Ammons has been released and extinguished pursuant to Nebraska Revised Statute 77-1862 upon the expiration of 15 years after the date upon which the special assessment became delinquent and that the assessment on the particular property in Ordinance No. 9339. levied on October 4, 1977, should be removed. ORDINANCE NO. 3 .79 AN ORDINANCE to amend certain portions of Special Levy Ordinance No. 9339 levying assessments for building demolitions in 1977 by repealing the assessment on property located at 3106 Decatur Street in the City of Omaha, Douglas County,Nebraska. WHEREAS, Special Levy Ordinance No. 9339 was passed by the City Council of the City of Omaha on October 4, 1977,levying special assessments for building demolitions on certain lots in the City of Omaha, and it has been ascertained that the assessment on the following described property and the amounts so levied by Special Levy Ordinance No. 9339 should be repealed. The special assessment has been released and extinguished pursuant to Nebraska Revised Statute Section 77-1862 upon the expiration of 15 years after the date upon which the special assessment became delinquent and should be removed. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That such portion of the Special Levy ordinance No. 9339, passed October 4, 1977,relating to and levying special assessments for building demolition removal upon the following described property: Owner: Esther L.Ammons, 5123 North 54th Street,Omaha,NE 68104 Property Address: 3106 Decatur Street, Omaha,NE 68111 Legal Description: Lowes Subdivision Lot 18, Block 4, West 38 East 76 Feet of Lots 16- 17 and 38X127.5 Amount: $101.51 be and it hereby is repealed, and said property levy and interest on the same, and the same hereby is,held for naught,the same as though not included in such Special Levy Ordinance No. 9339, and the total amount of special Levy Ordinance No. 9339 be amended accordingly. The owner of the property, Ms. Esther L. Ammons, had the garage removed and therefore the City has no claim for any removal costs. However, the assessment of $101 .51 was the City's attempt to reclaim its reimbursement that it made to the contractor, who had sought reimbursement from the City for the cost of his bond to do the garage removal. The lien has been against the property for 20 years as of October 1997. The principal amount of $101 .51 plus accrued interest of $293.97 has grown to a total of now $395.48 against the property. The lien against the property has aged beyond the statute of limitations of 15 years. Therefore, the lien is not collectible by the City unless Mrs. Ammons voluntarily pays the principal and interest that has accrued thus far. Mrs. Ammons' position is that she had the garage removed at her own expense and therefore met her obligation to the City. Furthermore, the contractor did no work in terms of removing the garage. In view of the fact that the statute of limitations has ran out on this particular situation, Mr. Brown recommends that the City remove the lien.
