shall,upon conviction thereof,be punished as provided
10 in section 1-10 of this Code. Every such person shall be deemed guilty of a separate offense for each
11 day on which such violation, neglect or refusal shall continue.
12 Sec. 40-359.Appeals. •
13 Any person aggrieved by any decision made in the enforcement or administration of the
14 provisions of this article may appeal therefrom to the administrative appeals board by complying
15 with the provisions of section 2-171 et seq. of this Code.
16 Sec. 40-360. Neglect of duty.
17 It shall be unlawful for any certified hoisting and portable engineer to:
18 (a) Endanger life, limb or property by careless operation of the equipment under his
19 control.
20 (b) Grossly neglect his duty.
21 (c) Be intoxicated, or under the influence of controlled substances, including
22 medications which slow response time while on duty.
23 Secs. 40-361--40-373. Reserved.
24 DIVISION 2. CERTIFICATES
25 Sec. 40-374. Required.
26 (a)It shall be unlawful for any person other than the legitimate holder of a certificate of the
27 required grade to operate any machine or appliance used for the mechanical handling of materials
28 of construction for the excavation of, or the handling or transfer of,or the grading, leveling, sloping

1 or compacting of, earth or other materials, in,upon or about any building or other structure, or any
2 public or private works, or the site thereof, during the construction, alteration, repair or demolition
3 thereof.

4 (b) It shall be unlawful for any person to employ any person who is not the holder of a
5 certificate of the required grade or to direct, compel or permit any person who is not the holder of
6 a certificate of the required grade to operate any such machine or appliance in the manner as set forth
7 in paragraph(a) hereof.
8 Sec. 40-375. Exceptions.
9 Nothing contained in the provisions of this division shall be construed as:
10 (a) Covering the operation of trucks used in the transfer of materials mentioned in
11 section 40-374.
12 (b) Covering the operation of concrete mixers or mortar mixers unless such machines
13 have connected thereto a skip or other device whereby materials are conveyed thereto
14 or removed therefrom in such manner that skilled operation is necessary to protect
15 life, limb or property.
16 (c) Requiring a certificate for operators of bulldozers and road patrols engaged in the
17 removal of snow.
18 Sec. 40-376. Classification.
19 The board of examiners shall issue hoisting and portable engineer's certificates in three
20 grades as follows:
21 (a) A first grade certificate shall entitle the legitimate holder thereof to take charge of
22 and operate any machine or appliance used for the mechanical handling of materials
23 of construction, the handling and driving of piles, or the excavation, handling,
24 transfer, grading, leveling, sloping or compacting of earth or other materials, all or
25 any of which when used upon or about any building or other structure, or any public
26 or private works, or upon or about any such site, during construction, alteration,
27 repair or demolition of anything thereon or any part thereof or anything pertinent
28 thereto.
29 (b) A second grade certificate shall entitle the legitimate holder thereof to take charge of
30 and operate any machine or appliance for the purposes described in subsection (a)
31 hereof,except such as are operated by steam,or which require a steam boiler for their
32 operation.

1 (c) A third grade certificate shall entitle the legitimate holder thereof to take charge of
2 and operate any machine or appliance for the handling, transfer, grading, leveling,
3 sloping or compacting of earth or other materials for the purposes described in
4 subsection(a)hereof,except such as are operated by steam,or which require a steam
5 boiler for their operation, or which are lifting, swinging, dipping, or dumping
6 mechanisms controlled by levers and cables or chains passing over or around brake-
7 controlled drums which, if manipulated by an unskilled operator,may be a menace
8 to life, limb or property.
9 Sec. 40-377. Qualifications.
10 An applicant for a certificate required by the provisions of this article shall meet the
11 following qualifications:
12 (a) Be at least 18 years of age.
13 (b) Be in good health, of sound mind, and good character.
14 (c) Have the following appropriate experience:
15 (1) First grade certificate: at least one year's actual experience in the operation
16 and care of steam boilers and steam-operated equipment.
17 (2) Second or third grade certificate: at least one year's actual experience in the
18 operation of equipment,but no knowledge of steam boilers or steam engines
19 will be required.
20 (d) The applicant's physical qualifications and operating skill shall be vouched for by
21 two current certificate holders, at least one of whom shall be the user of equipment
22 coming under this chapter or a certified hoisting and portable engineer.
23 Sec. 40-378.Application.
24 Any person desiring a certificate required by the provisions of this division shall make
25 written application therefor to the permits and inspections division.
26 Sec. 40-379. Issuance; notice of failure of examination.
27 (a)Within ten days after the date of examination,the board of examiners shall issue,without
28 additional charge,a certificate of the grade applied for to the applicant who has passed a satisfactory
29 examination, or shall notify an unsuccessful applicant of his failure to pass such examination.

