Transmitted herewith is a Resolution approving an Engineering Services Agreement with HDR
Engineering, Inc., for the preparation of preliminary design plans for the widening of 132nd
Street from Webster Street to West Maple Road. This project is included in the 1999-2004
Capital Improvement Program as Project No. 405. .
According to the terms of the Engineering Services Agreement, HDR Engineering, Inc., will
provide data collection, a survey, a traffic study, basic design plans for grading, pavement,
drainage, determination of utility conflicts, and environmental assessment for the proposed
improvement. The services are listed in more detail in Exhibit"A"of the Agreement.
HDR Engineering, Inc., has agreed to perform the engineering services listed in the Agreement
for the fee of $234,992.44. The fee will be paid from the 1996 Street & Highway Bond,
Organization 1509, Fund 341, HDR Engineering, Inc., has filed the required Annual Contract
Compliance Report Form, CC-1, in the Human Relations Department. The Director of Human
Relations will review the firm to determine its compliance with Ordinance 28885.
The Public Works Department requests your consideration and approval of the attached
Resolution and Agreement.

ENGINEERING AGREEMENT
CITY OF OMAHA
PREPARATION OF PRELIMINARY ENGINEERING PLANS FOR
IMPROVEMENTS
OF THE 132nd STREET,WEBSTER STREET TO WEST MAPLE ROAD
THIS AGREEMENT,made and entered into this /5 day of,144
1999 by and between the firm of HDR Engineering, Inc, a corporation of the State of
Nebraska,with offices at 8404 Indian Hills Drive, Omaha, Nebraska 68114-4049 and
hereinafter referred to as the "Consultant", and the City of Omaha,Nebraska, acting by
and through its Mayor, hereinafter,referred to as the "City".
WITNESSETH:
WHEREAS,the City desires to engage the Consultant to render professional
engineering services as hereinafter set forth for the necessary engineering services as
required for the preparation of preliminary plans for improvements of the 132°d STREET,
WEBSTER STREET TO WEST MAPLE ROAD.
WHEREAS,the Consultant is willing to perform such engineering work in
accordance with the terms hereinafter provided and does represent that he is in
compliance with the Nebraska Statutes relating to the registration of Professional
Engineers.
NOW THEREFORE,in consideration of these facts, the parties hereto agree as
follows:
L DEFINITIONS
Wherever in this agreement the following terms are used, or pronouns used in
their stead,they shall have the meaning here given:
The `EFFECTIVE DATE"of this agreement shall mean the date mentioned in the
first paragraph of this document.
"CONSULTANT' or"CONTRACTOR" shall mean HDR Engineering,Inc.,
whose business and mailing address is 8404 Indian Hills Drive, Omaha,Nebraska
68114-4049.
"CITY" shall mean the City of Omaha,Nebraska, and the Mayor of the City of
Omaha or his authorized representative.

To "ABANDON"the work shall mean that a determination has been made by the
City that conditions or intentions as originally existed have changed and that the work as
contemplated herein is to be renounced and deserted for as long in the future as can be
foreseen.
To "SUSPEND"the work shall mean-that.it has been determined by the City that
conditions or intentions as originally existed have changed and that the work as
contemplated herein should be ceased on a temporary basis. This cessation or holding in
this undetermined state will prevail until such time as a determination can be made to
abandon the work or to reinstate under the conditions as defined in this agreement.
To 'TERMINATE" or the'TERMINATION"of this contract shall be the
cessation or quitting of this contract based upon action or failure of action on the part of
the Consultant as defined herein and as determined by the City.
IL GENERAL DESCRIPTION OF SCOPE AND CONTROL WORK
The Consultant shall,upon receipt of the Notice to Proceed from the City,
perform all the services required under this agreement for the project described above and
as outlined in the attached Exhibit"A", Schedule of Services, hereby made a part of this
agreement.
III. TIME OF BEGINNING AND COMPLETION
The Consultant shall begin work on the project upon receipt of written "Notice to
Proceed"from the City. The work on the project shall be completed within 270 calendar
days after receipt of the written Notice to Proceed. The time for completion of the work
shall be equitably adjusted for delays not the fault of Consultant.
The City shall have 14 calendar days for review of preliminary plans and studies.
Delays grossly affecting the completion of the work within the time.specified for
completion attributable to or caused by the Consultant or the City shall be considered as
cause for termination of this agreement by the other.
It is hereby mutually agreed that the City has continuing rights to work progress
inspections and any and all additions, deletions, changes,elaboration's or modifications
of the services to be performed under the terms of this agreement which may from time to

time be determined by the City as desirable or preferable, shall be controlling and
governing.

IV. ABANDONMENT, CHANGE OF PLAN, SUSPENSION AND
TERMINATION
The City shall have the absolute right to abandon the project or to change the
general scope of work as defined in Section-n,'at any time. Such action on its part shall
in no event be deemed a breach of contract.
The right is reserved by the City to suspend this agreement at any time or to
terminate for just cause. Such suspension or termination may be effected by giving the
Consultant fifteen (15) days written notice. Should the project be suspended for thirty
(30)days or more, Consultant's Fee and time for completion shall be equitably increased.
If the City abandons the work or subtracts from the work as presently outlined,the
Consultant shall be compensated on the basis of the percentage completion ratio of the
net fee shown in Exhibit `B", plus actual costs as defined in Section VL In determining
the percentage of work completed, the City shall consider the work performed by the
Consultant to the total amount of work contemplated by this agreement.
Additions to the scope of work as defined in Exhibit "A"will require negotiation
of a supplemental agreement or agreements. For any work beyond the scope of services
outlined by Exhibit"A", the Consultant will be required to document the additional work,
estimate the cost to complete said work and obtain written approval from the City before
such work begins. 1
V. OWNERSHIP OF ENGINEERING DOCUMENTS
All tracings,plans, maps, computations, sketches,charts,computer/digital files
and other data prepared or obtained under the terms of this Agreement shall be delivered
to and shall become the property of the City without restriction or limitation as to its
further use.
'VI FEES AND PAYMENTS •
In consideration of the performance of the Engineering Services described in this
Agreement,the Consultant shall be paid actual cost plus a fixed fee to a maximum fee of
$234,992.44. The maximum fee will consist of a compilation of estimated direct salary
cost,direct non-salary costs, indirect salary cost,indirect non-salary cost and direct salary
payroll additives, as provided in Exhibit`B", attached,plus sub-contracts as provided in
Exhibit"C" attached.
Direct salary costs are defined as direct salaries paid to principals, engineers,
technicians,draftsmen and other personnel directly assigned by the Consultant to this
project.

