This Agreement is a companion document to the Resolution selecting a contractor to provide maintenance activities for the public ground areas in Regency. The financial obligations of the City and Regency Homes Association, as represented in this Agreement, differ from previous agreements between these parties. In past agreements, the City has assumed the financial obligation for 86% of the total grounds . maintenance costs within the Regency public areas;the remaining 14%was reimbursed to the City by the Regency Homes Association. The attached Agreement, however, obligates the City to pay for only those maintenance activities currently being provided through contracted services to parks and public areas within newly annexed areas. These maintenance items for which the City will be solely financial responsible are detailed within the Agreement as Exhibit"B". The document also provides an opportunity for Regency Homes Association to select additional. maintenance activities, above the level to be provided by the City, agree to have these tasks performed by the City's contractor and then reimburse the City for these additional costs. This document's companion Resolution,which awards the contract to maintain these public areas, has been structured in such a manner to allow contractor payment based upon the specific tasks performed and the number of time each activity is annual provided. This allows for a clear separation between the costs associated with the City's standard maintenance tasks and the additional activities the Association may choose to request be provided at their expense. WITNESSETH WHEREAS, in 1983 City annexed Sanitary and Improvement District No. 188, commonly known as the Regency Subdivision; and, WHEREAS, such annexation included public park,parkways,and street right of way areas; and, WHEREAS, since annexation such areas have been maintained under grounds maintenance agreements with private contractors hired by City with the input of Regency; and, WHEREAS,such areas have been maintained by such private contractors at a level of service in excess of the standard City grounds maintenance level, including, but not limited to, irrigation, since annexation through monetary contributions from Regency and with City general funds pursuant to periodic agreements between City and Regency; and, WHEREAS,the last such agreement has terminated; and, WHEREAS,the City has solicited and received bids from private contractors for grounds maintenance of the public parks,parkways and street rights of way in the Regency Subdivision area for the year 1998 and for the years 1999 through 2002 through four one year extension options; and, WHEREAS, it is necessary to apportion the level of funding between the parties to reflect that City shall provide monetary support in an amount equivalent to the cost charged by the private contractor to be hired by City for the services which comprise the standard City grounds maintenance level and that Regency shall pay the cost charged by the private contractor to be hired by City for any services desired by Regency in excess of such level; and, WHEREAS,it is necessary to provide for the payment of water used in the irrigation of such areas if Regency desires continuation of such irrigation; and, WHEREAS, City and Regency desire to enter into an agreement to set forth the parties' respective rights, duties, and obligations and to apportion the level of funding between the parties so that City shall provide monetary support in an amount equivalent to the cost charged by the private contractor to be hired by City for the services which comprise the standard City grounds maintenance level and that Regency shall pay the cost charged by the private contractor to be hired by City for any services desired by Regency in excess of such level and the cost of water for irrigation. • NOW,THEREFORE, for and in consideration of the mutual covenants and agreements herein contained, City and Regency do hereby mutually undertake,promise, agree and contract each for itself and its successors and assigns as follows: ARTICLE I. - TERM OF AGREEMENT The term of this Agreement shall commence upon its date of execution and shall, after December 31, 2002,be subject to termination by written notice of such termination given by City to Regency or by Regency to City not fewer than forty-five (45) days before December 31 of any year of such term. ARTICLE II. -PURPOSE The purpose of this Agreement is to set forth the parties' respective rights, duties, and obligations for the funding of grounds maintenance costs for the public park,parkways, and street rights of way in that area of the City of Omaha commonly known as the Regency Subdivision as more specifically set forth on Exhibit"A",Plat of Regency Park and Public Areas, attached hereto and incorporated