Transmitted herewith is a Resolution approving Supplemental Agreement No. 2 to the Engineering
Services Agreement with HDR Engineering,Inc.,for the final design of the replacement of the 10th
Street viaduct south of Jackson Street. The original Agreement was adopted by the City Council by
Resolution No. 824 on March 26, 1996. Supplemental Agreement No. 1 was adopted by Resolution
No. 358 on February 3, 1998.
This supplement includes the final design of the viaduct. The original agreement and first
supplement concerned the preliminary design of the viaduct. The prior agreements with HDR are
unchanged except where specifically modified by Supplemental Agreement No. 2. Details of the
changes are included in Exhibit "A" to the Supplement.
HDR Engineering, Inc., has agreed to perform the additional services detailed in the attached
agreement for a fee of$636,723.00. The total contract amount would increase from $274,982.00
approved previously to the$911,705.00 listed in the Supplemental Agreement. The additional funds
are payable from the 1993 Street& Highway Bond#5, Organization 1509, Fund 335.
HDR Engineering, Inc.,has filed the required Annual Contract compliance Report Form, CC-1, in
the Human Relations Department. As is City policy,the Human Relations Director will review the
consulting firm to determine its compliance with Ordinance 28885.
The Public Works Department requests your consideration and approval of the attached Resolution
and Supplemental Agreement No. 2.

THIS SUPPLEMENTAL AGREEMENT, made and entered into this 3--,

through its Mayor and City Council, hereinafter referred to as the "City", and HDR
ENGINEEIRNG, INC. a corporation of the State of Nebraska, hereinafter referred to as
the "Consultant".
WITNESSETH:
WHEREAS, the City and Consultant are parties to an agreement dated the
twenty-sixth day of March, nineteen ninety six and supplemented on the fifth day of
February, nineteen ninety eight for the preliminary design of improvements of the 10th
Street Viaduct, Pacific to Jackson Street, hereinafter referred to as the "Original
Agreement", and
WHEREAS, it is necessary that Final Design efforts not included in the Original
Agreement be added under this Supplemental Agreement, and
WHEREAS, it is necessary to increase the Consultant's compensation by this
Supplemental Agreement for the additional work necessary to complete the project,
NOW, THEREFORE, in consideration of these facts, the parties hereto agree as
follows:

I. GENERAL TERMS OF AGREEMENT. All terms and conditions contained in the
Original Agreement between the parties shall be binding to both parties with the
exception of the amendments contained hereinafter.
II. GENERAL DESCRIPTION OF SUPPLEMENTAL SCOPE AND CONTROL OF
WORK. The Consultant, will perform additional services for Final Design stipulated in
the attached Exhibit "A", Scope of Services and Fee Summary, hereby made a part of
this Supplement Agreement.
Ill. TIME OF BEGINNING AND COMPLETION. The Consultant will complete all
services stipulated in the Original Agreement and this Supplemental Agreement by
March 29, 2000. The time for completion shall be equitably adjusted for delays not the
fault of Consultant.
Delays grossly affecting the completion of the work within the time specified for
completion attributable to or caused by the Consultant or the City shall be considered as
cause for termination of this agreement by the other.
It is hereby mutually agreed that the City has continuing rights to work progress
inspections and any and all additions, deletions, changes, elaborations or modifications
of the services to be performed under the terms of this agreement which may from time
to time be determined by the City as desirable or preferable, shall be controlling and
governing.
IV. FEES AND PAYMENTS. For the work required, the Original Agreement plus
Supplement No. 1 is amended and the limiting maximum costs, including all
subconsultant costs is increased from $253,700 to $830,120, an increase of$576,420.
The fixed fee is increased from $21,282 to $81,585 an increase of$60,303. The total
contract amount is increased from $274,982 to $911,705, an increase of$636,723
which the Consultant must not exceed without the prior written approval of the City.