Direct non-salary costs include,but are not limited,to those costs incurred by the
Consultant for travel, subsistence, supplies, reproductions,photography,printing,
computer charges, subcontractors, special equipment and materials required for this
project and such other similar items.
Indirect salary costs are defined as actual wages paid to all employees,clerical and
stenographic, administrative and supervisory of the Consultant for work not directly
chargeable to individual contracts.
Indirect non-salary costs are all non-salary costs of the Consultant's business
operations which are not directly chargeable to individual contracts.
The direct salary payroll additives are related costs which are paid by the
Consultant such as Social Security and unemployment taxes,wages paid for vacations
and holiday,wages paid for sick,military,jury and other authorized leave, group
insurance,pension and so forth.

For the purposes of calculating the maximum fee under this Contract, the sum of
the indirect additives shall be 1.6257 times the direct salary costs. An amount consisting
of 12% of the total sum of direct salary costs plus indirect additives was added for profit.
The Consultant shall submit monthly invoices which shall be based on actual
costs incurred during the calendar month. The monthly payments shall be based upon the
satisfactory prosecution of the work and shall be substantiated by monthly.progress
reports. The Consultant shall submit a final voucher for the project no later than 30 days
after the close of the Consultant's fiscal year during which the project is completed.
The acceptance by the Consultant of the final payment shall constitute and operate
as a release to the City for all claims and any liability to the Consultant,his
representatives and assigns for any and all things done, furnished or relating to the
services rendered by the Consultant under or in connection with this Agreement or any
part thereof.

The Consultant shall maintain all books, documents,papers, accounting records
and other evidence pertaining to costs incurred and study activities and shall make such
materials available at his office at all reasonable times during the contract period and for
three (3) years from the date of final payment under this Agreement; such records to be
available for inspection by the City and copies thereof shall be furnished by the
Consultant,if required.
The Consultant shall be responsible to determined.when his actual costs shall
exceed the anticipated costs for any work activity. In such event, the Consultant must
immediately notify the City in writing.

The Consultant shall also be responsible to identify when a change in the work
scope necessitates an increase in the maximum fee under this contract. When the
Consultant identifies that an increase is in order,he will be required to estimate the
additional costs necessary to complete the additional work,document the reasons for this
increase and receive prior approval from the City in writing before expenditures beyond
the maximum fee amount are incurred. The City shall not be obligated to reimburse the
Consultant for costs which have not been approved in excess of the maximum fee
amount_
VIL FORBIDDING USE OF OUTSIDE AGENTS
The Consultant warrants that he has not employed or retained any company or
person, other than bona fide employees working for the Consultant,to solicit or secure
this Agreement and that he has not paid or agreed to pay any company or person, other
than a bona fide employee any fee, commission,percentage,brokerage fee, gift or any
other consideration contingent upon or resulting from the award of making of this
Agreement. For breach or violation of this warranty,the City shall have the right to
deduct from the Agreement price or consideration, or otherwise,recover the full amount
of such fee, commission, percentage, brokerage fee, gift or contingent fee.
VIII. RESPONSIBILITY FOR CLAIMS LIABILITY
The Consultant agrees to save harmless the City from all Claims and Liability due
to the negligent activities of himself,his agents or his employees. In this connection, the
Consultant will carry insurance in the following kinds and amounts.
1. Comprehensive Auto $100,000 P.L. $50,000 P.D.
Liability
2. Comprehensive General $300,000 P.L. $50,000 P.D.
Liability
3. Workmen's Compensation Statutory
4. Professional Liability $1,000,000
The insurance specified above shall be maintained until the Consultant's work has
been completed and accepted by the City. The Consultant shall furnish proof of
insurance coverage,if requested by the City.

IX. NON-RAIDING CLAUSE
The Consultant shall not engage the services of any personnel or persons presently
in the employ of the City for work coVered by this Agreement without the written consent
of the employer of such persons.
X. - GENERAL COMPLIANCE WITH LAWS
The Consultant hereby agrees to comply with all Federal, State and Local Laws
and ordinances applicable to the work.
XI. PROFESSIONAL REGISTRATION AND SUBCONTRACTS
• The Consultant hereby agrees to affix the seal of a registered professional
engineer license to practice in the State of Nebraska on all reports and plans prepared
hereunder except for those plans designed by the City.
The Consultant agrees to provide these professional services using staff personnel
with specialized skills, experience and professional qualifications. Any work
subcontracted other than that specifically provided by this Agreement shall first have the
written approval of the City.
XII. ORGANIZATION CHART
The Consultant shall furnish an organization chart of all key personnel who will
be involved in this project as outlined in this Agreement. Any deviations or revisions in
personnel as shown in the project organization chart shall be subject to the prior approval
of the City. All personnel revisions or replacements shall be made with people of equal
ability and experience,in the opinion of the City, and failure of the Consultant to provide
capable replacements to the satisfaction of the City shall be basis for termination of the
Contract and the method of Contract settlement shall be as outlined in Section IV. The
project organization chart is as shown in Exhibit"D"hereto, and made a part of this
Agreement.
XIII. ARBll'KATION
Any disputes between the City and the Consultant not disposed of by this
Agreement between the parties may be settled by arbitration as provided by Section 25-
2103 through 25-2120,Nebraska Reissue Revised Statutes of 1943.
XIV. FAIR EMPLOYMENT PRACTICES ACT
The Consultant agrees to abide by the provisions of the Nebraska Fair
Employment Act of 1965,R.R.S. 1943,48-1101 through 48-1125.

