Transmitted herewith is a Resolution approving Supplemental Agreement No. 3 to the
Engineering Services Agreement with HDR Engineering, Inc., for additional items which were
not included in the original scope of services for the replacement of the 10th Street viaduct south
of Jackson Street. The original Agreement was adopted by the City Council by Resolution No.
824 on March 26, 1996. Supplemental Agreement No. 1 was adopted by Resolution No. 358 on
February 3, 1998. Supplemental Agreement No. 2 was adopted by Resolution No. 414 on
February 9, 1999.
The original agreement and first supplement concerned the preliminary design of the viaduct.
The second supplement concerned the final design of the viaduct. The prior agreements with
HDR are unchanged except where specifically modified by Supplemental Agreement No. 3.
Details of the additional work which was not included in the original scope of services are
included in Exhibit"A"to the Supplement.
HDR Engineering, Inc., has agreed to perform the additional services detailed in the attached
agreement for a fee of $209,677.00. The total contract amount would increase from
$911,705.00 approved previously to the $1,121,382.00 listed in Supplemental Agreement No. 3.
The additional funds are payable from the year 2000 Street& Highway Bond Organization 1509,
Agency 140, Street& Highway Allocation Fund 305.
HDR Engineering, Inc., has filed the required Annual Contract Compliance Report Form, CC-1,
in the Human Relations Department. As is City policy, the Human Relations Director will
review the consulting firm to determine its compliance with Ordinance 28885.

THIS SUPPLEMENTAL AGREEMENT, made and entered into this
day of 2000 by and between the City of Omaha, acting by and
through its Mayor and City Council,hereinafter referred to as the "City", and HDR
ENGINEEIRNG, INC. a corporation of the State of Nebraska, hereinafter referred to as
the "Consultant".
WITNESSETH:
WHEREAS, the City and Consultant are parties to an agreement dated the
twenty-sixth day of March, nineteen ninety six and Supplemental Agreement No. 1
dated the fifth day of February, nineteen ninety eight for the preliminary design of
improvements of the 10th Street Viaduct, Pacific to Jackson Street, hereinafter referred
to as the "Original Agreement", and
WHEREAS, the City and Consultant are parties to Supplemental Agreement No.
2 dated March 3, 2000 for final design services of the 10th Street Viaduct, and
WHEREAS, it is necessary that addditional Final Design services not
contemplated be added under this Supplemental Agreement, and
WHEREAS, it is necessary to increase the Consultant's compensation by this
Supplemental Agreement for the additional work necessary to complete the project,
NOW, THEREFORE, in consideration of these facts, the parties hereto agree as
follows:
•
I. GENERAL TERMS OF AGREEMENT. All terms and conditions contained in the
Original Agreement between the parties shall be binding to both parties with the
exception of the amendments contained hereinafter.
II. GENERAL DESCRIPTION OF SUPPLEMENTAL SCOPE AND CONTROL OF
WORK. The Consultant, will perform additional services for Final Design stipulated in
the attached Exhibit "A", Scope of Services and Fee Summary, hereby made a part of
this Supplement Agreement.
III. TIME OF BEGINNING AND COMPLETION. The Consultant will complete all
services stipulated in the Original Agreement and this Supplemental Agreement by
August 15, 2000. The time for completion shall be equitably adjusted for delays not the
fault of Consultant.
Delays grossly affecting the completion of the work within the time specified for
completion attributable to or caused by the Consultant or the City shall be considered as
cause for termination of this agreement by the other.
It is hereby mutually agreed that the City has continuing rights to work progress
inspections and any and all additions, deletions, changes, elaborations or modifications
of the services to be performed under the terms of this agreement which may from time
to time be determined by the City as desirable or preferable, shall be controlling and
governing.
IV. FEES AND PAYMENTS. For the work required, the Original Agreement plus
Supplemental Agreements 1 & 2 is amended and the limiting maximum costs, including
all subconsultant costs is increased from $830,120 to $1,018,730, an increase of
$188,610. The fixed fee is increased from $81,585 to $102,652 an increase of $21,067.
The total contract amount is increased from $911,705 to $1,121,382, an increase of
$209,677 which the Consultant must not exceed without the prior written approval of the
City.
The Consultant will be paid the additional fee on the same terms stipulated in the
Original Agreement and, except as specifically amended by this Supplemental
Agreement, all terms and conditions or the Original Agreement remain in full force and
effect. The contract amounts previously listed in this Supplemental Agreement do
include an increase in the allowable indirect additives from the Original Agreement.
The indirect additives multiplier is increased from 1.55 times direct salary costs to
1.6292 times direct salary costs for labor added under this Supplemental Agreement.
IN WITNESS WHEREOF, the Consultant and the City have caused these
presents to be executed by their proper officials thereunto duly authorized as of the

