The attached Resolution approves the Amendment to the Subdivision Agreement between Celebrity
Homes, the Wood Creek Towrihome Owners Association, Sanitary and Improvement District
(S.&I.D.) 385 of Douglas County,Nebraska and the City of Omaha. The Subdivision Agreement
was approved by the City Council on September 29, 1998,which provided public improvements for
Wood Creek Replat One, a subdivision located southeast of 180th and "F" Streets.
This Amendment to the Subdivision Agreement is for Wood Creek Replat Two, which is a replat
of part of Lot 33 of Wood Creek Replat One. The Amendment to the Subdivision Agreement shows
the changes in lot lines and revises the public improvement exhibits to reflect the replat and stipulate
which public improvements will be built by S.&I.D. 385, those which will be paid for by special
assessment and those to be paid by General Obligation of S.&I.D. 385. The estimated total cost of
improvements is $309,297.00 of which$40,983.00 will be paid by General Obligation. If S.&I.D.
385 is annexed by the City,any outstanding General Obligation Debt would be assumed by the City.
The Public Works Department requests your consideration and approval of the attached Resolution
and Amendment to the Subdivision Agreement.

AMENDMENT TO SUBDIVISION AGREEMENT
FOR"WOOD CREEK REPLAT TWO"
THIS AMENDMENT, made and entered into this 2244 of ,�.�1999, by and between CELEBRITY
HOMES (hereinafter referred to as "Subdivider"), SANITARY A D IMPROVEMENT DISTRICT NO. 385 of
DOUGLAS COUNTY, NEBRASKA, (hereinafter referred to as "SID"), the WOOD CREEK TOWNHOME OWNERS
ASSOCIATION (hereinafter referred to as the "Association"), and the CITY OF OMAHA, a Municipal Corporation in
the State of Nebraska(hereinafter referred to as"City").
WITNESSETH
WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit
"A",which parcel of land (hereinafter referred to as the"Area to be Developed") is outside the corporate limits of the
City within the City's zoning and platting jurisdiction;and,
WHEREAS, the area to be developed is a replat of part of Lot 33 of Wood Creek Replat One,.a platted and
recorded subdivision in Douglas County, Nebraska for which the Subdivider, the City, and the SID, have previously
entered into a Subdivision Agreement(hereinafter referred to as the"Agreement"), adopted by the City Council of the
City on December 23, 1997 (Wood Creek) and September 29, 1998 (Wood Creek Replat One) setting forth certain
conditions;and
WHEREAS,additional improvements are required to be constructed as shown on Exhibit"B", entitled "Paving
and Storm Sewer" and Exhibit"C"entitled "Sanitary Sewer". All provisions of the previous agreements are valid and
shall remain in effect for these additional improvements.
WHEREAS, all provisions of the original Agreement are valid and shall remain in effect except the following
paragraphs which are revised as follows:
Section IX, Paragraph A. The Subdivision Agreement is amended to provide for a reallocation on a pro rata basis in
the interceptor sewer fees paid by the SID, computed as follows:

:64 UNITS @$673.20 = $43,084.80
TOTAL REPLAT AMOUNT= $43,084.80
PREVIOUSLY PAID:

TOTAL PREVIOUSLY PAID= $85,536.00
TOTAL CREDIT $42.451.20
Section X, paragraph"F.", is hereby added:
F. Outlot"A" and "B",Wood Creek Replat Two is a creek or natural drainage channel and shall be designated as a
sewer, drainage and channel way. Public maintenance in this area shall be limited to cleaning obstacles from the
channel. All lawn, other vegetation, mowing and maintenance shall be the responsibility and expense of the
adjacent property owner. As a natural drainage way, the channel may meander out of the boundaries of Outlots
"A"and"B". The public has no responsibility to prevent such meandering.

This.Amendment to the Subdivision Agreement shall be binding upon the parties, their respective successors and
• u assigns and shall run with the land as shown on Exhibit"A".

Agreement,effective on the day and year first above written.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Celebrity Homes proposes to build a subdivision to be known as Wood
Creek Replat Two which will be located Southeast of 180th and "F" Streets; and,
WHEREAS, Sanitary and Improvement District (S.&I.D.) 385 will build public
improvements in this subdivision; and,
WHEREAS, Celebrity Homes and S.&I.D. 385 wish to construct a sanitary sewer
system and connect said system to the Sanitary Sewer System of the City of Omaha; and,
WHEREAS,Celebrity Homes has or will create the Wood Creek Townhome Owners
Association to provide identified ongoing maintenance for the outlots; and,
WHEREAS,the parties wish to agree upon the manner and the extent to which public
funds may be expended in connection with public improvements to be constructed within the area
to be developed or serving the area to be developed and the extent to which the contemplated public
improvements specifically benefit property in the area to be developed and to what extent the cost
of the same shall be specially assessed; and,
WHEREAS, Wood Creek Replat Two is a replat of a portion of Lot 33 of Wood
Creek Replat One; and,
WHEREAS,the City Council approved the Subdivision Agreement for Wood Creek
Replat One on September 29, 1998; and,
WHEREAS, S.&I.D. 385 is due a refund of$42,451.20 from the Papillion Creek
Interceptor Fund because of the downzoning; and,
WHEREAS,an Amendment to the Subdivision Agreement has been prepared setting
forth all the provisions mentioned above.