XV. SUCCESSORS AND ASSIGNS
This Agreement shall be binding on successors and assigns of either party.
XVL SUBLETTING,ASSIGNMENT OR TRANSFER
Subletting, assignment or transfer of all or part of the interest of the consultant
(except as provided) is hereby prohibited unless prior written consent of the other parties
is obtained therefore.
XVIL NONDISCRIMINATION
The Consultant shall not, in the performance of this Agreement, discriminate or
permit discrimination against any person because of race, sex, age, or disability or
political or religious opinions or affiliations in violation of federal or state local
ordinances.
XVIIL PROJECT SCHEDULE
Exhibit"E" attached hereto is incorporated herein as the proposed project
schedule.
XIX. CERTIFICATION OF CONSULTANT
The attached certification,identified as Exhibit"F", shall be completed by the
Chief Administrative Officer of the Consultant and is hereby made a part of this
Agreement.
XX. UNEMPLOYMENT COMPENSATION FUND PAYMENTS
Before final payment is made by the City to the Consultant of the final three
percent(3%) due hereunder,the Consultant shall furnish the City a written•clearance from
the Commissioner of Labor of the State of Nebraska certifying that all payments due of
contributions or interest which may have arisen under this contract have been paid by the
Consultant, or its subcontractor to the Unemployment Compensation Fund of the State of
Nebraska.
XXL CITY SUPERVISION
It is hereby mutually agreed that the City shall have responsible supervision of all
the services included herein,but no employee of the Consultant's direction is or shall be
deemed to be an employee of the City. The Consultant shall at all times have or cause to
have in force Workers Compensation insurance covering all its employees and those of
any subcontractor and those of anyone under its direction and control.

XXIL PAYMENT FOR SERVICES, MATERIAL AND EQUIPMENT
The Consultant agrees to pay all persons, firms or corporations,having contracts
directly with the Consultant or with subcontractors of Consultant, all just claims due them
for the payment of services, material and equipment furnished and for the payment of
material and equipment rental which is actually used or rented in the performance of this
contract.
XXIII. ASSESSMENT FOR TAXATION
Consultant shall comply with, and shall cause to be complied with Section 77-
1323,Reissue Revised Statutes of Nebraska, 1943,as amended and shall furnish a
certified statement to be attached to the contract That all equipment to be.used on the
• project, except that acquired since the assessment date, has been assessed for taxation for
the current year, giving the County where assessed. During the performance under this
contract, additional such statements shall be furnished by the Consultant as may be
required by such law or as may be required by the City or its authorized agent.
XXIV. AMENDMENTS OR ADDITIONS
No amendments or additions shall be made to this Agreement except in writing.
Future agreements between the parties must likewise be in writing.
XXV. FINANCIAL INTEREST
Pursuant to Section 8.05 of the Home Rule Charter of the City of Omaha,no
elected official or any officer or employee of the City shall have a financial interest, direct
or indirect,in any City contract. A violation of that section with the knowledge of the
Consultant,in addition to constituting employee malfeasance, shall be cause for the City
to unilaterally terminate or void this Agreement.
XXVL INCREASE OF FEE
The parties hereto acknowledge that, as of the date of the execution of this
Agreement, Section 10-142 of the Omaha Municipal Code provides as follows: Any
amendment to contracts for purchases which taken alone increase the original fee as
awarded(a)by ten percent, if the original fee is one hundred fifty thousand dollars
($150,000) or more, or(b)by seventy-five thousand dollars ($75,000) or more, shall be
approved by the City Council in advance of the acceptance of any purchase in excess of
such limits. However,neither contract nor purchase amendments will be split to avoid
advance approval of the City Council.

XXVII. DRUG-FREE WORKPLACE POLICY
The Consultant shall have an acceptable and current drug-free workplace policy on file
with the State.
XXVIII. STANDARD OF PERFORMANCE
The Standard of care for all professional engineering, consulting and related services
performed or furnished by the Consultant under this Agreement will be the care and skill
ordinarily used by members of the Consultant's profession practicing under the same or
similar circumstances at the same time and in the same locality. The Consultant makes
no warranties, express or implied, under this Agreement or otherwise, in connection with
the Consultants services.

XXVIV. PEES AND PAYMENTS
Upon completion and acceptance of the preliminary design services by the City, a final
audit, if deemed necessary, of all invoiced amounts will be completed by the City or State
or authorized representative, and the Consultant agrees to furnish the City or State all
necessary documentation for the audit.
XXX. FINAL DESIGN SERVICES
The scope of services for final design shall be determined at the conclusion of
preliminary design. Final design services are not a part of this agreement but may be
added by supplemental agreement between the City and the Consultant.
XXXI. CONSTRUCTION ADMINISTRATION SERVICES
The scope of services for construction administration services shall be determined
at the conclusion of final design. Construction administration services are not a part of
this agreement but may be added by supplemental agreement between the City and the
Consultant.

