The attached Resolution's purpose is to authorize an application from the City of Omaha to the State
of Nebraska Emergency Management Agency's (NEMA) program known as the Special Hazard
Mitigation Grant-Tree Recovery Program.
This grant requests funds to be utilized for tree planting and tree pruning. The total project amount
is $730,040.00. Of this amount, 75% or $547,530.00 will be provided by federal funds. The
remaining cost of$182,510.00 will be provided by the City of Omaha through the funds previously
designated for storm related expenditures.
During the October 26 storm,Omaha's trees experienced considerable damage. Through a concerted
effort on the part of local and state governments, volunteers, other agencies and the general public,
most obvious storm damage has been repaired;however,much work is still necessary to replant trees
in Omaha's city parks. Additionally, selective pruning is recommended to extend the life of those
trees sustaining significant storm damage.
The availability of these tree related federal funds is unique, as normal federal, public damage
and regular hazard mitigation funds cannot be used to replace or prune trees. However, there
does exist a hazard mitigation set-aside program that has been approved to fund a tree recovery
effort. The Governor has decided to use this special program to support local replacement
projects for those areas affected by the October 26 storm.
This City's proposed grant would expend$630,040.00 for replanting trees IN OMAHA PUBLIC
PARKS with the remaining grant funds of$100,000.00 to be utilized for pruning existing park
trees.
The Finance Department is authorized to pay the City's share of this cost in the amount of
$182,510.00 from Fund No. 129, 1997 Federal Assistance Fund

STATE - LOCAL CONTRACTUAL AGREEMENT
SPECIAL HAZARD MITIGATION GRANT
TREE RECOVERY PROGRAM
This agreement between the State of Nebraska (STATE) and - 10`rr1Q.Dia.
(Applicant) shall apply for all assistance funds provided by The
Special Hazard Mitigation Grant, Tree Recovery Program. The maximum Federal
funds provided by the Federal Emergency Management Agency (FEMA) shall be $54014O.°o
The applicant contribution shall be 25% of the total project amount approved by the
Nebraska Emergency Management Agency.
1 The following assurances extracted from Standard Form 424 D (4-88)
prescribed by OMB Circular A-102 may or may not be applicable to this hazard
mitigation grant. The Disaster Assistance Officer of the Nebraska Emergency
Management Agency should be contacted in the event of any applicability
questions. As the duly authorized representative of the applicant I certify that
the applicant:
a. Has the legal authority to apply for Federal assistance, and the institutional,
managerial and financial capability (including funds sufficient to pay the
non-Federal share of project costs) to ensure proper planning,
management and completion of the project described in this application.
b. Will give the awarding agency, the Comptroller General of the United
States, and if appropriate the State, through any authorized representative,
access to and the right to examine all records, books, papers, or
documents related to the assistance; and will establish a proper accounting
system in accordance with generally accepted accounting standards or
agency directives.
c. Will not dispose of, modify the use of, or change the terms of the real
property title, or other interest in the site and facilities without permission
and instructions from the awarding agency. Will record the Federal interest
in the title of real property in accordance with awarding agency directives
and will include a covenant in the title of real property acquired in whole in
part with Federal assistance funds to assure nondiscrimination during the
useful life of the project.
d. Will comply with the requirements of the assistance awarding agency with
regard to the drafting, review and approval of construction plans and
specifications.
e. Will provide and maintain competent and adequate engineering supervision
at the construction site to ensure that the complete work conforms with th=

approved plans and specifications and will furnish progress reports and
such other information as may be required by the assistance awarding
agency or State.
f. Will initiate and complete the work within the applicable time frame after

g. Will establish safeguards to prohibit employees from using their positions
for a purpose that constitutes or presents the appearance of personal or
organizational conflict of interest, or personal gain.
h. Will comply with the Intergovernmental Personnel Act of 1970 (42 U.S.C.
Para. 4728-4763) relating to prescribed standards for merit systems for
programs funded under one of the nineteen statutes or regulations
specified in Appendix A of OPM's Standards for a Merit System of
Personnel Administration (5 C.F.R. 900, Subpart F).