herein by this reference as if fully set forth herein, and to apportion the level of funding between the parties so that City shall provide monetary support in an amount equivalent to the cost charged by the private contractor to be hired by City for the services which comprise the standard City grounds maintenance level and that Regency shall pay the cost charged by the private contractor to be hired by City for any services desired by Regency in excess of such level and the cost of water for irrigation. The"standard City grounds maintenance level"shall be those grounds maintenance services provided City-wide for similar public property as set forth in Exhibit "B". ARTICLE III. - GROUNDS MAINTENANCE SERVICES City shall prepare bid specifications for grounds maintenance of the public park,parkways, and street rights of way specified on Exhibit "A", which specifications shall include the Contract Specifications, attached hereto as Exhibit"C" and incorporated herein by this reference as if fully set forth herein,and be drafted in such a manner as to clearly indicate the services which comprise the standard City grounds maintenance level and the cost thereof and any other services desired by Regency and the cost thereof, and in accordance with its applicable regular procedures, invite and take bids from eligible bidders on such bid specifications. The bid specifications will reflect that any services in excess of the standard City grounds maintenance level shall be optional, and will be performed only upon the prior written request for same by Regency. City shall provide an opportunity for Regency to participate in the preparation of such bid specifications and provide Regency with a copy of the bid tabulation, which shall include a list of the bidders and their respective bids received by City upon the bid specification, as soon as practicable, after opening of bids received. Regency shall,before any meeting of the City Council to decide the response of the City to such bid or bids,recommend to City the bidder whose bid it deems to be acceptable and best under the circumstances. -2- City shall, with due consideration of such recommendation of Regency, but in its sole discretion, accept some bid or reject all bids in accordance with its applicable regular procedures. If and when City timely accepts a bid therefor and enters into a grounds maintenance contract with a private contractor,Regency shall then or thereafter pay City, in cash, an amount equivalent to the private contractor's specified costs of the services desired by Regency in excess of contractor's specified costs of the standard City grounds maintenance level, in prompt response to a billing statement therefor prepared by City and tendered to Regency, for 1998 and of each subsequent calendar year during the term of this Agreement, so long as such excess service had been approved by Regency as set forth above. Provided, that nothing in this Agreement shall require the City to provide grounds maintenance for the public park,parkways,and street rights of way in that area of the City of Omaha commonly known as the Regency Subdivision as more specifically set forth on Exhibit"A",through a private contractor and City specifically reserves the right to provide such services utilizing its City employee labor force, so long as Regency is, in such event, allowed to privately contract for any excess services desired. ARTICLE IV. -UTILITY COSTS Regency shall pay City, in cash, an amount equivalent to any billings received from the Metropolitan Utilities District,for water used to irrigate the public park,parkways and street rights of way specified on Exhibit"A"in prompt response to any billing statements therefor prepared by City and tendered to Regency,for 1998 and of each subsequent calendar year during the term of this Agreement. GENERAL The areas included in this contract are the areas within the"Limits of Maintenance"on the • accompanying plan and include only public street right of way, parks and parkways. All areas between the sidewalk and street curbs shall be maintained including Dodge Street,Pacific Street right of ways, medians and islands(watered, sprayed,fertilized and edged around)by Contractor. All tractors and other equipment that are operated within the"Limits of Maintenance"area shall have turf tires. The City shall be furnished a listing and must approve all herbicides,fungicides,pesticides and fertilizers used by the Contractor. The Contractor shall notify the City no less than 24 hours prior to the application of all chemicals and fertilizers and the City may supervise these applications. The City shall be furnished a monthly work schedule no later than the 25th of each month for the coming month. Non compliance may result in the termination of the contract. Written weekly progress