Transmitted herewith is a Resolution approving an Agreement with the Federal Emergency
Management Agency (FEMA) to buy privately owned homes and trailers, relocate the people in
them, and remove the homes or trailers from the area designated as the Weir Crest Neighborhood
Floodplain. The area of Phase I is generally between 61st and 62nd Streets and north of"Q" Street.
The homes and trailers in this area have been repeatedly flooded when the nearby Papio Creek
reaches high water levels.
FEMA will provide 75%of the funds to be used under a Federal Disaster Declaration. The Papio-
Missouri River Natural Resources District(NRD) and the City have an Interlocal Agreement which
was adopted by Resolution No. 1725 on June 23, 1998 to share the remaining local share of the cost
equally at 121/2% each.
The entire cost of Phase I of the project is estimated to be$1,635,250.00. The portion to be paid by
FEMA is$1,226,438.00. The portion to be paid by the NRD is $204,406.00. The portion to be paid
by the City is $204,406.00.
The portion to be paid by the City, in the amount of$204,406.00, is to be paid from the 1993 Storm
Sewer Bond Organization 1510, Fund 343.
The Public Works Department requests your consideration and approval of the attached Resolution.

STATE - LOCAL CONTRACTUAL AGREEMENT
HAZARD MITIGATION GRANT PROGRAM
This agreement between the State of Nebraska (STATE) and City of Omaha Public Works
Department (Applicant) shall apply for all assistance funds provided by or
through the State to the Applicant as a result of the Federal Disaster Declaration ( 1027).
The Federal funds provided by the Federal Emergency Management Agency (FEMA)
shall be $ 1,226,438. The State contribution shall be $ 0 and the applicant
contribution shall be $ 408,812.
1 The following assurances extracted from Standard Form 424 D (4-88)
prescribed by OMB Circular A-102 may or may not be applicable to this hazard
mitigation grant. The Disaster Assistance Officer of the Nebraska Emergency
Management Agency should be contacted in the event of any applicability
questions. As the duly authorized representative of the applicant I certify that
the applicant:
a. Has the legal authority to apply for Federal assistance, and the institutional,
managerial and financial capability (including funds sufficient to pay the
non-Federal share of project costs) to ensure proper planning,
management and completion of the project described in this application.
b. Will give the awarding agency, the Comptroller General of the United
States, and if appropriate the State, through any authorized representative,
access to and the right to examine all records, books, papers, or
documents related to the assistance; and will establish a proper accounting
system in accordance with generally accepted accounting standards or
agency directives.
c. Will not dispose of, modify the use of, or change the terms of the real
property title, or other interest in the site and facilities without permission
and instructions from the awarding agency. Will record the Federal interest
in the title of real property in accordance with awarding agency directives
and will include a covenant in the title of real property acquired in whole in
part with Federal assistance funds to assure nondiscrimination during the
useful life of the project.
d. Will comply with the requirements of the assistance awarding agency with
regard to the drafting, review and approval of construction plans and
specifications.
e. Will provide and maintain competent and adequate engineering supervision
at the construction site to ensure that the complete work conforms with the

k. Will comply, or has already complied, with the requirements of Titles II and
III of the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970 (P.L. 91-646) which provides for fair and equitable
treatment of persons displaced or whose property is acquired as a result of
Federal and federally assisted programs. These requirements apply to all
interests in real property acquired for project purposes regardless of
Federal participation in the purchases.
I. Will comply with the provisions of the Hatch Act (5 U.S.C. Para. 1501-1508
and 7324-7328 which limit the political activities of employees whose
principal employment activities are funded in whole or in part with Federal
funds. .
m. Will comply, as applicable, with the provisions of the Davis-Bacon Act (40
U.S.C. Para. 276a to 276a-7), the Copeland Act (40 U.S.C. Para. 276c and
18 U.S.C. Para. 874), the Contract Work Hours and Safety Standards Act
(40 U.S. Para. 327-333) regarding labor standards for federally assisted
construction subagreements.
n. Will comply with the flood insurance purchase requirements of Section
102(a) of the Flood Disaster Protection Act of 1973 (P.L. 93-234) which
requires recipients in a special flood hazard area to participate in the
program and to purchase flood insurance if the total cost of insurable
construction and acquisition is $10,000 or more.
o. Will comply with environmental standards which may be prescribed
pursuant to the following: (a) institution of environmental quality control
measures under the National Environmental Policy Act of 1969 (P.L. 91-
190 and Executive Order (EO) 11514; (b) Environmental Policy Act of
1969 (P.L. 91-190) and Executive Order (EO) 11514; (b) notification of
violating facilities pursuant to EO 11990; (d) evaluation of flood hazards in
floodplains in accordance with EO 11988; (e) assurance of project
consistency with the approved State management program developed
under the Coastal Zone Management Act of 1972 (16 U.S.C. Para. 1451 et
seq.); (f) conformity of Federal actions to State (Clean Air) Implementation
Plans under Section 176(c) of the Clean Air Act of 1955, as amended (42
U.S.C. Para. 7401 et seq.); (g) protection of underground sources of
drinking water under the Safe Drinking Water Act of 1974, as amended,
(P.L. 93-523); and (h) protection of endangered species under the
Endangered Species Act of 1973, as amended, (P.L. 93-205).
p. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Para.
1271 et seq ) related to protecting components or potential components of
the national wild and scenic rivers system.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,the area between 61st and 62nd Streets and north of"Q" Street has been

WHEREAS, the Federal Emergency Management Agency(FLMA)has declared the
Weir Crest Neighborhood Floodplain area to be in a Federal Disaster area and will provide 75% of
the cost to purchase the houses and trailers, relocate the people in them, and remove the homes or
trailers from the area; and,
WHEREAS,the City and the Papio-Missouri River Natural Resources District(NRD)
have an Interlocal Agreement which was adopted by Resolution No. 1725 on June 23, 1998 to share
equally the remaining local share with each paying 121 % of the total cost; and,
WHEREAS,the City's cost for the project is estimated to be$204,406.00 which will
be paid from the 1993 Storm Sewer Bond Organization 1510,Fund 343.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Agreement between the City and the Federal Emergency Management
Agency to buy private homes in the Weir Crest Neighborhood Floodplain and relocate the people
in them is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay $204,406.00 from the 1993
Storm Sewer Bond Organization 1510, Fund 343.