Representative. The Applicant is aware that limited funding available for
mitigation requires cost-sharing on the basis of 75 percent federal and 25
percent non-federal contributions and that the Applicant may be required to
provide all or part of the non-federal share for such mitigation activities. For
this disaster the Applicant will assume 25% of the match.
3. The Applicant will return to the State, within fifteen days of such request by the
Governor's Authorized Representative, any advance funds which are not
supported by audit or other federal or state review of documentation maintained
by the Applicant.
4. The Applicant will comply with all applicable codes and standards as pertains to
this project and agrees to provide maintenance as appropriate. Applicant will
also be aware of the provisions of RRS 81-829.73

Special Hazard Mitigation Grant Tree Recovery Program for the
City of Omaha, Nebraska
Project Description
This project will focus tree plantings and selective pruning within existing City of Omaha
Parks. Our park system is over 7000 acres in size with more than 260 parks. We have
identified a three tier approach to planting and pruning. Projects will be completed
according to their designated priority. Once the Priority One projects have been funded,
Priority Two projects will be completed. Should any funds remain, some of the Priority
Three projects will be executed. The intent is to address as many parks s as the funds
allow.
The City of Omaha reserves the right to shift priorities based on other private funding
sources.
This planting and pruning effort will cost $729,120 plus $920 from the newly annexed
Douglas County SID 241 for a total of$730,040. We will spend $630,040 planting new
trees. Approximately $100,000 will be spent pruning existing trees in order to prolong
their life within the park.
We anticipate that we will be able to plant 3600 trees and prune 670 trees.
Priority One Parks
With the first priority parks we will address 16 of the largest parks within the system.
These parks are the image makers for the City of Omaha. They are also ones that
experienced much of the damage from the October 1997 storm.
Priority One parks include NP Dodge Park, Adams Park, Levi Carter Park, Fontenelle
Park, Benson Park, Tranquility Park,Northwest Park, Walnut Grove Park, Seymour
Smith Park, Hitchcock Park, Mandan Park, Spring Lake Park, Hanscom Park, Elmwood
Park and Memorial Park.
The planting approach to these parks will be very comprehensive and broad. We will
look at the entire park, select key areas of focus and plant these areas. The conceptual
planting plans for these parks are already nearly complete.
The pruning within these parks will be the first priority for pruning.
These Priority One Parks may receive significant private funds for tree planting, shrub
planting, reforestation, meadow creation,tree pruning and selective thinning, and entry

Priority Two Parks
Priority Two Parks are ones that have also experienced significant loss of tree stock, or
have never received adequate trees. We are currently engaged with creating overall
master plans for some of these parks or will shortly begin such.
Priority Two Parks include 12 Community Centers, Churchich, Florence, Gallagher,
Harper, Miller Water Park, Pacific Place, Orchard, Roxbury, Tranquility Tennis Center,
Upland, Westchester, Crosskey, Pheasant Run, Rambleridge, Black Elk Park.
Priority Three Parks
Should funds remain, we will plant and prune a number of Priority Three Parks. These
are all of the remaining parks within the City of Omaha. We will plant parks that are in
most need of trees as determined by City Staff and prune parks that have a significant
number of trees in need.

Tree Planting
Plans by Registered Landscape Architects
All of the planting plans, contract documents, and installation observation will be
supervised by Registered Landscape Architects. The City of Omaha Parks, Recreation
and Public Property currently has three such professionals on staff. Private landscape
architectural firms will also be used to execute individual park planting plans.
Specifications include a two August guarantee
The City of Omaha standard planting specification is attached. We will incorporate any
more stringent criteria that are suggested by the Landscape Planting Specifications
published by the Nebraska Forest Service, September 1997.
Our current specifications require that all plant material survive two consecutive Augusts
or is replaced by the nursery.
Public Bidding
All Planting contracts will be bid publicly.
Installation by private contractor
All planting will be completed by private contractor.
Watering and Maintenance by Park Maintenance
Trees will be watered throughout the season with watering crews from the Park
Maintenance Division. We expect that every tree will be watered on a 10 day interval.
Plant List and Size.
Deciduous trees will be generally 1.75"to 2.5" caliper and evergreen trees 3 - 6', all B&B
material. Attached is a list of probable tree types to be used on the planting projects.

