Honorable President and Members of the City Council,
Attached for your approval is an ordinance that will delete several unused and
obsolete sections of the Omaha Municipal Code in chapters 19 and 30. The
reason for the deletion of each section or article is as follows i e .ci'� ,4e•

• Section 19-41 Business Sales. This section is not required for regulation
purposes and does not produce a significant source of revenue. This used to
be defined as going out of business sales, however the definition was
deleted. It was intended to delete this section as a part of the 1996 budget
process. It was determined that retailers have sales for many different
reasons and going out of business was just another excuse which did not
need to be regulated by the city.
• Section 19-45 Commercial sound trucks. This section is obsolete. We have
not issued a commercial sound truck permit in ten years. This type of
advertising is no longer used.
• Section 19-52 Food stores; meat markets. This section does not define any
fee and does not deal with anything regulated by the city.
• Section 19-68 Night soil wagons. This type of permit was obsolete 100 years
ago, as people no longer need their chamber pots emptied.
• Section 19-76 Refreshment trucks, mobile units, and stands. This section
covers an occupation which is a type of peddler and is covered in section
19-89. Therefore it is duplication and not required.
• Section 19-87 and Sections 19-271 thru 19-281 Telegraph companies.
These sections are all obsolete. There are no more telegraph companies
and we have received no revenue from this source in several years.
• Section 19-93 Weighmasters. The state of Nebraska now issues licenses for
this type of work so this is not required to be a part of the city ordinances.
• Sections 19-331 thru 19-351 Passport and Identification Shops. The fee for
this type of permit was dropped as a part of the 1996 budget process. We no
longer get any revenue from this source. Passport photos are regulated by
the Department of State and further regulation by the city is not required.
•
• Sections 30-151 thru 30-187 Auctions and Auctioneers. The fee for
auctioneers was deleted as part of the 1996 budget process. It was deleted
because it was not needed for regulation purposes and it did not generate
significant revenue. In light of the fact that we no longer charge a fee for this
type of permit these sections no longer serve a purpose.

The amount of the occupation tax levied and imposed against tcicgraph companies

same by tcicgraph from the city to persons and places within the state, but shall not include
any business done to or from points outside the state or any business done for the
government of the United States or any of its departments or agencies.
Section 7. That Section 19-92 of the Omaha Municipal Code, reading as follows, as
heretofore existing, is hereby repealed.

Bcforc the issuance of any permit as certified public wcighmastcr, or any renewal
thereof, the applicant shall pay to the director a fcc of$25.00 per year, $37.50 per year

All persons engaged in the business of providing identification documents shall
maintain a complete file in which shall be kept an exact duplicate of each and every piece
of identification issued to each and every person obtaining identification documents.

It shall be the duty of every provider of identification to maintain for examination,
upon demand,by the police chief,or some person under his or her direction, or any member
of the police department,the entire file required by section 19-333.
DIVISION 2. PERMIT
Sec. 19-341. Required.
It shall be unlawful for any person to engage in the business of providing
identification documents without first having obtained a permit from the permits and

Before any permit shall be issued under the provisions of this article, the applicant
therefor shall file with the city a bond in the amount of$25,000.00 with one surety to be
approved by the law department, conditioned upon the due observance of the provisions of
this article and any other applicable provisions of law, and assuring that such auctioneer will
promptly-par over to the proper party entitled thereto all moneys and proceeds derived from
sales made at auctions by such auctioneer, less his reasonable expenses and commissions,
and further conditioned for the payment to any person of any damages said person may suffer
by reason of any false statement or misrepresentations made by such auctioneer.
Sec. 30 156. Issuance of permit.
The city clerk shall issue the permit required by the provisions of this article upon

Each permit issued under the provisions of this article shall set forth the name of the
permittee, his place of business and the period for which such permit is i3sued.

his business;provided,however,that in such event the permittec shall be liable for any and
all acts performed by such assistant in the same manner as if he himself conducted such

No auctioneer, in making sales, shall use any means of attraction by crier, drum, fife,
