AN ORDINANCE to amend Section 23-361 of the Omaha Municipal Code entitled, "Rate of
accumulation.";to increase the sick leave earned by Fire Management employees;to repeal
section 23-361 of the Omaha Municipal Code as heretofore existing; and, to,provide the
effective date hereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That Section 23-361 of the Omaha Municipal Code is hereby amended to read as
follows: •
Sec. 23-361. Rate of accumulation.
(a) Every regular or probationary employee classified as police
management (class D), functional positions (class EE), and
administrative and executive classifications (class AA), as provided
in section 23-176, who are not covered by a collective bargaining
agreement, shall receive six hours of sick leave allowance for each
full semimonthly pay period of service.
Upon the first day of the month following the effective date
of this amended section [May 27, 1992], every regular or
probationary employee classified as civilian management (class A)
and administrative and executive employees (class AA) shall accrue
sick leave in accord with bi-weekly pay periods at the rate of ten
hours per month.
(b) Sick leave shall be earned by regular and probationary
employees classified as fire management (class C), as provided in
section 23-176,who are assigned to a 24-hour shift at the rate of 47-5
2 hours each semi-monthly pay period, and, for those employees in
fire management assigned to a 40-hour work week, sick leave shall
be earned at the rate of five six hours each semimonthly pay period.
(c) Sick leave shall be earned by uniformed employees assigned
to a 40-hour workweek at the rate of six hours per semimonthly pay
period of service.

(d) Any employee who is absent from work without pay in excess
of five days during a semi-monthly pay period shall not receive any
sick leave allowance during the semimonthly pay period.
Section 2. That Section 23-361 of the Omaha Municipal Code as heretofore existing is
hereby repealed.
Section 3. This Ordinance,not being of legislative character,and in accordance with Section
2.12 of the Home Rule Charter of the City of Omaha, shall be in full force and take effect
immediately upon the date of its passage.