FINAL DESIGN ADDITIONAL SERVICES
SCOPE OF SERVICES
General
This Scope of Services addresses out of scope work that was required for the final design
plans and special provisions for the 10th Street Viaduct project. The documentation for
extra work includes additional scope items verbally authorized by the Omaha Public
Works Department as well as cost overruns due to increased sheet count and special
provisions beyond what was expected when the original scope was prepared.
1.0 Streetscaping near 10th & Pacific
Mitigation negotiated with the State Historic Preservation Office for loss of the 10th
Street entrance to the former Burlington Depot required additional work along 10th Street
and Pacific Street. HDR prepared additional plans for sidewalk replacement and
streetscaping along the east side of 10th Street between Mason and Pacific Streets and the
north side of Pacific Street from 9th to 10th Street. Work included sidewalk replacement
along 10th Street and Pacific Street; decorative railing and stanchions; historic light
standards; railing on the retaining wall parallel to Pacific Street and additional right-of-
way research and plans. The additional right-of-way effort was performed by Ehrhart
Griffin and Associates and is documented in Task 18.0.
Addition of this work required three additional sheets (Removals, Construction,
Lighting).
2.0 Sewer replacement,Sta 10+80.2 to 13+48.25
At the direction of Scott McIntyre and concurrence of the Omaha Public Works
Department, a design for the replacement of the trunk line combination sewer under the -
centerline of 10th Street was prepared for the limits indicated. This effort included design
of all new laterals and reconnection of existing taps.
3.0 Sewer replacement,Sta 13+87 to 14+15.5
At the direction of Scott McIntyre and concurrence of the Omaha Public Works
Department, a design for a new storm sewer between Jones Street and the new north
bridge abutment was prepared. Between Tasks 2.0 & 3.0 four additional sewer profile
sheets were required beyond the original estimate.
4.0 In-situ sewer liner,Sta 10+24 to 10+80.2
At the direction of Scott McIntyre and concurrence of the Omaha Public Works
Department,the existing combination sewer along the centerline of 10th Street and under
the existing railroad yard will be in-situ lined. Effort included addition of build notes and
limits for the in-situ liner and metric conversion, marking-up and modifying a sample
special provision provided by the City (see task 11.0).

5.0 Signal plans, 10th &Pacific Street
At the request of the City Traffic division,plans were prepared for traffic signal
replacement at 10th and Pacific. Effort included coordination with the City, drafting of
signal plans, and incorporation of City supplied quantities. This work required one
additional drawing. In addition, additional sidewalk removal and replacement was
required on the west side of 10th Street between Pacific Street and the beginning of
pavement replacement near Sta. 9+27 to extend the limits of the traffic interconnect
conduit.
6.0 Sidewalk/paving replacements, 10th & Leavenworth
As authorized by the Omaha Public Works Department, sidewalk replacement along the
south side of Leavenworth Street was required to remove the"kink"in the existing
sidewalk which passes around existing bridge piers. This work also included removal of
an existing "L" wall;removing,replacing and replumbing a storm sewer inlet for bridge
foundation removal and pavement replacement adjacent to the"L" wall. As agreed with
the Omaha Public Works Department,no additional man-hours are included for this task
' in this supplemental agreement.
7.0 Filling underground vaults
During the course of final design, an underground coal storage vault was found adjacent
to the former Neon Goose Restaurant. In addition,the sidewalk in front of the Pullman
Hotel was found to be a structural sidewalk with a basement area below. Both areas will
need to be in-filled. Additional details were required for these efforts resulting in an
additional sheet. A new soil-supporting foundation wall had to be designed to handle the
soil load from the infill at the Pullman Hotel. For special provision effort, see Task 11.0.
8.0 Additional coordination with PO Annex owners
Numerous meetings were held with the LeBron family concerning impacts to their
property at 1002 Mason Street. In addition, the City asked HDR to investigate the
feasibility of adding a spiral ramp structure at the west end of their building for access to
the steet level and track level entrances to their building. This effort also included a
reimbursement cost to the owners of$357.84 to cover reproduction cost of building plans
sheets. The City was not able to coordinate getting into the building until September
1999. As a result, structural design was delayed and coordination of roadway and
structural sheets was delayed. Roadway sheets required revisions once this coordination
did take place.
9.0 Coordination for historic lighting
The original project scope assumed that the City would select a light fixture at an early
stage of final design so that HDR could perform a lighting analysis and complete lighting
plans. The City decided to replicate a historic light standard for use on this project
however, this decision was delayed until the late stages of the project. This affected
HDR's ability to advance the lighting design. Also, lighting illumination level design
had to be performed twice since the City first designated a single globe fixture and later

