Hal Daub,Mayor Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Subdivision Agreement between the City of Omaha and Ames Partnership, LLP. This-Subdivision Agreement covers the public and private improvements of ' Mormon Bridge Plaza of Douglas County,Nebraska located Southwest of Mormon Bridge Road and McKinley Street. . This Subdivision Agreement stipulates which public and private improvements will be built by Ames Partnership, LLP in.Mormon Bridge Plaza. The entire cost of improvements made in this development will be paid by the Subdivider. The Subdivision Agreement will benefit the City of Omaha and the Subdivider in clarifying the responsibilities of the parties in building and maintaining the improvements in the subdivision. The Public Works Department requests your consideration and approval of the attached Resolution and Subdivision.Agreement. Foster, Acting Director 7 Date Parks, Recreatin &Public Property=; P:\PW\11084skz.doc 40 SUBDIVISION AGREEMENT MORMON BRIDGE PLAZA This Subdivision Agreement, made this/Y day of /u , 2000, by and between Ames Partnership, L.L.P., a Nebraska limited liability partncr ip (hereinafter referred to as "SUBDIVIDER"), and the City of Omaha (hereinafter referred to as "CITY"). WHEREAS, the Subdivider is the owner of the land shown on the proposed plat attached hereto as Exhibit"A" (hereinafter referred to as "PROPERTY"); and, WHEREAS, the Subdivider proposes to install curb and gutters to Outlot A to bring into compliance with City of Omaha standards and also install sidewalks on the Property; and, WHEREAS, the Subdivider and City desire to agree on the method for the installation for the improvements to be constructed on the property. NOW, THEREFORE, in consideration of the above the following is agreed between the parties hereto: 1. Public Improvements. All public improvements exist except sidewalks along Mormon Bridge Road and McKinley Street, to service the Subdivision. 2. Private Improvements. Attached hereto as Exhibit "B" and incorporated herein by this reference is a drawing showing the private paving of Outlot A, the public sidewalk along Mormon Bridge Road and the landscaping plan approved by the City of Omaha Planning Department. 3. Outlot A. Attached hereto as Exhibit "D" and incorporated herein by this reference, is a copy of the letter from NUT Construction, Inc. dated July 6, 2000, evidencing the existing thickness of the concrete contained in Outlot A of seven (7) inches in compliance with City of Omaha standards. Subdivider shall construct and install a system of curb and gutters along the existing street contained in Outlot A as shown on Exhibit "A", with an engineers estimate prepared by Kirkham, Michael & Associates for the cost to perform the construction, design, and inspection of the improvements attached hereto as Exhibit "C" and incorporated herein by this reference. The Subdivider shall have the work completed prior to recording the Plat or adequate financial guarantees acceptable to the City will be provided to insure the improvements are installed in the spring of 2001. The width for Outlot A has been increased to thirty- three feet (33') and the street shall be centered within the Outlot. Subdivider, its successors and assigns, shall be responsible for all construction, maintenance including snow removal and ownership of the Outlot A. 4. Storm Sewer. The storm sewer system is already constructed and serving • the Property. At such time of the development of each lot, Subdivider, its successors and assigns, shall be responsible for the connection of each lot to the storm sewer system. 5. Sidewalks. The Subdivider shall cause sidewalks along the west side of Mormon Bridge Road to be constructed immediately after the filing of the subdivision plat. For the south side of McKinley Street and both sides of Outlot A, sidewalks will be constructed according to the following schedule: (1) Sidewalks shall be constructed immediately abutting • undeveloped lots on either side of Lots 4, 5, 6 and 7, as soon as the lots on such side have been developed. A lot shall be developed for the purpose of this section when a dwelling has been constructed on the lot. (2) Sidewalks shall be constructed immediately abutting developed lots as soon after development as weather permits. (3) In any event, all sidewalks shall be constructed within the property within three years of the recording of the subdivision plat. 6. Right to Connect to City Sewer System. The City hereby acknowledges that it has given Subdivider the right to connect the sanitary sewer system of the Property to the City sanitary sewer system, subject to obtaining proper permits and paying the regular fees and front footage fees. 7. Binding Effect.
