This location is a business currently operated by Ethel M. Martin, incorporated as Chocolate City, Inc., doing business under the name "Chocolate City." At this location the keno business will be conducted as an ancillary activity to the existing bar • business. Keno bets will be received and paid at the location but the actual number selection will continue to be performed at the keno games operated at Bourbon Street Lounge. Additional information about the location and.Omaha First's plans are included within the application submitted to the City. A liquor license is presently issued to this location. The Planning Director has advised that this location does not meet the off-street parking requirements which would be applied to a new business offering keno. However,the keno criteria only require keno satellite locations to provide the off-street parking required by the Zoning Code. Thus, they do not require an existing business with non-complying off-street parking to provide additional parking. Nevertheless, this keno criterion is just a standard used to apply the direction in the operator contracts that locations must provide "sufficient parking to accommodate members of the general. public who may wish to come to the location to observe or play the game of keno or engage in any other activity conducted on the premises." V C_25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebr RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS,the City of Omaha has entered into a Lottery Operator's Agreement with Omaha First Corporation,for the operation of a keno-type lottery at certain locations within the City of Omaha and areas of Douglas County(hereinafter "the Lottery Operator's Agreement"); and, WHEREAS, the Lottery Operator's Agreement provides that Omaha First Corporation, subject to the approval of the City Council, may operate satellite keno locations where keno tickets are sold and redeemed but where number selection is not performed; and, WHEREAS,the Lottery Operator's Agreement and pertinent regulations require that satellite locations shall be operated in accordance with all provisions of the Lottery Operator's Agreement and Keno Application Procedures and Criteria adopted by this Council; and, WHEREAS, on April 11,2000, Omaha First Corporation submitted an application for the City Council's permission to operate a satellite keno location at premises known as 4024 North 24th Street, a business currently operated by Ethel M. Martin,incorporated as Chocolate City, Inc., doing business under the name "Chocolate City." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT,in accordance with its Lottery Operator's Agreement with the City of Omaha, Omaha First Corporation is granted approval to operate a satellite keno location at the business operated by Ethel M.Martin,incorporated as Chocolate City,Inc,.,under the name "Chocolate City", at 4024 North 24th Street in Omaha,Nebraska. BE IT FURTHER RESOLVED: THAT, such approval is subject to continued compliance with the law, the Lottery Operator's Agreement, as amended, the keno location criteria, and the terms, conditions, and representations in the application for approval of this location.