1 (b) All certificates shall be signed by the secretary of the board and countersigned by the
2 superintendent of the permits and inspections division.
3 Sec. 40-380. Duration.
4 Every certificate issued under the provisions of this division shall be valid for a period of one
5 year from its date of issuance, unless sooner revoked prior thereto.
6 Sec. 40-381. Renewal--Generally; fee.
7 (a) Any certificate issued under the provisions of this division may be renewed upon the
8 payment of the renewal fee of $20.00, except during the period any such certificate may be
9 suspended or revoked.
10 (b) If such renewal fee has not been paid within 30 days after the expiration date of such
11 certificate, it shall become void. Thereafter,the legitimate holder of such certificate will be required
12 to pay a renewal fee of double the amount set forth in paragraph(a) hereof
13 Sec. 40-382. Same--Reexamination.
14 If a certificate issued under the provisions of this division has not been renewed within one
15 year from date of its expiration, it shall not be renewable; and the holder thereof will be required to
16 file a new application in the same manner as set forth in this division governing original applications
17 for certificates, and pass the examination set forth by this division for applicants seeking an original
18 certificate, before being entitled to a new certificate.
19 Sec. 40-383. Same--Proof of competency.
20 Before issuing renewal of a hoisting and portable engineer's certificate, the board of
21 examiners may require further proof of the applicant's competency if, in the interest of public safety,
22 it deems such additional proof necessary. Failure of the applicant to produce such satisfactory proof
23 or to satisfactorily pass the prescribed examination within 30 days shall be cause for refusal by the
24 board to renew such certificate.
25 Sec. 40-384. Revocation or suspension.
26 (a)Any certificate issued under the provisions of this division may be revoked or suspended
27 by the board of examiners for:
28 (1) The operation by a certificate holder of any of the machines or mechanisms covered
29 by this article in so careless or reckless a manner as to endanger life, limb or
30 property;

1 (2) The loan of his certificate to another person to enable that person to secure work in
2 the name of the certificate holder; or
3 (3) The violation of any applicable provisions of this Code, state law or city ordinance,
4 rule or regulation.
5 (b) It shall be unlawful for the holder of any suspended or revoked certificate to do or
6 perform any of the things the doing or performing of which requires a certificate during the period
7 of time his certificate is suspended or revoked.

9 DIVISION 3. BOARD OF EXAMINERS
10 Sec. 40-396. Created.
11 There is hereby created in and for the city a board which shall be known as the board of
12 examiners for hoisting and portable engineers.
13 Sec. 40-397. Composition.
14 The board of examiners for hoisting and portable engineers shall be composed of three
15 members, one of whom shall be the boiler chief mechanical inspector of the city.
16 Sec. 40-398. Qualifications of members.
17 No appointee shall be eligible as a member of the board of examiners who has not been the
18 holder for the past five years prior to his selection of a valid second grade hoisting and portable
19 engineer's certificate issued by authority of the city.
20 Sec. 40-399. Appointment of members.
21 The mayor, in accordance with the provisions of the city's Charter and this Code, shall
22 appoint the two members of the board of examiners other than the city boilcr chief mechanical
23 inspector.
24 Sec. 40-400. Term of members.
25 The appointed members of the board of examiners shall serve terms of office of two years
26 each from the date of the expiration of the predecessor's term of office.

