Transmitted herewith is a resolution accepting the attached agreement which was entered into
between the City of Omaha Public Works Department and Knudson Appraisal Services for the
provision of appraisal services as a result of the widening of 72nd Street between Jones Street
and Western Avenue. Further, the resolution authorizes the Finance Department to pay the
amount of $32,000 upon completion of the conditions of the agreement from the Street and
Highway Bond, Organization 1509, 1996 Street and Highway Bond Issue No. 1, Fund 341.
The Public Works Department requests your consideration and recommends your approval of
this resolution.

Dear Mr. Larson:
In accordance with your request, I am submitting a fee proposal for appraisal services in conjunction
with the above-captioned project. I have made a preliminary inspection of the properties for which
the City of Omaha requires appraisal services. My proposal involves preparing short form appraisal
reports on two properties and full "before and after"narrative reports on six properties.
My appraisal fee includes the research necessary to obtain proper comparable sales and to make land
value comparisons in order to estimate the value of the damages involved for land acquisitions and
temporary construction easements for the project. The appraisal reports will conform to the Uniform
Standards ofProfessional Appraisal Practice(USPAP)and the Standards ofProfessional Practice and
Code of Professional Ethics Promulgated by the Appraisal Institute.
The tract number, owner and/or occupant of the property, and type of report to be prepared, along
with the appraisal fees are as follows:

appraisal I will not exceed this fee of$32,000 unless additionalppal work is identified and a mutual s
agreement increase is authorized by you. I agree to furnish three copies of each of the individual tract
reports.
Supplemental appraisals and/or addendums to appraisals such as corrections to the original appraisals,
requiring a review and revamping of original facts caused by the City making a change or request by
the City for updating on appraisals, shall be paid for by an additional fee. Said fees in this paragraph
are to be in addition to the lump sum fee above specified and will not exceed 30%of the total fee for.
this appraisal proposal.
It is understood that payments for time spent on pre-condemnation work and time spent for the actual
date of condemnation hearing proceedings,including payments for time spent with conferences held
with City attorneys, consultation fees, court testimony, court hearing, court preparation, site
inspections, appraisal review, appraisal updates, and witness fees for appearances in court, shall be
paid on the basis of$110.00 per hour.
I will furnish the individual tract reports within 90 days after receiving written authorization to
proceed.
In addition, we mutually agree on the following:
1. Neither myself nor the City shall, in the performance of this agreement, discriminate or permit
discrimination against any person because of race, sex,age, or political or religious opinions, or
affiliations in violation of federal or state laws or local ordinances.
2. Pursuant to Section 8.05 of the Home Real Charter of the City of Omaha, no elected official or
any officer or employee of the City shall have a financial interest, direct or indirect, in the City
government. Violation of that Section with the knowledge of contracting party in addition to
constituting employee malfeasance, shall be cause for the City to unilaterally terminate or void
this agreement.
3. No amendments or additions to this agreement shall be made between the parties except in
writing.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, an agreement was entered into by the City of Omaha Public Works
Department and Knudson Appraisal Services on October 19, 1999, a copy of which agreement is
attached and made a part hereof; and,
WHEREAS, the City of Omaha is in the process of acquiring property for the
widening of 72nd Street between Jones Street and Western Avenue and is required by state and
federal regulation to complete appraisals and appraisal reviews on each tract which it is going to
acquire; and,
WHEREAS, Knudson Appraisal Services is an experienced appraisal company
which has agreed to prepare appraisals for each of the properties described in the attached
contracts; and,
WHEREAS, the City has agreed to make payment to Knudson Appraisal Services
in the amount of$32,000 upon completion of the appraisal work described in the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the agreement between the City of Omaha Public Works Department and
Knudson Appraisal Services is hereby approved and the Finance Department is to make payment
in the amount of$32,000 upon completion of the conditions of the attached agreement from the
Street and Highway Bond, Organization 1509, 1996 Street and Highway Bond Issue No. 1, Fund
341.
