Transmitted herewith is a Resolution approving an Engineering Agreement with HGM
Associates, Inc. for the preliminary and final design for the .improvement of 114tn
Street from Pacific Street to Burke Street. This project will change the existing 2-lane rural road
section to a three-lane urban street with stormwater drainage facilities. This project is part of the
1999-2004 Capital Improvements Program as Project No. 402 for transportation projects.
The attached Agreement authorizes HGM Associates, Inc. to prepare a preliminary design, a
final design, a cost estimate, and drawings and bidding documents. Details of the project are
included in Exhibit"A"to the Agreement.
HGM Associates, Inc. was selected by the Architectural/ Engineering Selection Committee for
this project. HGM has agreed to perform the engineering services detailed in the Agreement for
a fee of $187,632.29 for the preliminary design and an additional $167,070.00 for the final
design. The total sum for both phases is $354,702.29. This will be paid from the 1996 Street &
Highway Bond Organization 1509, Fund 341.
HGM Associates, Inc. has filed the required Annual Contract Compliance Report Form, CC-1, in
the Human Relations Department. The Human Relations Director will review the consulting
firm to determine its compliance with ordinance 28885.
The Public Works Department requests your consideration and approval of the attached
Resolution and Agreement.

ENGINEERING AGREEMENT
CITY OF OMAHA
PREPARATION OF PRELIMINARY ENGINEERING PLANS FOR
IMPROVEMENTS
OF THE 114TH STREET, PACIFIC STREET TO BURKE STREET
THIS AGREEMENT made and entered into this 9 T fZ. day of
Digra4 1999 by and between the firm of HGM Associates Inc. a corporation of
the State of Nebraska, with offices at 1104 Douglas Street, Omaha,Nebraska
68102-1839 and hereinafter referred to as the "Consultant", and the City of
Omaha, Nebraska, acting by and through its Mayor, hereinafter, referred to as the
"City".
WITNESSETH:
WHEREAS, the City desires to engage the Consultant to render
professional engineering services as hereinafter set forth for the necessary
engineering services as required for the preparation of preliminary and final plans
for improvements of the 114th STREET, PACIFIC STREET TO BURKE
STREET.
WHEREAS, the Consultant is willing to perform such engineering work
in accordance with the terms hereinafter provided and does represent that he is in
compliance with the Nebraska Statutes relating to the registration of Professional
Engineers.
NOW THEREFORE, in consideration of these facts, the parties hereto
agree as follows:
I. DEFINITIONS
Wherever in this agreement the following terms are used, or pronouns
used in their stead,they shall have the meaning here given:
The "EFFECTIVE DATE" of this agreement shall mean the date
mentioned in the first paragraph of this document.
"CONSULTANT" or"CONTRACTOR" shall mean HGM Associates
Inc., whose business and mailing address is 1104 Douglas Street, Omaha,
Nebraska 68102-1839.
"CITY" shall mean the City of Omaha,Nebraska, and the Mayor of the
City of Omaha or his authorized representative.
To "ABANDON"the work shall mean that a determination has been made
by the City that conditions or intentions as originally existed have changed and
that the work as contemplated herein is to be renounced and deserted for as long
in the future as can be foreseen.
To "SUSPEND" the work shall mean that it has been determined by the
City that conditions or intentions as originally existed have changed and that the
work as contemplated herein should be ceased on a temporary basis. This
cessation or holding in this undetermined state will prevail until such time as a
determination can be made to abandon the work or to reinstate under the
conditions as defined in this agreement.
To "TERMINATE"or the "TERMINATION" of this contract shall be the
cessation or quitting of this contract based upon action of failure of action on the
part of the Consultant as defined herein and as determined by the City.
II. GENERAL DESCRIPTION OF SCOPE AND CONTROL WORK
The Consultant shall, upon receipt of the Notice of Proceed from the City,
perform all the services required under this agreement for the project described
above and as outlined in the attached Exhibit"A", Schedule of Services,hereby
made a part of this agreement.
III. TIME OF BEGINNING AND COMPLETION
The Consultant shall begin work on the project upon receipt of written
"Notice to Proceed" from the City. The work on the project shall be completed
within 644 calendar days after receipt of the written Notice of Proceed. The time
for completion of the work shall be equitably adjusted for delays not the fault of
Consultant.
The City shall have 14 calendar days for review of preliminary plans and
studies.
Delays grossly affecting the completion of the work within the time
specified for completion attributable to or caused by the Consultant or the City
shall be considered as cause for termination of this agreement by the other.
It is hereby mutually agreed that the City has continuing rights to work
progress inspections and any and all additions, deletions, changes, elaboration's
or modifications of the services to be performed under the terms of this agreement
which may from time to time be determined by the City as desirable or preferable,
shall be controlling and governing.

