Such a donation is permissible under Section 5.21 of the City Charter, upon favorable recommendation of the Finance Director and upon finding by the Purchasing Agent that the vests are no longer useable for any City purpose. In accepting these vests, the Rolfe, Iowa Police Department, the National Bureau of Investigation (NBI), Caraga Region of the Philippines, and the City of Davao, Republic of the Philippines, Special Mayor's Anti-Crime Response Team(SMART),hereby agree to release the City of Omaha, its officers and employees, and hold them harmless from all claims for damage or injury arising from, or alleged to arise from,the ownership or use of such vests. espectfully, LCOAJ1 Donald L. I have enclosed the request from the Caraga Regional Office of the National Bureau of Investigations, Butuan City, Philippines as it was forwarded through my office. Briefly, the Caraga Regional Office of National Bureau of Investigations is located on the island of Mindanao in the Philippines. Mindanao is considered .as the most critical island of the Philippines as local law enforcement not only encounters:the normal criminal elements but those of the Communist Rebels and Muslim Rebels still at war with.the Philippine government: This increases the rate of encounters with armed suspects ready to fire upon law enforcement far beyond what we encounter here in the U.S. Thus approval of the-request from these Agents for Body Armor would greatly be appreciated. The procedure for obtain surplus vests from the Omaha Police Department is as follows: 1. A letter from your office or the National Bureau of Investigations in the Philippines should be forwarded to me requesting a specific donation. 2. A resolution is prepared for our City Council that declares the property surplus as well as making the donation. 3. The National Bureau of Investigations in the Philippines will have to send a separate letter so their request can be considered on its own merit. In that particular instance,we would also like to conduct a background investigation and to obtain certain assurances that the vests would be used for law enforcement purposes only. Upon my return I was request to return to Rolfe as Chief,which I gladly accepted. Wednesday in a conversation with agents of the NBI, I received a request for Body Armor. I recalled a news broadcast that the Omaha Police had donated some your surplus Body Armor to Police in South America. Today, I contacted Russ Davis and asked if your department had any surplus Body Armor stilt available. Russ related that there were still surplus available, however a letter of request and approval would be needed through your office. Therefor, 1 would like to request a donation of ten (10) pieces of Body Armor from your department, two—three,which may stay with my department for reserves and seven—eight,that I would send to the NBI in the Philippines. Should this request be approved I would like to pick these up between February 1 -3,as 1 will be in Omaha to travel to and from Dallas. Further, should your department have other surplus items that are available, I would be interest in that also. Law Enforcement in the Philippines is presently on a total reconstruction program and there is a need for any equipment. I look forward to your response to this request in the near future. Thank you. The Special Mayor's Anti-Crime Response Team (SMART) is the imiir"ediate response police unit within the City of Davao. Their mission includes but is not limited to, narcotic investigations, syndicated investigations, anti-teriorist response and more. Recently, SMART encountered a counterfeiting syndicate that resulted the seizise of over 100,000 United State dollars and was recognized by the United States Secret Service for their effcerts_ These types of investigation place the investigators directly in the line of fire without proper protection.
