outside city limits, along with a waiver to Section 53-9(9), Sidewalks (a

Location: Southeast of Pawnee and Blair High Roads
I. GENERAL INFORMATION:
Purpose: To plat the existing 20.06 acre unplatted parcel into a single lot in order to
establish building rights per Chapter 53 of the Omaha Municipal Code and
develop the lot with a single family residence.
Existing Use(s): Agricultural Existing Zoning: AG, AG-ED
Adjacent Land Use(s): Adjacent Zoning:

Applicable Regulations: If approved, development of the site will be subject to
the regulations of the AG-Agricultural District, including:
• Section 55-87, Minimum lot area: 20 acres.
Development of the site is also subject to the
requirements of the ED-Lake Cunningham
Environmental Resources Overlay District, as well as
all other applicable regulations.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site
Characteristics:
The unplatted parcel is comprised of 20.06 agricultural acres located
northwest of Cunningham Lake in far northwest Omaha. Property in the
area is comprised of agricultural uses including very low density farmstead
residences.
Development
Proposal:
Submitted materials show platting of the existing parcel into a single 20 acre
lot in order to establish building rights for the property and to allow
development of a single family residence.

Public
Improvements:
Right-of-way: Public Works has noted the requirement for a minimum 50
feet of right-of-way along Pawnee Road. The submitted Final Plat
document shows the 50 feet of dedication.
Dedication of right-of-way will result in an existing fence to be located within
the Pawnee Road right-of-way (portions of the fence may already be located
within the right-of-way). Remove the fence from the Pawnee Road right-of-
way.
Obtain a waiver from the Zoning Board of Appeals to allow the existing
gravel driveway to remain.
Environmental: Portions of the property are located within the Cunningham Lake
Environmental Resources Overlay District. The project area does not
include areas exceeding 17 percent slope and no sensitive features are
impacted as a part of this request. The impact study, grading, and
erosion/sediment control plans are satisfactory and comply with the
requirements of the Overlay District requirements.
Utilities: All utilities will be provided as required by Chapter 53, Subdivisions, of the
Omaha Municipal Code.
Land Use and
Planning:
Omaha Municipal Code Section 53-14, Enforcement includes requirements
for the transfer and development of property within Omaha city limits or the
Extraterritorial Jurisdiction (ETJ).
Section 53-14(2) states, “It shall be unlawful to sell, trade or otherwise
convey any lot or parcel of land as a part of or in conformity with any plan,
plat or replat of any subdivision within the application of this chapter unless
said plan, plat or replat shall have first been approved as prescribed by this
chapter and files and recorded in the office of the register of deeds.”
Section 53-14(3) states, “No permit shall be issued for any structure on a
site or tract of land which is not a lot of record at the time of the effective
date of this ordinance from which this article is derived or which has not
been approved or recorded in accordance with the provisions of this chapter
unless it is approved by the planning director in accordance with the
provisions of this chapter.”
The existing 20 acre parcel is proposed to be subdivided into a single lot in
compliance with Chapter 53 and will allow the property owner to transfer
and/or develop the property. The applicant has indicated their intent to
construct a single family residence on the proposed lot, with a similar
density and agricultural character as the surrounding area. Minimum
requirements of the AG-Agricultural District and Chapter 55, Zoning are
being met.
III. ANALYSIS:
Conditionally, the minor plat generally complies with the objectives of the Omaha Master Plan
and the requirements of the Omaha Municipal Code.

IV. RECOMMENDATIONS:
Approval of the waiver to Section 53-9(9), Sidewalks.
Approval of the Preliminary Plat, subject to the following conditions:
1. Show the dedication of a minimum 50 feet of right-of-way along Pawnee Road on the plat.
2. Removal of the existing fence from the Pawnee Road right-of-way.
Approval of the Final Plat subject to the conditions of Preliminary Plat approval.
