Fanslau Planning Director Date: November 30, 2022 Subject: Approval of a Major Amendment to the Large Project Special Use Permit in the GI District 5701 South 85th Circle; 5639, 5711, 5805, 5810, and 5820 South 86th Circle Case # C8-17-257 The applicant (Ponca Tribe of Nebraska) is requesting a Major Amendment to a Large Project Special Use Permit in a GI District located at 5701 South 85th Circle; 5639, 5711, 5805, 5810, and 5820 South 86th Circle. This amendment would allow modifications to the parking layout of the site in order to meet fire code requirements. A Large Project Special Use Permit was approved with conditions by the Planning Board on November 1, 2017 and subsequently approved by City Council on February 6, 2018. The applicant later requested and received two, one year extensions of this Special Use Permit which were approved by the planning board on March 4, 2020 and March 3, 2021, respectively. A major amendment to allow the addition of a parking garage and childcare facility was approved by City Council on October 19, 2021. The previously approved plan involves repurposing the former InfoGroup headquarters property for the following activities: ● Tribal Services Offices for offices and support functions to serve as tribal headquarters and tribal court. ● Health Clinic to serve Ponca Tribe members as well as other Native Americans and non- Natives, including primary health, behavioral health, physical therapy, wellness center, pharmacy, imaging, lab, optical, dentist, tribal health administration and health education. ● Community gathering space for community events. ● Transportation Center with storage for 20-30 vans that the Tribe uses to transport people to and from the Health Services Building. ● Ceremonial sweat lodge, parking garage and childcare facility. This major amendment is requested for site plan changes in response to comments from the City Fire Department. The Fire Department required 24' drive aisles as well as 25' radii on driveway accesses (where physically feasible), which resulted in the northern parking lot being modified to accommodate these changes. The southern access was reduced from two access points to a single access. Another driveway access for the fire route was provided north of the entrance canopy due to clearance issues with the City's fire truck. Several parking stalls were removed due to the new access north of the canopy, but the majority were added back to the northeastern portion of the site. The overall project still meets City parking code requirements. Case Number: C8-17-257 Page 2 PJB Currently, 5 feet of perimeter landscaping exists adjacent to 86th Circle. With the aforementioned changes, that landscaping is reduced to 3', which has triggered the submitted major amendment. While 26 parking stalls are proposed to be closer than the existing location to the property line, there are additional areas along the Health Clinic Building that will have increased landscaping. Also, the parking will be located behind a black metal fence and not highly visible from the public right-of-way (ROW). Furthermore, existing boulevard trees will be saved, and additional landscaping will be installed as an overall improvement to the site and view from the public ROW. COMMENTS: Public Improvements: The project must comply with the City’s driveway regulations. All development must comply with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and must treat the first 1/2” of stormwater for water quality. ANALYSIS: The applicant has provided adequate justification to support the proposed landscaping waiver. A waiver from the Zoning Board of Appeals must be obtained, prior to forwarding the request to City Council for final approval. Conditionally, the requested Major Amendment to the Large Project Special Use Permit in the GI District is acceptable based on the criteria in Section 55-885. RECOMMENDATION: Approval of the Major Amendment to a Large Project Special Use Permit in the GI District subject to the following conditions: 1. Obtain the necessary waiver from the Zoning Board of Appeals prior to forwarding the request to City Council for final approval. 2. Compliance with the submitted site plans. 3. Compliance with all applicable stormwater management ordinances and policies. 4. Compliance with the City’s driveway regulations. 5. Compliance with all other previously approved conditions of the Large Project Special Use Permit.
