Hal Daub,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving Supplemental Agreement No. 1 to the Engineering Services Agreement with HDR Engineering, Inc. for the preliminary design of the replacement of the 10th Street viaduct south of Jackson Street. The original Agreement was adopted by the City Council by Resolution No. 824 on March 26, 1996. Additional design services are required because of the protracted time needed for the preliminary design stage including a number of layouts and design iterations needed to address the concerns of all parties. The original agreement with HDR is unchanged except where specifically modified by the Supplemental Agreement No. 1. Details of the changes are included in Exhibit "A" to the Supplement. HDR Engineering, Inc. has agreed to perform the additional services detailed in the attached agreement for a fixed fee not to exceed$35,513.00. The total contract amount would increase from $239,649.00 approved in the original Agreement to the $274,982.00 listed in the Supplemental Agreement. The additional funds are payable from the 1993 Street& Highway Bond Organization 1509, 1993 Street and Highway Fund 333. HDR Engineering, Inc. has filed the required Annual Contract Compliance Report Form, CC-1, in the Human Relations Department. As is City policy,the Human Relations Director will review the consulting firm to determine its compliance with Ordinance 28885. WITNESSETH: WHEREAS, the City and Consultant are parties to an agreement dated the twenty-sixth day of March nineteen ninety six for the preliminary design of improvements of the 10th Street Viaduct, Pacific to Jackson Street, hereinafter referred to as the "Original Agreement", and WHEREAS, it is necessary that work not contemplated in the Original Agreement be added under this Supplemental Agreement, and WHEREAS, it is necessary to increase the Consultant's compensation by this Supplemental Agreement for the additional work necessary to complete plete the project, NOW, THEREFORE, in consideration of these facts, the parties hereto agree as follows: I. GENERAL TERMS OF AGREEMENT. All terms and conditions contained in the Original Agreement between the parties shall be binding to both parties with the exception of the amendments contained hereinafter. 4111(oo025B) January 7, 1998 Page 1 of 3 II. GENERAL DESCRIPTION OF SUPPLEMENTAL SCOPE AND CONTROL OF WORK. The Consultant, will perform additional services stipulated in the attached Exhibit "A", Scope of Services and Fee Summary, hereby made a part of this Supplemental Agreement. III. TIME OF BEGINNING AND COMPLETION. The Consultant will complete all services stipulated in the Original Agreement and this Supplemental Agreement by March 31, 1998. The time for completion shall be equitably adjusted for delays not the fault of Consultant. Delays grossly affecting the completion of the work within the time specified for completion attributable to or caused by the Consultant or the City shall be considered as cause for termination of this agreement by the other. It is hereby mutually agreed that the City has continuing rights to work progress inspections and any and all additions, deletions, changes, elaborations or modifications of the services to be performed under the terms of this agreement which may from time to time be determined by the City as desirable or preferable, shall be controlling and governing. IV. FEES AND PAYMENTS. For the work required, Section VI of the Original Agreement is amended and the limiting maximum amount, including all subconsultant costs is increased from $221,615 to $253,700, an increase of$32,085. The fixed fee is increased from $17,854 to $21,282 an increase of$3,428. The total contract amount is increased from $239,469 to $274,982, an increase of$35,513 which the Consultant must not exceed without the prior written approval of the City. The Consultant will be paid the additional fee on the same terms stipulated in the Original Agreement and, except as specifically amended by this Supplemental Agreement, all terms and conditions or the Original Agreement remain in full force and effect. SP 90-23 SUPPLEMENTAL AGREEMENT NO. 1 Introduction: This Supplemental Agreement provides for out of scope services for the Preliminary Design Phase of the 10th Street Viaduct. Additional costs have been incurred due to the protracted schedule for completion of the Preliminary Design Phase. Additional services that were required are as follows: Tasks: 1.0 .Leavenworth Ramp Survey Through the course of preliminary design, it was decided that a new at-grade ramp to the UPRR Intermodal site would be provided to replace both the existing at-grade ramp from Leavenworth Street and the motor freight ramp structure currently extending east off of the 10th Street Viaduct. As this road was not included in the original scope of the project,the City agreed to authorize additional survey and design effort for this ramp. A survey cost of$2500 was previously estimated by our subconsultant, Ehrhart Griffin and Associates. Since the letter dated October 25, 1996 from the city authorized the additional survey and design work but did not increase the contract amount at that time, the $2500 survey fee is requested in this supplemental agreement. 