RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Section 14-116 of the Revised Statutes of Nebraska authorizes the
City of Omaha to regulate the subdivision of land within three miles of the corporate limits of
the City but not within the City; and,
WHEREAS, the owners of certain unplatted real estate have executed and
submitted a plat HARRIS ADDITION, a minor plat outside city limits, located northwest of North
Post Road and 40th Street; and,
WHEREAS, the Planning Department has recommended the approval and
acceptance of this plat.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OMAHA:
THAT, the plat entitled HARRIS ADDITION, a minor plat outside city limits, located
northwest of North Post Road and 40th Street, is hereby approved and accepted.

I. GENERAL INFORMATION: AK ' -
Purpose: To plat the existing 4.40 acre parcel into one lot for single family residential
use.

Future Land Use Designation(s): Ponca Special Development
Applicable Regulations: If approved, development of the site will be subject to
the existing DR-Development Reserve zoning
regulations, the ED-North Hills Environmental
Resource District regulations, as well as all other
applicable regulations.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site The property is comprised of approximately 4.40 unplatted acres in the
Characteristics: North Hills Environmental District. Property in the vicinity is heavily wooded
and steep terrain in the North Hills. Areas north, south, and southwest of
the site are a part of the Intercessors of the Lamb, Inc. campus. The site is
accessed from North Post Road via access easement south and east of the
site.
Development Development plans have not been submitted with the application. However,
Proposal: in discussions with the Planning Department the applicant has indicated
they intend to construct a single family residence on the property. The
property is unplatted today and must be subdivided to create a buildable lot.
As a part of this Minor Plat, the applicant has included a request to waive
the requirement for lot frontage and will continue to access the site via the
existing access easement.
Public Any new or revised driveway connections to North Post Road require the
Improvements: review and approval of the Douglas County Engineer's office.
The previously recorded access easement that is intended to provide
access from North Post Road to the site runs along the eastern side of a 40
foot wide portion of the parcel located north and east of the subject property.
However, the easement does not actually connect to the subject property.
The easement must be revised to actually provide a legal means of
in•ress/e•ress between the subject propert and North Post Road.
Utilities: Coordinate with OPPD regarding proposed electrical service to the site. An
easement will likely be required to cross an adjacent property in order to
serve the site.
Water, gas, and electricity will be provided as required by Chapter 53,
_Subdivisions, of the Omaha Municipal Code.
Land Use and The requested subdivision of the property creates a single buildable lot from
Planning: the existing parcel and is appropriate. The proposed lot and anticipated
development must meet all requirements of the DR-Development Reserve
zoning regulations.
Prior to forwarding this request to City Council, revise the submitted plat
documents to provide an acceptable building envelope on Lot 1.
Section 55-901(a)(4)(c) notes that construction of a single-family residence
on an existing tract or lot is exempt from the requirement for approval of a
Special Use Permit. This tract has existed without change or subdivision
for many years and, as such, a Special Use Permit for construction of a
single-family residence is not required.
III. ANALYSIS: _
Conditionally, the minor plat generally complies with the objectives of the Omaha Master Plan
and the requirements of the Omaha Municipal Code.
IV. RECOMMENDATIONS:
Approval of the waiver to Section 53-8(4)(d), Lot frontage.
Approval of the Preliminary Plat, subject to meeting the following conditions:
1. Submit revised plans providing an acceptable building envelope on Lot 1.
2. Provide a revised access easement that includes direct access from the easement to Lot
1,
3. I Obtain review and approval from the Douglas County Engineer's office for any
_ new/revised driveway connections. __
4. Coordinate with OPPD on provision of electrical service to the site. _
Approval of the Final Plat subject to the conditions of Preliminary Plat approval and submittal
of an acceptable final subdivision agreement(if necessary) prior to forwarding the City Council.