AND
SCHEDULE OF SERVICES
FOR
IMPROVEMENT OF 132ND STREET,-WEBSTER STREET TO WEST MAPLE
ROAD
A. DESCRIPTION OF PROJECT
This Agreement provides for engineering services as required for the preparation of the
Preliminary Plan Package for improvement of the above existing street. The work
required for this project includes data collection, survey,basic design plans for grading,
pavement, drainage appurtenances, determination of utility conflicts,Environmental
Assessment,traffic accommodations and any other incidental items necessary for the
proposed improvement of the 132nd STREET,WEBSTER STREET TO WEST MAPLE
ROAD, a distance of approximately 8450 feet and all east-west streets a sufficient
distance for proper design. •
The preliminary design will not include the Blondo Street intersection. The"gap"is
estimated to be 300' in length. This "gap"will be designed by the firm selected by the
City of Omaha to design the Improvements to Blondo Street, 123`d Street to 134th Street.
The geometry of the turn lanes will be included in this contract. Coordination between
the two projects will be necessary. •
The City of Omaha, Plan Preparation Manual dated September 15, 1997 will be followed.
B. SCHEDULE OF SERVICES
1. The Consultant shall perform the necessary ground survey including the project
centerline,intersecting streets, alleys and drives, the tying of located or
reestablished land monuments to the survey centerline and cross-sections and
profiles necessary for the hydraulic design and right-of-way survey.
2. The project will be designed according to the Omaha Metropolitan Area
Stormwater Management Design Manual and the AASHTO Policy on Geometric
Design of Highways.and Streets. The City of Omaha Standard Plates will be
utilized. The City of Omaha Standard Specifications for Public Works
Construction will be utilized. Any.,deviations from the above must be approved
by the City prior to preparation of plans.

3. Plot plans and profile sheets at a scale of one inch equals fifty feet for the plan
portion and one inch equals fifty feet horizontal and one inch equals five feet
vertical for the profile portion. Plan sheets shall be made on 22"x 34" sheets with
a 0.5"margin on the Top,the Right and on the Bottom of the sheet. The Left side
of the sheet shall have an expanded.l..325" margin. These margins result in a
bordered image area which measures 21"High by 32.125"Wide.
Care shall be exercised in drawing all construction details. All notes shall be
properly spaced and all lettering shall be of an engineering style. Clarity must be
maintained to allow reduction of half-size plans.

feet.

6. Prepare a complete drainage plan of the project, determine drainage areas,
determine location of curb inlets and other drainage structures and determine the
size of the storm sewer system. Plot the longitudinal drainage profiles of the
proposed storm sewer.on the profile portion of the P/P sheets and transverse pipes
on cross-section sheets at a scale of one-inch equals 10' horizontal and one inch
equals 5' vertical. Plot the existing storm sewer on the sheets as necessary.
7. The Consultant shall develop plans to approximately the 35% complete stage to
include sufficient preliminary design to show the plan and elevation, typical
section of the proposed roadway,the tentative drainage,potential utility conflicts,
proposed cross-sections, limits of construction and a preliminary estimate of
construction costs. Two sets of plans (V2 size black line plots) shall be submitted
to the City at this stage. The Consultant and the City will conduct a plan-in-hand
evaluation on site as.a part of this review.
8. Geotechnical Study to include subsurface borings,laboratory testing and
geotechnical recommendations report. The pavement recommendation will be
provided by the City of Omaha.
9. Environmental Assessment in accordance with FHWA's T6640.8A guideline
policy and Nebraska Department of Roads DORSTEP.
10. Public Hearing to present plans to interested property owners and general public.
Hearing will be done in accordance with environmental process.

C. CITY WILL PROVIDE AT NO.COST TO THE CONSULTANT:
1. The City shall furnish plans and documentation showing location of all storm and
sanitary sewers, traffic signals, drainage studies and other pertinent information
that is available for the project area.
2. The City shall furnish plans showing the location of all proposed street and sewer
• construction projects on or adjacent to the project so that design work may be
coordinated and proceed to a satisfactory conclusion and shall notify utilities of
the construction work contemplated together with all information presently
developed relative to this project.
3. All bench marks available in the adjacent area.
4. Title search of each individual tract of property requiring either easements or
acquisition.
5. Current traffic projections and counts, including turning movements and accident
data
6. Sample set of plans on an urban-type project showing drafting details.
7. CAD GIS aerial files of the corridor.
8. Advertise, obtain the location, and conduct the public hearing.
9. Provide pavement recommendations.
10. Distribute the EA to the reviewing agencies.
D. TASK DESCRIPTIONS
Provide for engineering services required for field survey; geotechnical investigations;
preliminary design plans; estimate of probable construction cost; and an environmental
assessment.

1.0 Project Management
Includes management time for preliminary design, survey coordination,
geotechnical coordination, environmental assessment coordination,invoicing, and
progress reporting. Management time is based on the schedule in Exhibit "E". If
the schedule is delayed additional management time will be required.
2.0 Field Survey—(Lamp Rynearson&Associates)
2.1 Perform all survey work in English units. Tying in all survey control
along the project to be used in determining Right-of-Way, ownership of
parcels and easements. Work includes preliminary efforts toward
developing Exhibit"A"plan sheets.
2.2 Locating geotechnical borings. •
2.3 Coordinating utility locations and locating potholed utilities (if necessary).
2.4 Setting benchmarks and tying with a closed level circuit.
2.5 Bench levels shall run by direct leveling methods and no "side shots"will
be permitted. Levels shall close within an allowable error of 0.05 feet per
square root of the distance in miles.
2.6 The Consultant shall run a closed level circuit, establishing intermediate
benchmarks along the project and on intersecting streets beyond the limits
of the project. This level circuit must be tied into the benchmarks
provided by the City.
2.7 Natural topographic features and man-made features, above ground, shall
be recorded by electronic data collection. All such topographic features
which are pertinent to the design or are necessary to properly show the
effect of the proposed work upon the adjoining property and/or
improvements shall be recorded.
2.8 A DTM shall be provided for use in cross-section creation. Survey shall
include elevations of curbs, drives, sidewalks and retaining walls.

