Hal Daub,Mayor Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Subdivision Agreement between the City of Omaha and Rodney R.Kush and Kathleen J.Kush. This Subdivision Agreement covers the public improvement of Kush Plaza of Douglas County,Nebraska located Southeast of 72nd and "L" Streets. This Subdivision Agreement stipulates which public improvements will be built by the Subdivider in Kush Plaza. The entire cost of improvements made in this development will be paid by the Subdivider. The Subdivision Agreement will benefit the City of Omaha and the Subdivider in clarifying the responsibilities of the parties in building and maintaining the improvements in the subdivision. The Public Works Department requests your consideration and approval of the attached Resolution and Subdivision Agreement. KUSH and KATHLEEN J. KUSH, husband and wife (hereinafter referred to as "Subdivider"), and the CITY OF OMAHA (hereinafter referred to as "City"). WHEREAS, the Subdivider is the owner of proposed Lots One (1) through Five (5), inclusive, shown on the proposed plat attached hereto as Exhibit"A" (hereinafter referred to as "Property"); and WHEREAS, the Subdivider proposes to build private and public improvements on the Property; and WHEREAS, the Subdivider wishes to connect the sanitary sewer that will provide service to Lots Two (2) to Five (5), inclusive. to the sewer system of the City of Omaha; and WHEREAS, the Subdivider and City desire to agree on the method for the installation and allocation of expenses for Public Improvements (hereinafter defined) to be constructed in the Property. NOW, THEREFORE, in consideration of the above the following is agreed between the parties hereto: 1. Public and Private Improvements. The private improvements shall consist of and be limited to the construction and installation of the "Access Road," "Sanitary Sewer" and "Storm Sewer"generally depicted on Exhibit"B,"attached hereto and incorporated herein by reference ("Private Improvements"). All Private Improvements must receive the approval of the Public Works Department of the City prior to construction. The only public improvement is sidewalks along "L" Street ("Public Improvement"). 2. Water, Gas and Electrical Power. The Subdivider agrees to enter into an agreement with the Metropolitan Utilities District regarding all water and gas line extensions on the Property, and into an agreement with the Omaha Public Power District for power lines to be installed on the Property.. Copies of all agreements with the Metropolitan Utilities District and the Omaha Public Power District will be provided to the City within four (4) months from the date of this Agreement. 3. Installation of Private Improvements. The Subdivider agrees to commence the timely and orderly installation of the Private Improvements pursuant to Section 53-9 of the Omaha Municipal Code and shall have the improvements installed or adequate financial guarantees shall be provided to the City prior to recording of the final plat. 4. Payment for Private Improvements. The Subdivider shall pay the cost of all the Private Improvements, as well as all charges by the Metropolitan Utilities District for water and gas line installation and charges by the Omaha Public Power District for underground electrical service or overhead power installations. 5. Maintenance Obligation. The owner of Lot One (1) shall be responsible for the ongoing maintenance of the Private Improvements provided, however, so long as the Subdivider owns all of the lots comprising the Property, the Subdivider reserves the right to subject the Property to conditions, covenants and restrictions ("CC&R"). The CC&R will reserve unto the owner of Lot One(1) the obligation of maintenance of the Private Improvements on the Property but shall also create the procedure for the re-allocation of the costs of such maintenance among the various lots comprising the Property based upon pre- determined formulas. 6. Sidewalks. Sidewalks shall be installed by the Subdivider adjacent to Lots Three (3), Four (4), and Five (5) on the "L" Street frontage road when the applicable lot is developed or within three (3) years, whichever is sooner. 7. Right to Connect to City Sewer System. The City hereby acknowledges that it has given the Subdivider the right to connect the sanitary sewer system of the Property to the City sanitary sewer system, subject to obtaining proper permits and paying the regular and front footage fees. 8. Binding Effect. This Subdivision Agreement shall be binding upon the parties, their respective successors, and assigns'and shall run with the Property. Kush and Kathleen J. Kush propose to build a Subdivision, Kush Plaza, which will be located Southeast of 72nd and"L" Streets; and, WHEREAS,Rodney R.Kush and Kathleen J.Kush wish to connect to Omaha's sewer system, the system of sanitary sewers to be constructed by the Subdivider within the area to be developed; and, WHEREAS,Rodney R.Kush and Kathleen J.Kush will be responsible for on-going maintenance for the private improvements; and, WHEREAS,the parties wish to agree upon the manner in which public improvements will be built by Rodney R.Kush and Kathleen J. Kush and to clarify the responsibilities of the parties in building and maintaining the improvements in the subdivision;and, WHEREAS, a Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT,the Subdivision Agreement between the City of Omaha and Rodney R.Kush and Kathleen J. Kush,as recommended by the Mayor, providing for the public improvements and sewer connections to the Omaha sewer system,is hereby approved.
