The Fire Department requests approval of two employment contracts for EMS instructors. °Tihe
purpose of these contracted positions is to train Omaha Fire personnel, both initially and providing
continuing education in the field of emergency medical services(EMS). Previously,this service was
provided by an outside agency at a greater cost, and the Fire Department had little control over the
scheduling of the training. The scheduling conflicts and overtime expenses will be reduced
significantly when this instruction is offered in-house by the Omaha Fire Department.
The State of Nebraska requires that all levels of EMS personnel, such as emergency medical
technicians and paramedics, be certified in basic and, later, advanced cardiac life support, and pre-
hospital trauma life support. These contracted positions will provide training to ensure the City of
Omaha complies with this requirement.
The two positions are EMS Education Coordinator at a salary of $50,000 per year and EMS
instructor at a salary of$35,000 annually. The contracts do not call for the City to provide any
dental and health insurance benefits. The contracts are for three years,to run from January 1, 1998,
through December 31, 2001.
Funds for the positions have been appropriated and will be available in the 1998 Fire Department
Budget under Fund 001, Agency 131, Organization 1312.
The contractor has on file a current Annual Contract Compliance Report Form(CC-1). As is City
policy, the Human Relations Director will review the contractor to ensure compliance with the
Contract Compliance Ordinance.

AN ORDINANCE giving approval to an Agreement involving payments out of appropriations of
more than one year in conformity with section 5.17 of the Home Rule Charter; such
agreement being between the City of Omaha and Alice ("Twink") Dalton providing for
professional services as a Training Division and EMS Coordinator for the Fire Department
for a term of three years at a cost of$50,000.00 per year; providing for payments out of
certain funds and providing for the effective date hereof
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That approval is hereby given to the attached Agreement involving payments
from appropriations of more than one year in conformity with section 5.17 of the Home Rule
Charter; such agreement being between the City of Omaha and Alice ("Twink")Dalton providing
for Professional services as a Training Division and EMS Coordinator for the Fire Department for
a term of three years at a cost of$50,000.00 per year.
Section 2. That the costs to be paid by the City of Omaha under such agreement shall be paid
from the Fire Training Bureau Fund,Number 001, Object 1312, Item 2735.
Section 3. That this Ordinance, being administrative in character, shall be in full force and
take effect immediately upon its passage.

THIS CONTRACT is made and entered into in TRIPLICATE by and between the City of
Omaha, a Municipal Corporation of the Metropolitan Class in Nebraska, hereinafter
called the "City" and, Alice ("Twink")Dalton a person, hereinafter called the
"Consultant".
In consideration of the following mutual agreements and covenants, it is understood and
agreed by the Parties hereto that:
1. City hereby engages Consultant and Consultant does hereby agree and
undertakes to personally perform the contract for City Fire Department educational
consulting services subject to the provisions hereof and subject to the specific provisions
in Exhibit A, attached hereto and incorporated herein, for the sum of$50,000.00 per year
payable by the City in equal monthly amounts. Consultant is an independent contractor
and will not receive any City employee benefits, including with out limitation, health,
dental or pension benefits and will not be covered by the City for Workers Compensation
payments or benefits.
2. Consultant shall conform with the applicable Specifications of this contract,
being Exhibit A, "Job Description Training Division and EMS Coordinator". In addition
thereto the consultant will be expected to perform such services a minimum of 40 hours
per week , normally Monday through Friday. Provided that Consultant shall have a total
of 15 days in the first contract year, and 20 days in each succeeding year, for
discretionary absences, for either vacation or sickness, and up to an additional 10 days per
year that are specifically devoted to receiving professional continuing education. No
absences for any or all of such leave purposes shall exceed two consecutive weeks.
Consultant will be provided with a pager and will be provided with transportation during
the performance of services on an as needed basis and may drive a City automobile as
needed but no specific auto is provided.
3. The Consultant will start performing the contract services within 14 days of
receipt of a copy of this agreement signed by the City and will continue such performance
to the end of the contract term. The City is relying upon the personal knowledge and skill
of the Consultant, therefore no professional portion of this work shall be performed by
another without the written consent of the City.
4. All provisions of each document and items referred to in Paragraph 2 above
shall be strictly complied with the same as if rewritten herein, and no substitution or
change shall be made except upon written direction,the form of which shall be by written
"Change Order" of the City; and substitution or change shall in no manner be construed
to release either party from any specified or implied obligation of this Contract except as
specifically provided for in the Change order.
5. Consultant does hereby state, warrant and covenant that she has not retained or
employed any company, or person, other than bona fide employees working for said
Consultant to solicit or secure this Contract, and that she has not paid or agreed to pay