1 Sec. 40-401. Removal of members.
2 The planning director,with the consent of the city council,and for good and sufficient cause,
3 may at any time remove any appointed member of the board of examiners for hoisting and portable
4 engineers from office. Absence from three consecutive meetings of the board, without good and
5 proper cause, shall be cause for removal from office of such member.
6 Sec. 40-402.Vacancies.
7 Vacancies occurring in the membership of the board of examiners for hoisting and portable
8 engineers resulting in unexpired terms shall be filled in the same manner as original appointments,
9 for the unexpired.term.
10 Sec. 40-403. Compensation of members.
11 The appointed members of the board of examiners for hoisting and portable engineers shall
12 each receive the sum of$10.00 for each meeting attended as compensation for services.
13 Sec. 40-404. Chairman and secretary.
14 The city boilcr chief mechanical inspector shall serve as the chairman and secretary of the
15 board of examiners for hoisting and portable engineers.
16 Sec. 40-405. Meetings.
17 (a)The board of examiners for hoisting and portable engineers shall convene upon call of the
18 secretary either for the conduct of examinations or for the transaction of other necessary business.
19 (b)The chairman shall preside at all meetings,or in his absence a temporary chairman shall
20 be chosen for the meeting.
21 (c)Two members shall constitute a quorum for the transaction of all business.
22 (d) Minutes shall be made and kept of all meetings of the board.
23 Sec. 40-406. Adoption of rules and regulations.
24 The board of examiners for hoisting and portable engineers shall adopt, from time to time,
25 such rules and regulations as may be expedient and necessary for its proper functioning.

6 DIVISION 4. EXAMINATIONS
7 Sec. 40-419. Required.
8 No certificate shall be issued under the provisions of this article unless the applicant therefor
9 shall first successfully pass an examination therefor. The board of examiners for hoisting and
10 portable engineers shall conduct such examinations as it shall deem necessary to determine an
11 applicant's qualification for a certificate of the grade applied for.
12 Sec. 40-420. Fee.
13 The fee for an examination shall be paid at the time of filing the application for a certificate
14 required by this article and shall be as follows:
15 (a) First or second grade certificate $35.00
16 (b) Third grade certificate 20.00
17 No fee shall be returnable to the applicant who fails to pass the examination.
18 Sec. 40-421. Scope.
19 (a)The examination for a first grade hoisting and portable engineer's certificate shall include
20 the following subjects:
21 (1) Steam boilers and appurtenances thereto.
22 (2) Pile driving.
23 (3) Cableways when used for purposes of construction or demolition.
24 (4) Lifting, lowering, swinging, dipping or otherwise excavating and dumping
25 mechanisms the, operation of which is controlled by levers and cables or chains
26 passing over or around brake-controlled drums sufficiently complex that special skill

1 and training is necessary in their manipulation to properly safeguard life, limb and
2 property.
3 (5) Hydraulic apparatus or mechanisms used for the removal or replacement of earth or
4 other material.
5 (6) Machines or mechanisms used for channeling,trenching, grading, leveling, sloping,
6 removing or compacting of earth or other materials where the operations of such
7 machines or mechanisms are not controlled by levers and cables or chains passing
8 over or around brake-controlled drums sufficiently complex that special skill and
9 training are necessary in their manipulation to properly safeguard life, limb and
10 property.
11 The applicant will be required to show that he has sufficient knowledge of the care, operation,
12 maintenance and repair of the various items included in his examination so that his handling of any
13 or all of them will not in any manner endanger life, limb or property.
14 (b)The examination for a second grade hoisting and portable engineer's certificate will omit
15 items (1), (2) and (3), but will include all the subjects set forth in the other items enumerated in
16 paragraph(a) of this section.
17 (c)The examination for third grade hoisting and portable engineer's certificate will include
18 only item(6) in paragraph (a) of this section.
19 Sec. 40-422. Notice of examination; failure to appear.
20 Within 30 days after the date of application for a certificate required by this article, the
21 applicant shall be notified by the secretary of the board of examiners, in writing, to appear before
22 the board at a time and place set for such examination. Such notice shall be sent at least five days
23 prior to the date set. Any applicant who fails to present himself before the board of examination at
24 the time so set shall forfeit the examination fee and his application shall be canceled,unless for good
25 and sufficient cause he has been excused by the secretary.
26 Sec. 40-423. Passing grade.
27 No applicant for a certificate required by this article who fails to pass correctly at least 75
28 percent of all tests or questions in the examination shall be considered competent to receive such
29 certificate.

