Transmitted herewith is an Ordinance declaring the necessity of appropriating and acquiring certain
private property for the purpose of constructing a new fire station in the southeast part of the city
replacing Fire Station #3. This new fire station will be located at the southwest corner of the
intersection of 16th Street with Spring Street.
The new fire station will be constructed on land currently owned by the Omaha Public Power
District whose Board of Directors has agreed to sell the land to the city for this purpose. This site
was selected by the Fire Department after careful review of its service runs from Fire Station#3 over
a number of years. The review indicated the overwhelming majority of calls for service to be to sites
east of 24th Street and this location will provide improved fire and rescue service response within
Fire Department time objectives.
This Ordinance provides that the City negotiate with the property owner for said property and that
any of the property which cannot be acquired through negotiation be obtained through
condemnation; however,we do not believe this course of action will be necessary. Payment for all
costs incurred in acquiring this property will be paid from the 1996 Public Facility Bond Fund 338,
Agency 131, Organization 1315, Object 2501.
The Administrative Services Department recommends approval of this Ordinance.

AN ORDINANCE declaring the necessity of appropriating and acquiring,for the purpose of the City
of Omaha,the necessary lands for the purpose of constructing a new fire station to serve the
southeastern portion of the city, replacing existing Fire Station#3; providing that the City
negotiate with the property owners for acquisition of the property necessary for this project;
providing that as to each specified parcel of land which cannot be obtained by negotiation,
condemnation proceedings be undertaken and completed; and ,providing for the effective
date hereof
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That it is proper and necessary and it is hereby declared proper and necessary to
appropriate certain lands for the purpose of constructing a new fire station to serve the southeast
portion of the city,replacing existing Fire Station#3. Said property and lands for this purpose are
described as follows:
Lots 1 through 8, inclusive, in Block 7, Deer Park, together with the east half of
vacated alley adjacent to said lots.
Section 2. That the Administrative Services Department of the City of Omaha be, and it is
hereby authorized, empowered and directed to negotiate, through either employees of the City of
Omaha or through persons employed therefor or through any combination thereof, with the owners
of the above described property for the acquisition of said property by the City of Omaha for the
aforesaid purpose and said Department shall report to the City Council on said negotiations. Upon
failure to agree by negotiations with the owners of any of the above described property for the
acquisitions thereof by the City of Omaha,the Administrative Services Department is authorized,

empowered and directed together with the Law Department of the City of Omaha, to proceed
forthwith to acquire any such property not obtained by negotiation for the City of Omaha for the
aforesaid purpose by condemnation proceedings in accordance with the Laws of the State of
Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha
required to be given the owners or other persons having interest in and to any of the above described
real property may be given by either the Administrative Services Department or the Law Department
of the city of Omaha. The Administrative Services Department shall be responsible for recording
of all deeds, easements or other acquisition documents resulting form the exercise of the authority
granted under this Ordinance in the Register of Deeds Office in the appropriate county.
Section 3. That this Ordinance shall take effect and be in full force fifteen(15) days
from and after its passage.
