City of Omaha Public Works Director Hal Daub,Mayor Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving an Agreement with Sanitary and Improvement District (S&ID) 361 to install a traffic signal at 156th and Adams Streets. S&ID 361, also known as Millard Oaks, lies adjacent to the intersection. This area has shown a significant increase in traffic flow in recent years and the amount of traffic at the intersection warrants a traffic signal. The construction cost to install the signal is estimated to be $50,000.00. Both the City of Omaha and S&ID 361 agree to pay half of the construction cost, i.e. approximately $25,000.00 each. In addition, the City agrees to design the signal, bid the contract, provide inspection services, provide future maintenance, and pay for the electricity to operate the signal. The cost for the City's portion of the project will be paid from the year 2000 Capital Signal Construction Organization 1434, Agency 140, Street and Highway Allocation Fund 103. I Date. ayor's ffice 1e ate Public Works Director Approved as to Funding: Stanley P. mm Date Acting Finance Director P:\PW\10643skz.doc AGREEMENT • THIS AGREEMENT is made and entered into by and between Sanitary and Improvement District S.I.D. 361, hereinafter referred to as"S.I.D", and the City of Omaha,Nebraska, hereinafter referred to as "City"; and, WHEREAS, S.I.D. lies adjacent to 156`h Street and Adams Street; and, WHEREAS, this area has shown a significant increase in the vehicular traffic flow, and S.I.D. acknowledges the desirability to expeditiously act so as to insure the timely,installation of a traffic-signal at the intersection of 156th Street and Adams Street in order-to enhance the safe and efficient flow of vehicular traffic; and, WHEREAS, the S.I.D. will take financial responsibility for one-half of the cost of this signal installation. WHEREAS,the parties hereto have reached an Agreement concerning the signalization of said intersection. NOW, THEREFORE, it is mutually agreed between the parties hereto as follows: 1. City will perform, or cause to be performed, as appropriate,the following tasks at its expense: (a) Development of engineering plans by registered professional engineers in accord with the City of Omaha Standard Specifications for the installation of a traffic signal. (b) Secure the services of a contractor for the construction of such project. (c) Cause the traffic signal to be constructed in accordance with the plans and specifications approved by the parties hereto. 2. S.I.D agrees to pay for one half of the final total construction cost of said signal. (This cost will not include inspection costs.) The total construction cost of said signal is estimated to be$50,000.00. The City will make payments, as requested, to the contractor for work completed. After final payment has been made, the City will bill S.I.D. for one-half the final total construction cost. This payment from the S.I.D. will be due within 60 days of the date on the City's bill. 3. Neither this Agreement nor City's approval on the location of said traffic signal, shall be deemed a delegation of City's authority in the exercise of its police power over public traffic signals. Accordingly, City may at its discretion cause the 1 removal, relocation or modification of such traffic signal at any time, if the following conditions occur,to-wit: (a) The signal is no longer required due to a decrease in traffic volume, or (b) The operation, location, or configuration of the traffic signals are deemed to be hazardous or inefficient. If said traffic signal is removed, it shall become the property of the City of Omaha. 4. The City will provide all maintenance, repair, and signal timing to said traffic signal. 5. The City will be responsible for the electrical energy cost of said traffic signal. 6. Pursuant to Section 8.05 of the Home Rule Charter of the City of Omaha, no elected official or any officer or employee of City shall have a financial interest, direct or indirect, in any city agreement. A violation of that section with the knowledge of S.I.D., in addition to constituting employee malfeasance, shall be cause for the City to unilaterally terminate or void this Agreement. 7. S.I.D. or City shall not, in performance of this Agreement, discriminate or permit discrimination against any person because of race, sex, age, national origin, or political beliefs or affiliations in violation of federal or state laws. 8. This instrument contains the entire agreement of the parties and shall be binding upon the successors and assigns of the respective parties. No amendments, deletions, or additions shall be made to this Agreement except in writing. EXECUTED this [ day of , 2000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Agreement with Sanitary and Improvement District 361 to install a traffic signal at the intersection of 156th and Adams Streets,is hereby approved.
