THE CITY COUNCIL OF THE CITY OF OMAHA met in open session on Tuesday, January 10,

and was called to Order by Council President Pete Festersen.

TAX INCREMENT FINANCING (TIF) PROJECT PLAN RESOLUTION
20. RES. 2022-1152 – Res. that, The Square Apartments Tax Increment Financing (TIF)
Redevelopment Project Plan, for the redevelopment project site located southwest of
South 30th and Leavenworth Streets., which proposes the existing building be demolished
and a four story apartment building with 73 units will be constructed, and authorizes the
City’s participation through the allocation of TIF in an amount up to $1,835,438.00, plus
capitalized interest, to offset TIF eligible expenses including, but not limited to acquisition,
demolition, site work, engineered foundations, architectural and engineering costs, and
public improvements as required, containing a provision for the division of ad valorem
taxes as authorized by Section 18-2147 through 18-2150, Revised Statutes of Nebraska,
as analyzed and determined to be in conformance with the Community Development Law
and as recommended by the City Planning Department, be and hereby is approved – see

CONSENT AGENDA
City Clerk Elizabeth Butler stated that any member of the City Council may cause any item placed
on the Consent Agenda to be removed. Items removed from the Consent Agenda shall be taken
up by the City Council immediately following the Consent Agenda in the order in which they were
removed unless otherwise provided by the City Council Rules of Order.

27. RES. 2023-0027 – Res. that, as recommended by the Mayor, the contract with Jensen
Gardens, Inc., in the amount of $239,630.90, for OPW 54205, being the Retaining Wall
Repair, 20th Street and Woolworth Street Project, is hereby approved. (The Finance
Department is authorized to pay the cost of $239,630.90, from the 2018 Transportation
Bond Fund 13185, Transportation Bonds Organization 117117.) – see attached.

28. RES. 2023-0028 – Res. that, as recommended by the Mayor, the contract with Eriksen
Construction Co., Inc., in the amount of $11,180,550.00, for OPW 53597, being the 6th &
Leavenworth Grit Facility Improvements Project, is hereby approved. (The Finance
Department is authorized to pay the cost of $11,180,550.00, from the Sewer Revenue
Improvements Bond Fund 21124, Capital Asset Replacement Program Bond Organization
116913; Sewer Revenue Bonds will be issued to finance this project.) – see attached.
29. RES. 2023-0029 – Res. that, as recommended by the Mayor, Change Order No. 6 with
Western Engineering Company, Inc., in the amount of $1,514,517.85, for additional work
on OPW 53935, being the 2020 Residential Resurfacing, Package 2 Project, is hereby
approved. (The Finance Department is authorized to pay an additional sum of
$1,514,517.85, which is to be paid from the Street Allocation Fund 12131, Major Street

30. RES. 2023-0030 – Res. that, as recommended by the Mayor, the Professional Services
Agreement with Nebraska Title Company, in the amount of $31,250.00, to provide
professional engineering services on OPW 54139, being the Signal Infrastructure Phase
E2 Project, is hereby approved. (The Finance Department is authorized to pay a fee not
to exceed $31,250.00, from the 2018 Transportation Bond Fund 13185, Transportation

31. RES. 2023-0031 – Res. that, as recommended by the Mayor, the Professional Services
Agreement with Alfred Benesch & Company, in the amount of $860,378.45, to provide
professional construction phase engineering services on OPW 53698, being the Copper
Creek Interceptor Sewer Repair Project, is hereby approved. (The Finance Department is
authorized to pay a fee not to exceed $860,378.45, from the Sewer Revenue
Improvements Fund 21124, Neighborhood Sewer Renovation Organization 116911;

