Transmitted herewith is a Resolution accepting the attached Negotiator's Report submitted by Tim
Phelan made in accordance with Necessity Ordinance No. 35011,passed August 24, 1999,declaring
the necessity of appropriating and acquiring certain private property for the purpose of widening
Dodge Street, 67th Street to 69th Street, known as City Project S.P. 92-2.
The Negotiator, Tim Phelan,was successful in acquiring two parcels of land or interest in property
required for the project for the total negotiated amount of$341,402.00. This amount includes the
Replacement Housing Relocation Benefit which is required by state and federal law.
The cost of two parcels of land or interest in property negotiated shall be paid from the Street and
Highway Bond Organization 1509, 1996 Street and Highway Bond Issue#1, Fund 341.
The Public Works Department requests your consideration and recommends your approval of this
Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Tim Phelan,Negotiator,has submitted to the City Council a Negotiator's
Report, attached, in accordance with Necessity Ordinance No. 35011, passed August 24, 1999,
declaring the necessity of appropriating and acquiring certain private property for the purpose of
widening Dodge Street, 67th Street to 69th Street; and,
WHEREAS, the report shows that the Negotiator, Tim Phelan, was successful in
negotiating and acquiring two parcels of land or interest in property required for the project.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Negotiator's Report of Tim Phelan made in accordance with Necessity
Ordinance No. 35011 be and hereby is approved.
THAT,the Finance Department is authorized to pay the cost of the negotiated parcels
of land or interest in property acquired and Replacement Housing Relocation Benefit in the amount
of$341,402.00 from the Street and Highway Bond Organization 1509, 1996 Street and Highway
Bond Issue#1, Fund 341.
