It directs and authorizes the Law Department to pay $61,000 in complete settlement of all claims and causes of action in a case entitled Coleman v. Grigsby, et al., Doc. 958 No. 837, presently pending in the District Court of Douglas County, Nebraska. Payment would be made from. the Contingent Liability Fund. This case arises from injuries Ms. Robin Coleman suffered on March 20, 1995, when her vehicle was struck by a vehicle operated by Omaha Police Officer Alvin Grigsby. Officer Grigsby was en route to a call and proceeded through a red traffic signal, striking Ms. Coleman. Both vehicles were totaled. Ms. Coleman received medical care in Omaha and was unable to work for several months. This twenty-seven year old woman continues to experience pain and weakness to her back and left shoulder. The District Court of Douglas County has determined that Officer Grigsby was negligent in his operation of his motor vehicle and has, therefore, determined that Ms. Coleman should recover. Additional information about this case has been submitted in a confidential memorandum and you may review it in an executive session called to discuss and consider pending litigation. Payment will be made from the 2000 Budget, General Fund Contingent Liability Account, Fund No. 104, Agency No. 195, Organization No. 1951. C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebr RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, litigation is pending in the District Court of Douglas County, Nebraska, entitled Robin Coleman v. Alvin Grigsby, et al., Doc. 958 No. 837, wherein the Plaintiff alleges the City of Omaha is liable for injuries suffered by Ms. Coleman when she was struck by a City of Omaha police cruiser on March 22, 1995; and, WHEREAS, the District Court of Douglas County, Nebraska has found the City of Omaha and the officer negligent; however, the amount of the damages and the allegations concerning damages constitute disputed claims; and, WHEREAS, the City of Omaha Law Department recommends that it is in the best interest of the City of Omaha and the residents thereof to resolve this litigation by paying the sum of$61,000 to Ms. Coleman in full and complete settlement of all causes of action she may have arising out of the incident; and, WHEREAS, Ms. Coleman has agreed to accept that amount as full and complete settlement of her claims. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the City of Omaha Law Department is authorized and directed to pay the sum of$61,000 to Robin Coleman in full and complete settlement of all claims and/or causes of action in Robin Coleman v. Alvin Grigsby, et al., Doc. 958 No. 837, presently pending in the District Court of Douglas County, Nebraska; that the Finance Department shall issue such warrants as are necessary to complete this payment; and the funds shall be paid from the 2000 Budget, Contingent Liability Fund, Fund No. 104, Agency No. 195, Organization No. 1951.
