Location: South of 29th and Burdette Streets I. GENERAL INFORMATION: Purpose: To subdivide 3.046 acres into 22 lots and one outlot to allow for low-density residential redevelopment. Existing Use(s): Undeveloped Existing Zoning: R7 Adjacent Land Use(s): Adjacent Zoning North: Residential North: R7 South: Residential South: R7 East: Highway 75 East: ROW West: Residential West: R7-ACI/R7-ACI-PUR Future Land Use Designation(s): The Future Land Use Plan designation includes a mix of low-density residential, high-density residential and open space. The intersection of 30th and Lake Street is designated as an existing Convenience Mixed Use area (10-acre). Zoning History: C12-20-093, C11-14-226: Preliminary Plat approval of HIGHLANDER EAST, with approval of a Major Amendment to the PUR-Planned Unit Redevelopment, approved by city council on 8/25/15. Associated Request: C12-20-093: Final Plat approval of HIGHLANDER EAST. Applicable Regulations: The project will be required to comply with the base R7 zoning district, the ACI overlay district, and all other applicable regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The subject site, legally described as Lot 7, Highlander East (pending City Council approval and recording of final plat), comprises approximately 3 acres of undeveloped land. Development Proposal: The applicant proposes to subdivide the property into 22 lots and one outlot to allow for low-density residential redevelopment. Public Improvements: Sanitary Sewer: Sanitary sewer will be provided as required by City code. Storm Sewer: Storm sewer will be provided as required by City code. HIGHLANDER EAST REPLAT 1 Case No. C12-20-227 PJB Page: 2 Sidewalks: Sidewalks must be provided as required by the subdivision ordinance. Grading and Drainage: The project must comply with all stormwater management policies and ordinances, including providing for a no net increase in stormwater runoff and treating the first half inch for water quality. Parks and Open Space: Provide for the use, ownership, and maintenance of the outlot in the subdivision agreement. Land Use and Planning: A detailed zoning review of the submitted conceptual development plans has not been completed. However, it appears that some of the proposed structures do not meet setback requirements for the R7 zoning district. The applicant has indicated that an NCE plan or PUR may be pursued in order to reduce the setback requirements to match the context of the surrounding area and to implement heightened design standards for future owners of the proposed lots. The applicant must continue to coordinate with Urban Design staff if design standards for the proposed housing is desired. The applicant requests a waiver of lot depth for multiple lots on the southern part of the proposed subdivision. There are multiple existing properties in the general area of the project that do not meet the minimum lot depth requirement of the subdivision ordinance (100 feet). The proposed lot depth waiver is in keeping with the surrounding neighborhood and can be supported. The proposed subdivision consists of Lot 7, Highlander East, which is pending City Council approval of the final plat. The Highlander East subdivision must be recorded prior to the recording of this replat with the Register of Deeds. The subdivision application identifies the zoning for the parcels as R7-ACI-1(PL)-(PUR). However, the subject site is not a part of an approved PUR plan nor is it within an urban design overlay district. The street name for the northern part of 28th Street must be changed to 28th Avenue on the final plat mylars. The proposed replat is in conformance with Chapter 53, Subdivisions, of the Omaha Municipal Code. III. ANALYSIS: The proposed in-fill redevelopment project will have a positive effect on the surrounding community and will encourage redevelopment of the neighborhood. The proposed subdivision carries out the goals and objectives of the City of Omaha Master Plan and North Omaha Village Revitalization Plan. Approval of the Preliminary Plat subject to the following conditions: 1. Provide sidewalks along all streets. 2. Comply with all stormwater management policies and ordinances. 3. Provide for the use, ownership, and maintenance of the outlot in the subdivision agreement. 4. Record the Highlander East subdivision prior to the recording of this replat with the Register of Deeds. 5. Coordinate with Urban Design staff if design standards for the proposed housing is desired. 6. Coordinate with Planning staff regarding the street name for proposed 29th Street on the final plat mylars. 7. Change the street name for the northern part of 28th Street to 28th Avenue on the final plat mylars. Approval of the final plat, subject to the conditions of preliminary plat approval and submittal of an acceptable final subdivision agreement, if necessary, prior to forwarding to City Council. V.