report shall be submitted to the City. This report shall include all work completed during the previous week. The progress report shall be completed and forwarded to the City with the monthly invoicing for work completed or at shorter intervals as requested by the City. The City will inspect all equipment to be used by the Contractor prior to the commencing of the contract. The Contractor will be responsible for storage of all equipment and material and have adequate provisions for the storage off the site. The contractor has reviewed the project site•,in particular the irrigation system. The Contractor is satisfied with the status of the system and agrees to take over the system, maintain and repair the system in a manner such as to return the system to the City fully operational at the end of the contract period. Any additions,modifications or improvement to the system shall be recorded by.the contractor,reported to the City with progress reports and shall become the property of the City upon the termination of the Contract. The Contractor or an employee must have a current 1st Class Arborist License issued by either the City of Omaha or the State of Nebraska. The Contractor shall have the arborist in direct and personal charge of all tree work and the arborist shall be on the job at least 50%of the working hours. The arborist shall have a current local address and telephone number through which he/she may be contacted. The following estimates are based on the history of performance as gathered by the City over the past three(3)years 1995-96-97. The estimates are approximated and shall be validated as required for satisfactory performance of this contract. All variations shall be based solely upon the determination of the City. - 2. CLEANUP-Weekly •-- The contractor shall pick up,remove and dispose of all paper,bottles,cans,leaves,trash and all other debris from all areas within the"Limits of Maintenance". The Contractor shall perform a cleanup at intervals of once each week, however,if any particular part of the area becomes littered to any unusual extent between such general cleanup intervals the Contractor shall perform a cleanup of that particular area. Specifically the park and vicinity around the park including the entranceway into the subdivision at REGENCY MAINTENANCE CONTRACT PAGE 1 EXHIBIT_ PAGE 4 `'" 96th Street shall be cleaned five(5)times per week. Grass clippings and mud washed onto the walks shall be removed by the Contractor. The general sweeping of streets and walks are excluded. 3. MOWING-26 times(Monday through Friday ONLY) The grass shall be mowed as scheduled and approved by the City. In general the grass shall be mowed when the grass is 4 to 4 1/2 inches long and shall be mowed to the height of 2 1/2 to 2 3/4 inches. All kick-out doors of the mowers shall face away from the street. All street and concrete shall be kept clean and free from clippings. All areas that cannot be mowed by mechanical mowers shall be trimmed by hand leaving the area in a neat and well kept condition. Mulching type mowers may be used by the Contractor as approved by the City. Removal of the grass clippings will be required if grass clippings are left in large clumps,bunches,or windrows. When required all grass clippings shall be gathered and removed from each site daily. Grass clippings shall be cleaned off by the Contractor from all signs,planters,structures, walks and other appurtenances upon completion of each mowing. All grass and lawn areas as indicated on the accompanying plan shall be mowed at each mowing,including right of ways along Dodge Street and Pacific Street. All damage done to sod or trees and plantings as a result of work performed by the Contractor shall be repaired by the Contractor by replacement of sod in damaged areas or replacement of trees and plantings. 4. PLANT AND SOD WATERING-9 times/14 Day Interval The Contractor shall water all areas within the"Limits of Maintenance"except Dodge and Pacific Streets to maintain and promote vigorous growth. Included under this item are all trees, shrubs,ground cover, islands,planters,or any other plants including grass. The Contractor shall furnish all personnel and watering equipment including but not limited to hoses, quick couplers,sprinklers and miscellaneous other equipment necessary to complete the watering cycle within the 14 day interval or as designated by the City. The Contractor may use the existing irrigation system. a. Plant watering shall be completed on all plants(trees, shrubs,ground cover,ect.)within the"Limit of Maintenance"as designated in the accompanying drawing as scheduled and approved by the City. b. The Contractor shall water all the grass within the"planted area"(designated on the accompanying drawing)as necessary to maintain and promote vigorous growth as scheduled and