RES 2023-0121 - Real Estate Purchase Agreement with Intervet Inc for property located north of 214th and Grover Streets City Clerk Office Use Only: Publication Date(If applicable): RESOLUTION NO. 2-0Z—D1ZI Agenda Date: 2023 Department: Lf 1 71t Submitter: L..i' C El C, CITY OF OMAHA LEGISLATIVE CHAMBER Omaha, Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, the City of Omaha and Intervet Inc. wish to enter into the attached Real Estate Purchase Agreement ("Agreement") for the sale and transfer a parcel of land no longer needed for public purposes by the City of Omaha, to Intervet Inc., located north of 214th and Grover Streets as legally described on the attached Exhibit "A" ("Real Property"), in consideration of the sum of Eight Hundred Ninety Thousand and 00/100 Dollars ($890,000.00); and, WHEREAS, pursuant to Omaha Municipal Code Section 27-52, a real estate appraiser authorized by state law to appraise the type of real estate desired to be purchased, has appraised the value of the Real Property to be $890,000.00; and, WHEREAS, on December 7, 2022, the Planning Board of the City of Omaha, upon recommendation, recommended the disposal of said property; and, WHEREAS, Sections 27-53 and 27-54 of the Omaha Municipal Code provide that the City Council may authorize by resolution the disposal of City property by sale for an amount not less than the appraised value. WHEREAS, it is in the best interest of the City of Omaha and the residents thereof to enter into an Agreement with Intervet Inc. for the sale of the Real Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, the attached Real Estate Purchase Agreement between the City of Omaha and Intervet Inc. for the sale of a parcel of land be approved; to provide that upon completion of the conditions in the attached Agreement, the Mayor of the City of Omaha is hereby authorized to execute and deliver a Special Warranty Deed, and the City Clerk to attest the same, to Intervet Inc. to convey the real property described therein and City Staff are authorized to execute any other such documents necessary or appropriate to complete the sale of the real property described in the attached Agreement, which real property is located north of 214th and Grover Streets, in consideration of the sum of Eight Hundred Ninety Thousand and 00/100 Dollars ($890,000.00); and no expenses associated with the transfer of this property.
