II. SPECIAL INFORMATION:
Site
Characteristics:
The site comprises approximately 420 acres of land. Thomas Creek runs
from north to south across the eastern length of the property, parallel to
Blair High Road. The southeast portion of the site is currently being
developed with a data center. The balance of the site is generally rolling
agricultural hillside.
Development
Proposal:
This case was laid over at the December 7, 2022 planning board meeting
at the applicant’s request.
The applicant proposes to subdivide the property into six lots and two
outlots in five phases along with a rezoning to GI-General Industrial for the
entire site. An associated Major Amendment to the Large Project Special
Use Permit to allow Communication services in the GI District has been
submitted for consideration concurrently with this request (Case #C8-21-
233) along with a waiver request to allow development in the Future
Development Zone for a portion of the site (Case #C3-22-287).
It should be noted that portions of the proposed final plat have already
received preliminary plat approval and/or final plat approval as part of a
previous application. The purpose of this request is to incorporate an
additional 187 acres into the overall site for the continued construction of a
data center.
Public
Improvements:
Traffic and Circulation: Coordinate with Douglas County on the proposed
vacation of 117th and Hadan Streets, including the 120th Street paving
obligations and the timing of the recording of the vacation concurrently
with the next phase final plat. Portions of 117th and Haden Streets will be
vacated as part of this plat request or related process.
The vacation of Haden Street and 117th Street right of way must follow
County and State requirements.
Place a note on the plat that there shall be no direct access to State
Street, 120th Street, Rainwood Road, or Highway 133 from any lots or
outlots.
Grant an access easement between 117th Circle and Lot 7; show the
easement on the plat.
Acquire the property for all public street rights-of-way which are outside of
the subject property. Either record a paper ROW dedication concurrently
with the plat, or include the full width of the ROW on the plat.
Coordinate with Douglas County on the ultimate profile of 120th Street and
Rainwood Road, and grade the subdivision to match the profile.
Construct temporary turnarounds at the termination of all stub streets.

Provide for all improvements identified in the final approved traffic study,
as approved by the City and NDOT.
Construct right-turn deceleration lanes at all public street intersections
along the subdivision’s Rainwood Road, 120th Street, and State Street
frontages.
For the 117th Street connector approach to 120th Street and the 117th
Circle approach to Rainwood Road, construct the street to meet local
industrial standards, including a 38’ width and no median.
On the final plat, dedicate 50’ of ROW along the centerline of 120th Street
and Rainwood Road, plus an additional 10 feet for the first 300 feet from
the intersection of 120th and Rainwood.
Coordinate with Douglas County and Public Works on the required
improvements to Rainwood Road and 120th Street.
Coordinate with the Planning and Public Works Departments on the
Complete Streets Design Guide Design Checklists.
The 60 feet of right of way dedication along Rainwood Road, east of 120th
Street, must extend an additional 69 feet.
Proposed site grades along the western, northern, and southern
boundaries of the platting, adjacent to 120th Street, Rainwood Road, and
State Street respectively, must be coordinated with the future
improvement of those roadways. The consultant will be required to submit
cross section information, for review purposes, that shows the
relationship of the proposed site grading to the existing and future 120th
Street, Rainwood Road, and State Street improvements. Certification of
the grade coordination will be required prior to the City of Omaha's
approval of the final plat.
The proposed street connections from the development to Rainwood
Road, State Street, and 120th Street will require permits from the Douglas
County Engineer’s office and must meet proper sight distance criteria and
incorporate intersection improvements as required by current City/County
Access Policy. The cost of the roadway improvements for the street
connections, if required, will be the responsibility of the developer. The
sight distance criteria to be used in the evaluation of the State Street
connection, will be AASHTO Stopping Sight Distance for SO MPH design
(425').
Sanitary Sewer: To avoid construction of public sewers through any of the
buildable lots, coordinate with Public Works on an acceptable phasing
plan, including the lot boundaries of the future final plat phases.

In the subdivision agreement, cover the fees and off-site public
improvements (as identified by Public Works) necessary to accommodate
the increased sanitary sewer flows.
Construct an outfall sewer along the subdivision’s Rainwood Road
frontage, extending west to 120th Street.
Submit the 30% design report for the sanitary sewer to the Public Works
Design Division per Section 2.14 of the City’s Wastewater Collection
Systems Design Manual.
Storm Sewer: Receive preliminary approval of the PCSMP from Public
Works prior to the application for final plat approval; upload the drainage
study and preliminary plans to Permix.
Storm sewer and/or drainage design computations and final plans must be
submitted to the Douglas County Engineer’s office for review that relate to
the handling of roadway and site drainage along the development
boundary adjacent to Rainwood Road, 120th Street, and State Street.
Sidewalks: Construct sidewalks along all public street frontages, including
Rainwood Road, 120th Street, and State Street.
Utilities: OPPD has current underground service on the west side of 120th Street;
overhead on the west side of 117th Street; and overhead on the north side
of Hayden Street. Coordinate with OPPD on relocation or removal of
distribution equipment.
Any grading, sewer or utility work carried out in conjunction with this
development, in Rainwood Road, 120th Street, or State Street right-of-
ways, will require a permit(s) from the Douglas County Engineer’s office.
Grading and
Drainage:
Place Thomas Creek in a separate outlot from any excess unusable
ground.
Verify that the proposed property line along Thomas Creek falls outside of
the 3:1 + 50’ section.
Any drainageway (other than Thomas Creek) must be placed in an outlot
sized to accommodate either the 3:1 + 20’ section, or the 100-year storm
flow (whichever is greater).
The development must comply with all applicable stormwater
management ordinances and policies, including providing for no net
increase in stormwater runoff and treatment of the first half inch of
stormwater for water quality.
Parks and
Open Space:
Parks: Provide for the location of a 10’ wide concrete trail on the west side
of the creek. The trail must be located within a 30’ wide easement. The 30’
easement shall be located outside of the 3:1+20’ setback from the
centerline of the creek. Coordinate with the Parks department on the
easement location, trail alignment/design and construction details.

