The attached Resolution authorizes S.I.D. No. 300, Pepperwood,to expend, for park improvements,
an amoiI t not to exceed $241,387.15, including soft costs, and to accept the bid of LawnSmith&
Co.,Inc. Ito provide these improvements. Approval will result in construction generally consisting
of earthwork, concrete sidewalks, gazebo and flower garden,foot bridge,picnic shelter with tables,
installation of playground equipment, landscape plantings and seeding.
Improvements for this park were authorized by the Park and Recreation Advisory Board on August
4, 1997, in an amount not to exceed$241,400.00. These improvements correspond to the low base
bid received which, including soft costs, totals $241,387.15.
This purchase was approved by the City Council on December 23, 1997 by Resolution No. 3504.
However, the required notice of the public hearing before the City Council was not published on
behalf of the S.&I.D. less than five days prior to the hearing as required by § 31-740 R.S. Supp.
1996, so it is necessary to reapprove these S.&I.D. improvements.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Sanitary and Improvement District No. 300,Pepperwood, owns park
property located at 15109 Charles,utilized for park and recreation purposes; and,
WHEREAS, Pepperwood S.I.D. is now requesting approval of the costs for
improvements to the park within the S.I.D.; and,
WHEREAS,the project and costs in the amount of$241,400,00 were recommended
for approval by the Parks and Recreation Advisory Board on August 4, 1997; and,
WHEREAS,the total cost of improvements,and soft costs,is$241,387.15; and,
WHEREAS,the Parks,Recreation and Public Property Department recommends that
the amount of$241,387.15 be approved; and,
WHEREAS,competitive bids were received by the District's Engineers; and,
WHEREAS,the Mayor has recommended acceptance of this bid; and,
WHEREAS,on December 23, 1997,such purchase was approved by the City Council
by Resolution No. 3504; and,
WHEREAS, the notice of the public hearing before the City Council of the City of
Omaha f1r the aforementioned resolution was not published on behalf of the S.&I.D. less than five
(5) days before the public hearing as required by Nebraska Revised Statute Section 31-740 R.S.
Supp. 1996, so it is necessary for the City Council to approve another resolution after a public
hearing held no less than five(5)days after notice of the hearing has been published in a newspaper
of general circulation in the municipality in accordance with the aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