IV. ABANDONMENT, CHANGE OF PLAN, SUSPENSION AND
TERMINATION
The City shall have the absolute right to abandon the project or to change
the general scope of work as defined in Section II, at any time. Such action on its
part shall in no event be deemed a breach of contract.
The right is reserved by the City to suspend this agreement at any time or
to terminate for just cause. Such suspension or termination may be effected by
giving the Consultant fifteen (15) days written notice. Should the project be
suspended for thirty (30) days or more, Consultant's Fee and time for completion
shall be equitably increased.
If the City abandons the work or subtract from the work as presently
outlined, the Consultant shall be compensated on the basis of the percentage
completion ratio of the net fee shown in Exhibit B, plus actual costs as defined in
Section VI. In determining the percentage of work completed, the City shall
consider the work performed by the Consultant to the total amount of work
contemplated by this agreement.
Additions to the scope of work as defined in Exhibit"A"will require
negotiation of a supplemental agreement or agreements. For any work beyond the
scope of services outlined by Exhibit "A", the Consultant will be required to
document the additional work, estimate the cost to complete said work and obtain
written approval from the City before such work begins.
V. OWNERSHIP OF ENGINEERING DOCUMENTS
All tracings, plans, maps, computations, sketches, charts, computer/digital
files and other data prepared or obtained under the terms of this Agreement shall
be delivered to and shall become the property of the City without restriction or
limitation as to its further use.
VI. FEES AND PAYMENTS
The cost of services for the Preliminary design, as detailed in the Scope of
Work, shall be performed for a lump sum amount of$187,632.29. Additional
services will be charged on an hourly basis in accordance with Provider's
standard hourly rate schedule. The express written consent of the City shall be
required for all additional services.
The cost of services for the Final Design, as detailed in the Scope of
Work, shall be performed for a lump sum amount of$167,070.00. Additional
services will be charged on an hourly basis in accordance with Provider's
standard hourly rate schedule. The express written consent of the City shall be
required for all additional services.
The Consultant shall submit monthly invoices, which shall be based on
actual costs incurred during the calendar month. The monthly payments shall be
based upon the satisfactory prosecution of the work and shall be substantiated by
monthly progress reports. The Consultant shall submit a final voucher for the
project no later than 30 days after the close of the Consultant's fiscal year during
which the project is completed.
The acceptance by the Consultant of the final payment shall constitute and
operate as a release to the City for all claims and any liability to the Consultant,
his representatives and assigns for any and all things done, furnished or relating to
the services rendered by the Consultant under or in connection with this
Agreement or any part thereof.
The Consultant shall maintain all books, documents,papers, accounting
records and other evidence pertaining to costs incurred and study activities and
shall make such materials available at his office at all reasonable times during the
contract period and for three (3) years from the date of final payment under this
Agreement; such records to be available for inspection by the City and copies
thereof shall be furnished by the Consultant, if required.
The Consultant shall be responsible to determine when his actual costs
shall exceed the anticipated costs for any work activity. In such event, the
Consultant must immediately notify the City in writing.
The Consultant shall also be responsible to identify when a change in the
work scope necessitates an increase in the maximum fee under this contract.
When the Consultant identifies that an increase is in order,he will be required to
estimate the additional costs necessary to complete the additional work, document
the reasons for this increase and receive prior approval from the City in writing
before expenditures beyond the maximum fee amount are incurred. The City shall
not be obligated to reimburse the Consultant for cost which have not been
approved in excess of the maximum fee amount.
VII. FORBIDDING USE OF OUTSIDE AGENTS
The Consultant warrants that he has not employed or retained any
company or person, other than bona fide employees working for the Consultant,
to solicit or secure this Agreement and that he has not paid or agreed to pay any
company or person, other than a bona fide employee any fee, commission,
percentage,brokerage fee, gift or any other consideration contingent upon or
resulting from the award of making of this Agreement. For breach or violation of
this warranty, the City shall have the right to deduct from the Agreement price or
consideration, or otherwise, recover the full amount of such fee, commission,
percentage, brokerage fee, gift or contingent fee.