3.0 Geotechnical Investigations—(Thiele Geotech, Inc.)
3.1 Gather and correlate subsurface information from previous projects
adjoining the 132nd Street,Webster Street to West Maple Road project.
3.2 Supplement existing subsurface information with additional borings.
3.3 Perform laboratory testing of soil samples obtained from the boring
program.
3.4 Provide recommendations for the roadway pavement design and for
retaining walls other earth supported improvements in accordance with
.standard practice.
3.5 Consultation and review as preliminary design is developed.
4.0 Site Inspection
One (consultant only) site visit to investigate the project site,to prepare a photo
log of the site and to familiarize the design staff with the site and to identify areas
of concern.
5.0 Environmental Assessment
Based upon an environmental review NDOR and FHWA determined that the
project is a class III action therefore an Environmental Assessment is the
appropriate level of documentation required to comply with NEPA.
These work tasks have been developed to satisfy federal and state requirements
for the environmental evaluation of this roadway project. This includes
requirements of the Corps of Engineers and other agencies not necessarily
responsible for roadway construction.. Because of the nature of the project and its
location many of the categories assessed as a routine part of the NEPA process
have limited applicability to this corridor. For these categories,the EA will
briefly cover the topic and document why the issue is not applicable. The
assumptions by resource topic have been identified in the various subtasks.
The EA must assess how the natural and human environment will be affected by
the project. The EA will contain a discussion of four general topics:

(a) Description and need for the proposed action.
(b) Discussion of the alternatives considered.
(c) Discussion of social, economic, and environmental impacts of the
proposed action and alternatives, including no build(affected
environment and environmental consequences).
(d) Listing of agencies/persons consulted.
The focus will be on the important impacts and issues with less important areas
only briefly discussed.
Based upon the extent of adverse impacts,mitigation measures will be identified,
as required. Detailed mitigation plans with specific criteria and associated
monitoring activities are outside the scope.
5.1 Agency Scoping Meeting-and Preliminary Coordination
At the onset of the work,the following meetings will be conducted:
• Meeting with NDOR and FHWA to provide these two key agencies
with current information on the project status and obtain their
agreement to be co-sponsoring agencies for the EA.
• Key agencies responsible for ariministering environmental regulations
will be contacted to provide input.
The following outlines the specific environmental issues that will be
addressed. Some will consist of short discussions,while others, will be
more extensive. The level of detail presented for each issue will be
determined following agency scoping meetings.
5.2 Purpose and Need Statement. This is essentially chapter one of the EA.
The project will be described and the need for and purpose of the project
documented.
5.3 Alternatives. This will be the documentation for the effort to be
completed in Task 6. Since this is a reconstruction project; the proposed
alignment will closely follow the existing alignment. Alternates
developed will be associated to vertical alignment and turn lane
requirements.

5.4 Social Impacts—Land-Use/Community Resources
Since the project is on existing alignment and not a new facility evaluation
of social impacts is assumed to involve only minimal effort.
(a) Document existing conditions relative to the following and review,
as necessary,with the appropriate City planning staff:
• Land use plans
• Zoning ordinances
• Community facilities and services
• Neighborhood boundaries, circulation patterns,and activity
centers
It is anticipated the most recent Comprehensive Plan will serve as the
primary input for this section.
(b) Document potential social impacts based on the identification of
the following issues:
• The number of and type of displacements due to right-of-
way acquisition (none anticipated).
• Changes in access to community facilities and city services
including emergency vehicle access (none anticipated).
• Changes to existing neighborhood/community boundaries
and community cohesion.
• Consistency of proposed alternatives to existing land
use/development plans.
5.5 Economic Impacts
Since this is a reconstruction project with no anticipated relocations
potential economic impacts are assumed to be limited to temporary
accesses to businesses located in the vicinity of the project.
(a) Conduct field review inventory of businesses in the study area,
noting proximity to existing roadways.
(b) Assess the potential impacts to businesses as a result of changes in
access, travel patterns, improved traffic-capacity, and visibility.
(c) Assess the potential impacts to the local tax base associated with
right-of-way acquisition and any relocation of
businesses/households.
(d) Based on the estimated construction cost, calculate the number of
construction-related jobs generated by each alternative.

5.6 Environmental Justice '
(a) Identify minority and economically disadvantaged populations
affected by the proposed project.
(b) Assess the potential impacts on any minority and economically
disadvantaged populations.
(c) Determine if the impacts are adverse and disproportionately high.
5.7 Air Quality: Evaluate impacts on local air quality,both during project
construction and at project completion. Results of the previous Blondo
Street modeling will apply. Neither monitoring of existing background
levels of air quality nor computer modeling will be used.
5.8 Noise Impacts:
• Evaluate noise impacts for noise sensitive receptors along
the alternative corridor.
• Identify worse-case noise receptor locations for each
alternative.
• Determine existing noise levels by monitoring and future
noise levels by computer modeling of future traffic noise
sources using FHWA's STAMINA 2.0/OPTIMA(TNM
1.0A may be used in lieu of STAMINA at the discretion of
the engineer.
• Format traffic information for use in the noise analysis, and
include existing and future peak hour volumes,percentages
of heavy and medium trucks, and operating speeds.
• Compare the predicted noise levels to FHWA Noise
Abatement Criteria and identify/evaluate appropriate
mitigation measures consistent with State policies and
guidelines.
•
5.9 Habitat/Flora/Fauna Impacts: The project area is fully developed, T&E
species and/or critical habitat impacts are not anticipated. Work will
include a field visit to document the disturbed and developed nature of the
project area.

