Condition(s):
1. Submitting an amended subdivision agreement to account for the differences
between the existing and proposed subdivisions.
2. Provisions for the private ownership and maintenance of the private streets,
including street lighting, in the subdivision agreement.
3. Constructing sidewalks along 168th Street as well as both sides of the private street.
4. Submitting a 100-year storm analysis.
5. Noting the minimum lowest floor elevation for each lot on the final plat to ensure
they are above the spillway level of the nearby lake.
6. Changing Outlot"I"to Outlot"A".

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the preliminary plat entitled LEGACY VILLAS located Southwest
of 168th Street and Oak Drive, attached hereto and made a part hereof as Exhibit "A", with a
request for a waiver of Section 53-8(2)(b) cul-de-sac length to allow an 890 foot long cul-de-sac
has been approved by the City of Omaha Planning Board; and,
WHEREAS, Section 53-6 of the Omaha Municipal Code requires the submission
of preliminary plats to the City Council for its consideration; and,
WHEREAS, the acceptance of this preliminary plat with a waiver of Section 53-
8(2)(b) cul-de-sac length to allow an 890 foot long cul-de-sac, is tentative in nature and does not
constitute or require approval of the final plat of this subdivision by the City of Omaha Planning
Board or City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the preliminary plat entitled LEGACY VILLAS located Southwest of
168th Street and Oak Drive with a waiver of Section 53-8(2)(b) cul-de-sac length to allow an 890
foot long cul-de-sac is hereby accepted; and, the preparation of the final plat of this subdivision
is hereby authorized.