VIII. RESPONSIBILITY FOR CLAIMS LIABILITY
The Consultant agrees to save harmless the City from all Claims and
Liability due to the negligent activities of himself, his agents or his employees. In
this connection, the Consultant will carry insurance in the following kinks and
amounts.
1. Comprehensive Auto $100,000 P.L. $50,000 P.D.
Liability
2. Comprehensive General $300,000 P.L. $50,000 P.D.
Liability
3. Workmen's Compensation Statutory
4. Professional Liability $1,000,000
The insurance specified above shall be maintained until the Consultant's
work has been completed and accepted by the City. The Consultant shall furnish
proof of insurance coverage, if requested by the City.
IX. NON-RAIDING CLAUSE
The Consultant shall not engage the services of any personnel or persons
presently in the employ of the City for work covered by this Agreement without
the written consent of the employer of such persons.
X. GENERAL COMPLIANCE WITH LAWS
The Consultant hereby agrees to comply with all Federal, State and Local
Laws and ordinances applicable to the work.
XI. PROFESSIONAL REGISTRATION AND SUBCONTRACTS
The Consultant hereby agrees to affix the seal of a registered professional
engineer license to practice in the State of Nebraska on all reports and plans
prepared hereunder except for those plans designed by the City.
The Consultant agrees to provide these professional services using staff
personnel with specialized skills, experience and professional qualifications. Any
work subcontracted other than that specifically provided by this Agreement shall
first have the written approval of the City.

XII. ORGANIZATION CHART
The Consultant shall furnish an organization chart of all key personnel
who will be involved in this project as outlined in this Agreement. Any deviations
or revisions in personnel as shown in the project organization chart shall be made
with people of equal ability and experience, in the opinion of the City, and failure
of the Consultant to provide capable replacements to the satisfaction of the City
shall be basis for termination of the Contract and the method of Contract
settlement shall be as outlined in Section IV. The project organization chart is as
shown in Exhibit "E"hereto, and made a part of this Agreement.
XIII. ARBITRATION
Any disputes between the City and the Consultant not disposed of by this
Agreement between the parties may be settled by arbitration as provided by
Section 25-2103 through 25-2120,Nebraska Reissue Revised Statutes of 1943.
XIV. FAIR EMPLOYMENT PRACTICES ACT
The Consultant agrees to abide by the provisions of the Nebraska Fair
Employment Act of 1965, R.R.S. 1943, 48-1101 through 48-1125.
XV. SUCCESSORS AND ASSIGNS
This Agreement shall be binding on successors and assigns of either party.
XVI. SUBLETTING, ASSIGNMENT OR TRANSFER
Subletting, assignment or transfer of all or part of the interest of the
consultant (except as provided) is hereby prohibited unless prior written consent
of the other parties is obtained therefore.
XVII. NONDISCRIMINATION
The Consultant shall not, in the performance of this Agreement,
discriminate or permit discrimination against any person because of race, sex, age,
or disability or political or religious opinions or affiliations in violation of federal
or state local ordinances.
XVIII. PROJECT SCHEDULE
Exhibit"F" attached hereto is incorporated herein as the proposed project
schedule.