32. RES. 2023-0032 – Res. that, as recommended by the Mayor, the Professional Services
Agreement with Alfred Benesch & Company, in the amount of $1,992,954.02, to provide
professional construction phase engineering services on OPW 52470, being the Forest
Lawn Creek Inflow Removal and Outfall Storm Sewer Project, is hereby approved. (The
Finance Department is authorized to pay a fee not to exceed $1,992,954.02, from the
Sewer Revenue Improvements Fund 21124, CSO Control Implementation Organization
116918; Sewer Revenue Bonds will be issued to finance this project.) – see attached.
33. RES. 2023-0033 – Res. that, as recommended by the Mayor, the Professional Services
Agreement with Alfred Benesch & Company, in the amount of $1,078,224.00, to provide
professional design phase engineering services on OPW 54374, being the 61st and Radial
Storm Sewer (CSO) Project, is hereby approved. (The Finance Department is authorized
to pay a fee not to exceed $1,078,224.00, from the Sewer Revenue Improvements Fund
21124, CSO Control Implementation Organization 116918; Sewer Revenue Bonds will be
issued to finance this project.) – see attached.
34. RES. 2023-0034 – Res. that, as recommended by the Mayor, the Professional Services
Agreement with JEO Consulting Group, Inc., in the amount of $20,360.00, to provide
professional services on OPW 54417, being the John J. Pershing Drive Slope Repair
Project, is hereby approved. (The Finance Department is authorized to pay a fee not to
exceed $20,360.00, from the 2018 Transportation Bond Fund 13185, Transportation

35. RES. 2023-0035 – Res. that, as recommended by the Mayor, the Supplemental
Agreement No. 1 between the City of Omaha and the Nebraska Department of
Transportation, with a cost to the City of $711,560.60, for Federal Aid Project CMAQ-
28(146), State Control No. 22879, OPW 53807, being the Signal Infrastructure Phase C2
Project, is hereby approved. (Will be paid from the 2018 Transportation Bond Fund 13185,
Transportation Bonds Organization 117117. The City Council hereby authorizes the Mayor
and City Clerk to sign the Agreement on behalf of the City of Omaha.) – see attached.
36. RES. 2023-0036 – Res. that, as recommended by the Mayor, the Supplemental
Agreement No. 1 between the City of Omaha and the Nebraska Department of
Transportation, with a cost to the City of $699,956.20, for Federal Aid Project CMAQ-
28(147), State Control No. 22880, OPW 54093, being the Signal Infrastructure Phase D1
Project, is hereby approved. (Will be paid from the 2018 Transportation Bond Fund 13185,
Transportation Bonds Organization 117117. The City Council hereby authorizes the Mayor
and City Clerk to sign the Agreement on behalf of the City of Omaha.) – see attached.
37. RES. 2023-0037 – Res. that, as recommended by the Mayor, the Program Agreement
between the City of Omaha and the Nebraska Department of Transportation, with the
City’s cost share currently estimated at $45,020.40, for Federal Aid Project CMAQ-
28(152), State Control No. 22903 and OPW 54481 being the Signal Operations Center
Street/42nd Street/60th Street Project, comprised of upgrading signal and
communications infrastructure for up to 40 signals within the City of Omaha, an agreement
establishing an understanding of each party's responsibilities is hereby approved. (W ill be
paid from the 2018 Transportation Bond Fund 13185, Transportation Bonds Organization
117117. The City Council hereby authorizes the Mayor and City Clerk to sign the
Agreement on behalf of the City of Omaha.) – see attached.
38. RES. 2023-0038 – Res. that, as recommended by the Mayor, the Program Agreement
between the City of Omaha and the Nebraska Department of Transportation, with the
City’s cost share currently estimated at $74,283.60, for Federal Aid Project CMAQ-

City of Omaha and HPIV, LLC, to construct seventy (70) apartment units within a 108
mixed income housing complex for tenant households located at 2111 North 30th Street,
is hereby approved. Four (4) “fixed” HOME assisted units are to be rented as their principal
place of residence to qualified tenant households; three (3) of these will be available to
eligible households who have incomes at or below 80% of the Median Family Income
(MFI) and one (1) unit will be available for households at or below 50% of the MFI.

Award #15PBJA-22-GG-02068-JAGX, awarded by the U.S. Department of Justice, Office
of Justice Programs, Bureau of Justice Assistance; to provide law enforcement programs,
prevention and education programs, prosecution and court programs, corrections and
community corrections programs, mental health programs and crisis intervention teams,
and planning, evaluation and technology improvement programs; to authorize payment
from such grant funding and involving appropriations of more than one year in conformity
