The purpose of the attached Resolution is to authorize the donation of ten (10) used, out-of-
warranty, ballistic vests to the Rolfe, Iowa Police Department and the National Bureau of
Investigation (NBI), Caraga Region of the Philippines, and ten (10) used, out-of-warranty, ballistic
vests to the City of Davao, Republic of the Philippines, Special Mayor's Anti-Crime Response
Team (SMART). Such a donation is permissible under Section 5.21 of the City Charter, upon
favorable recommendation of the Finance Director and upon finding by the Purchasing Agent that
the vests are no longer useable for any City purpose.
In accepting these vests, the Rolfe, Iowa Police Department, the National Bureau of Investigation
(NBI), Caraga Region of the Philippines, and the City of Davao, Republic of the Philippines,
Special Mayor's Anti-Crime Response Team(SMART),hereby agree to release the City of Omaha,
its officers and employees, and hold them harmless from all claims for damage or injury arising
from, or alleged to arise from,the ownership or use of such vests.

RELEASE OF LIABILITY
I. Daniel Becker, 45 years of age, with residence of 806 Arthur St. Rolfe, Iowa 50581, am the
Chief of the Rolfe Police Department and have authority to sign for the National Bureau of
Investigation, Caraga Region of the Philippines. Hereby proclaim that, I am the lawful
representative of the Rolfe Police Department and National Bureau of Investigation, Caraga
Region of the Philippines to accept and waive all liability of said "Body Armor" donated by the
Omaha Police Department. That said "Body Armor" will be used by personnel of the Rolfe
Police Department and National Bureau of Investigations, Caraga Region of the Philippines.
This release of liability is with the understanding, that said "Body Armor" is outdated without
warrantee and shall not hold liable the Omaha Police Department, City of Omaha, State of
Nebraska nor the various manufactures of said "Body Armor" should such not perform as
expected.
This release of liability further releases the Omaha Police Department, City of Omaha, State of
Nebraska and various manufactures of any civil, criminal or other such court proceeding should
said "Body Armor"not perform as expected.

Re, Request for Donation of Surplus Body Armor
Don,
Thank you for responding to my letter that I sent in January with regards to surplus body armor.
I have enclosed the request from the Caraga Regional Office of the National Bureau of
Investigations, Butuan City, Philippines as it was forwarded through my office.
Briefly, the Caraga Regional Office of National Bureau of Investigations is located on the island
of Mindanao in the Philippines. Mindanao is considered .as the most critical island of the
Philippines as local law enforcement not only encounters:the normal criminal elements but those
of the Communist Rebels and Muslim Rebels still at war with.the Philippine government:
This increases the rate of encounters with armed suspects ready to fire upon law enforcement far
beyond what we encounter here in the U.S. Thus approval of the-request from these Agents for
Body Armor would greatly be appreciated.
Further, my department is a small department with a very stretched budget My department
could also use 2 pieces of Body Armor for our officers.. =

Thank you for your letter of January 13, 2000 requesting a donation of surplus ballistic vests to
your department.
The procedure for obtain surplus vests from the Omaha Police Department is as follows:
1. A letter from your office or the National Bureau of Investigations in the Philippines
should be forwarded to me requesting a specific donation.
2. A resolution is prepared for our City Council that declares the property surplus as well as
making the donation.
3. The National Bureau of Investigations in the Philippines will have to send a separate
letter so their request can be considered on its own merit. In that particular instance,we
would also like to conduct a background investigation and to obtain certain assurances
that the vests would be used for law enforcement purposes only.
I look forward to being of service to your department. Please forward the necessary
correspondence and we will begin the process to get you some ballistic vests. Please contact me
if you have any questions or need additional information.

Don,
Recently, I returned from conducted training of the Philippine National Police and the National
Bureau of Investigations in the Philippines. Upon my return I was request to return to Rolfe as
Chief,which I gladly accepted.
Wednesday in a conversation with agents of the NBI, I received a request for Body Armor. I
recalled a news broadcast that the Omaha Police had donated some your surplus Body Armor to
Police in South America.
Today, I contacted Russ Davis and asked if your department had any surplus Body Armor stilt
available. Russ related that there were still surplus available, however a letter of request and
approval would be needed through your office.
Therefor, 1 would like to request a donation of ten (10) pieces of Body Armor from your
department, two—three,which may stay with my department for reserves and seven—eight,that
I would send to the NBI in the Philippines. Should this request be approved I would like to pick
these up between February 1 -3,as 1 will be in Omaha to travel to and from Dallas.
Further, should your department have other surplus items that are available, I would be interest
in that also. Law Enforcement in the Philippines is presently on a total reconstruction program
and there is a need for any equipment.
I look forward to your response to this request in the near future. Thank you.

Response Team (SMART), Davao City, was recently visited by Daniel Becker, Chief of Police
of the Rolfe Police Department During this visit, it was brought to Inspector Cloribel's attention
that your department maintained an over stock of used body armor that may be available for
donation to police officers in need.
The Special Mayor's Anti-Crime Response Team (SMART) is the imiir"ediate response police
unit within the City of Davao. Their mission includes but is not limited to, narcotic
investigations, syndicated investigations, anti-teriorist response and more. Recently, SMART
encountered a counterfeiting syndicate that resulted the seizise of over 100,000 United State
dollars and was recognized by the United States Secret Service for their effcerts_
These types of investigation place the investigators directly in the line of fire without proper
protection. Your donation of ten (10) pcs. such used / out dated body armor to the SMART
would be a commendable act worthy of praise and admiration_

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City possesses used ballistic vests, which are out-of-warranty
and have been replaced with newly purchased vests; and,
WHEREAS, the Rolfe, Iowa Police Department; the National Bureau of
Investigation (NBI), Caraga Region of the Philippines; and the Davao City Special Mayor's
Anti-Crime Response Team (SMART), Republic of the Philippines, has inquired as to whether
such used, out-of-warranty, ballistic vests might be available for use by their personnel; and,
WHEREAS, pursuant to Section 5.21 of the Omaha Home Rule Charter, 1956, as
amended, the purchasing agent has determined that such used, out-of-warranty ballistic vests are
unusable for any City purpose; and,
WHEREAS, such Charter provision permits the City Council, upon
recommendation of the Finance Director, to authorize disposal by donation to any organization
to be used for the public good; and,
WHEREAS, the Finance Director has recommended disposal by donation of such
used, out-of-warranty,ballistic vests; and,
WHEREAS, by copy of this Resolution the Rolfe, Iowa Police Department; the
NBI, Caraga Region of the Philippines; the Davao City Special Mayor's Anti-Crime Response
Team (SMART), Republic of the Philippines; and their personnel are hereby put on notice that
such twenty (20) ballistic vests are used, out-of-warranty, and may not provide the protection for
which they were originally warranted, and acknowledge and accept such vests in their "as is"
condition; and,
WHEREAS, in accepting these vests, the Rolfe, Iowa Police Department, the
National Bureau of Investigation (NBI), Caraga Region of the Philippines, and the City of Davao,
Republic of the Philippines, Special Mayor's Anti-Crime Response Team (SMART), hereby agree
to release the City of Omaha, its officers and employees, and hold them harmless from all claims for
damage or injury arising from,or alleged to arise from,the ownership or use of such vests; and,