Trails and/or open space constructed within the development that are not
part of the suburban park master plan shall be privately constructed and
maintained by the developer, HOA or other approved entity.
Provide for the use, ownership, and maintenance of the outlots in the
subdivision agreement, including internal road connections and security
fencing.
Environmental: Prairies: Initial development of the State & Hwy 133 Addition resulted in a
loss of prairie ecosystem which was not flagged prior to the grading
activities that removed it from the site. The City’s Master Plan Land Use
Element suggests the destruction or removal of prairie lands requires
mitigating actions by the developer. Westwood, the City, and Papio NRD
have agreed to mitigate the lost prairie through the establishment,
monitoring, and continued maintenance of 43.48 acres of reconstructed
prairie to be created at Glacier Creek Preserve, located to the north of the
intersection of State Street and 144th Street via a $100,000 donation by
Westwood. No other prairie grass habitat exists on the balance of the
State & Hwy 133 Addition property.
Wetlands: Phases 4 and 5 of the project site include an additional 0.26
acres of wetlands and 2,689 linear feet of drainage presumed to be
jurisdictional. Except for 0.01 acres of wetlands, the waters will be in
Outlot D. Phase 2 includes 0.04 acres of wetlands in the proposed North
120th Street right-of-way. Phase 3 does not have any jurisdictional
wetlands or drainage. There is no wetland mitigation requirements for any
of the phases.
Noxious Weeds: Nebraska Statute (2-955) states that property owners are
responsible for the control of Noxious Weeds and to prevent Noxious
Weed seeds from spreading onto adjoining properties. A letter of approval
of a Noxious Weed Plan from Douglas County is required.
Tree Canopy/Mitigation: Per the Tree Canopy Report submitted in
December 2022, the project will impact approximately 12.5 acres of the
tree canopy, with 520 trees required for canopy mitigation. This total
includes the tree canopy identified with the previously approved final plat,
which required 464 mitigation trees. An additional 56 mitigation trees are
necessary for the expanded site. Coordinate with city staff on a final
acceptable tree mitigation planting plan.
Emergency
Management:
The applicant will be required to submit a letter from Douglas County
Emergency Management confirming that acceptable emergency warning
is being provided for the area.
Financing: If State and Highway 133 Addition will not be located in a Sanitary
Improvement District, a maintenance agreement will be required before
Douglas County will provide routine maintenance of public streets or
request street lights on behalf of the Developer. If not located in a
Sanitary Improvement District, major maintenance activities are the
responsibility of the adjacent property owner.

Land Use and
Planning:
Future Land Use: The property is in an area designated primarily as
Industrial, with a small portion designated as Open space in the Omaha
Master Plan. The requested rezoning to GI-General Industrial District is
consistent with the Master Plan.
Plat: The legal description on the submitted preliminary plat does not
reflect the existing platted lots of record and must be revised on the final
plat document.
PDZ: A majority of the property is located within the Present Development
Zone, but a small portion on the northwest part of the site is located in the
Future Development Zone (FDZ). Therefore, a variance to the Present
Development Zone is included with this request. This area will be sewered
by the remaining portions of the development to the east and thus the
requested waiver is acceptable.
III. ANALYSIS:
Conditionally, the proposed subdivision and rezoning is consistent with the goals and
objectives of the Omaha Master Plan and the requirements of Chapter 53, Subdivisions of the
Omaha Municipal Code.
IV. RECOMMENDATIONS:
Approval of the waiver to the PDZ-Present Development Zone.
Approval of the rezoning from AG to GI.
Approval of the Preliminary Plat, subject to the following conditions:
1.Coordinate with Douglas County on the proposed vacation of 117th and Hadan Streets,
including the 120th Street paving obligations and the timing of the recording of the
vacation concurrently with the next phase final plat.
2. Place a note on the plat that there shall be no direct access to State Street, 120th
Street, Rainwood Road, or Highway 133 from any lots or outlots.
3. Grant an access easement between 117th Circle and Lot 7; show the easement on the
plat.
4. Acquire the property for all public street rights-of-way which are outside of the subject