The Consultant will be paid the additional fee on the same terms stipulated in the
Original Agreement and, except as specifically amended by this Supplemental
Agreement, all terms and conditions or the Original Agreement remain in full force and
effect. The contract amounts previously listed in this Supplemental Agreement do
include an increase in the allowable indirect additives from the Original Agreement.
The indirect additives multiplier is increased from 1.55 times direct salary costs to
1.6292 times direct salary costs for labor added under this Supplemental Agreement.
IN WITNESS WHEREOF, the Consultant and the City have caused these
presents to be executed by their proper officials thereunto duly authorized as of the

SCOPE OF WORK FOR PHASE II—FINAL DESIGN
10TH STREET VIADUCT
BETWEEN MASON AND JACKSON STREET
DESCRIPTION OF SERVICES
Phase II services provide for miscellaneous pick-up survey, geotechnical consultation
during final design, an asbestos abatement plan for one affected property, final roadway
design,preparation of legal descriptions for right-of-way acquisitions, final bridge
design, final design of retaining walls, miscellaneous structure design, final roadway
lighting design,preparation of special provisions, a summary of pay quantities and a
statement of probable costs for the 10th Street Viaduct in Omaha Nebraska. Limits of the
project are from approximately 59 meters south of Mason Street to 47 meters north of
Jackson Street and also include a new driveway into the Union Pacific Railroad(UPRR)
intermodal site at 9th and Leavenworth Street. Work will be completed in accordance
with the requirements of the City of Omaha, the Nebraska Department of Roads and the
Federal Highway Administration. Payment items and specifications shall be in
accordance with the 1997 Nebraska Department of Roads Standard Specifications for
Highway Construction, metric units edition. Final design services are based on the
Preliminary Design Report for this project dated March, 1998 modified as follows:
• As part of the final design, a vehicular ramp between the upper and lower
levels of the Western Heritage Museum parking structure shall be included.
This ramp will run the length of the parking deck along the north edge of the
deck but will not directly connect to the loth Street Viaduct.
• The plaza area in front(west) of the entrance to the Western Heritage
Museum will be downsized from what is depicted in the Preliminary Design
Report since the Museum no longer needs vehicular drop-off on this plaza.
Consideration will be given to providing adequate room for a future trolley
stop at this location.
DRAFTING AND PLAN REQUIREMENTS
Final plans, quantities and specifications shall be prepared utilizing metric units
throughout. Details and notes will be properly spaced and shall utilize a lettering size to
allow clarity to be maintained upon reduction to half sized plans. Plans shall be prepared
on 610 mm x 914 mm sheets. The margin on the right side shall measure 17 mm,top and
bottom will measure 42.5 mm and the left side (binding edge) shall measure 107 mm.
The border lines shall measure 525 mm x 790 mm. Paper stock for plan sheets shall be
vellum or white bond capable of producing an acceptable reproduction.
Roadway plan and profile sheets shall be prepared at a scale of 1:500 horizontal and
1:100 vertical. Separate large-scale plan sheets will be provided at 1:200 scale as
necessary to properly depict all aspects of the roadway design. Drafting of the various
removals, construction items, geometrics, utility revisions, etc. shall be in tabular form
conforming to the method used by the Nebraska Department of Roads (NDOR). All

drafting on the plan sheets will be done using Micro Station CADD using standard
symbols and procedures of the NDOR. The roadway cross sections and storm sewer
profiles will be CADD plots on paper at a scale of 1:100 horizontally and vertically.

FINAL DESIGN SCOPE AND ASSUMPTIONS
Tasks
1. Project Management
This task includes activities to initiate and monitor project schedules, manpower
assignments and internal cost controls throughout this phase of the project. Also included
are efforts to prepare and process invoices and monthly progress reports; monitor
subconsultant activities; and prepare project correspondence with the City of Omaha, the
Nebraska Department of Roads as well as affected railroads, utilities and adjoining
property owners. This project management task is based on an expected duration for
final design of nine months.
2. Meetings
Due to the anticipated compressed schedule required for final design in order to
accomplish a late summer, 1999 letting, it is assumed that progress meetings will be held
with the Omaha Public Works Department every six weeks to keep the project on
schedule and identify critical items requiring action. For a nine month design schedule,
this translates into six progress meetings. Assume three HDR staff attending each
meeting for a three hour duration. Also, assume 1 hour of Project Manager and one hour
of Steno time to document each meeting.
In addition to the progress review meetings, assume the following meetings at four hours
of Project Manager,three hours of Design Engineer and one hour of Steno time: two
coordination meetings for project lighting,two utility coordination meetings, one railroad
meeting and four meetings with adjoining property owners (Stork Club, Burlington
Depot, Burlington Mail Terminal building and Western Heritage Museum).
3. Data Collection, Coordination, Quality Control Reviews & Final Revisions
This task includes the assembly and review of data for final design; the integration of
supplemental survey; day-to day coordination with the City, utilities, and survey
subconsultant on roadway and right of way issues; and quality control reviews on
roadway and bridge plans. An allowance of 88 man-hours has also been provided for
revisions to plans following the Final Submittal.
4. Roadway Design and Plans
Included in this task are horizontal and vertical alignment design, geometric design,
roadway templating, drainage design, and identification of limits of construction. Plan
sheets to be developed consist of typical sections, aerial photo (2A),plan and profiles,
geometrics,joints, and elevations, storm sewer profiles, and cross sections.