changed to double globes. In addition, HDR was required to coordinate efforts to develop
a special provision for the historic light casting (see Task 11.0).
10.0 Precast concrete stanchions on bridge and retaining walls
At the request of Hank Vieregger and Tim O'Brien, HDR developed details for precast
posts with stanchions and precast posts with.light supports. Details had previously been
prepared for cast-in-place posts with stanchions and details had been partially prepared
for cast-in-place posts for light posts pending finally trolley wire loads. The precast
details had to be developed for eighteen different combinations of post types and
controlling dimensions occurring on the main viaduct, retaining walls and Post Office
Annex structures. Addition of the precast post details created five new structural sheets.
11.0 Additional Special Provision Efforts
Several unanticipated special provision were required for the final design effort or special
provisions were required for items that were additions to the project scope.
• In-situ sewer liner: Metric conversions, mark-up and revisions to sample City-
supplied special provision.
• Filling underground vaults: New special provision was required
• Pecast Concrete Posts: Developed full special provision for precast posts including
acceptance and testing of concrete
12.0 Metric conversion for UPRR Submittal
New submittal requirements issued by UPRR in the last year were not available when the
original final design scope was developed. The UPRR now requires that all plans
developed in metric units provide English equivalent units for information pertinent to
the Railroad. In addition submittal includes completion of a detailed checklist and
compliance to numerous requirements that were not previously required.
13.0 Additional effort/rework due to late receipt of City traffic signal,signing,
striping,maintenance of traffic mark-ups
City designs for traffic signalization,lane striping and barricading/signing were received
for drafting by HDR during the last week before the original due date. This late submittal
required overtime for drafting technicians and reviewing engineers as HDR attempted to
hold to the original submittal date. In addition,the late submittal by the City also
required some degree of rework by HDR staff to fit details on sheets that already had
some drafting completed.
14.0 Conversion of City of Omaha standard plates
Eight Standard plates were supplied by the City of Omaha for various standard details.
Two of the plates (Plates 725 &684)were not in electronic format and had to be drafted
in Microstation. The remaining plates had to be converted from AutoCADD format to
Microstation format and also all of the plates had to be converted to metric units for use
on this project. As agreed with the Omaha Public Works Department, no additional man-
hours are included for this task in this supplemental agreement.

15.0 Additional roadway sheets
The original cost proposal for roadway, right-of-way and lighting sheets estimated 61
sheets. Actual roadway,R.O.W. &lighting sheet count was 73 sheets. Eleven of the
twelve additional sheets are accounted for in tasks 1.0, 3.0, 5.0, 7.0 &14.0. The drafting
for the one additional unaccounted sheet and the extra quantity effort for all other out-of-
scope roadway tasks are added in this task.
16.0 Additional structural sheets
The original cost proposal for structural sheets estimated 86 total sheets. Actual total for
structural sheets was 117 (plus two sheets for OPPD pull boxes paid by OPPD).
Deducting the five extra sheets from Task 10.0,there was an overrun of 26 sheets or
30%. In comparing sheets for the proposal vs. actual,the majority of the overruns were
for the special structures (entrance structures, retaining walls, modifications to the P.O.
Annex, &replacement of the WHM plaza). In general, through the course of design, it
became evident that the design and detailing of these structures could not be generalized
particularly with respect to detailing of parapets and metal handrails. Also structures
involving attaching to existing structures required extensive field measurements and
additional detailing to convey the design intent in the final plans.
Man-hours for the additional 26 structural sheets are based on 95% of the hours per sheet
used in the original estimate.
17.0 Trolley subconsultant
As approved by the Omaha Public Works Department, LTK Engineering Services was
utilized to develop trolley pole loads for a potential future trolley. These loads were
utilized to develop anchor bolt designs for lightpoles mounted on the precast posts for the
bridge and retaining wall structures. The approved fee for LTK was $2559.
18.0 Additional Right-of-Way effort for sidewalk improvements
Ehrhart Griffin and Associates has documented their additional costs for this added right-
of way efforts in order to perform the sidewalk improvements along 10th Street by the
Pullman Hotel and along Pacific Street from 9th to 10th Streets. This effort was estimated
at$1595 (see separate attached estimate from EGA).
19.0 Project management for out-of-scope effort
Out-of-scope tasks required additional management effort. In addition, extension of
project schedule necessitated additional management activity.
