On March 23, 2000, S.I.D. 392, Cinnamon Creek and S.I.D. 376, Mission Park West, entered into an Interlocal Cooperation Agreement to share the cost of public park improvements. The park site is located in the Mission Park West subdivision, but will serve the residents of both subdivisions. Per the Interlocal Cooperation Agreements, the park improvement costs were estimated to be a total of $555,538.00 including soft costs. Each S.I.D. would pay a total of $277,769.00. The landscape architects for Mission Park West have received bids on the public park improvements and the low bid was $397,438.00. With soft costs at 35%, the total project cost will be $536,540.76. Therefore, each S.I.D. will pay$268,270.35 including soft costs. The Subdivision Agreement for S.I.D. 376, Mission. Park West, approved public park improvement costs of $358,000.00. The Subdivision Agreement for S.I.D. 392, Cinnamon Creek, was approved prior to the Interlocal Cooperation Agreement being executed. Therefore, the City Council needs to approve S.I.D. 392's participation in the park improvement project and the expenditure of$268, 270.35, which will be a general obligation of the district. WHEREAS, the parties hereto are duly existing bodies corporate and politic in accordance with and under the laws of the State of Nebraska and more particularly Article 7 of Chapter 31 of the Revised Statutes of Nebraska, 1943, and any applicable amendments thereto and that said Districts have been formed in accordance with said statutes and the Decrees of the District Court of Douglas County, Nebraska: and WHEREAS, in order to promote the health and safety of the residents of said Districts and pursuant to the authority granted the parties per the Nebraska Interlocal Cooperation Act, the parties desire to effectuate the construction of park and recreational improvements on Lot 296, Mission Park 2nd Addition, Phase II, Douglas County, Nebraska located within the boundaries of and owned by SID #376; and WHEREAS, the construction of park and recreational improvements would be beneficial to both Districts and for the joint use of their residents. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the parties agree as follows: 1. That SID #376 construct thereon the park and recreational improvements set forth in the Engineers' Estimates prepared by Ciaccio Dennell Group, Inc. with an estimated total project cost of$555,538.50. Both parties agree that SID#376 shall advertise for bids and enter into a contracts) with the lowest responsible bidder for the construction of the aforesaid park and recreational improvements and generally provide for the construction supervision and direction. 2. That SID #392 shall contribute to SID#376 fifty percent (50%) of the total cost of park improvements. 3. The parties hereby agree to and shall save each other harmless and their officers • and employees, and agents from all claims and liability whatsoever or character due to or arising out of any acts, conduct or omissions and negligence of each othcr or each party's officers, agents, employees or others acting for or under the direction of each. Each party hereby agrees to comply and to cause all contractors doing work occasioned by this Agreement to comply with all Federal and State laws, rules and other applicable statutes. No. 392, Cinnamon. Creek,Douglas County,Nebraska, does not include any public parks within the subdivision; and, WHEREAS, Sanitary and Improvement District (S.I.D.) No. 376, Mission Park West, Douglas County, has a lot dedicated as a public park and it is available for use by both subdivisions; and, WHEREAS, S.I.D. 392 and S.I.D. 376 have entered into an Interlocal Cooperation Agreement that calls for the two subdivisions to share equally in the cost of the public park improvements in the Mission Park West Subdivision; and, WHEREAS, bids for said park improvements have been received and the total cost including soft costs will be$536,540.76; and, WHEREAS, per the terms of the Inter-local Cooperation Agreement the cost to each S.I.D. will be $268,270.35; and, WHEREAS, the Parks, Recreation and Public Property Department recommends that the park improvement costs be shared by S.I.D. 392 and 376 per the Interlocal Cooperative Agreement; and, WHEREAS, all necessary City approvals have been obtained for these improvements.