5. Construction Phasing, Traffic Engineering, and Special Plans
This task consists of developing a construction phasing plan and associated maintenance
of traffic signing, striping, and barricading, drafting the permanent signing and pavement
markings to be engineered by the City, and developing required special plans. Phase
construction of the 10th Street Viaduct may also be required to reestablish north access to
the Western Heritage Museum by the holiday season at the end of the first year of
construction. Engineering and sheet development of retaining wall plans and bridge
approach slab details are included in the structural engineering tasks.
6. Construction and Removals, Quantities, and Special Provisions
Development of construction and removal sheets, quantities and estimates, funding
category breakouts, and roadway special provisions are involved in this task. Also
included is preparation of an AutoCAD format CADD file submittal as requested by the
City.
7. Lighting Design
Lighting design for the project will consist of determining pole and luminaire locations
along 10th Street between Mason and Jackson Streets and along the at-grade freight
access ramp from 9th & Leavenworth Streets. Design for security lighting at the stairs to
the viaduct at 10th and Leavenworth will also be provided. It is assumed that the City
will provide lighting criteria defining illumination levels and light source types. At the
65% submittal,pole and luminaire locations will be shown along with illumination levels
based on the agreed upon light source types. It is anticipated that the City will coordinate
all comments from the 65% submittal so that the following items can then be provided at
the final submittal without further review: a schedule of materials; conduit/conductor
routing diagrams; control schematics; connection diagrams; temporary lighting
requirements (if needed); details for pull boxes, control panels and conduit embedment;
special provisions and a construction cost estimate.
8. Final Bridge Design— 10th Street Viaduct
This task includes design, design checking,plan preparation, quantities, quantity checks
and preparation of special provisions for the 10th Street Viaduct between Mason and
Jackson Street. Deliverables include a 65% submittal to the City of Omaha(three sets of
full size plans), a 90% submittal to the City and the Nebraska Department of Roads (four
sets of full size plans to NDOR and three sets of full size plans to the City) and a final
plan submittal. Copies of design and quantity calculations as well as design and quantity
check calculations will accompany the final submittal. For nonstandard items not
covered by the NDOR standard specifications, special provisions will be prepared. The
final submittal will also include bridge input for the construction cost estimate. Assume
that four sets of the final bridge plans would also be sent to both railroads for approval.