XIX. UNEMPLOYMENT COMPENSATION FUND PAYMENTS
Before final payment is made by the City to the Consultant of the final
three percent (3%) due hereunder, the Consultant shall furnish the City a written
clearance from the Commissioner of Labor of the State of Nebraska certifying
that all payments due of contributions or interest which may have arisen under
this contract have been paid by the Consultant, or its subcontractor to the
Unemployment Compensation Fund of the State of Nebraska.
XX. CITY SUPERVISION
It is hereby mutually agreed that the City shall have responsibility
supervision of all the services include herein, but no employee of the Consultant's
direction is or shall be deemed to be an employee of the City. The Consultant
shall at all times have or cause to have in force Workers Compensation insurance
covering all its employees and those of any subcontractor and those of anyone
under its direction and control.
XXI. PAYMENT FOR SERVICES, MATERIALS AND EQUIPMENT
The Consultant agrees to pay all persons, firms or corporations, having
contracts directly with the Consultant or with subcontractors of Consultant, all
just claims due them for the payment of services, material and equipment
furnished and for the payment of material and equipment rental which is actually
used or rented in the performance of this contract.
XXII. ASSESSMENT FOR TAXATION
Consultant shall comply with, and shall cause to be complied with Section
77-1323, Reissue Revised Statutes of Nebraska, 1943, as amended and shall
furnish a certificate statement to be attached to the contract that all equipment to
be used on the project, except that acquired since the assessment date, has been
assessed for taxation for the current year, giving the County where assessed.
During the performance under this contract, additional such statement shall be
furnished by the Consultant as may be required by such law or as may be required
by the City or its authorized agent.
XXIII. AMENDMENTS OR ADDITIONS
No amendments or additions shall be made to this Agreement except in
writing. Future agreements between the parties must likewise be in writing.
XXIV. FINANCIAL INTEREST
Pursuant to Section 8.05 of the Home Rule Charter of the City of Omaha,
no elected official or any officer or employee of the City shall have a financial
interest, direct or indirect, in any City contract. A violation of that section with the
knowledge of the Consultant, in addition to constituting employee malfeasance,
shall be cause for the City to unilaterally terminate or void this Agreement.
XXV. INCREASE OF FEE
The parties hereto acknowledge that, as of the date of the execution of this
Agreement, Section 10-142 of the Omaha Municipal Code provides as follows:
Any amendment to contracts for purchases which taken alone increase the
original fee as awarded (a)by ten percent, if the original fee is one hundred fifty
thousand dollars ($150,000) or more, or(b)by seventy-five thousand dollars
($75,0000) or more, shall be approved by the City Council in advance of the
acceptance of any purchase in excess of such limits. However, neither contract
nor purchase amendments will be split to avoid advance approval of the City
Council.
XXVI. CONSTRUCTION ADMINISTRATION SERVICES
The scope of services for construction administration services shall be
determined at the conclusion of final design. Construction administration services
are not a part of this agreement but may be added by supplemental agreement
between the City and the Consultant.

FOR
IMPROVEMENT OF THE 114TH STREET
PACIFIC STREET TO BURKE STREET
A. DESCRIPTION OF PROJECT
This Agreement provides for engineering services as required for the preparation
of the Preliminary and Final Plan Package for improvement of the above existing
street. The work required for this project includes data collection, survey, basic
design plans for grading, pavement, drainage appurtenances, determination of
utility conflicts, traffic accommodations and any other incidental items necessary
for the proposed improvement of the IMPROVEMENT OF THE 114TH STREET
PACIFIC STREET TO BURKE STREET, a distance of approximately 4,300 feet.
The City of Omaha, Plan Preparation Manual dated September 15, 1997 will be
followed.
B. SCHEDULE OF SERVICES
1. The Consultant shall perform the necessary ground survey including the
project centerline, intersecting streets, alleys and drives, the tying of
located or reestablished land monuments to the survey centerline and
cross-sections and profiles necessary for the hydraulic design and right-of-
way survey.
2. The project will be designed according to the Omaha Metropolitan Area
Stormwater Management Design Manual and the AASHTO Policy on
Geometric Design of Highways and Streets. The City of Omaha Standard
Plates will be utilized. The City of Omaha Standard Specifications for
Public Works Construction will be utilized. Any deviations from the
above must be approved by the City prior to preparation of plans.
3. Plot plan and profile sheets at a scale of one inch equals twenty feet for the
plan portion and one inch equals twenty feet horizontal and one inch
equals five feet vertical for the profile portion. Plan sheets shall be made
on 22"x34" sheets with a 0.5"margin on the Top, the Right and the
Bottom of the sheet. The Left side of the sheet shall have an expanded
1.325"margin. These margins result in a bordered image area, which
measures 21"High by 32.125" Wide.