PLANTING
PART 1 - GENERAL
RELATED DOCUMENTS:
Drawings and general provisions of Contract, including General and Supplementary Conditions
and Division-1 Specification sections, apply to work of this section.
1.01 DESCRIPTION OF WORK:
A. The work under these items shall consist of furnishing,planting, mulching and
guaranteeing trees, shrubs and groundcover plants of the type and size indicated on
the plans or special provisions. It shall also include all incidental operations, such as
the replacement of dead and unsatisfactory plants or unsatisfactory materials before
final acceptance of the contract,plant maintenance by the Contractor after"Initial
Acceptance", etc.
1.02 SUBMITTALS:
A. The contractor shall submit the following samples, certifications or test results prior
to use on the project.
1. Sample of wood mulch.
2. Sample of tree guard.
PART 2 - PRODUCTS
2.01 MATERIALS:
A. Shredded mulch shall be shredded, woody material free of insects, disease, debris and
seeds. The Contractor shall apply a pre-emergent, approved by the Park Planner, in
all shrub beds and tree saucers prior to mulching.
B. Tree guard shall be 8" diameter by 10"high corrugated polyethylene pipe.

adopted by the American Joint Committee on Horticulture Nomenclature, 1942,

Edition. Size and grading standards shall conform to those of the American
Association of Nurserymen, "American Standard For Nursery Stock", ANSI Z60.1-
1990, unless otherwise specified. No substitution shall be permitted except by written
permission of the Park Planner.
D. The quality of all plants shall be typical of their species or variety. They shall have
normal well-developed branches and vigorous root systems. They shall be free from
significant defects, such as girdling roots, root bound, bark damage, topped or co-
dominant stems which will not allow the plant to develop normally. All plants shall
be nursery-grown unless otherwise stated.
E. For measurement purposes, a plant shall be dimensioned as it stands in its natural
position. Trees shall be calipered six (6) inches above ground. Stock furnished shall
be a fair average of the minimum and maximum sizes specified. Large plants cut
back to sizes specified will not be accepted.
PART 3 - EXECUTION
3.01 PREPARATION:
A. The Contractor shall have all underground utilities marked on the ground prior to
beginning any plant pit excavations. It will be the responsibility of the Contractor to
immediately repair any utility damaged during the planting operations to the
satisfaction of the Park Planner and at no additional cost to the Owner.
B. The Contractor shall stake the location of the proposed trees, shrubs and groundcover
plants unless otherwise stated on the drawings and have their locations approved by
the Park Planner prior to beginning plant pit excavation. Trees shall be staked
individually. Areas for multiple shrub or groundcover plantings shall be outlined on
the ground and the number of plants indicated in some manner without staking the
location of individual shrub or groundcover plants. The Contractor shall notify the
Park Planner at least forty eight (48) hours in advance to the Contractor wanting to
begin planting in a particular area.
C. In preparing plants for moving, all precautions customary and in good practice shall
be taken, and workmanship that fails to meet the highest standards shall be rejected.
All plants shall be dug to retain as many fibrous roots as possible. The size of the ball
of"balled and burlapped" and "balled and platformed" plants shall conform to those
of the American Association of Nurserymen, "American Standard For Nursery
Stock", ANSI Z60.1-1990, unless otherwise specified. The ball shall be a solid ball
of earth securely held in place by burlap and a stout rope. Oversize, exceptionally
heavy plants are acceptable if the size of ball or spread of the roots is proportionately

