Transmitted herewith is a Resolution accepting the attached Negotiator's Report submitted by
Tom Lund and Tim Phelan made in accordance with Necessity Ordinance No. 35186, passed
April 4, 2000, declaring the necessity of appropriating and acquiring certain private property for
the purpose of reconstructing the 10th Street Viaduct, known as City Project S.P. 90-23.
The Negotiators, Tom Lund and Tim Phelan, were unsuccessful in acquiring 2 parcels of land or
interest in property required for the project which addresses are 950 South 1Ot Street and 1001
South 10th Street and the Public Works Department recommends that the Law Department of the
City of Omaha take the necessary steps and procedures to condemn the 2 parcels of land or
interest in the property non-negotiated.
The cost of the condemnation awards based on the Report of Appraisers made for the 2 parcels
of land or interest in property non-negotiated shall be paid from the 1996 Street and Highway
Bond Fund No. 305, Organization No. 1509, Agency No. 140, year 2000 Funding.
The Public Works Department requests your consideration and recommends your approval of
this Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Tom Lund and Tim Phelan, Negotiators, have submitted to the City
Council a Negotiator's Report, attached, in accordance with Necessity Ordinance No. 35186,
passed April 4, 2000, declaring the necessity of appropriating and acquiring certain private
property for the purpose of reconstructing the 10th Street Viaduct, known as City Project S.P. 90-
23; and,
WHEREAS, the report shows that the Negotiators, Tom Lund and Tim Phelan,
were unsuccessful in negotiating and acquiring 2 parcels of land or interest in property which
addresses are 950 South 10th Street and 1001 South 10th Street, required for the project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT,the Negotiator's Report of Tom Lund and Tim Phelan made in accordance
with Necessity Ordinance No. 35186 be and hereby is approved.
THAT, the Finance Department is authorized to pay the cost of the condemnation
awards based on the Report of Appraisers made for the 2 parcels of land or interest in property
non-negotiated from the 1996 Street and Highway Bond, Fund No. 305, Agency 140,
Organization 1509, year 2000 Funding.
BE IT FURTHER RESOLVED:
THAT, the Law Department of the City of Omaha be and it hereby is authorized
to take all necessary steps and procedures to condemn the required property or interest in
property for the 2 parcels of land non-negotiated.
