Since that time, delinquent interest has accrued to the aforementioned lien assessment amount. Because of a mix-up in communication between Reverend Hooks and the City as to what further investigation was going to be done relative to the assessment, the delinquent interest has accrued as a result of Reverend Hooks withholding payment of the lien amount, pending what he understood was to be further communication from the City on the matter. No such additional communication was anticipated by the City in response to Reverend Hooks' objections relative to the assessment. The resolution should read that the amount of delinquent interest owing would be waived in the amount that is appropriate as of date of passage of the resolution by the City Council, which is anticipated to be March 23, 1999. A copy of the original ordinance assessing Reverend Hooks' property is attached and should also be attached to the resolution waiving the delinquent interest. INFORMATION ATTACHED: YES X NO NONE AVAILABLE wk c: Councilmembers, City Clerk, Finance Director, Council Staff GCr C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebr 19 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, on March 19, 1996, the City Council adopted Ordinance No. 9894, which assessed sewer lateral repair costs against several properties including that belonging to the Rev. Robert T. Hooks and Aloyce J. Hooks located at 4116 North 41st Street; and, " WHEREAS, due to miscommunication between Rev. Hdoks and the City of Omaha as to what further investigation was going to be done relative to the assessment of such costs, delinquent interest has accrued due to the withholding of payments by Rev. Hooks pending what he understood was to be further communication from the City of Omaha on the matter; and, WHEREAS,the City was unaware of his expectation of some further communication concerning the appropriateness of such assessment and, in fact, no such further communication is to be made by the City; and, WHEREAS, it is appropriate to waive all interest that has accrued on delinquent payment up to the date of this Resolution. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, all interest up to and including the date hereof, accrued on any delinquent payments of the following described owner and property is hereby waived, said assessment having been levied in Ordinance No. 9894 of the City of Omaha, being Sewer Lateral Repair Group 95-2. The waiver hereby made is applicable to all interest on the delinquent payments on the following described property and ownership: VOLLMER PLACE 0329 0000 24 46 x 127 Robert T.
