Transmitted herewith for your consideration is a resolution authorizing the Purchasing Agent to issue
a purchase order for the Department of Administrative Services, Vehicle Impound Lot, to contract
with Don Peterson & Associates for providing auctioneer services. A detailed bid tabulation is
attached.

The bid specifications provided an opportunity for the City to consider and evaluate various types
of proposals presented by the bidders to the Council on Tuesday, December 9, 1997.
Specifications were developed and bids were requested and opened on April 15, 1998. The
specification and the bid results were forwarded to the City Law Department for their review and
recommendation of bid award to the vendor. By memo dated May 4,.1998, by Robert J. Hamer,
Assistant City Attorney, to Barb Oetter, his recommendation was to award to the low bidder, Don
Peterson & Associates Real Estate, Inc., 100 E 6th Street, P.O. Box 1268, Fremont, Nebraska
68025.

The Administrative Services Department, Vehicle Maintenance Division, recommends acceptance
of the low bid as recommended by the Law Department. It is our intent to award based on the
Buyer's Premium Fee of$5.95 for each item/vehicle sold. This concept of payment will be paid by
the buyers; however, it has been determined that approximately 2% of the items sold will be less
than$20;this fee will be paid by the City and is estimated to cost$1,550.00 per year. The Flat Fee
proposed by Don Peterson for miscellaneous property items of$495.00 is acceptable and will cost
the City$5,940.00 per year. The total payment/cost to the City is estimated to be$7,490.00 per year
for this service.
Don Peterson and Associates has filed the required Annual Contract Compliance Report Form,
CC-1, in the Human Relations Department; as is City policy, the Human Relations Director will
review the company to determine its compliance with the Contract Compliance Ordinance.
The Administration, with the concurrence of the Administrative Services Department and the
Vehicle Maintenance Division, recommends your favorable consideration of this Resolution.

You recently sent me some information concerning bids taken by Purchasing for your Department dealing
with auctioneering services at the Vehicle Impound Facility and requested an opinion. I have reviewed
these matters and have the following opinions: •
First, the original bidding taken several months ago was not awarded due to the belief that the costs were
excessive and the alternate bid of a buyer's premium was outside of the bid specifications. I agree that the
alternate bid was outside the specifications. It could not form the basis of a bid as originally advertised.
Second, I had the opinion that sufficient time had passed that the addition of the buyer's premium
information could form the basis of a second bid invitation, and
Third, there is nothing about the process that prevents award on the basis of lowest and best bid,The prior
action of the Council reversed the bid rejection but made no award.
In the bids taken April 15, 1998, all the necessary bonds were included. As I understand it, the Insurance
Certificate of one of the bidders did arrive later but the City has not typically made insurance certificates
a requirement, the omission of which would cause bid rejection.
In conclusion, I feel your Department is able to recommend the award to the low bid on the bid opening
of April 15, 1998.

per vehicle/item of equipment and$495.00 for miscellaneous property,being the lowest and best bid
received for Auctioneering Services at the Impound Lot.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT,the bid of$5.95 per vehicle/item of equipment and$495.00 for miscellaneous
property from Don Peterson&Associates Real Estate, Inc. for Auctioneering Services for the City
of Omaha Vehicle Impound Lot,being the lowest and best bid received be accepted and the contract
awarded.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay the cost of Auctioneering
Services for the City of Omaha Vehicle Impound Lot from the General Fund No. 001, Agency 100,
Organization 1006.