Care shall be exercised in drawing all construction details. All notes shall
be properly spaced and all lettering shall be of an engineering style.
Clarity must be maintained to allow reduction to half-size plans.
4. Plot plan sheets for the entire project at a scale of one (1) inch equals
twenty (20) feet.
5. Develop the roadway template to create the roadway cross-sections and
plot the cross-sections at a scale of one-inch equal's 20' horizontal and
one-inch equal's 5' vertical.
6. Prepare a complete drainage plan of the project, determine drainage areas,
determine location of curb inlets and other drainage structures and
determine the size of the proposed storm sewer system. Plot the
longitudinal drainage profiles of the proposed storm sewer on the profile
portion of the P/P sheets and transverse pipes on cross-section sheets at a
scale of one-inch equals 20' horizontal and one inch equals 5' vertical.
Plot the existing storm sewer on the sheets as necessary.
7. The Consultant shall develop plans to approximately the 35% complete
stage to include sufficient preliminary design to show the plan and
elevation, typical section of the proposed roadway, the tentative drainage,
potential utility conflicts, proposed cross-sections, limits of construction
and a preliminary opinion of construction costs. Two sets of plans (1/2
size black line plots) shall be submitted to the City at this stage. The
Consultant and the City will conduct a plan-in-hand evaluation on site as a
part of this review.
8. Geotechnical study to include subsurface boring, laboratory testing and
geotechnical recommendations report. The pavement recommendation
will be provided by the City of Omaha.
9. Public Informational Meeting to present plans to interested property
owners and general public.
10. Final design and right-of-way plans shall be prepared following the plan-
in-hand and Public Informational Meeting. The Consultant shall develop
plans based on decisions made at the plan-in hand and Informational
Meeting to the 90% complete stage. The 90%plans shall be sent to the
City for review and comment. The Consultant shall complete and submit
final plans based on the 90 %review for the City letting.

C. CITY WILL PROVIDE AT NO COST TO THE CONSULTANT:
l. The City shall furnish plans and documentation showing location of all
storm and sanitary sewers, traffic signals, drainage studies, any available
drawings showing utility locations, and other pertinent information that is
available for the project area.
2. The City shall furnish plans showing the location of all proposed streets
and sewer construction projects on or adjacent to the project so that design
work may be coordinated and proceed to a satisfactory conclusion and
shall notify utilities of the construction work contemplated together with
all information presently developed relative to this project.
3. All bench marks available in the adjacent area and state plane coordinates.
4. Title search of each individual tract of property requiring either easements
or acquisition.
5. Current traffic projections and counts, including turning movements and
accident data.
6. Sample set of plans of an urban-type project showing drafting details.
7. CAD GIS aerial files of the corridor and areas East and West to complete
the drainage study and display for Informational Meeting.
8. Advertise, obtain the location, and conduct the Public Informational
Meeting, also incidentals such as copies, van rental, screen rental.
9. Provide pavement recommendations.
10. As built drawings of improvements of 114`h or adjacent road or storm
sewer.
11. Preliminary Hydraulic Study of Crestridge Area.
12. Wells Engineering to provide Hydraulic Report of TWIN 8x8.
13. Signal Design, Barricades and Signage.
14. Topographic maps of the 114`h Street area.
15. Existing ROW plans along 114th Street.

D. TASK DESCRIPTION
Provide the engineering services required for project management; field survey;
geotechnical investigations; preliminary and final roadway design; public
informational meeting, and ROW plans.
1.0 Project Management
1.1 Includes management time for preliminary and final design, survey
coordination, geotechnical coordination, invoicing, and progress
reporting. Management time is based on the schedule in Exhibit
"A". If the schedule is delayed additional management time will be
required.
1.2 A single project manager, approved by the City, shall be assigned
to this project.
1.3 No change in project manager shall be permitted unless approved
by the City.
1.4 All coordination shall be through the City's project liaison.
1.5 Project manager shall provide a 90% complete full-size plan and
profile drawings to the City for review prior to the final plans
being submitted.
1.6 Upon completion and acceptance of final drawings, one set of full
size prints, required computer printouts, and electronic data
information shall be delivered to the City.
2.0 Field Survey
2.1 Perform all survey work in English units. Tying in all survey
control along the project to be used in determining right-of-way,
ownership of parcels and easements. Work includes preliminary
efforts toward developing Exhibit"A"plan sheet.
2.2 Perform survey in sufficient detail to prepare construction
drawings. That includes starting 1000' south of Pacific on 114`h
Street to 200' north of Burke. Survey of Intersecting streets
includes Meadow Road up to Howard Street including Storm
sewer profile and topographical features. Survey of Jackson Street
to at least 300' East of 114`h. Remaining intersections will be
surveyed 200' East or West of 114`h Street.