9. Final Bridge Design—Western Heritage Museum Garage Ramp
This task includes preparation of design plans for a structural ramp connecting the upper
and lower levels of the Western Heritage Museum Parking Garage. Since this effort is an
additional task to the project since the Preliminary Design Report, it will also include a
preliminary layout design for review by the City of Omaha and the Western Heritage
Museum. This preliminary layout will be provided with the 65%roadway field check
plans. Upon approval of the preliminary layout by the City and Western Heritage
Museum, design, design checking, quantities, quantity checking and any applicable
special provisions will be prepared for the structure. A 90% submittal (four sets of full
size prints to NDOR and three sets to the City) and final design submittal are also
assumed. The final submittal will also include copies of design and design check
calculations along with quantity and quantity check calculations. It is assumed that
design will be in accordance with the Uniform Building Code requirements for parking
structures as opposed to AASHTO bridge requirements and that height restriction barriers
will be utilized to limit traffic to passenger vehicles.
10. Structural Design—Ancillary Structures
This effort will include structural design of the various ancillary structures involved on
the project. These structures include the stair tower to the viaduct at 10th and
Leavenworth Street, modifications to the Burlington Mail Terminal Building at 1002
Mason Street, the plaza area in front of the Western Heritage Museum, the four
pedestrian accesses to buildings adjoining the viaduct(Butternut Building, Ford Storage
West, and two entrances at Ford Storage East), underpinning of the Burlington Depot
Plaza at the existing south bridge abutment and the addition of stairs and/or a handicap
accessible ramp in front of the Burlington Depot. It is assumed that the design of the
stairs/ramp at the Burlington Depot will also include some manhours from our
architectural staff to integrate these additions into the existing architecture of the Depot.
11. Retaining Wall Design
Cast-in-place (CIP) retaining walls are anticipated at the following locations:
• In front of the Stork Club (formerly the Neon Goose Restaurant),
• In front of the old Burlington Depot,
• At each wing of the north abutment,
• At the northeast wing of the proposed parking garage ramp.
In addition the south abutment would be founded on an MSE retaining wall.
This design effort would include preparation of layout plans for all CIP and MSE walls
and design of CIP walls. Provision is also allowed for accommodating the specialized
lightweight backfill required at the walls near the south abutment.

12. Asbestos Abatement Plan
This task includes preparation of special provisions for removal of asbestos material prior
to demolition of a building under the 10th Street Viaduct that joins the buildings at 1003
Jones Street and 901 Jones Street. Our subconsultant, AMI Group, will prepare the
asbestos abatement plan.
13. Geotechnical Consultation
Woodward Clyde Consultants (WCC)will provide consultation on geotechnical issues
during final design. WCC will provide final pile tip elevations, provide foundation
recommendations for the proposed parking garage ramp, provide consultation on
lightweight backfill design, and develop special provisions or plan notes as needed for
vibration assessment/monitoring during pile driving and for monitoring of petroleum
fumes during footing excavation.
14. Supplemental Survey
Supplemental survey will be required at several locations and this effort will provided by
be our subconsultant, Ehrhart Griffin and Associates (EGA). The supplemental survey
includes additional topo at the intersection of 10th and Jackson Streets, additional topo at
the location of the proposed parking garage ramp, ties and finished floor elevations at the
Burlington Mail Terminal Building and the Pullman Hotel and additional utility
locations.
15. Right-of-Way Design
EGA will also provide services for right-of-way design associated with the final design
effort. EGA shall prepare surveyor's certificates and individual tract maps for each
property to be purchased. The right-of-way strip map (Exhibit A)will be updated as
required for final design. Legal descriptions for permanent and temporary easements
shall also be prepared.
Design Process and Deliverables
Roadway plans will be developed to an approximate 65 percent completion stage,
including final grade lines, templated cross sections, construction notes, and limits of
construction, and three full-size plan sets submitted to the City for a design field review.
All reviewing agencies will participate in the field review.
Following design field review, the consultant shall complete the final design and submit
three copies of full size drawings to the City of Omaha and four copies of full size
drawings to the State of Nebraska Department of Roads for final review.