increased. Loose, broken or fabricated balls of earth will be rejected. "Balled and
platformed" plants shall be securely tied with a stout rope to sturdy platforms equal in
size to the diameter of the upper half of the ball of earth.
D. For delivery, all plants shall be packed, transported and handled with utmost care to
ensure protection against injury. Plants shall be planted the same day they are
delivered to the project site. If this cannot be done, balled and burlapped plants shall
be set on the ground and the balls covered with moist soil, wood chips and/or straw.
Until planted, all plant material shall be properly maintained by the Contractor to the
satisfaction of the Park Planner.
E. All plants are subject to inspection and approval at point of origin before and/or after
award of contract and at the project site before and/or after they are planted. Any
plant material rejected by the Park Planner shall be immediately removed from the
site and replaced with acceptable plant material at no additional cost to the Owner.
3.02 PLANTING SEASONS:
A Spring Planting: Balled and burlapped stock may be planted in the Spring between
March 15 and June 1., if weather and soil conditions permit. These dates may be
extended by the Park Planner if daytime temperatures remain below 80 degrees
Fahrenheit.
B. Fall Planting: Balled and burlapped stock may be planted in the between August 15
and October 31, if weather and soil conditions permit. These dates may be extended
by the Park Planner if the weather and soil conditions permit.
C. Container stock may be planted using the same dates and conditions as outlined for
balled and burlap stock (#3.02.A and #3.02.B.).
3.03 PLANTING:
A. The Contractor shall excavate all plant pits and shall furnish, plant, maintain and
replace all plant materials specified in the "Plant List" in accordance with these
specifications and as shown on the drawings and as directed by the Park Planner.
B. The Contractor shall be liable for any damage to property caused by planting
operations and construction, and all areas disturbed shall be restored to their original
condition to the satisfaction of the Park Planner and at no additional cost to the
Owner.
C. Planting of trees and shrubs shall be in pits that are at least three times as wide as the
diameter of the ball or container and of a depth equal to the ball or container height.

All plant pits shall have sloping sides unless otherwise directed or detailed on the
drawings.
D. Backfill shall be clean soil salvaged from excavation of the planting well, unless
considered unacceptable by the Park Planner. Excavated soil not suitable for backfill
material shall be removed from the site by the Contractor and replaced with topsoil
approved by the Park Planner. All backfill shall have a uniform appearance and shall
be lose, friable and free of hard clods, construction debris, clumps of grass, garbage,
and rocks over 2 inches in diameter.
E. Balled and Burlap Plantings:
1. Plants shall be planted plumb at the same level at which they have grown unless
otherwise specified on the drawings. The balls of earth of balled and burlapped
plants shall not be loosened or otherwise damaged during planting operations.
All roots which are bruised or broken shall be pruned with a clean cut. Carefully
remove as much of the wire, burlap and /or tying material as possible from the
root ball without damaging the roots or the root ball. Soil shall be firmed at six
inch to eight inch intervals and thoroughly settled with water until the entire
plant pit has been filled with soil to match finished grade.
F. Container Stock Plantings:
1. Plants shall be planted plumb at the same level at which they have grown unless
otherwise specified on the drawings. Carefully remove the container. Spread
out the roots and remove/wash as much of the "container soil" from the roots.
Do not use the "container soil" as backfill in the plant pit. All roots which are
bruised or broken shall be pruned with a clean cut. Keep roots spread out in the
plant pit as backfill is added. Soil shall be firmed at six inch to eight inch
intervals and thoroughly settled with water until the entire plant pit has been
filled with soil to match finished grade.
G. Trees shall be mulched with four inch thick layer of wood chips. The wood chips
shall cover the entire area of the hole dug for the tree. Mulch shall be kept away from
the base of trees by the Tree Guard. Do not place any mulch inside the Tree Guard.
H. All shrubs and plantbeds shall be mulched with four inch thick layer of wood chips.
I. Beds shall be reworked to a minimum depth of 18 inches until they are friable, free
from mortar and debris, accurate to line and grade, and otherwise suitable for planting
operations.