approved by the City. Sufficient water shall be applied each watering to soak the ground to a depth of 4 inches. c. Additionally,planters, islands, medians and walkways are included within the watered areas. The Contractor shall drain all irrigation lines to the meter pit or drain points,as constructed,each fall prior to such time that frost may damage lines. The Contractor shall furnish and use an air compressor to blow the water out of the irrigation system during the draining operation. The Contractor shall put the irrigation system in service each spring ahead of date scheduled for the first watering. The Contractors responsibility starts at the last valve beyond the discharge side of the water meter in the meter pit of all irrigation systems. The Contractor shall repair all leaks or broken components of the system. All components include but are not limited to backflow preventers, pipe,fittings,valves,quick coupler lids, sprinkler heads and all other items required to make the system functional. The system will be inspected by the City at the end of each irrigation season and the Contractor shall demonstrate that the system is in proper operational order at the time. All repairs required including breaks in lines or leaking valves, shall be made promptly by Contractor. The plans for the existing irrigation system are available in the Park Maintenance Office and show the extent and installation of the existing irrigation which is available for the Contractor's use. REGENCY MAINTENANCE CONTRACT PAGE 2 EXHIBIT MC"- PAGE 5 A watering cycle is defined as a 14 day interval starting on Sunday as Day 1 and ending on Saturday as day 14. The 9 waterings will generally commence the first Sunday in June and end the first Saturday in October. The City at its discretion may modify this schedule as the need or condition warrants. 5. WEEDING-6 times The Contractor shall weed all planting urns, shrub beds,planted islands and other non-turf areas within the"Limits of Maintenance". Herbicides may be used to control weed growth within planting areas. Weeding shall consist of eradicating all weeds. All growth evident between application of herbicides shall be physically removed by the contractor. Weeding shall be scheduled and approved by the City and will normally be done as follows:May 15-31, June 7-15,June 25-July 3,July 15-31, August 15-31, September 15-30. 6. FERTILIZING TURF AREAS-4 times Fertilizer shall be applied to all areas within the"Limits of Maintenance"based on the following schedule: 1. Between March 1 and April 15th-all areas-Pre Emergent at 1 lb.of nitrogen per 1,000 sq.ft. 2. Between May 15 and June 1 -all areas at 1/2 lb. of nitrogen per 1,000 sq.ft. 3. Between July 1 st and July 15th-all areas at 1/2 lb of nitrogen per 1,000 sq.ft 4. Between September 15th and September 30th-all areas at 1 lb. of nitrogen per 1,000 sq.ft. This work shall include the application of substances to enrich the planting soil or to supply nourishment for plants and sod. 1. Fertilizer shall be homogenous granular type containing nitrogen(slow release),phosphoric acid and potash in the amounts specified: 32-4-10. a. 32-4-10 fertilizer with 25%of nitrogen to be slow release;slow release derived from 8.0 units sulfur-coated urea, 1%iron. 2. Pre-Emergent a. 24-3-7 with a minimum 1.15%team or 0.75%pendimethalin,0.64 ammoniacal nitrogen„ 18.11%urea nitrogen, 5.25%sulfur coated slow release urea nitrogen or polycoated nitrogen. Product must supply 2 pounds of actual team per acre and at the same time supply a minimum 0.96 lbs,nitrogen per 1,000 square feet or 1.5 lbs. of pendimethalin per acre,and at the same time supply a minimum of 0.96 lbs. nitrogen per 1,000 square feet. 3. Fertilizer shall be furnished and delivered in standard bags. Percent of the various required ingredients shall be stated thereon.. 4. The fertilizer shall be applied with approved mechanical spreaders at the rate specified in the specifications and shall uniformly cover the entire area. PESTICIDE All sodded areas will be treated with one application of Merit 75WP,(No substitute)to control insects and one application Chipco 26019-F will be applied to control fungus(No substitute).The application rates will be consistent with each pesticide label and applied during the last week of June through the first week of July. A spot application maybe needed to control additional insects. This requirement shall not limit in anyway the number of applications that must be performed under this contract. 