Provide the following deliverables upon completion of plans:
• One set of CADD plots of the bridge and roadway plans, including cross sections on
white bond or vellum paper. One electronic copy of the plans in AutoCAD format on
diskettes or CD-ROM.
• One set of quantity calculations to be completed on forms furnished by the Nebraska
Department of Roads.
• Special provisions for nonstandard items not covered by the standard specifications.
• One copy of structural design and quantity calculations and check calculations.
• Estimate of construction cost for the project based on unit prices for similar types of
construction.
The construction cost estimate shall include break-outs for the various funding categories
as well as the percent split for the two participating railroads.
Assumptions and Understandings
It is assumed that no further adjustments of the proposed profile for 10th Street will
be required in final design.
It is assumed that a ramp to the former Burlington Depot will not be included in the
project.
At the time of preparing this proposal, no decision had been made concerning the
inclusion of connecting hallways under the viaduct for properties located on each side of
the viaduct. In particular,this applies to a connecting hallway between Abbott Archives
and the Western Heritage Museum and between 1003 Jones Street and 901 Jones Street.
As such, no provision has been included in this proposal for design of these hallways.
Rail details required for the proposed 10th Street trolley will be included, but are to be
isolated from other plans and details as much as possible. Details will include provisions
for both bridge mounting and conventional ground installation of trolley rails. Details for
trolley stops and catenary power lines are not included in the scope for this project,
however it will be necessary that catenary loading be provided in order to design
anchorages for light poles and any other supplemental supports for the catenary lines on
the bridge. The bridge design will also accommodate the anticipated weights and loads
of the trolley stop structure and loading ramp.
Coordination with a special consultant hired separately by the City for visual treatment of
the retaining wall at the Stork Club Restaurant site may be required.
The final design will be coordinated with utility companies that may be affected. Utility
relocations, if necessary, will be done by the various utilities and will be depicted in the
plans. Proposed improvements and relocation of existing utilities will be limited to the
City storm and combined sewers that have to be relocated or adjusted due to the proposed
construction. Known elevations of existing gas, water,underground electrical, telephone
and fiber optics lines will be shown on the plans from potholes or soundings of each

respective utility line. It is currently assumed that there will be no bridge mounted
utilities attached for the length of the bridge other than bridge lighting and traffic signal
interconnect conduit which would be located within the bridge rail. Attachments,
hangers or bridge mounted pull boxes for under-bridge utilities have not been included in
this scope since any design costs required would be billed back to the utilities.
This proposal includes provision for survey effort to locate potholed utilities. However,
it is assumed that the City will contract separately for a contractor to perform the actual
excavation at the pothole locations.
One set of plans will be sent to all utility companies that have facilities within the limits
of construction. Each utility company will be requested to provide a schedule of the
work anticipated for their facilities, the estimated working days for all items of work, and
the estimated costs that are considered to be reimbursable for evaluation by the City of
Omaha. The relocation schedules and requests for reimbursement shall conform to the "
Utility Rehabilitation on Federal Aid Urban Systems Projects" and PPM 30-4 "Utility
Relocations and Adjustments".
For lighting design, it is anticipated that the 10th Street facility will be classified as a
major commercial thoroughfare requiring an average maintained pavement illumination
level of 1.2 foot candles with a max-to-min ratio of 3:1. The following items have not
been included in the estimate for lighting design: transitional lighting from city
intersections to the 10th Street Viaduct, supplemental under-bridge lighting, supplemental
lighting in the railroad yards, extra lighting at reconstructed business entrances,
demolition drawings for existing lighting systems or lighting on the ramp structure
between the upper and lower levels of the Western Heritage Museum parking garage. In
general, it is assumed that lighting design will be shown on the plans using a"soft
metric" conversion from standard English dimensions.
The design of traffic signal modifications at 10th and Jackson Street, permanent pavement
markings and signing will be performed by the City of Omaha on prints provided by the
consultant. The City will provide the consultant with red lines showing the final design
along with quantities, special provisions and an estimate of cost. The consultant will
draft the traffic signal modifications,pavement marking and signing plans from the plan

Maintenance of traffic during construction is assumed to be limited to the 10th and
Jackson Street intersection area and Leavenworth Street beneath the bridge. Traffic
control and barricading design will be performed by the City on prints provided by the
consultant. The City will provide the consultant with red lines showing final design
along with quantities, special provisions and estimate of cost. The consultant will draft
the traffic control and barricading from the plan sheets provided by the City and the plans
will be sealed by City personnel.

A right of way strip map (Exhibit A) and individual tract maps and legal descriptions for

all property to be acquired for additional right-of-way will be prepared by subconsultant
Ehrhart Griffin &Associates. Individual permanent and temporary easement legal
descriptions and tract maps for each affected tract will be prepared (see subconsultant
proposal).
Break-outs for the various funding categories will be prepared. Stationing, calculated
quantities and estimated costs for BRM funding, Federal Aid Urban System funding and
non-participating funding will be developed. Percent of work on Union Pacific Railroad
right of way and Burlington Northern Santa Fe Railroad right of way by group will be
determined and submitted.
The AutoCAD format CADD files to be submitted at project completion will not be
required to comply with level conventions established by the City of Omaha Public
Works Department.