1. All planting beds shall have all sod removed and excavated to depth to hold the
specified depth of mulch. Contractor shall remove all sod from the project site
unless otherwise directed by the Park Planner. In no case shall the sod be used
as backfill for newly installed plants.
J. All sucker growth and broken, dead, or badly bruised branches shall be removed with
clean cuts. All pruning cuts shall be made with sharp tools and shall be sharp and
clean.
K. Do not wrap tree trunks with tree wrap.
L. Tree staking is not required and is at the option of the Contractor. If the Contractor
decides to stake trees, they shall be done as per the planting details and as outlined
below.
1. All trees shall be staked or guyed securely in accordance with standard_practice.
Care shall be taken so that stakes and guy strapping will not create pedestrian or
vehicular hazards. Do not use wire and hosing for guying trees.
2. Stakes for supporting deciduous trees shall be 2 inch by 2 inch by 10 foot,No. 1
sound Douglas Fir or 10 foot long cedar posts stripped of bark. Each tree shall
have three stakes per tree, evenly spaced (120 degrees). Care shall be taken so
stakes do not pierce the tree ball when placed.
3. Stakes for supporting evergreen trees shall be 2 inch by 2 inch by 2 foot, No..1
sound Douglas Fir or 2 foot long cedar posts stripped of bark. Each tree shall
have three stakes per tree, evenly spaced (120 degrees). Care shall be taken so
stakes do not pierce the tree ball when placed.
4. Wide, belt-like strapping to be used to guy trees shall be a minimum of 1 inch
wide, Rainbow Chainlock Tree Ties (from England), as distributed by the
Good-Prod Sales, Inc., 825 Fairfield Avenue, Kenilworth, New Jersey, 07033;
phone number: (908) 245-5055 or approved equivalent. Submit sample to the
Park Planner for review prior to purchase and use on the project.
M. All plants shall be thoroughly watered as soon as possible after planting, but no later
than the end of each day for all plant material planted during the day. Until "Initial
Acceptance" by the Park Planner, the Contractor shall maintain and water all plant
material as weather conditions require. Due care shall be exercised to avoid "washing
out" the mulched soil. Minimum watering is considered as one thorough soaking per
week. Under extremely hot and dry conditions (as determined by the Park Planner),
minimum watering shall be considered as two thorough soakings per week.

3.04 MAINTENANCE OF PLANTING UNTIL "INITIAL ACCEPTANCE"
A. Maintenance of planting shall begin immediately after each plant is planted and
continue until "Initial Acceptance" by the Park Planner. Maintenance shall include,
but not be limited to watering, cultivation, removal of dead material, resetting plants
to proper grades in upright positions, restoration of the planting saucer and other
necessary operations. Weeds shall not be allowed to attain a growth of over six (6)
inches before being removed. If planting is done after seeding, proper protection of
seeded areas shall be provided and any damage resulting from planting operations
shall be repaired promptly at the Contractor's expense.
3.05 INSPECTION AND ACCEPTANCE
A. Planting installations will be inspected and approved for initial acceptance on a
"Planting Season" basis, if requested by the Contractor in writing. It will not be
necessary for a Contractor to complete all of the plantings before requesting
"Inspection of Completed Work" and "Initial Acceptance" unless all of the work is
completed in one planting season.
B. Inspection of Completed Work: When the Contractor feels that the work under the
Contract has been completed, he shall inform the Park Planner in writing of such and
request an inspection of the work by the Park Planner for "Initial Acceptance" of the
work. The inspection shall made within two weeks of the receipt of the written notice
from the Contractor.
C. Initial Acceptance: If the Park Planner finds all of the work satisfactory and in
compliance with the Drawings, Specifications and Contract Documents of the project,
the Park Planner shall inform the Contractor in writing of the "Initial Acceptance" of
the work. Once the Contractor has received written notice of "Initial Acceptance",
the warranty on all the material begins. The date for the beginning of the warranty
period shall be the date that the plant material was inspected and accepted for "Initial
Acceptance"by the Park Planner.
D. First August: During the first August after initial acceptance of the plant material,
the Park Planner shall inspect the work. Any plant(s) that the Park Planner finds dead
or not in satisfactory growth shall be removed, replaced and guaranteed as per Article
#3.06.
E. Final Acceptance: During the second August of the warranty period, the Park
Planner shall inspect the work. Any plant(s) that the Park Planner finds dead or not in
satisfactory growth shall be removed,replaced and guaranteed as per Article #3.06.