Vegetation sampling is not to be conducted. Additionally, general
description of terrestrial.community composition with particular emphasis
on listed threatened and endangered (T&E) species, as well as species of
special concern,will be prepared.-Information regarding T&E species
must be determined by consultation with the U.S.Fish and Wildlife
Service and Nebraska Game and Parks Commission inventories.
5.10 Wetlands/Floodplains
• Wetlands. Since this is a developed corridor wetlands are
not.anticipated. A•site visit will be conducted to identify
wetland areas under the jurisdiction of`the US Army Corps
of Engineers. Preliminary delineation, if required, after the
site visit will be based on site field delineation and SCS soil
surveys.
• Corps of Engineers permit under Section 404 of the clean
water Act are not anticipated.
• Floodplains. Floodplain evaluations to define approximate
floodplain limits for streams that affect corridor structure
crossings or embankment encroachments. Floodplain
delineation limits must be determined using available
floodplain mapping including the USGS Map of FloodPlain
Areas and appropriate FEMA mapping. Field surveys for
hydraulic cross sections or backwater analysis to provide
flood profile evaluations or site-specific limitations are not
to be performed.
• Based on the site visit,evaluate and quantify wetland and
floodplain impacts.
5.11 Water Quality Impacts: Compile information regarding water sources,
municipal/industrial, quality/quantity, groundwater, irrigation,recreational
water use. Review and verify stream and lake classifications and special
resource classifications.
Evaluate the potential impact on water quality from construction and/or
operation of the proposed alternatives and identify/evaluate potential
mitigation consistent with State policies and guidelines.

5.12 Hazardous Waste: Conduct a data base survey and windshield field
reconnaissance to identify thepresence of existing/potential hazardous
waste sites throughout each alternative corridor. Reference lists
identifying known hazardous waste locations such as the State's hazardous
waste list,the State's highway spill report, State's underground storage
tank listings, and the Comprehensive Environmental Resource
Compensation and Liability Information System(CERCLS) or the
Resource Conservation and Recovery Act (RCRA) information will be
utilized. Potential sites could include gas stations, above-ground tanks,
industrial properties,landfills,underground storage tanks, etc.
5.13 Historic/Cultural Resources: Review and summarize data, including
impact evaluation, regarding potential historic structures and
archaeological significant sites with coordination with SHPO. Potential
National Register eligible sites,within the study area, will be identified.
The project area is fully developed Historical/Cultural Resource impacts
are not anticipated.
5.14 Visual Analysis: The project is the reconstruction of an existing facility
and it is anticipated that the visual setting changes will be negligible. The
existing/proposed visual environment will be described.
•
5.15 Recreational Facility Impacts: Identify existing and planned public use
recreational areas,community parks, wildlife and waterfowl.protection
areas,bike trails, hiking trails, snowmobile trails, fishing and hunting
access areas,or other land uses that may be subject to Section 4(f)
requirements (none anticipated).

5.16 EA Preparation
Prepare the preliminary draft Environmental Assessment documentation
and submit 3 copies each to the City for review. NDOR and FHWA will
also be provided two copies.each for review. If Section 4(f) and/or
Section 106 documentation is determined to be warranted, and directed by
FHWA, or the NDOR, a supplement to this scope of work will be
required. Neither is anticipated.
Prepare revisions to the environmental document based on comments from
City,NDOR and FHWA preliminary review.
After FHWA signature,print 50 copies of the draft EA, and prepare Notice
.of Availability announcement. HDR will distribute the EA on behalf of
the City.
5.17 Finding Of No Significant Impact(FONSI) Determination and Final EA
The draft EA is a document that provides the basis for determination of
whether to prepare an Environmental Impact Statement (EIS)or FONSI.
The resultant decision expected under this agreement is the preparation of
a FONSL Based on comments received on the draft EA document,the
Consultant shall prepare the Final EA,including supporting
documentation, to be submitted to FHWA for review and ultimate
issuance of a FONSL
(a) Summarize all written comments from agencies, interest groups,

local governments, and individuals and prepare a list of
issues/concerns/responses for use in the final document.
(b) Prepare final EA document that identifies the selected alternative,
basis for selection,impacts, and mitigation, and responds to all
input received as a result of draft document availability and the
public hearing
• Submit preliminary final EA to the City,NDOR, and FHWA
for review and comment. Prepare final EA based on comments
from City,NDOR, and FHWA.
• Print 10 copies of the final EA document and distribute on
behalf of the City.
• It is assumed that no significant changes will result from the
review process requiring further work on the EA.

5.18 Public interaction meetings. Include effort for up to four
neighborhood/subdivision meetings. Allows for preparation time,
documentation time for each meeting.
6.0 . Preliminary Roadway Design
6.1 Data Collection and Review. Includes obtaining current traffic counts
from the City and projected traffic counts from the Metropolitan Area
Planning Agency to determine the required geometric configuration of the
.= left and right turn lanes, obtain the current aerial mapping of the project
site and obtaining sewer records and reports for existing sewers.
6.2 Traffic Study. To determine the geometric configuration of the seven at
grade intersections. Blondo Street is included in the Traffic Study.
6.3 Note Reduction/Preliminary Plotting. Compute and add station and offset
data for overhead utilities to the planimetric mapping. Merge the
underground utility data, drainage structure data, and the existing bridge
structure (twin 12' x 12')information in to the planimetric mapping.
6.4 Drainage Study. Determine runoff areas and runoff flows. Document the
findings in the project file.
6.5 Storm Sewer Design.Develop drainage concepts. Layout the proposed
storm sewer system and conduct a review to determine if conflicts with
existing utilities exist.
6.6 Utility coordination and verification. Contact all probable utility owners
in the corridor to verify the location and size of field located utilities.
These potential owners will include OPPD,MUD,US West, Sprint, Cox
Communications, AT&T, the City of Omaha and Williams Brothers
Pipeline
6.7 Horizontal Alignment. Establish the proposed horizontal alignment on
132nd Street and on the at grade intersections at Cuming Street,Hamilton
Street, Seward Street,Erskin Street,Miami Street, and Eagle Run Drive.
6.8 Vertical Alignment. Establish the proposed vertical alignment on 132nd
Street and on the intersections at Cuming Street,Hamilton Street, Seward
Street,Erskin Street,Miami Street, and Eagle Run Drive.

