Hal Daub,Mayor Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving a contract between the City of Omaha and Lawrence Myers for the purpose of Mr. Myers to provide professional services to the City regarding the grant received from the U.S. Department of Justice dealing with hate crimes. The Hate Crimes grant was accepted by the City Council on September 28, 1999, by Resolution #2639. Mr. Myers will act as the Hate Crimes Coordinator for which he will provide a single point of contact for the Hate Crimes Grant Coordination Council, City of Omaha, and the public. Mr. Myers will be responsible for multiple tasks to include: research and development of the community brochures•and coordination of the public service announcements, coordinate the public information sessions and community education/awareness conferences, coordinate and seek necessary training for prosecution of hate crimes, and coordinate the evaluation of the program through the University of Nebraska at Omaha. Mr. Myers will provide said services as an independent contractor for a period of no longer than eighteen (18) months. The cost of said services shall be performed on an hourly basis, but in no event shall exceed $3,041.66 per month with a total compensation not to exceed $54,750.00. DUTIES OF PROVIDER A. Provider agrees to perform the following professional services in relation to the Hate Crimes Grant from the U.S. Department of Justice: 1. Provide a single point of contact for the Hate Crimes Grant Coordinating Council, City of Omaha, and the public. Provider will be responsible for multiple tasks to include: Research and development of the community brochures and coordination of the public service announcements, coordinate the public information sessions and community education/awareness conferences, coordinate and seek necessary training for prosecution of hate crimes, and coordinate the evaluation of the program through the University of Nebraska at Omaha 2. Develop programming to improve Criminal Justice response to hate incidents through interventions that target decision-makers in the criminal justice system and increase community awareness. A final draft of proposed programming is due no later than February 1, 2000. Implementation of programming should start no later than June 1, 2000. 3. Develop and implement a training curriculum for Criminal Justice professionals to increase their level of knowledge about responding to hate incidents. A final draft of training curriculum due no later than May 15, 2000. Implementation of training curriculum due no later than September 15, 2000. 4. Develop community awareness training to community action/service groups. A final draft of proposed programming is due no later than February 1, 2000. Implementation of programming should start no later than April 1, 2000. 5. Develop a tracking system and information database of hate incidents for use by police,prosecutors, and courts. Implementation of tracking system and information database should start no later than June 15, 2000. 6. Create public relations, education materials, and public service announcements to encourage responsiveness of the general public. Final 1 ] a draft of educational materials and public service announcements is due no later than May 15, 2000. 7. Develop staffing plan to assist in the implementation of programming. 8. Identify volunteer and in-kind resources to assist in implementation of programming. 9. Prepare quarterly Client/Participant Tracking report and Service Tracking report for submission to The Bureau of Justice Assistance and George Washington University. The tracking reports are due on January 15, 2000, April 15, 2000, July 15, 2000, October 15, 2000, January 15, 2001, and April 15, 2001. Provider must complete the tracking reports no later than five (5) working days prior to the date the reports are due. In addition, Provider will complete and submit any other reports that are deemed necessary for the proper administration of the Hate Crimes Grant. 10. Develop instruments to reflect program specific data described by BJA assessment plan. Final draft due no later than April 1, 2000. 11. Assist project evaluator with the collection of data in order to determine outcomes (increased level of knowledge and responsiveness from both the criminal justice system and the community) and performance indicators (training curricula developed and delivered; PSA, education materials created and distributed; development of instruments to assess changes in attitude and knowledge). 12. Any modifications or changes to the scope of services or dates of deliverables, shall be in writing and by mutual agreement of the parties. II. DUTIES OF CITY A. City designates Kellie Paris-Asaka, Human Relations Department, as its contact person for the Hate Crimes Grant project, who shall provide a notice to proceed and such other written authorizations as are necessary to commence for proceed with the project and various aspects of it. B. The City agrees to pay Provider for the services described on a monthly basis. III. COMPENSATION AND PAYMENT A. The cost of services as specified in Section I of this Agreement, shall be performed on an hourly basis, but in no event shall exceed $3,041.66 per month with a total compensation not to exceed $ 54,750.00. 2 B. The duration of this Agreement shall be from the date of entry through April 30, 2001. C. INCREASE IN FEES The parties hereto acknowledge that, as of the date of the execution of the Agreement, Section 10-142 of the Omaha Municipal Code provides as follows: Any amendment to contracts or purchases which taken alone increase the original fee as awarded (a) by ten percent, if the original fee is one hundred fifty thousand dollars ($1500,000.00) or more, or (b) by seventy- five thousand dollars ($75,000) or more, shall be approved by the City Council in advance of the acceptance of any purchase in excess of such limits. However, neither contract nor purchase amendments will be split to avoid advance approval of the City Council. IV. ADDITIONAL SERVICES In the event additional services for the aforementioned project not covered under this Agreement are required, Provider agrees to provide such services at a mutually agreed upon cost. V. TERMINATION OF AGREEMENT This Agreement may be terminated by the City for cause and upon written notice to the provider of such termination and specifying the reason for termination and the effective date at least thirty (30) days'prior to the effective date of such termination. If the reason for termination is Provider's failure to perform any of the duties outlined in Section I, paragraphs 1 through 11, then Provider shall have ten (10) days from receipt of notice of termination to perform such duties or to cure the breach. In the event of termination, the Provider shall be entitled to just and equitable compensation for services rendered to date of termination, and all finished or unfinished documents, data surveys, studies, drawings, maps, models, reports or photographs shall become, at the City's option, its property. VI. INDEPENDENT CONTRACTOR It is understood and agreed by and between the parties that any and all acts that the Provider of its employees, agents, contractors or servants perform pursuant to the terms of this Agreement shall be undertaken as independent contractors and not as employees of the City. Provider shall have no authority to bind the city by or with any contract or agreement, nor to impose any liability upon the City. All acts and contracts of the Provider shall be in its own name and not in the name of the City, unless otherwise provided herein. VII. GENERAL CONDITIONS 3 A. Non-discrimination. Provider shall not, in the performance of this Agreement discriminate or permit discrimination in violation of federal or state laws or local ordinances because of race, color, sex, age, or disability as recognized under 42 USCS 11-1 et seq., and Omaha Municipal Code 13-89, or political or religious opinions, affiliations or national origin. B. Captions. Captions used in this Agreement are for convenience and are not used in the construction of this Agreement. C. Pursuant to section 8.05 of the Omaha Home Rule charter, no elected official or any officer or employee of the City shall have a financial interest direct or indirect, in any City Agreement. Any violation of this section with the knowledge of the person or corporation contracting with the City shall render the Agreement voidable by the Mayor or City Council E. Interest of the Provider. The Provider covenants that he presently has no interest and shall not acquire any interest, direct or indirect, which would conflict with the performance of services required to be performed under this Agreement; she further covenants that in the performance of this Agreement; no person having any such interest shall be employed by Provider. F. Merger. This Agreement shall not be merged into any other oral or written agreement, lease or deed or any type. This is the complete and full agreement of the parties. The services Mr. Myers shall perform as the Hate Crimes Coordinator are detailed in the professional service agreement, a copy of which is attached and by this reference made a part hereof; and, WHEREAS, Mr. Myers will provide said services as an independent contractor for a period of no longer than eighteen (18) months.