3.06 WARRANTY:
A. Guarantee: All plants within this contract, and their subsequent replacements, shall
be guaranteed for a minimum of two Augusts from the date of"Initial Acceptance" by
the Park Planner and shall be alive and in satisfactory growth at the end of the
guarantee period.
1. Any material that is 25% dead or more shall be considered dead and must be
replaced by the Contractor. A tree shall be considered dead when the main
leader has died back, or 25% of the crown is dead.
B. Replacement: During the first and second August of the guarantee period, inspection
will be made by the Park Planner. Any plant under this contract that is dead or not in
satisfactory growth, as determined by the Park Planner, shall be removed from the
site. These shall be replaced during the normal planting season as outlined (Article
#3.02) in the Specifications. All replacements shall be plants of the same kind and
size as specified in the plant list. Replacement plants shall be guaranteed for two
Augusts from their date of"Initial Acceptance" by the Park Planner, as described in
Article #3.06.
C. Replacements shall be at the Contractor's expense. A sum sufficient to cover the
estimated cost of possible replacements, including materials and labor, may be
retained by the Owner and paid to the Contractor only after all replacements have
been made and approved.
3.07 MAINTENANCE AFTER "INITIAL ACCEPTANCE"
A. All newly installed trees, shrubs, groundcover plants and all planting areas within the
contract limits of this Contract shall be maintained by the Contractor for the time
period stated below after"Initial Acceptance" by the Owner.
1. For plants installed during the Spring planting season, the maintenance period
shall begin on the date of"Initial Acceptance" and continue until June 15th of
the following year. After June 15th, the Owner shall take over maintenance of
such plant material.
2. For plants installed in the Fall planting season, the maintenance period shall
begin on the date of"Initial Acceptance", and continue till October 15th of the
following year. After October 15th, the Owner shall take over maintenance of
such plant material.
B. Maintenance shall include, but not be limited to weekly watering, weeding,
cultivating, pruning, adjustment and repair of stakes and guys, repair of washouts of

mulch and other horticultural operations necessary for the proper growth of plants and
maintaining of a neat appearance of all work under this Contract.
1. Minimum watering is considered as one thorough soaking per week. Under

Pruning
Selective Tree Pruning to Save Existing Trees.
Pruning will be accomplished on existing trees in order to prolong their anticipated life
span. This will include the removal of stubs, minimizing wounds and pruning to shape
the trees.
Pruning priorities and specifications will be prepared by arborists and administered by the
City Forester. Pruning will be completed by private contracts.
Throught this program we expect to prune between 50,000 and 100,000 trees.

TREE PRUNING SPECIFICATIONS
•
GENERAL
This is a tree pruning contract to bring the attached list(s) of woody vegetation into
compliance with Section 37 of the Omaha Municiple Code. Tree pruning, cleanup and
disposal are included.
The City of Omaha, Park Division shall be furnished a listing of the contractor's personnel
and motorized equipment.
The City may inspect all equipment to be used by the contractor prior to the commencing
of the contract. This resource list will be used by the City to determine the contractor's
ability to complete tree work.
The contractor will be responsible for the storage of all equipment, material and have
adequate provisions for storage off the work site.
TREE PRUNING
Pruning shall consist of the removal of dead or obviously weak branches, two inches in
diameter or greater and all sprouts on the lower eight feet of the tree. All limbs over
sidewalks to be a minimum of eight (8) feet. All limbs over major street surface shall have
a minimum clearance of fourteen (14) feet. All limbs over minor streets and alleys shall
have a minimum clearance of twelve feet (12).
Clear 6 feet around: signs; traffic lights, include pruning so that the lights are visible to
motorists for more than 150 feet.; street lights, so that the street light can be seen when
standing half way to the next street light and when standing on the adjacent public
sidewalks.
Remove all stubs to "natural target" pruning cuts.
All final cuts shall be"natural target" pruning cuts as described by Dr. Alex Shigo. Precut
branches that weigh over 20 pounds to prevent splitting into the parent limb.
When a tree should be removed due to extensive decay, splits or other defects, stop work
on that tree and notify the City of Omaha. Call 444-5956.
See attached illustrations.
The City reserves the right to decrease the total number of trees to be pruned. The City
also reserves the right to limit the work assigned to the successful bidder based upon that
contractor's recent work history.