1 Sec. 40-424. Waiting period for reexamination.
2 In the event any applicant for an examination required by this division shall fail such
3 examination, a reexamination shall not be granted for a,period of at least 30 days.
4 Sec. 40-425. Records.
5 Complete stenographic records shall be made and transcribed in typewritten form of all oral
6 examinations given under this division; and a complete record of each examination shall be kept by
7 the secretary for a period of two years from its date, after which time the record may be destroyed.
8 ARTICLE VI. REFRIGERATION
9 DIVISION 1. GENERALLY
10 Sec. 40-426. Installation generally.
11 No refrigeration system shall be installed hereafter in a building or structure, nor shall an
12 alteration or extension of an existing refrigeration system be made, except in conformity with the
13 provisions of this article and rules that may be adopted and promulgated by the permits and
14 inspections division under the provisions of this article.
15 Sec. 40-427. Adoption of rules and regulations.
16 In adopting rules and regulations for refrigeration installations, the permits and inspections
17 division shall embody in them the most approved methods and practices for the safety of life and
18 property.
19 Sec, 40-428. Additional standards.
20 Except as may be provided otherwise in this article or in duly adopted rules and regulations,
21 all plumbing, sheet metal and electrical installations shall conform to applicable provisions of this
22 Code.

2 Sec. 40-440. Permit required.
3 No installation of a refrigerating unit or system, nor any alteration or extension of a
4 refrigeration system,shall be made until a permit has been obtained from the permits and inspections
5 division.
6 Sec. 40-441. Exceptions to permit requirement.
7 No permit shall be required by the provisions of this division for the following:
8 (a) Noncondensing refrigeration systems using air as a refrigerant.
9 (b) Refrigerating equipment of the self-contained plug-in type that requires no special
10 convenience outlet and no other air or utility connection on motor vehicles and
11 railroad rolling stock.
12 Sec. 40-442. Application for permit.
13 Applications for permits required by the provisions of this division shall be submitted to the
14 permits and inspections division as provided in section 43-73.
15 Sec. 40-443. Submission of drawings.
16 Complete, detailed drawings of any work for which a permit is required by the provisions
17 of this division shall be submitted to the permits and inspections division at the time of making
18 application for such permit.
19 Sec. 40-444. Fees.
20 (a)No permit shall be issued under the provisions of this division until the applicant therefor
21 shall have paid the following applicable fee based on the dollar value of the installation, alteration

3 completion of the refrigeration equipment for which a permit is required by this division, make or

6 Sec. 40-447. Quadruple fees for commencing work without permit.
7 Any owner or his agent who shall fail to make application for the permit required by the
8 provisions of this article before starting any work for which a permit is required shall, upon being
9 granted a permit for such work,be required to pay quadruple the amount of the regular fees imposed
10 by this article, or$50.00, whichever is greater.

12 ARTICLE VII. STEAM FITTING
13 DIVISION 1. GENERALLY
14 Sec. 40-458. Definitions.
15 For the purposes of this article, the following words and phrases shall have the meanings
16 respectively ascribed to them:
17 Hydronic piping: All piping, valves, fittings and accessories necessary for a complete
18 hydronic heating and/or cooling system. This includes steam, chilled water, hot water, glycol, and
19 condenser water: Ammonia piping also shall be covered by the requirements of this section.
20 Sec. 40-459.Responsibility for work.
21 All work covered by the provisions of this article shall remain in full charge of the master
22 steam fitter doing the same until the same has been accepted by the owner of the premises upon
23 which such work has been performed.
24 Sec. 40-460. Penalty for violations.
25 Any person who shall violate any of the provisions of this article shall be deemed guilty of
26 a misdemeanor and upon conviction be punished as provided in section 1-10 of this Code. Any
27 person violating any of the provisions of this section with respect to performing any work prohibited
28 by this article and who shall fail or refuse to correct the same within five days after a conviction

1 thereof shall be deemed guilty of an independent separate offense each day thereafter during which
2 said work is permitted to remain in such condition.

