Attached for your consideration is a Resolution authorizing the acquisition of property located near
89th and Boyd Streets, as shown on the attached Exhibit"A" from Duane and Frances D. Dowd for
park land purposes. The value of the property, as well as the propriety of the taking by the City of
Omaha are disputed. Under this Resolution, payment for the property and any challenges as to the
value or the propriety of the taking would be settled upon a payment by the City of Omaha to Duane
and Frances D. Dowd, in the amount of$550,000.00.
Purchase of the property in this fashion is recommended by the Parks Department and Law
Department.
Your favorable consideration and passage of this Resolution is respectfully requested.

. WHEREAS,the Cityhas commenced acquisition procedures for property located near 1
89th and Boyd Streets in"Omaha,'.Nebraska; as shown on the attached Exhibit "A" owned by Duane " ,
and Frances Dowd, for park land purposes; and,
WHEREAS, the allegations of Duane and Frances Dowd and the contentions of the
City of Omaha constitute disputed claims as to the value of the property and propriety of the taking -
of this property; and,'•
WHEREAS,the circumstances of the questions of valuation and law suggest it would
be in the best interest of the City of Omaha and residents thereof to resolve this litigation by
settlement with the Duane and Frances Dowd.

NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
¶ OF OMAHA:

THAT,the Law Department of the City of Omaha conclude and settle the proceedings
to acquire the property, as shown on the attached Exhibit "A", and obtain a release from Duane and
Frances D. Dowd for all claims against the City related to the acquisition and use of the property,
in lawful manner by payment to Duane and Frances Dowd in the amount of$550,000.00; and,that
! the.Finance Department issue such a warrant as necessary, such funds to be paid from the Recreation
t and Culture Bond Fund#357 in the amount of$275,000 and Contingent Liability Reserve.Fund in
the amount of$275,000. . ;