2.0 Leavenworth Ramp Design This work includes preliminary design and drafting for a new at-grade ramp extending from roughly 9th and Leavenworth Street southeast into the UPRR Intermodal site. The ramp also provides access to the lower level of the Western Heritage Museum parking deck. The design had to consider grades and turning radii for the tractor trailer combinations that will use the ramp. In addition, the design of the ramp considered phased construction to allow the ramp to be built while maintaining continuous truck access to the intermodal site. 3.0 Additional Profile/Bridge Layout Iterations to Satisfy Railroad Requirements Through the course of preliminary design, several iterations were required to the 10th Street profile and the layout of the bridge spans to accommodate changes imposed by the railroads. Although the railroads had verbally concurred with initial profile and span arrangements which were developed in the Concept Stage of this project, when meeting with the railroads in the Preliminary Design Stage, it was insisted that a pier between the BNSF and UPRR mainline tracks be removed. This required a lengthening of a critical span and profile adjustments, including a grade raise, to accommodate the deeper structure. Due to the limited options available, rework included reprofiling of 10th Street, rechecking of numerous vertical and horizontal clearances to tracks, and resizing girder depths requiring multiple girder runs. Tie-in points to other critical points on the vertical profile also had to be rechecked as well as modifying the design speed for the vertical Exhibit "A Sheet 1 of _5 S .. curve. Also the resulting grade raise required additional work to the Burlington Mail Terminal Building at 10th and Mason Street, additional investigation into impacts to the retaining wall along the east side of 10th Street in front of Burlington Depot and the addition of retaining walls around the Neon Goose Restaurant. 4.0 Additional Coordination Meetings The original scope for the Preliminary Design Phase assumed coordination meetings with the City of Omaha,NDOR or other affected agencies on a monthly basis (six month original schedule - six meetings assumed). Meetings that were included in other scope items included the two design workshops for determining bridge architecture and a utility coordination meeting. Two of the extra meetings required travel to Lincoln. Also assume two additional meetings will be required between now and the completion of the Preliminary Design Phase. 5.0 Additional Coordination w/SHPO on Bridge Architecture One of SHPO's review comments to the draft EA required their input in reviewing the proposed architecture of the new bridge. This required developing a packet summarizing the workshop process, development of architectural schemes and a listing of constraints on the architectural elements that might have evolved through input of the railroad, city maintenance staff, etc. 6.0 Impact on Project Fee due to 1997 Labor Rates Since the project was originally to be completed entirely in 1996, HDR has incurred additional costs due to annual merit and cost of living increases to labor rates that took effect on January 1, 1997. Increases in labor rates also impact the total overhead charges too since overhead is a multiplier on labor. Although the Preliminary Design and public hearing phase may now extend into early 1998, assume that most of the labor for r Exhtbit "A" Sheet 2 of ::. fora public hearingwill be finished in late 1997 (no labor rate increase preparation included after January 1, 1998). 7.0 Project Administration The project management activities for Preliminary Design were originally based on a duration of six months (April 1, 1996 to September 30, 1996). An estimated revised end date for completion of Preliminary Design is March 31, 1998 to allow time to schedule and hold a public hearing as well as address comments. This represents 18 additional months requiring some level of project management activities, subconsultant coordination and invoicing efforts. The original budget for the six month project duration allotted approximately 20 man-hours per month for project administration. Although invoicing has been active for many of the extra months to date, assume approximately 6 man-hours per month for twelve of the extra months of the contract and 4 man-hours per month for six of the months due to the lower levels of project monitoring required.