4 DIVISION 2. HEATING AND POWER PLANT INSPECTOR
5 Sec. 40-472. General duties.
6 The provisions of this article shall be enforced by the mechanical
7 inspector.
8 Sec. 40-473. Qualifications.
9 The mechanical inspector shall be a certified steam fitter, shall have
10 had not less than ten years' practical experience as a steam fitter, and shall possess adequate
11 knowledge of the theory and practice of the work covered by this article.
12 Sec. 40-474. Adoption of rules and regulations.
13 The mechanical plant inspector shall make such rules and
14 regulations as may be necessary to the proper carrying out of the spirit and intent of this article;
15 however, such rules and regulations shall be along uniform lines.
16 Sec. 40-475. Inspection authority.
17 It shall be the duty of the mechanical inspector to investigate,at any
18 reasonable time, all cases reported or referred to him of the use of imperfect material or
19 workmanship on any job of hydronic, ammonia or power piping, or the violation of any of the
20 provisions of this article either by a master or journeyman steam fitter,builder or owner.
21 Sec. 40-476. Notice of dangerous conditions.
22 If, upon examination, the mechanical inspector shall find any
23 condition exists as would make the job or premises dangerous or liable to cause injury or damage
24 to person or property, it shall be the duty of the inspector to at once notify the owner or agent of the
25 building to cause the same to be made safe and to comply with the provisions of this article at once.

1 Sec. 40-477. Closing of premises.
2 Failure on the part of any owner or agent of any building at which a dangerous condition
3 exists, as provided in section 40-476, to comply with such notice within the time set forth in such
4 notice shall be sufficient cause for the closing of such building or plant by the
5 ply mechanical and such building or plant shall remain closed until such work has been made safe
6 to conform with the provisions of this article.
7 Sec. 40-478. Records.
8 The permits and inspections division shall keep a record of inspections and tests made by the
9 heating and power plant mechanical inspector, and shall keep a record book wherein shall be
10 registered the full name, residence and place of business of all persons engaged as master steam
11 fitters.

13 DIVISION 3. CERTIFICATES OF COMPETENCY
14 Sec. 40-490. Master's certificate required.
15 It shall be unlawful for any person to engage in the business of installation, alteration or
16 ,
17 It shall be unlawful for any person, including firms
18 and corporations. to engage in the business of steamfitting as a master steamfitter or to obtain
19 permits to perform this work unless they shall be the holder of a valid master steamfitter's license
20 and be registered and bonded as such as provided for in this article. Such license shall have been
21 issued by the Steamfitter Board of Examiners of the city. In case of any firm having more than one
22 (1)person engaged in the business of steamfitting. only one (1) person shall be required to qualify
23 as a master steamfitter. In the case of a legally constituted corporation, only one (1) officer who is
24 liable to service of regular processes shall be required to qualify as a master steamfitter.
25 In the case of the death of a master steamfitter.the Steamfitter Board of Examiners may issue to the
26 representative of the firm a temporary license to operate as a master steamfitter for a period of one
27 (1) year. The holder of the temporary license shall comply with all provisions of this chapter.
28 Sec. 40-491. Journeyman's certificate required.
29 It shall be unlawful for any person
30 to
31 engage in steamfitting as a journeyman steamfitter unless they shall be the holder of a valid

1 journeyman steamfitter's license. Such license shall have been issued by the Steamfitter Board of
2 Examiners of the city.
3 Sec. 40-492. Exceptions.
4 Nothing contained in the provisions of this division shall prohibit:
5 (a) The employment of apprentices or helpers working in conjunction with and under the
6 direct supervision of a duly certified master or journeyman steam fitter when such
7 master or journeyman steam fitter is present at all times during the installation of any
8 steam fitting work.
9 (b) Any person employing a licensed engineer of the first class from making any
10 ass repairs, which do not include additions or replacements of plant, or
11 alterations in the plant that
12 is operated by such engineer when such alterations-or repairs are made under the
13 supervision of sttek the first class engineer, nor the making of minor repairs in any
14 such plant by engineers of the second or third classes employed therein.
15 Sec. 40-493. Application; qualifications.
16 All applications for certificates of competency required by the provisions of this division
17 shall be made, in writing, to the board of steam fitter examiners on a form furnished by the board.
18 (a) The applicant for a certificate of competency as a master fitter shall:
19 (1) Have the knowledge to direct and supervise other persons in the installation
20 of hydronic systems; and

23 0, Have proper tools and equipment to properly execute the work permitted or
24 required by this chapter.
25 (3) Have at least four (4) years experience in the installation of steamfitting
26 systems while holding a journeyman steamfitter's license; or

28 continuous experience or four (4) years collective experience in the
29 installation of steamfitting systems.