6.9 Template Roadway x-sections. Develop the proposed templete for 132nd
St., Cuming St.,Hamilton St., Seward St.,Erskin St.,Miami St., and
Eagle Run Drive. Develop the x-sections and plot on sheets.

6.10 Utilize the working x-sections to establish the limits of construction.
6.11 Earthwork. Develop the earthwork estimate and report to accompany the
preliminary plans. Consideration will be given to impact of construction
phasing. The earthwork summary will be gross quantities and not phase
specific.
6.12 Plan in Hand/Field Check. Meet with the City of Omaha and evaluate the
plans in the field. Effort to compose the Plan in Hand report is included.
6.13 Geometric Design. Develop the proposed intersection geometry using a
WB-50 as the design vehicle on Blondo Street and a SU as the design
vehicle of the remaining intersections.
6.14 Progress Meetings. Regular.progress meetings (four are estimated)will be
held. Meeting minutes will be prepared and distributed.
6.15 Traffic Phasing Plans. Development of the proposed phasing concept to
determine the impacts and address the areas of concern.
6.16 Typical Sections. Typical sections will be developed for 132nd Street and
the six subdivision entrances. An urban four-lane section with a 16'
raised median is assumed.
6.17 Guardrail. Coordinate the guardrail with the roadway geometrics and
sidewalk over the twin 12'x 12' RCB to determine the impacts.
6.18 Landscape. Develop a typical section of the proposed median that will
provide details on the proposed plan.
6.19 Retaining Walls. Note the beginning and end of proposed walls on the
plan/profile sheet. Show the retaining wall in the appropriate x-sections.
6.20 Quantities and cost estimates. Preparation of two cost estimates for the
construction and removal items. The first estimate will be submitted with
the Plan in Hand submittal and the second estimate with the completed
Preliminary plan submittal:

6.21 Air Photo Sheets. Use the City of Omaha's GIS air photo's to develop the
Air Photo Sheets. Show,the proposed centerline alignment and the edge of
pavement in the plan drawings.
6.22 Design Coordination. Coordinate the proposed improvements with the
Blondo Street, 123th Street to 134th Street project.
7.0 Public Hearing
7.1 Prepare Exhibits.Preparation of public hearing exhibits. It is assumed that
a mosaic will be prepared from existing aerial photography of the site
.provided by the city. The mosaic would show the proposed improvements
and impacted properties. A one-inch equals 50' scale color plot of the
project is assumed.

7.2 Prepare Engineers Statement. A written engineer's statement will be
prepared to describe the proposed improvements and the potential impacts
of the project and to describe the alternatives that were studied.
7.3 Attend the Hearing.
7.4 Document the Public Hearing comments.
8.0 Quality Control. As a part of HDR's quality assurance program, senior level staff
will review the technical and financial aspects of the project at appropriate
intervals. It is anticipated that these reviews would occur prior to major milestone
submittals and at times of critical decisions between various potential options.
9.0 Revisions. Consists of minor revisions to the preliminary plan set following the
City's review and comments.

estimated cost of the study. A fee schedule for the project is attached in Exhibit A and the contract terms
are attached in Exhibit B. This proposal will be held open for a period of 45 days from the above date.
PROJECT DESCRIPTION
The project consists.of the reconstruction of roughly 9,000 lineal feet of 132nd Street. The existing 2 lane
roadway will be replaced with a 4 lane divided street with turning lanes. The existing section has gravel
shoulders and shallow ditches. The new alignment will roughly follow the existing centerline,with new
lanes extending through the shoulders on both sides. The profile will also be similar to the existing. To
accommodate the existing intersections, cuts and fills along centerline will be less.than 1 to 2 feet over
most of the project. An exception occurs at a crest north of Blondo Street where cuts of up to 6 feet are
possible . Embankment fills in the ditches could approach 3 to 4 feet in some areas. Cuts of up to 5 feet
are expected on the east side of 132nd Street near Seward Street.
. The improvements will include construction of new storm sewers and possibly some small retaining
C ) walls. The new pavement section will consist of Portland cement concrete on compacted native subgrade.
Based on previous experience in the area, the soils on the site are expected to consist of Peoria loess
deposits overlying older loess and till deposits in the upland areas of the project. In the draws that cross
the roadway, colluvial and alluvial soils may be encountered. Existing fills are also expected within the
roadway embankment.
SCOPE OF SERVICES
Our proposed geotechnical exploration will consist of test borings to obtain geologic information and
samples of the site soils, laboratory tests to determine the relevant engineering properties of the various
soil strata,and a report of geotechnical engineering recommendations.
With the anticipated soil conditions,we propose to conduct a total of 9 test borings. The borings will be
spaced across the site and at strategic locations. Based on boring depths of 10 to 15 feet, a total drilling
footage of 100 lineal feet is proposed. The borings will be sampled at intervals of 5 feet or less and a
descriptive log of the test borings will be prepared.
Based on the results of the test borings, a laboratory testing program will be established to evaluate the
engineering properties of the various soil strata. Laboratory testing may include moisture content and
density determinations to characterize the state and uniformity of:the deposits, unconfined compression
tests to determine shear strength parameters, and index property tests for classification.
Our report will discuss the general soil and ground water conditions underlying the site; present the
relevant engineering properties of the existing soils; provide earthwork and site preparation