Bids are solicited for each individual tree pruning.
DISPOSAL
All woody material must be disposed of in ways that are approved by the Park
Maintenance Superintendent.
The sweeping and removal of debris from the street, walk and other public areas will be
completed before the barricades are removed. All materials originating from pruned trees
must be removed. It will be the responsibility of the contractor to pay dump fees as may
be necessary for disposal. Delays in cleanup are to be reported by the contractor to the
Park Maintenance Superintendent on the day such delays occur along with an estimate of
when the cleanup can be expected. Any complaint calls resulting from the contractor's
failure to cleanup shall be investigated. If remedial action is required the City may take
such action as is required and the cost of such action shall be withheld from any monies
due to the contractor under this contract.
EXAMINATION OF CONDITION
It is required that each bidder will make a personal examination of the site of proposed
work and of its surroundings.
TIME OF STARTING AND COMPLETION
The work to be done under this contract is to begin within ten (10) calendar days from the
date of the"Notice to Proceed" letter from the City of Omaha, Park Maintenance
Division. The work shall be carried on diligently thereafter and shall be completed within
one and one half calendar days multiplied by the number of tree prunings on the list.
WORK PROGRESS
The contractor must notify the Park Maintenance Division at least once a week of their
work progress.
INSPECTION
The Park Maintenance Superintendent, or his designated representative may inspect the
work of the contractor at anytime and may suspend operation, if it is not being performed
in a SAFE MANNER, or not in accordance with the contract specifications. The
acceptance of an individual unit of work is solely within the discretion of the Park
Maintenance Superintendent

PROPERTY ACCESS
Contractor must obtain permission to use adjacent property for access to or from
worksite.
HOURS OF WORK
No saws or power equipment shall be started prior to 7:00 a.m. or after 10:00 p.m.
Monday through Saturday. No work shall be done on Sunday or legal Holidays, except in
case of emergency.
FORESTER'S CERTIFICATE
The contractor must have a current Arborist License from the City of Omaha, prior to
being awarded the bid.
CONTRACTOR REPRESENTATIVE
The contractor shall have a current licensed Arborist in direct and personal charge of the
work and the Arborist and shall be on the job at least 50% of the working hours. The
Arborist shall have a current local address and telephone number through which he may be
contacted.
SAFETY
The contractor shall use safety procedures and devices as recommended by applicable
ANSI Standards or required by City ordinance and shall be liable for all accidents and
damages occasioned in any way by his acts, or by acts or neglect of sub-contractors,
agents, employees or workers.
This includes the use appropriate means to prevent pedestrians and observers from
entering into the tree work area.
POSTING
The Park Maintenance Division, upon request will furnish"No Parking" signs. If there
persists a particular parking problem, the contractor should contact the Park Maintenance
Division. When a job is completed, the signs must be immediately removed.
STREET BLOCKING
In the event thoroughfares need to be blocked it will be done in accordance with"The
Manual of Barricading Standards, Specifications, Methods and Materials for the City of
Omaha" adopted March 3, 1992. For more information call Traffic Engineering (444-
5250).