1 The applicant shall pay a non-reimbursable examination fee of Sixty($60.00)
2 to the Secretary of the Steamfitter's Board of Examiners.
3 In the case where an applicant for a master steamfitter's license has failed to
4 pass an examination, the applicant may take another examination any time
5 after the expiration of three (3) months from the previous date of
6 examination.
7 (b) The journeyman applicant must have had at least four years' experience as an
8 apprentice or workman in the steam fitter field as the same applies to this chapter.
9 All applicants for a journeyman steamfitter license must satisfy one of the following:
10 W1 At least four(4)years practical experience in the installation of steamfitting
11 systems and successfully completing an apprenticeship program certified by
12 the U.S. Department of Labor, Bureau of Apprenticeship: or
13 ,(2l At least eight(8)years practical experience. .
14 The applicant shall pay a non-reimbursable examination fee of Thirty Five Dollars
15 ($35.00)to the City of Omaha.
16 In the case where an applicant for a journeyman steamfitter's license has failed to
17 pass an examination,the applicant may take another examination any time after the
18 expiration of three months from the date of examination.

3 b . Each applicant must provide a certificate of insurance which provides combined
4 coverage for bodily injury and property damage in the amount of at least three hundred thousand
5 dollars ($300,000.00) for the protection of the city.
6 Sec. 40-496. Issuance.
7 Upon the successful completion of the appropriate examination, the board of steam fitter
8 examiners shall authorize the issuance of the certificate of competency for which application was
9 made.
10 Sec. 40-497. Expiration.
11 Laj All certificates of competency issued under the provisions of this division shall expire
12 on December 31 next following their date of issuance.
13 (l , All current original and new master steamfitter licenses issued under the provision
14 of this chapter may be renewed by the Steamfitter Board of Examiners without reexamination at the
15 date of expiration provided that:
16 (1) The license holders'purpose and conditions remain unchanged.
17 ‘2,Z The steamfitter Board of Examiners has not been made aware by affidavit or
18 other evidence that the license holder is no longer competent or entitled to a
19 license renewal.
20 Sec. 40-498. Renewal--Generally.
21 Every certificate of competency issued under the provisions of this division may be renewed
22 by the holder thereof upon payment of the required renewal fee to the permits and inspections
23 division within 30 days of the expiration of such certificate; however, a reexamination may be
24 required if the board of examiners finds the same to be necessary.

25 (b) Having
26 one (1)or more convictions within the past year by a court of law for a violation of
27 the laws, ordinances, or rules and regulations of the Board.

2 , Causes sufficient which shall include,but not be limited to;fraud,
3 deception and unsatisfactory work,in the opinion of the Board.

5 Any person having their license revoked for cause shall not be granted a new license for a
6 period of one (1) year thereafter, and shall be required to submit to examination as described in
7 section 40-493. Any suspension shall be for such term of conditions judged appropriate by the
8 Board,but in no case shall any suspension exceed six (6)months.
9 Sec. 40-502. Appeals.
10 Whenever any person has made application for a certificate of competency as a master or
11 journeyman steam fitter and such certificate has been denied or refused by the examining board, or
12 whenever any certificate heretofore granted has been revoked by the examining board, such an
13 applicant or such person whose certificate has been refused or revoked may appeal from such action
14 of the examining board to the administrative appeals board by complying with the provisions of
15 section 2-171 ct scq. of this Code.
16 Sec. 40-503. Established place of business required. •
17
18 Every licensed master steamfitter shall have
19 an established place of business registered with the secretary of the Steamfitter Board of Examiners.
20 The master steamfitter's license shall be posted in a conspicuous place in the place of business. The
21 place of business shall be located in an area appropriately zoned for such a business under chapter
22 55 of this code.
23 This provision shall not prevent a master steamfitter from having a place of business and
24 dwelling combined, provided that the place of business fronts on a public thoroughfare, and has a
25 separate entrance with the business named displayed.
26 Sec. 40-504. Display of Business Name.
27 All trucks used by the master steamfitter in the conduct of their business shall have the name
28 of the master steamfitter or the name used by their business. Letters must be not less than two (2)
29 inches high on both sides of the truck.