recommendations; and recommend design criteria and parameters for pavements, retaining walls, and
other earth supported improvements. •
ESTIMATED COST&SCHEDULE
Based on the indicated work scope, the total cost for this study is estimated at $2,200. The maximum
amount will not be exceeded for the geotechnical exploration unless additional work is authorized.
Approximately 4 weeks from your notice to proceed will be required to complete the study. The schedule
is somewhat dependent on weather, site access conditions, and other factors including the actual
subsurface conditions identified in the test borings. If this proposed schedule does not meet your project
requirements,we would be happy to discuss alternate schedules.
ADDITIONAL SERVICES
Subsequent to completion of the geotechnical exploration report, additional services are often required
that are not included in the above estimate. These include consultation with the design team and review
of the final plans and specifications. In addition, construction phase quality control testing is 'an
additional service not included in the above estimate. If we are requested to provide additional services
including, but not limited to the above, you will be billed in accordance with Exhibit A - Fee Schedule.
We would be happy to provide cost estimates for any additional services at your request.

services on the referenced project. The survey datum will be City of Omaha GIS. We will provide
you in AutoCad Rel 14, the planimetrics, 3-D lines, points, breaklines and visible utilities from 200
feet south of the four-lane paving at Webster Street to 200 feet north of the four-lane paving south
of West Maple. We will also provide you with the planimetrics of the paving from Webster Street
south to the center line of West Dodge Road and from 200 feet north of the four-lane paving to
West Maple Road. The survey corridor will be from 35 feet east of the east right of way of 132nd
Street to 35 feet west of the west right of way. We will also survey a minimum of 200 feet on all
side streets except Blondo. At Blondo we will go to the right of way of 132nd Street. We will survey
the joint patterns on the side streets at a later date after you have determined the match points
along the streets.

The above work will be billed on a cost plus fee basis as shown on Exhibits A(Preliminary Survey

CONTRACT COMPLIANCE
During the performance of this Contract,the Consultant agrees as follows:
1. The Consultant shall not discriminate against any employee or applicant for
employment because of race, religion, color, sex or national origin. The
Consultant shall take affirmative action to insure that applicants are employed and
that employees are treated during employment, without regard to their race,
religion, color,sex or national origin. As used herein, the word"treated" shall
mean and include, without limitation, the following: recruited (whether
advertising or by other means); compensated; selected for training,including
apprenticeship; promoted; upgraded; demoted; downgraded; transferred; laid off;
and terminated. The Consultant agrees to and shall post in conspicuous places,
available to employees and applicants for employment,notices to be provided by
the consulting officers setting forth the provisions of this nondiscrimination
clause.
2. The Consultant shall in all solicitations or advertisements for employees placed by
or on behalf of the Consultant, state that all qualified applicants will receive
consideration for employment without regard to race,religion,color, sex or
national origin.
3. The Consultant shall send to each labor union or representative of workers with
which he has a collective bargaining agreement or other contract or understanding
a notice advising the labor union of worker's representative of the Consultant's
commitments under the Equal Employment Opportunity Clause of the City of
Omaha and shall post copies of the notice in conspicuous places available to
employees and applicants for employment.
4. The Consultant shall furnish to the Contract Compliance Officer all Federal forms
containing the information and reports required by the Federal government for
Federal contracts under Federal rules and regulations, and including the
information required by the Contract Compliance Ordinance,inclusive, and shall
permit reasonable access to his records. Records accessible to the Contract
Compliance Officer shall be those which are related to Paragraphs 1 through 7 and
only after reasonable notice is given the Consultant. The purpose for this
provision is to provide for investigation to ascertain compliance with the program
provided for herein.

5. The Consultant shall take such actions with respect to any subcontractor as the
City may direct as a means of enforcing the provisions of Paragraphs 1 through 7
herein,including penalties and sanctions for noncompliance,provided,however,
that in the event the Consultant becomes involved in or is threatened with
litigation as the result of such directions by the City,the City will enter into such
litigation as is necessary to protect the interests of the City and to effectuate the
provisions of the Ordinance and in the case of contracts receiving Federal
assistance,the Consultant or the City may request the United States to enter into
such litigation to protect the interests of the United States.
6. The Consultant shall file and shall cause his subcontractors, if any to file
compliance reports with the Consultant in the same form and to the same extent as
required by the Federal government for Federal contracts under Federal rules and
regulations Such compliance reports shall be filed at such times as directed shall
contain information as to the employment practices,policies,programs and
statistics of the Consultant and his subcontractors.
7. The Consultant shall include the provisions of Paragraphs 1 through 7 of this
Section,Equal Employment Opportunity Clause and the Contract.Compliance
Ordinance in everycontract orpurchase order so that such provisions will be
binding upon each subcontractor or vendor.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the preliminary design for the widening of 132nd Street from
Webster Street to West Maple Road has been programmed in the 1999-2004 _Capital
Improvement Program as Project No. 405; and,
WHEREAS, the Engineering Services will include data collection, a survey, a
traffic study, basic design plans for grading, pavement, drainage, determination of utility
conflicts, and an environmental assessment for the improvement; and,
WHEREAS, HDR Engineering, Inc., has agreed to perform the services listed in
the attached agreement, which by this reference is made a part hereof, for a fee in the amount of
$234,992.44, which will be paid from the 1996 Street & Highway Bond, Organization 1509,
Fund 341; and,
WHEREAS, the Public Works Department does not have sufficient staff to
undertake this project at this time.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Engineering Services Agreement with HDR Engineering, Inc., for a
preliminary design for the widening of 132nd Street from Webster Street to West Maple Road, is
hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay $234,992.44 for those