8. FERTILIZFD SHRUBS- 1 time All shrubs at the park area and residential islands. Fertilize tree and shrub beds in November or December,as scheduled,with slow release high nitrogen fertilizer 46-0-0 at the rate of one pound per 1,000 square feet. 9. WEED CONTROL-2 times Dandelion and Broad Leaf control. Weed control material shall be Trimec. The weed control material shall be a type that can be applied with no mist or drift.Extreme precautions must be taken not to damage the trees and shrubs. Any tree or shrub damaged or killed by the weed control material shall be replaced with a similar size and species by the Contractor. Application shall be made a minimum of(2)times per year with the first application between April 20 and May 10 and the second application between September 15 and October 1. Application rate shall be as recommended by the manufacturer with special consideration given to proximity of plants which might be damaged. Contractor to vary application rates within limits as appropriate for field and weather conditions at the same time of spraying. All weed spraying shall be done by a person holding a Certified Pesticide Applicator Certificate issued by the State of Nebraska. The Contractor assumes all risk and will be solely responsible for any damage caused by the application of chemicals. 10. SPRAYING FOR INSECTS,FUNGUS AND OTHER TREE INFESTATIONS- 1 time All trees and shrubs will be treated a minimum of once a year. The applications will be applied as recommended by the manufacturer. The application will be applied when necessary to best control insects and fungus growth. Other spray material shall also be used when and as required to control all insect and fungus conditions in the trees,shrubs and ground cover,that may arise during the maintenance contract. Areas to be treated are within the"Limits of Maintenance". A partial list of chemical treatment is set forth below. If any insect,fungus or other plant infestations appear which are not included in the following list,the Contractor shall furnish the chemicals and apply the same to the affected plants as recommended by the Douglas County Extension Agent. All treatments shall be made by a person holding a First Class Arborist License and a Certified Pesticide Applicator • Certificate issued by the State of Nebraska. The First Class Arborist License holder must be the Contractor or one of the Contractor's employees. No sub-contractors will be accepted. REGENCY MAINTENANCE CONTRACT PAGE 4 _EXHIBIT_:_"C' PAGE 7 • Treatments will not occur without approval and 24 hour prior notice to the City. Preventive measures shall be taken during the proper season to protect against pest damage. Treat according to the following schedule. SPRAY WINDOW PEST CHEMICAL CONTROL Mites Kelthane/Miteaside White paper test 6 or more on 2x5 paper test Aphids Diazinon/Malathion When foliage curls or leaf or stem mass over 3 square inches Second Week of April- Zimmerman Dursban Spray trunk and branches,all Second week of August pine species except White pine At bud break(third week Sphaeropsis of April) and 7 Days Diplodia Bordeax/Ten-Cop Spray needles to drip point later(First week May) Clearys 3336 Spray everyday that weather permits until all pines have been sprayed twice or May 8th whichever comes first. During this two week period two applications should occur approximately one week apart. 5-01 5-15 Ash Borer Dursban/Lindane 15 days after tapping 5-21 10 day Oystershell Cygon 2E 1st crawler up to 10 days later 6-20 6 days Bag Worm Dimethoate/Diazinon/ When bags first appear. Malathion Trees shall be inspected on a continual basis to determine the need for spraying. The Contractor will review with the Contract Compliance Manager the list of treatments/chemicals each March. Any changes will be listed and submitted to the Contractor in writing. 11. PIN OAK TREATMENT Pin Oaks shall be treated with the following which is a modification of Dr. Carl Whitcomb's soil tube method. Auger holes 2 inches in diameter, 10 inches deep with one hole for each inch of trunk diameter measured at 4 1/2 feet. The first four holes are drilled 6 feet out from the trunk at the four cardinal points of the compass. The second set of holes are drilled at a radius of 10 feet and no closer than 4 feet to any other hole. Additional holes as needed are spaced at 14, 18,22 foot radii. Two-inch diameter perforated plastic drain line is used as a liner so as to keep the hole open at the soil surface. Put 1/2 pound of Micromax fertilizer in the bottom,then 1/2 pound of granular elemental sulfur _ (92%)then fill the remainder of the hole with a high Nitrogen fertilizer(such as 24-4-19,or 17-7-12). All(39)Pin Oaks shall be treated for Iron Chlorsis yearly. Treatment is to be approved by the Contract Compliance Manager. REGENCY MAINTENANCE CONTRACT EXHIBIT "C" PAGE 5 PAGE 8 12. POWER RAKING- 1 time Power raking shall consist of operating power rake over all of the turf area. The power rake used shall be capable of cut depth of 1-7/8 inches with blades not in excess of one inch apart on a flail type reel speed not less than 1900 rpm(at engine speed of 2600 rpm);the