2.3 Locating geotechnical borings.
2.4 Survey coordination with utility locations, which includes locating
potholed utilities (if necessary).
2.5 Setting benchmarks and tying with a closed level circuit.
2.6 Bench levels shall be run by direct leveling methods and no "side
shots"will be permitted. Levels shall close within an allowable
error of 0.05 feet per square root of the distance in miles.
2.7 The Consultant shall run a closed level circuit, establishing
intermediate benchmarks along the project and on intersecting
streets beyond the limits of the project. This level circuit must be
tied into the benchmarks provided by the City.
2.8 Natural topographic features and man-made features, above
ground, shall be recorded by electronic data collection. All such
topographic features, which are pertinent to the design or are
necessary to properly show the effect of the proposed work upon
the adjoining property and/or improvements, shall be recorded.
2.9 A DTM shall be provided for use in cross-section creation. Survey
shall include elevations of curbs, drives, sidewalks and retaining
walls.
2.10 The necessary land monuments (section and quarter-section line
monuments) shall be located to the nearest 0.05'.
2.11 Survey field book and all survey computer data shall be given to
the City upon completion of final existing drawings.
3.0 Geotechnical Investigation—(Terracon)
3.1 Gather and correlate subsurface information from previous projects
adjoining the 114`h Street, Pacific Street to Burke Street project.
3.2 Supplement existing subsurface information with additional
borings.
3.3 Perform laboratory testing of soil samples obtained from the
boring program.

3.4 Provide recommendations for the roadway pavement design and
for retaining wall or other earth supported improvements in
accordance with standard practice.
3.5 Consultation and review as preliminary design is developed.
4.0 Site Inspection
4.1 One (consultant only) site visit to investigate the project site, to
prepare a photo log of the site and to familiarize the design staff
with the site and to identify areas of concern.
4.2 Meeting with Parks and Recreation Department for future trail and
Meadow Lane Park issues.
4.3 Attend a plan-in-hand with city staff.
4.4 Do a final site inspection and review with final plans.
5.0 Preliminary and Final Roadway Design_
5.1 Data Collection and Review. Includes obtaining current traffic
counts from the City and projected traffic counts from the
Metropolitan Area Planning Agency to determine the required
geometric configuration of the left and right turn lanes, obtain the
current aerial mapping of the project site and obtaining sewer
records and reports for existing sewers.
5.2 Traffic Study. Includes determining the geometric configuration of
the nine at-grade intersections. Including a review at Pacific Street
for dual left and right turn lanes. Design alternatives for
Jackson/Meadow Road realignment. A possible signal or trail
crossing at Burke and pedestrian signal location between Palamino
Road and Jones Street.
5.3 Note Reduction/Preliminary Plotting. Compute and add station and
offset data for overhead utilities to the planimetric mapping. Merge
the underground utility data, drainage structure data, and
information in to the planimetric mapping.
5.4 Drainage Study. Determine runoff areas and runoff flows.
Document the findings in the project file including 10 &100 year
run off analysis with storm water routing.

5.5 Storm Sewer Design. Develop drainage concepts. Layout the
proposed storm sewer system and conduct a review to determine if
conflicts with existing utilities exist.
5.6 Utility coordination and verification. Contact all probable utility
owners in the corridor to verify the location and size of field
located utilities. These potential owners will include OPPD, MUD,
US West, Sprint, Cox Communications, AT&T, and the City of
Omaha.
5.7 A Design Speed of 45 mph shall be used.
5.8 Horizontal Alignment. Establish the proposed horizontal alignment
on 114111 Street and on the intersections at Jones Street, Jackson
Street, Harney Plaza, Farnam Street, Palamino Road, Meadow
Road, Crestridge Road and Mason Court.
5.9 Vertical Alignment. Establish the proposed vertical alignment on
114`h Street and on the intersections at Jones Street, Jackson Street,
Harney Plaza, Farnam Street, Palamino Road, Meadow Road,
Crestridge Road and Mason Court.
5.10 Template Roadway x-sections. Develop the proposed template for
114`h Street, Jones Street, Jackson Street, Harney Plaza, Farnam
Street, Palamino Road, Meadow Road, Crestridge Road and
Mason Court. Develop the x-sections and plot on sheets.
5.11 Utilize the working x-sections to establish the limits of
construction. Preliminary design and final design.
5.12 Earthwork. Develop the earthwork estimate and report to
accompany the preliminary plans. No consideration will be given
to impact of construction phasing. The earthwork summary will be
gross quantities and not phase specific.
5.13 Plan in Hand/Field Check and Final Review. Meet with City of
Omaha Public Works to evaluate the plans in the field. A plan in
hand report will be prepared.
5.14 Geometric Design. Develop the proposed intersection geometry
using a WB-50 as the design vehicle on Pacific Street and a SU as
the design vehicle of the remaining intersections. Also review
culdesac or hammerhead geometry.