15 The members of the board of steam fitter examiners shall be appointed by the mayor and
16 confirmed by the city council.
17 Sec. 40-518. Term of members.

4 Whenever any work coming under the provisions of this article has been covered or
5 concealed by lathing,plastering,flooring or otherwise before inspection and approval thereof,then
6 the mechanical inspector shall have the right and authority to eut-dough
7 cause to have removed such obstruction sufficiently to afford an
8 adequate means of making a proper inspection.
9 Sec. 40-565. Conduct of tests.
10 All tests of roughing-in work for hydronic or power piping systems must be made to the
11 finished floor or wall line and must be made in the presence of the
12 mechanical inspector and must be applied by the steam fitter in charge of the work. Such tests shall
13 be maintained for a sufficient length of time to allow the hcating and powcr plant mechanical
14 inspector to make a thorough and complete examination of the work. If defective material or
15 workmanship is found on the job, the same must be removed and replaced with the proper kind of
16 material and workmanship.
17 Sec. 40-566. Seal of approval.
18 The mechanical inspector shall, on approval of the roughing-in or
19 completed work coming under the provisions of this article,place thereon a notice or seal stating that
20 the work has been inspected and approved.
21 Sec. 40-567. Certificate of completion.
22 If, after having made the proper final inspection on any permitted
23 system the same is found to be properly done and to be perfectly tight as required by this article, it
24 shall be the duty of the mechanical inspector to issue to the master steam
25 fitter in charge of the work a certificate of completion setting forth the fact that the work has been
26 tested and inspected and the same found to have been done according to the requirements of this
27 article.
28 Sec. 40-568. Quadruple fees for commencing work without permit.
29 Any owner or his agent who shall fail to make application for the permit required by the
30 provisions of this article before starting any work for which a permit is required shall,upon being

3 Sec. 40-579. General standards.
4 Fire protection systems such as automatic sprinklers, fire hose systems, underground fire
5 mains, valves, alarms, pumps and fire command stations shall be designed and installed in strict
6 compliance with the appropriate NFPA fire and building code requirements.
7 Sec. 40-580. Control valves.
8 (a) Control valves are required on all fire services. Acceptable locations of valves in
9 descending order of preference are:
10 (1) Listed indicated valves at each connection into the building at least 40 feet from
11 buildings if space permits.
12 (2) Control valves installed in a cut-off stair tower or valve room accessible from the
13 outside not more than ten feet from the door.
14 (3) Valves located in risers with indicating posts arranged for outside operation.
15 (b) Unacceptable are the key-operated valves, due to the fact that a situation could arise
16 where the system might be shut down, and in the event of a fire the fire department may not be able
17 to put the system back in service without the proper tool.
18 Sec. 40-581. System tests.
19 All systems shall be tested per NFPA requirements.Fire service mains and building entrance
20 of mains shall not be covered until visually inspected. Additions to existing systems of 13 or more
21 sprinkler heads will require hydrostatic testing.

23 The installation, alteration, repair or replacement of any fire protection system shall not be
24 undertaken within the jurisdiction of the city without a permit issued by the permits and inspections

Attached is the Motion in response to the above referenced log book request. This Motion includes
the changes you requested to the Mechanical Code. As you will note,the request to include a cross
reference of various sections of the Mechanical Code was not included in this Motion. Historically,
the cross referencing of the code sections are an editorial function that the code company performs
at the time of publication. Upon passage of this ordinance,we can request those cross references that
you have indicated to the code company to include when they publish this ordinance.
Your additional request regarding the requirements of the ADA do not appear to conflict with the
wording of the current provisions in Section 40-377(d).
The remaining changes that you have requested are reflected in the attached motion.
