1 AN ORDINANCE to amend Section 55-890 of the Omaha Municipal Code providing for fee
2 increases; and to provide for the effective date hereof.
3 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
4 Section 1. Section 55-890 of the Omaha Municipal Code is hereby amended to read as
5 follows:
6 Sec. 55-890. Application fee schedules.
7 (a) Purpose: The purpose of the application fee schedule is to partially defray the
8 administrative costs of this chapter.
9 (b) Application Fee Schedules:
10 (1) Site plan approval application $ $ 85.00
11 (2) Conditional use permit application 210.00
12 a. Major amendment 190.00
13 b. Minor amendment 75.00
14 (3) Special use permit application 560.00
15 a. Major amendment 340.00
16 b. Minor amendment 75.00
17 (4) Rezoning applications:
18 a. Rezoning to AG, DR, R1 through R5 or MH 250.00
19 b. Rezoning R6 through R8 490.00
20 c. Rezoning to office, commercial
21 industrial districts 985.00
22 d. Mixed use districts 985.00
23 1. Major amendment 340.00
24 2. Minor amendment 130.00

16 (c) Other Fees Required by Omaha Municipal Code: Payment of fees specified above
17 shall not exempt an applicant from payment of any other fee set forth by a provision
18 of this code.
19 (d) Adjustment of Fees:
20 (1) Government subdivision: No fee shall be charged for any application filed
21 by a subdivision of local, state, or federal government.
22 (2) Planned unit developments: No fee shall be charged for any application for
23 a planned unit development located within Zone A as designated by the
24 Urban Development Policy.
25 (3) Concurrent applications: No fee shall be charged for a rezoning application
26 filed simultaneously with a subdivision plat application.
27 (4) Location: No fee shall be charged for a rezoning application on property
28 located in Zone A as designated by the Urban Development Policy.

1 (5) Referred by Planning Board or City Council: No fee shall be charged for a
2 zoning board of appeals application when referred by the Planning Board or
3 City Council.
4 Section 2. Section 55-890 of the Omaha Municipal Code, as heretofore existing, is hereby
5 repealed.
6 Section 3. That this Ordinance shall become effective January 2, 1998.