5.15 Progress Meetings. Regular progress meetings (four for
preliminary and four for final are estimated) will be held. Meeting
minutes will be prepared and distributed.
5.16 Traffic Phasing Plans. Develop the proposed phasing concept to
determine the impacts and address the areas of concern.
5.17 Typical Sections. Typical sections will be developed for 114th
Street and the three subdivision entrances. An urban three-lane
section with a two-way center left turn lane will be used on 114th.
5.18 Landscaping. Develop a typical section of the sidewalk in Meadow
Lane Park and provide details on the proposed plan for any
landscaping (By RDG).
5.19 Retaining Walls. Note the beginning and end of proposed walls on
the plan/profile sheet. Show the retaining wall in the appropriate x-
sections. Final design will include a detail sheet of the wall and
location.
5.20 Quantities and cost estimates. Prepare two costs estimates for the
preliminary design including construction and removal items. The
first estimate will be submitted with the plan in hand submittal and
the second estimate with the completed preliminary plan submittal.
Final—75% and final submittal preparation of two cost estimates
for final design at the 75% and final plan submittal stage.
5.21 Air Photo Sheets. Use the City of Omaha's GIS air photo's to
develop the air photo sheets. Show the proposed centerline
alignment and the edge of pavement in the plan drawings.
6.0 Public Information Meeting
6.1 Prepare Public Informational Meeting exhibits. It is assumed that a
mosaic will be prepared from existing aerial photography of the
site provided by the City. The mosaic would show the proposed
improvements and impacted properties. A one-inch equals 50'
scale plot of the project is assumed.
6.2 Attend the Public Informational Meeting. Assume the City will
make copies of plans and handouts.
6.3 Document the Public Informational Meeting comments.

7.0 ROW Plans
7.1 Show all existing permanent easements on the drawings (show
those noted on information obtained from City furnished
documents—deeds not necessary).
7.2 Provide strip map showing existing right-of-way with proposed

7.3 Provide tract maps for any right-of-way easements and takings (60
parcels assumed).
8.0 Quality Control. As part of HGM's quality assurance program, senior
level staff will review the project progress at appropriate intervals. It is
anticipated that these reviews would occur prior to major milestone
submittals and at times of critical decisions between various potential
options.
9.0 Preliminary and Final Revisions. This item consists of minor revisions to
the preliminary and final plan set following the City's review and
comments

Terracon is pleased to submit this proposal for subsurface exploration and geotechnical
engineering services for design of the proposed 114h Street Improvements in Omaha, Nebraska.
This proposal presents our understanding of the project along with our proposed scope of
services, fees, and anticipated work schedule.
PROJECT DESCRIPTION
We understand the proposed project will consist of widening the existing two lane roadway to a 38-
ft back to back three lane urban section with sidewalks on both sides. The construction will include
regrading, pavement removal,the relocation of existing utilities, reconstruction of drives, pavement
reconstruction, possible new culverts, traffic signals, and retaining walls. Retaining walls are
planned on both sides of 114" Street, between Farnam and Crestridge, and will be in the range of
about 5 to 12 feet in height. Traffic signals will or may be installed at the Pacific Street, Meadow
Road, and Burke Street intersections. New storm sewers and manholes will be constructed and
are anticipated to generally be about 6 to 8 feet in depth. Consideration is being given to
realigning Meadow Road to match the location of Jackson Street. Two existing box culverts are
located on the alignment. These include a twin 6x6 ft culvert just north of Meadow Road, and a
twin 8x8 ft culvert just south of Burke Street. It is anticipated that modification or replacement of
these culverts may be required.
Minimal grade changes are anticipated in order to remain within the existing right-of way.
However, moderate cuts may occur due to the widening in the area of the proposed retaining
walls, and some fill may occur near the culvert south of Burke Street. �� •