unit shall have a full width gauge roller. The contractor shall use a tractor drawn(minimum width of 48 inches)power rake for open level areas. The cutting blades shall be operated so they just skim the soil,however,if unsatisfactory results are thus obtained the contractor shall notify the City and submit an alternate depth setting acceptable to the City. Additionally,the contractor shall power rake in the fall over all sodded areas. The cutter shall be set deep enough to pick up and clean the leaves from the grass in the fall power raking. All dead grass,leaves and debris removed in the fall power raking shall be disposed of in a suitable disposal area. The power raking performed during September through the first half of November,shall be done before the ground freezes to an extent that would interfere with the operations of the equipment. The additional aeration on the mounds and medians shall be performed at times approved by the City. 13. EDGING-2 times The contractor shall edge around all sidewalks two(2)times per year between June 1st and June 15th and August 15th and August 30th. The sod shall be trimmed back to a neat line and trimmings shall be removed from the area. 14. AERATION OF SOD-2 times Aeration shall consist of operating an aerator machine,over all the turf areas within the"Limits of Maintenance",with a machine is capable of completely removing soil plugs 5/8 inch in diameter and at least three inches deep,consistently. Aeration will occur between April 15th and May 15th and September 15th and October 15th.The removed plugs shall be six inches or less,center to center each way. The aeration machine shall be of adequate size and repair to perform the work in a reasonable length of time. The Contractor shall use a tractor drawn(minimum width of 48 inches)aerator for open level areas. The aeration performed during September through the first half of October, shall be done before the ground freezes to an extent that would interfere with the operations of the equipment. 15. SHEAR SHRUBS All shrubs shall be pruned/sheared so that at anytime they do not extend over a paved public use area. When shrubs are sheared,shrub foliage shall not be closer than 3 inches of extending over any paved use area. Shearing may occur continuously,however,inspection for compliance will occur between September 15th and October 15th. Yews and pfitzers at the intersections of walks shall be sheared to and maintained at their existing formal shape at least 4 times per year: generally at April 15th,May 15th, June 15th and August 15th or as approved by the City. 16. PRUNE TREES Pruning of trees within the"Limits of Maintenance"may be done at anytime. However,the inspection for compliance of the standard will occur between the 15th of September and the 15th of October of each year as scheduled with the Contractor. Pruning shall consist of the removal of dead or obviously weak branches,one inch in diameter or greater and all sprouts on the lower eight feet of the tree. All limbs over sidewalks to be a minimum of eight(8) REGENCY MAINTENANCE CONTRACT ,EXHIBIT "C PAGE 6 PAGE 9 feet. All limbs over major street surface shall have a minimum clearance of fourteen(14)feet. All limbs over minor streets shall have a minimum clearance of twelve feet(12). Prune limbs a minimum of four feet in any direction away from all street light globes and remove any limbs under the light globe that prevents light from reaching street surface. Prune limbs from around surface to base of street signs, (street names, no parking,stop, speed limit etc.)and two feet in any direction around sign. The removal of live wood shall be kept to a minimal amount. It is necessary to precut branches at least 6 inches beyond the finished cut, to prevent splitting into the parent stem or branch. The presence of extensive trunk decay shall be reported in writing to the Contract Compliance Manager. Proper pruning as described by Dr.Alex Shigo states that when marking a cut place the saw or shears in front of the branch crotch. Cut from the outer portion of the branch bark ridge down and slightly out,so as not to injure or remove the collar. Use sharp tools. Do not leave stubs. Do not paint cuts. 17.DISPOSAL All woody material must be disposed of in ways that are approved by the Contract Compliance Manager. The sweeping and removal of debris from the street,walk and other public areas will be completed before barricades are removed. All materials originating from pruned trees must be removed. It will be the responsibility of the contractor to pay dump fees as may be necessary for disposal. Delays in cleanup are to be reported by the contractor to the Contract Compliance Manager on the day such delays occur along with an estimate of when the cleanup can be expected. Any complaint calls resulting from the contractor's failure to cleanup shall be investigated. If remedial action is required the City may take such action as is required and the cost of such action shall be withheld from any moneys due to the contractor under this contract. 