The attached Ordinance authorizes a change in Sections 6-102, 6-103 and 21-5 of the Omaha
Municipal Code that relates to the requirement of keeping dogs on leashes within city parks. The
proposed change would retain this leash requirement, except for a specific area of Tranquility Park,
which will be specifically designated as an"off-leash"area.
This proposed change results from meetings between PR&PP and individuals representing Omaha's
dog owners interested in having public areas where they can exercise and train their dogs.
Numerous City's have found that establishing such"off-leash" areas have resulted in providing a
very positive public facility without unduly limiting other public use or compromising public safety.
In addition, this Ordinance specifically designates a portion of Tranquility Park as an"off-leash"
area. This is a portion of Tranquility Park, illustrated in the aerial drawing hereto attached, not
currently utilized for active recreation nor serving any significant passive recreation use.
Many years ago, the City's paunch manure product was buried within this portion of Tranquility
Park. Due to ongoing surface settlement and other compromises resulting from the paunch manure,
it is unlikely that this area will be developed past its current state. Representatives of the dog owners
group,however,have inspected this site and believe it is appropriate for their use. Adequate roads
and parking are available to serve this site.
The Parks, Recreation and Public Property Department recommends approval of this Ordinance
changing Sections 6-102, 6-103 and 21-5 of the Omaha Municipal Code that relates to the
requirement of keeping dogs on leashes within city parks.

5 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
6 Section 1. That Section 6-102 of the Omaha Municipal Code is hereby amended to read as
7 . follows:
r 8 "Sec. 6-102. Running at large.
9 It shall be unlawful for any person to allow or permit any dog which is owned, kept or
10 harbored by him to run or be at large in or upon the private premises of others or upon the streets,
11 highways and other public places of the city, except as provided in section 6-113."
12 Section 2. That Section 6-103 of the Omaha Municipal Code is hereby amended to read as
13 follows:
14 "Sec. 6-103. Restraint.
15 It shall be the duty of every owner in the city to keep his dog securely restrained by a chain
16 or otherwise confined in or upon his premises in some enclosure, except as provided in section 6-
17 113."
'18 Section 3. That Section 6-103 of the Omaha Municipal Code is hereby amended to read as
19 follows:
20 "Sec. 21-5. Animals at large.
21 It shall be unlawful for any person to allow or permit any dog or other animal to run at large
22 in any park, or enter any of the lakes, ponds, fountains or streams therein, except as provided'in
23 section 6-113."
24 Section 4. That a new section shall be added to the Omaha Municipal Code as follows:

1 "Section 6-113. Offl,eash Dog Areas.
I 2 Not withstanding any provision of this code to the contrary, any person may
3 permit any dog under his control,except a dog defined as dangerous in section 6-105,
4 to run or be at large in any fenced area of Tranquility Park designated by the parks.,
5 recreation and public property director as an "off leash" dog area."
6 Section 5. That Sections 6-102,6-103 and 21-5 of the Omaha Municipal Code as heretofore
7 existing are hereby repealed.
8 Section 6. That this Ordinance shall be in force and take effect(15) fifteen days from and
9 after its date of passage.
