residential complex and associated parking.

If approved, the project would be subject to the TOD-2-MX regulations
and all other applicable ordinances and policies.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site
Characteristics:
The subject property is located at the southeast corner of 48th and Dodge
Streets. The site comprises a total of 2.55 acres within multiple full lots
and portions of alley right-of-way located in a fully developed area in
Midtown Omaha. The site is developed with multiple commercial buildings
on the north part of the site and various residential structures on the south.
Property in the area is developed with a mix of residential, civic, and
commercial uses.
Development
Proposal:
The proposed plat combines the existing lots and alley right-of-way
comprising this site into a single lot of record. The alley is currently being
vacated through a separate vacation process. The applicant is proposing
to rezone the site from R7 and GC to TOD-2-MX.

The proposed rezoning will allow redevelopment of the site with a new 60-
foot, five story multifamily residential building, consisting of 329
apartments (59 efficiency, 126 one-bedroom, and 70 two-bedroom units),
along with 220 associated parking stalls (182 garage, 11 surface, and 27
on-street). Based on submitted plans, the redevelopment will require a
number of modifications to the TOD zoning regulations, which are
addressed as a part of the associated PUR-Planned Unit Redevelopment
Overlay District (C11-22-219).
A portion of the site is located within an ACI-Area of Civic Importance
Overlay District. The TOD-2-MX zoning district will require similar (and in
some cases enhanced) design requirements for development of this
property, making the ACI Overlay unnecessary. The applicant has
included a repeal of the existing ACI Overlay District as well as a repeal of
the PK-Parking Overlay District from a portion of the property as a part of
this request.
Public
Improvements:
Record the alley ROW vacation concurrently with the final plat.
Provide sidewalks along all street frontages.
Utilities: OPPD has distribution equipment on/near this property. Coordinate with
OPPD on removal or relocation of equipment.
Grading and
Drainage:
The project must comply with all applicable stormwater management
policies and ordinances, including providing for a no net increase in
stormwater runoff and treating the first ½” of stormwater for water quality.
Land Use and
Planning:
Future Land Use: The TOD Transit Oriented Development District is
intended to facilitate infill development and redevelopment in those parts
of the City which, because of their proximity to pedestrian oriented mass
transit infrastructure, are considered of primary importance to create
active, pedestrian oriented streetscapes and developments that vary in
intensity and use. The property is identified as appropriate for
development with Transit Oriented Development uses, including
multifamily residential development. The site is directly adjacent to
multiple Metro Transit Routes, including the Omaha Rapid Bus Transit
(ORBT) line. The requested rezoning to TOD-2-MX is appropriate.
Submitted development plans have been reviewed in detail for compliance
with the TOD regulations as part of the associated PUR request (C11-22-
219).
Urban Design: Property line locations do not provide adequate area for
sidewalks pursuant to Section 55-924 and must be revised to allow 18 feet
back-of-curb, to the extent feasible.
III. ANALYSIS:
Conditionally, the proposed subdivision and rezoning is consistent with and carries out the
goals and objectives of the City of Omaha Master Plan.

At the Planning Board meeting held August 3, 2022, Brian Akert, Holland Basham Architect, 119 South 49 Avenue, appeared before the Board. Mr. Akert submitted a survey of the subject property and explained the site plan. He pointed out that the Pittman Veterinary Hospital building will be the front door for the project. He offered to answer any questions. Don Seten, Housing Development Planner, appeared before the Board on behalf of the Planning Department. Mr. Seten submitted a site plan and stated that the project consists of 13 assembled parcels of which all buildings will be demolished and cleared with the exception of the Pittman building which is a local landmark. The new building will be five stories with 329 market rate apartment units with one and two bedrooms, 220 parking stalls inside the building, 11 service stalls off site and 27 parking stalls in the public right-of-way. The total project investment in the area is $82.3 million with a TIF request in the amount of $10,750,000.00 with $814,000.00 for public improvements. A portion of the TIF generated will go toward the street car system. The project meets the required criteria of the City’s TIF program, is an appropriate land use for the location and meets the City’s Master Plan goals. There were no opponents.
Specifically regarding #9 (C3-22-198):
Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department, stated that staff recommends approval. Mr. Moore motioned for approval. Ms. Franklin seconded the motion which carried 6-0.
Specifically regarding #17 (C10-09-015, C10-22-212, C12-22-213): Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department, stated that staff recommends approval of the rezoning from R7 and GC to TOD-2-MX, approval of the repeal of the ACI-Area of Civic Importance Overlay District, approval of the repeal of the PK-Parking Overlay District and approval of the Preliminary Plat, subject to the five conditions in the recommendation report and approval of the Final Plat, subject to the conditions of Preliminary Plat approval and submittal of an acceptable final subdivision agreement, if necessary, prior to forwarding to City Council.
Mr. Sotolongo motioned for approval of the rezoning from R7 and GC to TOD-2-MX, approval of the repeal of the ACI-Area of Civic Importance Overlay District, approval of the repeal of the PK-Parking Overlay District and approval of the Preliminary Plat, subject to the following conditions: 1. Record the alley ROW vacation concurrently with the final plat. 2. Provide sidewalks along all street frontages. 3. Coordinate with OPPD on removal or relocation of equipment. 4. Comply with all applicable stormwater management policies and ordinances 5. Revise property line locations to provide adequate area for sidewalks pursuant to Section 55-924 to allow 18 feet back-of-curb, to the extent feasible. The Board also moved for approval of the Final Plat, subject to the conditions of Preliminary Plat approval and submittal of an acceptable final subdivision agreement, if necessary, prior to forwarding the request to City Council for final action. Ms. Franklin seconded the motion which carried 6-0.
Specifically regarding #23 (C11-22-219):
Eric Englund, Assistant Director, appeared before the Board on behalf of the Planning Department, stated that staff recommends approval of the PUR-Planned Unit Redevelopment Overlay District, subject to submittal of acceptable final plans prior to forwarding to City Council. Mr. Pate motioned for approval of the PUR-Planned Unit Redevelopment Overlay District, subject to submittal of acceptable final plans prior to forwarding to City Council. Mr. Sotolongo seconded the motion which carried 6-0.
