The attached Resolution approves the Subdivision Agreement among the City of Omaha,
Jagmohan G. Desai, Trustee of the Jagmohan G. Desai Revocable Trust and Shobhana J. Desai,
Trustee of the Shobhana J. Desai Revocable Trust. This Subdivision Agreement covers the
public improvement of Abbott Drive Plaza of Douglas County, Nebraska located Northwest of
Avenue "H" and Abbott Drive.
This Subdivision Agreement stipulates which public improvements will be built by the
Subdivider in Abbott Drive Plaza. The entire cost of improvements made in this development
will be paid by the Subdivider. . ,
The Subdivision Agreement will benefit the City of Omaha and the Subdivider in clarifying the
responsibilities of the parties in building and maintaining the improvements in the subdivision.
The Public Works Department requests your consideration and approval of the attached
Resolution and Subdivision Agreement.

• SUBDIVISION AGREEMENT
ABBOTT DRIVE PLAZA
This Subdivision Agreement made this/ day of 2000 by and
between Jagmohan G. Desai, Trustee of the Jagmohan G. Desai Revocable Trust and Shobhana J.
Desai, Trustee of the Shobhana J. Desai Revocable Trust, (hereinafter referred to as
"SUBDIVIDER"), and the City of Omaha (hereinafter referred to as "CITY").
WHEREAS,the Subdivider is the owner of the land shown on the proposed plat
attached hereto as Exhibit "A" (hereinafter referred to as "PROPERTY"); and,
WHEREAS, the Subdivider proposes to install the necessary public
improvements to serve the Property.
NOW, THEREFORE, in consideration of the above, the following is agreed between the
parties hereto:
1. Public improvements. All required public improvements will be installed by
Subdivider as shown on Exhibit "B"; estimated costs of same are shown on Exhibit
iicti.
2. Water. Each lot will be served by MUD water as shown on Exhibit "B".
3. Electrical Power. Each lot will be served by underground power.
4. Sidewalks. Sidewalks will be installed by the Subdivider or property owner at the
time the lots are built upon along Avenue "H". Subdivider waives the right to protest
any future sidewalk improvement district proposed along Abbott Drive.
5. Payment for Improvements. The Subdivider agrees to pay the cost for all
improvements, using TIF proceeds to the extent available. The improvements will be
installed or adequate financial arrangements will be provided to the City for the
public improvements prior to filing the final plat.
6. Binding Effect. This Subdivision Agreement shall be binding upon the parties, their
respective successors and assigns, and run with the land shown on Exhibit "A".

ASSUMPTIONS:
1. Bottom of rubble fill estimated to be Elevation 969 at Hampton Inn site, and Elevation 970
at C-store site in Iowa, per soils reports. Street right-of-way excavated down to Elevation 973.
2. Bottom of rubble fill estimated at Elevation 971 at all three lots in Nebraska.
3. Structural fill calculated using 1.4 compaction factor.
4. Structural fill quantity based on 1.5-feet of fill over entire site to be paved.
5. C-Store structural excavation includes excavation under building, gas pump area and fuel tank area.
6. Structural excavation material can be utilized for fill areas under parking lot areas, under 1.5-feet cap.
7. Sanitary sewer will be 8-inch diameter.
8. Water main pipe will be 12-inch diameter.
9. Abbott Drive paving includes the 37.5-feet radius cul-de-sac.
10. Nebraska paving includes the signalization of the intersection of Avenue 'H'and Abbott Drive.
11. Stormwater detention facility will be located at northeast corner of site in Nebraska.
12. Site grading based on an elevation of 980 behind the east and west curb of Abbott Plaza,
sloping up to the west property line to Elevation 983 toward the northwest and Elevation 982 to the
east property line and north property line. (Approximately a 2% slope)

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Jagmohan G. Desai, Trustee of the Jagmohan G. Desai Revocable
Trust and Shobhana J. Desai, Trustee of the Shobhana J. Desai Revocable Trust proposes to
build a Subdivision, Abbott Drive Plaza, which will be located Northwest of Avenue "H" and
Abbott Drive; and,
WHEREAS, Jagmohan G. Desai, Trustee of the Jagmohan G. Desai Revocable
Trust and Shobhana J. Desai, Trustee of the Shobhana J. Desai Revocable Trust wishes to
connect to Omaha's sewer system, the system of sanitary sewers to be constructed by the
Subdivider within the area to be developed; and,
WHEREAS, the parties wish to agree upon the manner in which public
improvements will be built by Jagmohan G. Desai, Trustee of the Jagmohan G. Desai Revocable
Trust and Shobhana J. Desai, Trustee of the Shobhana J. Desai Revocable Trust and to clarify the
responsibilities of the parties in building and maintaining the improvements in the subdivision;
and,
WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Subdivision Agreement among the City of Omaha and Jagmohan G.
Desai, Trustee of the Jagmohan G. Desai Revocable Trust and Shobhana J. Desai, Trustee of the
Shobhana J. Desai Revocable Trust, as recommended by the Mayor, providing for the public
improvements and sewer connections to the Omaha sewer system, is hereby approved.