18. UTILITIES All water and electricity will be furnished by the City of Omaha at no cost to the Contractor. 19. TERMINATION The City of Omaha reserves the right to cancel this agreement for just cause bythe way of a fifteen(15) day written notice to the Contractor. 20. PAYMENT Payment to the contractor shall be made monthly as invoicing for services is sent to the Park Maintenance - Division at 1523 South 24th Street and the work is approved by the Park Maintenance Superintendent. Payment of the final 3%of the total amount of this contract shall be withheld until the provisions of Section III Item G-6 of this agreement are in compliance. LENGTH OF AGREEMENT This agreement will be in full force and effect starting from the notice to proceed through and including December 31, 1998,with four one year options that shall be at the City's discretion and at the same terms and conditions;four options 1999,2000,2001 and 2002. 22. SUBCONTRACTING Each bidder must have sufficient employees and equipment to perform the requirements of this contract. No subcontracting will be allowed without the prior written consent of the City. " . • .. . . -. .• • •• . . • - • I •- •. : • EXHIBIT "C" .N • • . .• •• • ,--r;;4 3 31 ks...e f• • . . .• • PAGE 13; f' •ill g T. •. . . . .• -c3 • : 2'1 • 0 r.,-..,• r.- •••" • • ... • • 0_ . -0 1...,.,c 1 • • • ,, ,, . • 2 , CITY OF OMAHA LEGISLATIVE.CHAMBER Omaha,Nebr 19 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS,in 1983 the City of Omaha annexed Sanitary and Improvement District No. 188,commonly known as the Regency Subdivision; and, WHEREAS,such annexation included public park,parkways, arid street right of way areas; and, WHEREAS, since annexation such areas have been maintained.under grounds maintenance agreements with private contractors hired by the City with the input of the Regency • Homes Association; and, WHEREAS,such areas have been maintained by such private contractors at a level of service in excess of the standard City grounds maintenance level, including, but not limited to, irrigation,since annexation through monetary contributions from the Regency Homes Association and with City of Omaha general funds pursuant to periodic agreements between the City and Regency Homes Association; and, WHEREAS,the last such agreement has terminated; and, • WHEREAS, the City has solicited and received bids from private contractors for grounds maintenance of the public parks; parkways and street rights of way in the Regency Subdivision area for the year 1998 and for the years 1999 through 2002 through four one year extension options; and, • WHEREAS, it is necessary to apportion the level of funding between the parties to reflect that the City shall provide monetary support in an amount equivalent to the cost charged by the private contractor to be hired by the City for the services which comprise the standard City grounds maintenance level and that Regency Homes Association shall pay the cost charged by the private contractor to be hired by the City for any services desired by the Regency Homes Association in excess of such level; and, By Councilmember Adopted City Clerk Approved Mayor C-25A CITY OF OMAHA LEGISLATIVE CHAMBER • • Omaha,Nebr July 2 1, 19 98 • PAGE 2 WHEREAS,it is necessary to provide for the payment of water used in the irrigation of such areas if Regency desires the continuation of such irrigation; and, WHEREAS; attached hereto is a proposed Agreement that sets forth the parties' respective rights, duties, and obligations and apportions the level of funding between the parties so that the City shall provide monetary support in an amount equivalent to the cost chlarged by the private contractor to be hired by the City for the services which comprise the standard City grounds maintenance level and that Regency Homes Association shall pay the cost charged by the private contractor to be hired by the City for any services desired by the Regency Homes Association in excess of such level and the cost of water for irrigation; and, WHEREAS,the Mayor recommends approval of such Agreement. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCILOF THE CITY OF OMAHA: THAT,as recommended by the Mayor,the attached Agreement between the City of Omaha and Regency Homes Association to provide for the apportionment of the costs of grounds maintenance of the public park, parkways and street right of way areas of the Regency Subdivision area of the city of Omaha through a private contractor to be hired by the City of Omaha and to specify other rights,duties and obligations of the parties,is hereby approved.
