The Resolution requests the Nebraska Liquor Control Commission require Five-20, Inc., dba "Planet Soull" at 1012 South 10th Street, Omaha, Nebraska, to submit a long-form application for renewal of its Class "C" liquor license. State statutes permit the City Council to request that a liquor licensee submit a formal application and undergo a public hearing before a liquor license is renewed. The City Council may make the request when a written protest is filed or upon the Council's own motion. If protests against renewal of a license are filed by three or more residents, the Council must hold a hearing to consider the protests. State law provides that a licensee is entitled to renew its license only if the licensee continues to meet the requirements that existed when the license was issued. A license need not be renewed if there is a change of circumstances affecting the qualifications for the license. For example, renewal can be denied if the licensee's conduct shows it does not exercise the type of management and control over the premises sufficient to insure that the business will conform to the statutes, rules, and regulations governing liquor sales. On August 1, 2000, a protest against the renewal of this license was filed with the City Clerk. Twelve persons giving residential addresses in the city have signed the protest. A copy of the protest is attached to the resolution. The statutes require that you have a hearing to consider the protest. Your hearing should not consider whether the license should be renewed. The only question at this time is whether there is sufficient reason to believe the licensee or the location no longer meets the qualifications to hold the license. If a long-form application is filed, the licensee will come back before you for a hearing on the application. You would then determine whether the liquor license should be renewed. If this Resolution is adopted, the Liquor Control Commission must require Five-20, Inc., to file a long-form application. If this Resolution is not adopted, the Liquor Control Commission may renew the liquor license without further hearings. Some disturbances and traffic problems. 23 Jan 00 Disturbance and Felony Assault 0100 hours RB 40663-S Bouncers at Planet Soull apparently maced the crowd to get them to disperse. At the same time, Latina Figures was accused of striking Deshawn Hernandez and her car during a hit and run (apparently deliberate) assault with a motor vehicle. Hernandez then chased Figures around the downtown area in a vehicle pursuit, striking Figure's car two times with her own vehicle. The disturbance moved to outside police headquarters, where Hernandez broke out Figure's window with a crowbar and hit Figure's with the same crowbar. Vice made 3 arrests for open container across the street from Planet Soull near-the.old Burlington building. 8 Feb 00 Meeting with Planet Soul Management 1400 Ms. Ofelia Roblems, Crime Prevention Specialist, met with management of Planett Soull 14 Feb 00 Meeting 0900 Ms. Ofelia Robles, Crime Prevention Specialist, met with Mr. Wes Hall, Grooves manager. 14 Feb 00 Meeting 1500 Ms. Ofelia Robles, Crime Prevention Specialist, met with Joe Manastero of Joe Banana's 20 Feb 00 Hit and Run Vehicle passing through the area struck by an apparently intoxicated driver who then fled the scene. 24 Feb 00 Problem Solving Meeting Meeting at Southeast Precinct with police and business representatives. 26 Mar 00 Shooting Roemon Jones was shot in the leg after leaving Planet Soull, at 0100 hours, at 11 th and Pacific. He stated that he was driving north on 11th when a male standingin the street fired 5-6 shots into victim's car, one. of black which struck Jones in the knee. There were at least 6 OPD officers in the area at the time, victim left the scene without attempting to contact any officers, and the officers heard the shots but could not find the victim. Victim said he saw officers but did not stop to ask for assistance from them. Victim said he did not know the name of the suspect, but recognized the suspect as a South Family Blood gang member. Victim claims no knowledge of any possible motive. Victims friends dropped him off at the hospital and took his car somewhere for an hour, they were evasive about their whereabouts and actions after the shooting. When employees intervened, the man assaulted them and had to be subdued. Donald Jarmon was arrested for misdemeanor assault, obstructing and disorderly. 12 June 00 Anonymous Complaint Male caller to Southeast Precinct identified himself as an Amtrack inspector, said last Friday and Saturday night people from Grooves and Planet Soull threw bottles at him, there were drunks all over, running around stopping traffic, men urinating in public, broken glass and garbage all over, total chaos, it's like a riot every night.at 1 A.M.. 13 June 00 Meeting with Management of Planet Soull Capt. Sundermeier met with management of Planett Soull 16 July 00 Help an Officer/Fight Disturbance Outside Grooves RB 89230-S,RB 1030 hours 89218-S Very large fight outside Grooves among people waiting in line to get inside. Mace was deployed by officers, one person assaulted one officer. Other fights were erupting in the vicinity. Three arrests were made from a fight at 10th and Pierce. Groove's manager Wendy Pete was uncooperative and accused the officers of racism when they tried to make a tavern report. 18 July 00 Neighbor Complaint Caller to Capt. Sundermeier complained about crowd disturbances and help an officer. 11-year resident of area, lives in 1100 block of 10th Street,very upset at turn the neighborhood has taken. Mark Sundermeier 11 Aug 00 Crowd Disturbance/Fights There was a large crowd disturbance on the sidewalk across the street from Planet Soull, north of Grooves. One person was arrested for false info, obstructing, and possession-of marijuana less Jounce. At about the same time a fight broke out in front of the Burlington building. Due to the large crowd officers were_unable_to determine who was involved in the fight. At least 8 cruisers were on the call, along with Able 1. Tavern Reports were done on both bars. Sgt. Oddo was able to video tape some of the disturbance.Officer Cornett advised that a person who identified himself as the general manager of Grooves provided the bar information to her. However a person who the general manager identified as an asst. manager was not cooperative, and said "why did you let them in, our lawyer said we don't have to let them in and show them anything". He refused to give his name. 23 Aug 00 Meeting with Planet Soull Capt. Sundermeier met with Mike Pirrucello, one of the owners of Planet Soull. Mr. Pirrucello agreed to issue ban and bar notices by registered mail to persons arrested for serious offenses outside of the establishment, and to work with Grooves management to make these into joint ban and bar notices.