A
PROTECTION OF EXISTING STRUCTURES
The contractor shall carefully protect all property including structures and utilities both
above and below the ground. All damages to property and structures, including walks and
driveways, trees, shrubs and turf, shall be satisfactorily restored or replaced by the
contractor at his expense. All property damage, public or private, will be reported to the
Park Maintenance Division in a timely manner. The contractor shall present a signed
release from the damaged property owner prior to final contract payment.
PUBLIC UTILITIES
The Park Division will advise the Power Company at the time of bidding of addresses
where power problems exist. The contractor is then responsible to coordinate with the
utility for power line clearance and/or wire drops. When pruning is done by OPPD it is
the contractor's responsibility to remove all pruned material by the end of the work day.
PUBLIC LIABILITY AND WORKMEN'S COMPENSATION
The successful bidder is to provide acceptable copies of Public Liability, Workmen's
Compensation Insurance and signed the contracts within ten (10) calendar days of bid
opening. Insurance Documents and signed contracts must be submitted to the Purchasing
Agent. The successful bidder shall provide a Certificate of Insurance indicating adequate
Workmen's Compensation, Public Liability of not less than $300,000.00, ($500,000.00 if
more than one person) and Property Damage of not less than $300,000.00 and with the
City of Omaha as additional insured. Failure to provide acceptable copies of insurance, or
to sign the contracts within ten (10) days shall be cause for rejection of said bid.
PAYMENTS
Trees pruned in conjunction with this contract will be paid in accordance with this
document and said payment price shall include all labor, materials, supplies, equipment and
supervision to remove the trees and dispose of the waste products. No separate payments
will be made for final clean-up, adjustments, alterations or other necessary corrections to
place the work in readiness for final inspection and acceptance.
Any payment to the contractor shall be made after the invoice for services is sent to the
Park Maintenance Division at 1523 South 24th Street and the work is approved by the
Contract Manager.
LIQUIDATED DAMAGES FOR DELAY
The contractor guarantees that he/she can and will complete the work within the above
time limit, or within the time as extended. Should the contractor fail to complete the work
within this time limit, or within such extra time as allowed by Park Maintenance Division,

there shall be deducted from monies due the contractor, a sum of Five Dollars ($5.00) per
tree, per day, not pruned. This sum shall be considered and treated not as a penalty, but as
liquidated damages due the City from the contractor by reason of inconvenience to the
public, an added cost of supervision, maintenance and other items which have caused an
expenditure of public funds resulting from the failure to complete the work within the time
specified.
TERMINATION
The City reserves the right to cancel this agreement by way of a written notice to the
contractor.
SUBCONTRACTING
Each bidder must have sufficient employees and equipment to perform the requirements of
this contract. No subcontracting will be allowed without the prior written consent of the
City.

WHEREAS, during the October 26, 1997, storm, Omaha experienced considerable
tree damage in public parks;and,
WHEREAS, most obvious storm damage has been repaired through concentrated
efforts by local and state governments, volunteers, other agencies and the general public; and,
WHEREAS, normal federal, public damage and regular hazard mitigation funds
cannot be used to replace or prune trees in City parks; and,
WHEREAS, within the Nebraska Emergency Management Agency there exists a
hazard mitigation set-aside program that has been approved to fund a tree recovery effort and has
been supported by the Governor to be used for local replacement projects for those areas affected
by the October 26 storm; and,
WHEREAS,the City of Omaha proposes to apply for this Special Hazard Mitigation
Grant-Tree Recovery Program in the amount of$730,040.00 and of this amount 75%or$547,530.00
will be federal funds; and,
WHEREAS, the remaining cost of$182,510.00, a 25%match,will be provided by
the City of Omaha through the funds previously designated for storm related expenditures; and,
WHEREAS,this grant would be in the best interest of the citizens of Omaha; and,
WHEREAS,the Mayor has recommended approval of this grant request.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT,as recommended by the Mayor,the City of Omaha will apply for a grant from
the State of Nebraska Emergency Management Agency in the amount of$730,040.00 with the
required 25%match of$182,510.00 being provided by the City of Omaha for tree planting and tree
pruning in the City of Omaha public parks. The Finance Department is authorized to pay the City's
share of this cost in the amount of$182,510.00 from Fund No. 129, 1997 Federal Assistance Fund.