This addendum addresses the final geotechnical design and engineering consultation for the
10th Street Viaduct Repl
acement in Omaha, Nebraska. This Addendum defines the scope of
our services and the associated fees.
The following work items have been identified by HDR:
•
Consultation on lightweight fill at the south abutment.
Recommended final pile tip elevations.
Plan review for geotechnical considerations.
Special provisions for vibration assessment and monitoring.
Plan notes or special provisions for monitoring petroleum fumes during footing
excavation.
Engineering recommendations for foundation design and site grading associated with new
access ramps between the upper an lower level of the existing Western Heritage Museum
parking deck.
We have not previously reviewed the preliminary plans for the viaduct.
SCOPE OF WORK
We propose to provide our services in the following manner:
1. We will consult with HDR and wall suppliers regarding the use of light weight
aggregates materials for the MSE wall at the south bridge abutment.
2. We will review available project plans and our geotechnical study to develop
final pile tip elevations.
3. We will review the preliminary bridge drawings and the final bridge drawings
for geotechnical.considerations.
- 4. -We will visit the site with a structural engineer toobs required condition

existing buildings an to evaluate the recommended extent of monitoring q
vibration issues. We expect that 8 buildings will require evaluation. We will analyze
potential vibrations for each building identified to determine the type of monitoring required.
We will consult with the structural engineer and will develop a vibration monitoring report.

5. We will review existing data and reports regarding the petroleum contaminated
soils and will develop a removal and disposal strategy with HDR for review by the Nebraska
Department of Environmental Quality (NDEQ). We will prepare plan notes and special
provisions regarding the presence of hydrocarbon materials that may be encountered during
construction of the footings.
6. We will prepare a letter report addressing the design of foundations for the new
ramp serving the Western Heritage parking garage. We do not plan to make additional
borings for this work.

pick up improvements completed since the preliminary survey
and other areas of concern listed below.
a. The intersection on 10th and Jackson Street, including
the buildings and their entrances on three corners and
the parking lot on the forth corner. The limits of
additional survey shall be a minimum of 100 meters
north on :10th Street, and 100 meters east and west on
Jackson Street and 50 meters or the face of the
buildings on either side of the centerline. On 10th
Street to the south, pick up a minimum of 50 meters
east into the new parking lot and west to the face of
the new parking structure all the way back to the Ford
Storage Buildings .

A DTM of the ground elevations will be supplied for your use in
profiling and cross-sections . The hard copy drawing will be on
Mylar sheets 593 mm x 841 mm.
We are immediately available to start work on this .project and
- would expect to start promptly following receipt of your
acceptance of this proposal. -
We will bill you for services and reimbursable expenses monthly
and at the completion of the project . Prompt payment on .
Submitted invoices for professional services is required.
Invoices are due within 30 days or maximum interest rates,

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: •
WHEREAS, an Engineering Services Agreement with HDR Engineering-Inc., for
the preliminary design of a replacement of the 10th Street viaduct south of Jackson Street was
adopted by the City Council by Resolution No. 824 on March 26, 1996, and Supplement No. 1 was
adopted by Resolution No. 358 on February 3, 1998; and,
WHEREAS, the original agreement and first supplement concerned the preliminary
design of the viaduct, which has been finalized, and this supplement concerns the final design of the
viaduct; and,
WHEREAS, HDR Engineering, Inc., has agreed to perform the services listed in
Appendix "A"of the attached Supplemental Agreement No. 2,which by this reference is made a part
hereof, for a fee of$636,723.00 which will increase the total contract amount from the$274,982.00
previously approved to the $911,705.00 listed in Supplemental Agreement No. 2; and,
WHEREAS, the additional cost will be paid from the 1993 Street&Highway Bond
HR 3299-#5, Organization 1509, Fund 335.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Engineering Services Supplemental Agreement No. 2 with HDR
Engineering, Inc., for the final design of the replacement of the 10th Street viaduct south of Jackson
Street, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay an additional $636,723.00 for
these engineering services from the 1993 Street&Highway Bond HR 3299-#5, Organization 1509,
Fund 335.
