Honorable President
and Members of the City Council,
The attached Resolution approves the purchase of Lots 1 and 175 in Brookhaven West by
Brookhaven West Sanitary Improvement District#435. These lots will be used as a public park.
The Resolution also authorizes this SID to expend $21,370.40, which includes soft costs, for this
purchase.
By previous action, the City Council approved acquisition of this property as a public park.
The attached Resolution also authorizes Sanitary Improvement District,No. 435, Brookhaven West,
and Sanitary Improvement District No. 436,I-80 Business Park to expend, for park improvements,
- ,on land located in SID No. 435 and SID No. 294, Brookhaven, an amount not to exceed
$398,398.00, including soft costs, and to accept the bid of Swain Construction Inc. to provide these
improvements. Approval will result in park construction generally consisting of earthwork,a 10 foot
wide concrete trail, a pedestrian bridge, construction of soccer fields and a play structure, drainage
improvements, fencing, landscape plantings and seeding.
Approval of this resolution provides the park facilities and amenities as illustrated in the park's
master plan.
The purchase and improvements for these parks areas were authorized by the Park and Recreation
Advisory Board at the August 1998 and the December 7, 1998 meetings in an amount not to exceed
$21,370.40 for the purchase and $405,000.00 for the improvements. These improvements
correspond to the low base bid received which, including soft costs,total $398,398.00.
This coordinated effort, involving SID#435, SID#436 and SID#294 will result in the development
of park facilities which will serve residents and property owners in all the contributing Sanitary
Improvement Districts. A prior Intergovernmental Agreement between these Sanitary Improvement
Districts exists authorizing this joint project.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Sanitary and Improvement District No.435,Brookhaven West, desires
to purchase Lots 1 and 175 in Brookhaven West to be utilized for park and recreation purposes; and,
WHEREAS, SID No. 435's expenditure for these lots will be $21,370.40 which -
includes softcosts; and,
WHEREAS,this expenditure was authorized by the Parks and Recreation Advisory
Board at their August, 1998, meeting; and,
WHEREAS, by previous action, the City Council approved acquisition of this
property as a public park; and,
WHEREAS, approval of this resolution provides the park facilities and amenities as
illustrated in the park's master plan; and,
WHEREAS, also, SID No. 435 and SID 436, 1-80 Business Park, desire to expend,
for park improvements,an amount not to exceed$398,398.00,including soft costs and to accept the

WHEREAS,these park improvements will be constructed on park lots owned by SID
No.435,Brookhaven West and SID NO. 294,Brookhaven and,upon construction, all park facilities
will be available to the public and used by residents of SID No.435, SID No.436 and SID No. 294;
and,
WHEREAS,this expenditure was authorized by the Parks and Recreation Advisory
Board at their December 7, 1998, meeting; and,
WHEREAS,the Parks,Recreation and Public Property Department recommends that
the amount of$21,370.40 and $398,398 00 be approved; and,
WHEREAS, competitive bids were received by the District's Engineers; and,

OF OMAHA:
THAT, as recommended by the Mayor, park acquisition costs in the amount of
$21,370.40,including soft costs, to purchase Lots 1 and 175 in Brookhaven West by SID No. 435,
Brookhaven West and park improvement costs in the amount of $398,398.00 by SID No. 435,
Brookhaven West and SID No. 436,I-80 Business Park are hereby approved.
FURTHER THAT, these costs incurred by SID No. 435 and SID No. 436 for land
acquisition and park improvements are a 100%obligation of these Sanitary Improvement Districts.