any company or person, other than bona fide employees working solely for the
Consultant, any fee commission, percentage, brokerage fee, gifts or any other
consideration, contingent upon or resulting from the award or making of this Contract.
For breach or violation of this statement, warrant and covenant, the City of Omaha shall
have the right to annul this Contract without liability.
6. Consultant shall conform with all applicable City Ordinances, with all
applicable State and Federal Laws, and with all applicable Rules and Regulations.
7. The term of this agreement is three years form the commencement of services
hereunder; however, both parties hereto have the right to cancel this agreement at any
time for any purpose upon giving 90 days advance written notice of such cancellation to
the other.
8. Consultant will not routinely be providing direct patient care; however due to
some exposure to the claims of such persons the City agrees to indemnify and save
harmless the Consultant from all claims, suits or actions of every kind and character made
upon or brought against her for or on account of any injuries or damages received or
sustained by any party or parties by or from the acts or omissions of the said Consultant
in doing the services herein contracted for including emergency patient care services or
instruction related thereto.
9. The Consultant shall not, in the performance of this Agreement, discriminate
or permit discrimination against any person because of race, sex, age, or political or
religious opinions or affiliations in violation of Federal or State laws or Local
Ordinances, and further the Consultant shall comply with City of Omaha Ordinance
28885 pertaining to Civil rights and Human Relations. It is agreed the Consultant shall to
the best of his knowledge, contract only with parties that withhold taxes as provided by
law and do not discriminate against any employee or applicant because of race, sex, color,
religion, age or national origin.
10. Consultant is not expected to supply any materials or labor from third parties,
however she shall pay all just claims due for the payment of all employees and mechanics
for labor that shall be performed, for the payment of all material and equipment
furnished, and for the payment of material and equipment rental which is actually used or
rented, and ordered in the Consultant's name, in the performance of the Contract.
11. Pursuant to Section 8.05 of the Home Rule Charter of the City of Omaha, no
elected official or any officer or employee of the City shall have a financial interest,
direct or indirect, in any City contract. A violation of that section with the knowledge of
the Consultant, in addition to constituting employee malfeasance, shall be cause for the
City to unilaterally terminate or void this Agreement.
12. The originally approved scope and primary features of a contract or purchase

will not be significantly revised as a result of amendments not approved in advance by
the City Council. The provisions of this Section will be quoted in all future City
contracts. Nothing in this Section is intended to alter the authority of the Mayor under
Section 5.16 of the City Charter to approve immediate purchases.

JOB DESCRIPTION
TRAINING DIVISION AND EMS EDUCATION/COORDINATOR
Nature of Work •
This is work that involves the development, coordination and implementation of all EMS
education programs administered to the Omaha Fire Department sworn personnel. This work
also involves the supervision and training of EMS faculty within the department. Coordination
involves a close working relationship with the Training Division, the EMS Bureau Chief, the
Assistant Chief over the Training Division and the department Medical Director. The work
involved also includes coordination of quality improvement programs, fielding inquiries from and
interactions with the public and community hospitals regarding procedures and protocols.
Essential Functions
Any one position may not perform all of the duties listed, nor do the listed examples include all of •
the duties that may be performed in positions allocated to this class. Also, the duties are note
necessarily listed in order of importance or frequency of performance.
Develops, coordinates and implements both primary and continuing education classes for
appropriate levels of paramedics, EMT's and EMT-I's within the department, including state
approved EMT instructors. Is directly responsible for the appointment, organization and
supervision of other faculty conducting EMS classes for OFD personnel to ensure standards are
met and curricula are followed. Serves as contact person with other EMS and EMS related
educational agencies working with OFD personnel. Has the ability to appoint a designee or
agent to serve as representative for any of these functions. Ensures that all designated local,
state and national requirements are met in order to maintain licensure.
In conjunction with Paramedic' Shift Supervisors and the Medical Director, develops and
coordinates continuous quality improvement (COI) for EMS.
Completes run reviews with specified department personnel.
Monitors and/or participates in patient care as a part of training responsibilities and/or
maintenance of licensure.
Maintains continuing education records and prepares reports as needed.
Maintains contact with area hospitals, educators, consultants and other training and
development professionals to exchange information. Participates in run reviews with area
hospitals to ensure quality patient care.
Creates, revises and implements EMS protocols in conjunction with the Medical Director.
Performs other related duties as assigned or as the situation dictates within the scope of this
classification.