PURPOSES OF STUDY
The purpose of this subsurface exploration is to obtain subsurface data and provide
recommendations for pavement subgrade preparation and design, storm sewer bedding and
installation, culvert and traffic signal foundations. General earthwork and construction
recommendations will also be provided.
SCOPE OF SERVICES
Subsurface Exploration
A total of twelve soil borings are proposed along the 114" Street alignment. One boring will be
drilled at the location of each of the two culverts. These borings will extend to depths of about 25
to 35 feet below existing grade. One boring will be drilled at the location of the proposed retaining
walls to a depth of about 20 feet below grade. One boring is proposed at each of the three
potential traffic signal locations, extending to a depth of about 15 feet, and six borings will be drilled
along the general alignment of the roadway and sewer reconstruction to depths of approximately
10 feet below grade. Most of the borings will be drilled on the west side of the road to avoid the
overhead power lines located on the east side of the right-of-way.
There appears to be sufficient room to perform the borings on the west side of the road without
blocking a traffic lane. However, due to potential utility conflicts, we anticipate that traffic control
may be required for at least some of the borings. Therefore, we have included one day of traffic
control, including two flagmen and signs in our scope for this project. -
Sampling will be in accordance with our standard procedures wherein thin-walled samples (ASTM
D 1587) are obtained in cohesive soils and split-barrel samples (ASTM D 1586) are obtained in
granular soil, miscellaneous fill, and weathered rock or other hard material. In each boring, four
samples will be obtained in the top ten feet, and one sample will be obtained every five feet for the
remaining depth.
Laboratory Evaluations
Testing would also be in accordance with our standard procedures wherein unconfined
compression or hand penetrometer, water content and density tests are performed on
representative portions of thin-walled tube samples. Water content and, when applicable, hand
penetrometer tests are routinely performed on split-barrel samples. A standard Proctor, moisture-
density relation test will be performed on representative subgrade soils. Two Atterberg limits tests
will also be performed on representative soils.

Engineering Analyses
A report will be prepared under the supervision of a professional engineer registered in the State of
Nebraska. Three copies of the report will be issued from our office and delivered by general mail.
The cost of express mail delivery will be borne by the client, as will the cost for any additional
reports needed.
Site Access and Boring Locations
The fee quoted below for our services is based on Terracon staking and drilling the borings, with
HGM Associates providing layout and elevations of the borings after drilling. Our fee is also based
on all boring locations being readily accessible to normal truck-mounted equipment and the need
for flagmen and signs to control traffic while partially blocking a lane of traffic.
Performance Schedule
We anticipate starting the field exploration within 5 to 7 days of receiving authorization to proceed.
We can proceed based on verbal approval. However, written authorization should still follow. If
desired, a verbal report could be provided within about 8 to 10 days after completion of thefield
work. Our completed engineering report would be submitted approximately 15 working days after
completion of the field work.
Fee Structure and Conditions
Based on the proposed program, we quote a lump-sum cost of $4,250.00. This price is based on
performing only the scope of services outlined above, and includes $400.00 for traffic control
during drilling. Should subsurface conditions be encountered which require major revisions in the
subsurface exploration program and/or result in significantly higher costs, we will contact you prior
to initiating this work. Our invoice will be submitted upon completion of our services. Unless
otherwise instructed, invoices will be submitted to:

This letter is to confirm RDG Crose Gardner Shukert's preliminary scope of services on the
improvement of 114th Street between Burke Street and Pacific Street.
We understand that our scope of services will include:
1. A general inventory of the corridor to define areas for special landscape attention.
2. Participation in the schematic design of the improvement, to identify and conceptualize
opportunities for landscape enhancement.
3.. Development of conceptual landscaping and enhancement plans for the corridor project,
• including linkages into Meadowbrook Park.
These services include an allowance of 80 hours in the preliminary design process and 40
hours in the final design and document review process. Total cost of these services will be a

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the preliminary and final design of a replacement for 114th Street
from Pacific Street to Burke Street has been programmed in the 1999-2004 Capital Improvement
Program as Project No. 402; and,
WHEREAS, the Engineering Services required include the preliminary and final
design for the project with the scope of services being more detailed in Exhibit "A" of the
Engineering Agreement; and,
WHEREAS, HGM Associates, Inc. has agreed to perform the services listed in
the attached agreement, which by this reference is made a part hereof, for a fee of$354,702.29,
which will be paid from the 1996 Street&Highway Bond Organization 1509, Fund 341; and,
WHEREAS, the Public Works Department does not have sufficient staff to
undertake this project at this time.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Engineering Services Agreement with HGM Associates, Inc., for the
preliminary and final design of the replacement of 114th Street from Pacific Street to
Burke Street, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay $354,702.29 for these
engineering services from the 1996 Street & Highway Bond, Organization 1509,Fund 341.
